I totally disagreed with you, read what Chief Gani Fawehimni says about it: Only N‘Assembly can remove Atiku –Gani By Geoffrey Ekenna Published: Friday, 22 Dec 2006 A human rights activist and lawyer, Chief Gani Fawehimni, SAN, has said that only the National Assembly can salvage the harm done to the Presidency by the defection of Vice President Atiku Abubakar, from the Peoples Democratic Party to the Action Congress. According to him, the 1999 Constitution does not envisage a situation where either the president or his deputy defects to another party, different from the one they were elected. Also, the National Vice- Chairman of the PDP for the South- East, Chief Fidelis Ozichukwu- Chukwu, said that the party was hamstrung by the constitution which did not make provision for such situation. Both men spoke with our correspondent in separate telephone interviews on Thursday. Fawehinmi, said that it was left for the National Assembly to classify the defection of the vice- president as gross misconduct or not, to determine whether to remove him from office or not. He said that by the provision of Section 142 of the Constitution, it was assumed that the president and his vice would run on the same ticket and as such, would also serve out their term together. Fawehinmi who stressed that there were no provisions in the constitution for such incidences, also said that he was sure that the National Assembly would not remove the vice-president. He said, ” Of course, what he has done amounts to gross misconduct. It is what the National Assembly will consider. In Nigeria, they do not resign, other wise he should have gone. They do not have shame and the honour to resign. The president can initiate his removal but if the National Assembly says no, that is the end of the matter. But I am afraid that the National Assembly will not even impeach him. The relationship between the president and the legislature is bad. They are aggrieved over the way the primaries of their parties went. But what he should have done ordinarily was to resign” However, in a statement he issued Thursday evening, Fawehinmi said that it would only be honourable if Abubakar vacates his position to allow the president appoint a replacement. He insisted that the action of Abubakar had serious implications for him. He said that the action of the vice-president had torn his joint ticket with Obasanjo apart. But Ozichukwu- Chukwu said that the PDP might not take any immediate action now on the defection of the vice-president, because of his status as a suspended member of the party. He said the fact that the law did not provide for such incidences made the matter worse. He, however, said that the president and the National Assembly would decide what to do with the position of Abubakar. Study the constitution ver well, there no place the says the President or VP can not change their poloitical party after election into office, for example, a Governor from the Northern Part defected from ANPP to PDP, also Lagos State Deputy Governor moved to another and nothing happen. |
Mariory:If you real understand 1999 Constitution, u wil see that the Presidency is not about one person, rather for the President and Vice President, that is why the Constitution emphasis that the President most have a running mate before the person can be deem elected to the office of President. The Vice President has his official jet, just has the president one. Report have it that the jet was bought in 2002 specfically for office of the Vice President. The Presidential Fleet is made up of jets for the President. Vice President, Senate President and Speaker of House of Representative. VP in official capacity should not be deny official jet. |

The crisis in the Presidency is taking a serious dimension in the country, report have it that OBJ ordered ATIKU official jet to be grounded for no reason and the order was not communicated to the VP at all, except when he got to the Presidential winge of the Airport. I think with OBJ latest action on his VP, it will make our democracy a laughing stock at the international community that what Nigeria is practising is not democracy but autocracy, futhermore,it will portrait OBJ as someone who does not tolerant the VP by denying him the constitutional benefits that are attached to Office of Vice President. If OBJ think is not comfortable in working with VP, he should instigate the National Assembly to impeach the VP rather than deny VP the constitutional benefit accrue to his office as seating VP. |

The fact still remains that people have been subjected to abject poverty due to HIGH LEVEL of mismanagement by the OBJ led Federal Government, critically look at what is happening in NNPC Account and award of Oil Block in the country u will cry for the high level of mismanagement going on there. I believe if the election can be free and fair, Atiku will defend Yar'adua hands down. |
After the emergence of the VP as AC candidate, if INEC did not screen him out base on the ongoing corruption in the PTDF, Atiku and Buhari may be the major Presidential candidates to look out for, because of their exposure,experience and acceptability in the country,even when you talk of full and adequate loyalists, these two presidential aspirants have it,especially Atiku as numerous loyalists all over the country through the PDM machinery. Some school of thoughts here in abuja have it that OBJ is dealing with the VP for any unjust reasons, if you study all the court cases that the VP have been challenging either the Government for his indicment or PDP, you will see that he has won most of all these cases. With what of seen of Yar'dua and heard about his person, OBJ just want somebody he can direct from his Ota Farm,sorry i mean Ota Estate. If INEC can conduct credible elections that is Free and Fair like that of MKO Abiola during June 12, 1993, i think PDP might lose the presidency like what happened in America where Republican defeated Democratic in United States of America. But the fear of most NIgerians is that can the elections be Free and Fair in 2007. I laugh when some people says that VP is corrupt, even OBJ is highly corrupt, sentiment apart, am from Ogun State, alot of things have change drastically for OBJ. For example, Ota Farm as turn to Ota Estate, what about TRANSCORP shares that OBJ as 200 Millions. During the first term the Federal Government claimed they spent 300 Billions on Nigerian roads, also Bode George was also indicted in the NPA audit report and nothing happens to all these people who are VERY CLOSE ASSOCIATES OF THE PRESIDENT WITH THE PDP. Another example is how Uba used our National Pride to smuggle money into USA and part of the money was used to procured Farming Equipment for OBJ Farm, will MR. PRESIDENT claim ignorant of this fact that was reveal by a Foreign government. The fact is this, OBJ is not a saint and no society is corruption free but how you manage it speaks volume of you. In a nutshell, OBJ should leave ATIKU and concentrates on how to conduct credible elections in 2007 and let's Nigerians decide his fate in 2007. |

The political terrain of Nigeria is so unique that you can say what will happen in the end. The just concluded PDP Primary that produce Kastina State Governor is not a surprise to me but the real JOKE is the issue of the running mate which most people think the battle line is between Odili and Duke but sources within the presidency have it that BABA is highly favour Odili for the slot. I think Odili doesnt merit the slot at all, i know Duke will have being a good and dedicated Vice President. Since we Nigerians advocates for generational change from the old politicians, i pray these governors should perform well in office. |

I will get our priority right, as n which of the sectors that needs serious attention from the governmet, like the educational, infrastructures, empowerment of the citizents and give these sectors adequate implementation in my first year n office. Ynot:I totally disagree with u and i think we should b careful abt the kind of word(s) we use against our leader(s). The Officeof the Vice President is the second highest office of the land and i think that office shold be accord respect at all time. The office of either the Vice President or Deputy Governor is to assist either the President or Governor, so if MR. President has not deem it fit to delegate responsibilty to his Vice President, the Vice has no choice now to abide within the constitution of the land. If the office of the Vice President or Deputy Governor is redundant, this shows the kind of constitution the military drafted and handed over to us. I think Vice President Atiku Abubakar should be blame for his redundancy in Presidency, it is part and parcel of politics and struggle for power. |

The country can not work because that are suppose to make it works are killing the country through numerous corruption, as is our so called LEADER. The basic problem of this great country blessed resources is BAD LEADERSHIP AND HIGH LEVEL CORRUPTION IN HIGH PLACES. Corruption exists all over the world but ours is out of hand because of numerous reasons in this country. We have a high level of unemployment, because of lack VISIONARY LEADERSHIP IN THE COUNTRY and lack of continuity of policy and programmes in the country. It amaze me to hear MR. PRESIDENT saying he has spent BILLIONS of NAIRA on NEPA NOW POWER HOLDING COMPANY OF NIGERIA, still yet this sector is not working at all and the government usually claims they have spent BILLIONS of Naira on ROADS and roads are still in BAD SHARP. Corruption is our MAJOR PROBLEM and our LEADERS are not sincere in FIGHT THIS GREAT PROBLEM THAT HAS BEDEVILLED THIS COUNTRY. Where our LEADERS suppose to TAKE A DECISIVE DECISION, they lack the power because most of those people engage in CORRUPTION ARE THEIR ASSOCIATES IN QUOTE. That is why Nigeria is not working? |
