The presumption of immigrant intent is a core concept of US immigration law that governs our visa process. Another overriding concept is our judgement of whether the applicant will use the visa correctly--to abide by the laws of the land and to return after a short stay. We understand that immigrant visa petitions can sometimes take years to process. In the meantime, an IV applicant may wish to make brief visits to the US but will not want to endanger their lawful, long-term plans to migrate. We look at those situations carefully and make decisions on a case-by-case basis. |

Actually, if they're traveling as a family, they only fill one form, so anything over $10k has to be declared on that one form. My family and I just returned from an international trip a few days ago and I wanted to fill different forms, they said no. Just one and declare everything there My advice would be to rather open a domiciliary account, deposit at least half the money there and get a USD-denominated debit card that they can use while here. This is a plastic-heavy country and it makes their lives a lot easier seyewest: No not at all... it's just right.. meanwhile you can hold more than $10k which you can divide between your wife and your self. |

And be sure to let her know when you land so she can be ready to pick up the phone Arbitrix: I will be travelling to Houston next month for a holiday during my annual leave. I just read a post about someone being sent back because the address he filled in his ds-160 was different from what he filled on arrival.
Now my issue is I will be staying with my sister who just bought a house and will be moving this Friday. This means the address I will fill on arrival will be different from what I filled in my ds-160 although it's the same zipcode.
I am a little nervous. What do u guys think?
P.s. it's my first time in the US. |

If you really want folks to help, you'll have to provide details of what exactly you said. You could be going to New York to visit the Statue of Liberty or Florida to DisneyWorld. abujaniv, permit me to ask this because I'm seeing a bit of a contradiction in terms here. As you have so clearly pointed out, in applying for an NIV, the applicant swears to not having an immigrant intent and is adjudicated by the CO as such. However, and herein lies the rub, the CO sometimes approves an NIV for applicants even with a pending IV application-an application which clearly demonstrates intent to migrate. So in effect, the CO is approving a non immigrant visa to someone with a demonstrable immigrant intent. Meaning one or both of two things: the applicant lied on oath in his NIV application (misrepresentation) and/or the CO knowingly approved a visa to an applicant who clearly misrepresented. My question here is 1. On what basis does such an applicant (I was one not so long ago and my visa was approved) overcome the presumption of intent despite a pending clear and sworn intention to migrate 2. I don't mean this the wrong way, just asking for purposes of clarity. Is the CO not breaking the law by approving non immigrant visas for applicants with a clear declaration of immigrant intent? 2. Or should we be talking rather that the applicant has to demonstrate on that occasion and that occasion only, that there is no intent to abuse the NIV on that singular occasion? Okay, even I have a headache after that. . . abujaniv: Hello topoexavier. It is not impossible to obtain a nonimmigrant visa (B1/B2, F1, etc.) while also pursuing an immigrant visa. That said, it may be a high hurdle to do so. In applying for the nonimmigrant visa, you are demonstrating and swearing that you do not have an immigrant intent, when clearly you do in this case. Your ties to your home country will be weighed against your external ties. |

Well done my good lady, I have an upcoming interview in July. My nerves are running riots because i was denied in 2013. My sister was granted a visa just yesterday but instead of making me feel better it has heightened my anxiety, I plan to spend my wedding anniversary and birthday in the USA, I am travelling with my hubby. Do you think those reasons are good enough? I also have a brother in the USA but we intend staying in a hotel for our privacy, although we will stay in the same state with him. Does it matter that we won't be staying in his house, if they ask if we will be visiting him, should i say yes or that he would be visiting our hotel instead. My reason for choosing the state he lives in, is so that he can actually visit us with his family. |

What I cannot, and have never understood is this DESPERATION to visit and migrate to the USA Many people say they want to go for a vacation. Folks, there are myriad places you can go for a vacation with way less visa hassle and less expensive than good ole US of A. The Carribean, for instance, are a glorious vacation getaway. Many places in Europe, too. I can understand those who wish to visit family. But if you get denied, chill. It's not the end of the world. Rushing to go get 'travel history' just so as to get a US visa is just, well, make I no talk. First time I applied for a US visa was to attend a sporting event. By the time I got an appointment scheduled, it was a couple of days to the end of the the event. I didn't get it. Second time was for a family event. I booked an appointment in Lagos and then to be safe, another in Abuja (back then you could book multilp,e appointments). Got there, got denied for reasons that were my fault. So I went to Abuja a couple of weeks later (abi na days sef, my memory fails me), got my application approved. My kids were born in the US. Wife is a USC. But for over 10 years, I never bothered to file for IV. Over the last few years, every time I get to The US, the CBP officials would ask why I haven't filed for IV. We would joke about it, they'd stamp me in and that would be the end of that. I simply divided my time between both countries. Then have the family come over for the summer months. Overall, we would have between 6-9 months per year as a family. It was only two years ago that we (mostly them) decided I should file. I've traveled to every continent on the planet, and there are tons of beautiful places to spend a vacation at. I remember that first time when I didn't get a visa. I got my girlfriend (before we got married) to meet me in Greece for a holiday. We had tons of fun on the crystal clear waters of the pristine beaches, visited historical sites (including the Parthenon), took the ferry from Eretreia to Athens. Hopped to Thessaloniki for a boat ride. We had the time of our lives! Mikehk2: I wouldn't know... My emphasis is strictly on those considering travel history as one of the ties required for certain cases like mine .. People get US VISA WITHOUT travel history yet there are some cases that are hard to overcome without competent travel history . #myopinion |

True. No point in booking a hotel. Keep things the same as before and be sure to explain situation properly and clearly to the VO. Booking a hotel just raises all manner of additional questions instead of having the VO focus on getting her to explain herself a bit ore on her previous denial OmoBendel24: Yeah, pretty obvious for now my brother, and not really necessary in my opinion in this particular situation if I may add, unless there are better reasons for such decision. In the same city? Is the brother's (a US citizen by birth) house that small, unaccommodating, not available or this is just for the purpose of lessening ties to the US? Hubby (medical profession, dont know which though) and other child not travelling if true is a tie on its own, her pay, years of experience at work and primary purpose of travel (part B, the "and as well see my brother whom I haven't seen in a while" part) ain't bad, travel history isn't too good for her case but not bad at all too. |

Oh I see now. Yes, I had travelled with it prior to that time. To the point you are making, I am a frequent traveller. I think I must have used that particular visa at least four times prior to that. In my opinion, I still think he can use it, provided he can clearly explain to the CBP Officer why he could not travel the first time seyewest: I mean have you traveled earlier with the said visa before you decided to travel few days to the expiration of the same visa? |

Not quite sure which of the visas you mean. But I travelled with the first one when it had just days to expire. Stayed for about six weeks, came back, renewed via Dropbox and travelled again one more time with the renewed visa before I got my Immigrant Visa seyewest: Have you traveled with the said visa before? |

Since a visa can only take one to the port of entry and ones stay is determined by the CBP. A visa should be valid till the very last day of its validity. |

Nah. Even one day left on a visa is fine. On my last NIV visa, I travelled with just days left on the visa and was stamped in for 6 months. I renewed when I got back seyewest: Don't you think 2 month left on a visa is too risky what if they don't allow you in? you should do dropbox and travel if they renew it. |
