The 3 Arms of govt are all independent of each other according to the separation of powers , The president has no input in the selection process of the CJN as he is selected by his peers under the auspices of the NJC and his name only sent to the President for submission to the National Assembly for Ratification by 2/3 majority meaning like the president and leader of the National assembly they are all there at the pleasure of the people of Nigeria.

jamace: CJN Cannot be suspended by the Executive without consultation with the NJC. The NJC, yes if it was a judicial misconduct, which assets declaration isn't. The CJN being a public officer and CCT being the only constitutional authority to deal with this type of issues has advised the president (who can suspend his appontee) to do the needful. |

Viergeachar: There is a standing appeal court judgment that no sitting judgment that no sitting judicial officer can be tried without clearance from the NJC.
Hence, the CCT was acting in error. Clearance would be only required from NJC if it was a judicial misconduct e.g a bribe for judgement. The constitution describes the role of the CCT in the case of all public officers, CJN inclusive. CCT is only exercising its constitutional duty. Is the NJC above the Nigerian constitution? |

But the appeal court has said the CCT should halt the trial. So can his suspension stand And why should the appeal court halt a trial in another court? Is that its function? It called an appeal court for a reason. You go to appeal court when you're not satisfied with a JUDGEMENT, but in the case of the suspended CJN, there is no judgement yet. |
