I think we need clarity on s62(2) of EA2022 under the heading: 62. Post-election procedure and collation of election results.

Also s70

Based on the two sections above, how exactly is electronic collation illegal?

fergie.001 Blunt.CrazeMan gar.field1

The Section-62(2) of the Electoral-Act (according to the Osun-Petition final judgement by the Supreme Court),, is not actually referring to any Collation System, but is referring to an electronic archive.. Which can be populated at any time - and not necessarily during the time the election is going on.

They also ruled that the IREV-Portal was the electronic archive which the Section-62(2) was referring to, (which in actual sense was not actually true..)

And then, the supreme court Judgement recently affirmed in the PEPT Judgement that the IREV-Portal is not a Collation System.. And also, that the IREV-Portal is not a platform for the verification of the polling-unit results during collation (this particular second part of the judgement is not really true, but there is nothing we can do about it for now, unless it gets reviewed, or another better-informed judgement passed in that regards).

So, let's just take the laws as flawed and as badly interpreted as they are currently., pending the time the Electoral-Act gets amended properly.

Then it should be made Legal. Electronic voting & collation are the way forward for election transparency & credibility.

Which is fine because it is neither possible nor legal right now.

You need an electronic voting machine to achieve that. The entire point some of us were making to the 25% Abuja people.
