Stop Admitting Law Students, Lawyer Tells NOUN A Port Harcourt-based lawyer and civil rights crusader, Barr. Chijioke Agi, has urged the National Open University of Nigeria (NOUN) to stop admitting students into its Faculty of Law until the issue of admitting its law graduates into the Nigerian Law School is resolved. He said until the issue is resolved, the fate of its law graduates would hang in the balance. Barr. Agi, who made the remarks while speaking with The Tide in Port Harcourt last Monday explained that in the 1990s, the Council for Legal Education abolished part time programme in Law in Nigerian universities in the bid to check half-baked lawyers and expressed regrets that the introduction of Law the in curriculum of NOUN, was a re-enactment of the old order. He said the legal tussle between NOUN students and the Council of Legal Education in the Federal High Court was yet to be determined . According to him, “until the legal battle between NOUN students and Council for Legal Education is determined, NOUN should not admit students to that Faculty”. This is because to become a lawyer, the law graduate must pass through the Law School. It makes no sense that one is a law gradicate yet, not a lawyer”, he stated Barr. Agi remarked that though the NOUN’s 10 Faculties were accredited by the National Universities Commission (NUC), the other faculties are running without hitches except the law Faculty. It would be recalled that the President Obasanjo’s administration established NOUN as a Federal Government’s Special Project in line with the Millenium Development Goals (MDGs). But the recalcitrance of the council of Legal Education over the admission of NOUN law gradates to the Nigerian Law School has put paid to the university’s efforts at training law graduates. |
Now, the questions begging for answers on account that justice is being denied these innocent students are: could it have been more ideal if these students had taken the law into their own hands with violence and, perhaps, a showdown that may warrant forceful closure of the Nigerian Law School campuses in the country? Is the court becoming a political party where political gimmicks are obtainable irrespective of the laid down rules? How long will the federal government watch a body under it subject its citizens to psychological trauma and deliberately frustrate with tactics and flimsy excuses innocent students who accepted its offers of admission and went through the same course-outlines as members of the agency? Is it a normalcy for parties, after closing their arguments, to start the matter afresh after fixing judgment without appellate orders, perhaps, a party is not satisfied on the arguments presented by its counsel? Overall, can we continue with the slogan that ‘anything is possible in Nigeria’? Justice delayed is ultimately denied. Hence, if a court refuses to give a judgment on a matter it competently heard, it implies the country is rapidly drifting towards George Orwell’s ‘Animal Farm’ where’ all animals are equal but some are more equal than others”. Nonetheless, the federal government and the judiciary should not forget that the victims are students who put in their best time and resources in pursuit of a desirable career. Regardless of whatever reasons, it is a politically-motivated attack on the legal system not to deliver a judgment after listening to parties. Sadly, the court is the last hope of the common man. To substantiate the assumptions, the AGF who is the fourth defendant representing the federal government submitted a secret written brief and successfully urged the court to accept it as oral arguments in an open court. What an aberration! Finally, on the judgment date, only the counsels representing the plaintiffs and NOUN were sighted at the court premises which was indicative that others were probably put on notice not to waste their time as the judgment would never come. This is, indeed a ridiculous and dangerous omen of egotism, tyranny and persecution. Umegboro writes from Abuja. |
THE sudden transfer of Hon. Justice B.O. Quadri of the Federal High Court in Port Harcourt to Abuja Judicial Division after fixing a date for judgment on the Nigerian Law School admission tussle between the students of National Open University of Nigeria (NOUN) and the Council of Legal Education (CLE), leaves much to be desired. The preliminary objection alone lingered in the court for over a year but finally was ruled in favour of the students prior to commencement of the substantive matters. NOUN, a FGN-special project in compliance with the UN Millennium Development Goal (MDG) on education was established by Chief Olusegun Obasanjo’s administration. To motivate Nigerians, Obasanjo enrolled in the university’s programme, graduated and is presently doing a doctorate degree in Theology; all for authentication purposes. The university’s ten faculties including Law are accredited by the National Universities Commission (NUC) and it has notable Nigerians, including members of the National Assembly, offering one programme or the other without hitches except Law, which faces challenges with the CLE, a body vested with the responsibility of training of law graduates in the law school. The students in a representative action through their counsel, Professor Amuda Kannike Abiodun (SAN), dragged the Council of Legal Education (CLE), the National Universities Commission (NUC), the Attorney General of the Federation (AGF) and the NOUN to court in Suit No: FHC/PH/CS/111/2015 to explain why gates of the Nigerian Law School were shut against them, contrary to provisions clearly spelt out in the Students Handbooks which guaranteed admission for vocational training upon award of a Bachelor of Laws degree (LL.B) by the university, and also prayed the court, among others, to order the CLE to admit them into law school immediately. The CLE’s summative arguments pointed at the Open and Distance Learning (ODL) mode of NOUN as against the conventional method hitherto dominant in the country. Already, the matter has lingered in the court for about three years, leaving the graduates idle and in a dilemma with series of a adjournments, preliminary objections, absences of judge and public holidays aborting the court sittings. Nevertheless, the graduates doggedly maintained decorum, believing that since the university’s law programme which is the subject matter is duly accredited by the statutory body and approved by the federal government, justice will ultimately prevail. Incidentally, on the day of arguments on December 07, 2016, Hon. Justice Quadri after listening to all the parties fixed January 27, 2017 for judgment with the students in high spirits, hoping futilely that the end had finally come, until the judge’s absence with no communication made it obvious. Usually, transfer of judges is not strange in the country but where such happens, two options are inevitable in sync with continuity in public service. The transferred judge is at liberty to personally deliver judgments on concluded matters or transfer case files to his successor to read the judgment. As the judgment was not delivered as scheduled, it implies that the students who submitted to the legal system may perpetually be kept in the court with different technicalities. To start with, is the Nigerian Law School a fiefdom of some citizens? What offences did the students commit to deserve such resolute hate and discriminatory tendencies against them? From the arguments, it was obvious that all enabling laws are in favour of NOUN as the opposing party only anchored on the proficiency of the noble profession which in law is merely persuasive. The dangerous implication is that having waited patiently since 2015 in the court and finally got to judgment but was tactically quashed for whatever reasons, the new judge may restart the case afresh which may linger again as evident in our judicial system. |
‘Varsities need to improve on devt and use of ICT’ UNIVERSITIES in Nigeria have been advised to scale up the development and use of Information and Communication Technology, not just at the infrastructure and human capacity levels, but also in content delivery. The director, Distance Learning Centre (DLC), University of Ibadan, Oyo State, Professor Bayo Okunade, made the call on Thursday at the opening of a two-day ‘Advocacy and Training Workshop on ODL Skills’ held at the Professor Isaac Folorunso Adewole (PIFA) Hall of the Centre, Ajibode Extension, Ibadan. He said that dual-mode universities (which all providers of Open Distance Learning in Nigeria currently are) particularly need to increase the use of ICT in teaching and learning in their regular (or conventional) content delivery. This, he noted, would in turn enhance the capacity of facilitators on the ODL mode. “The transition from the purely well entrenched part-time programme to ODL was cumbersome because we continue to operate at the very conventional level. “It has been very easy for many universities in Europe, Asia and the United States of America to be dual-mode because they have largely subscribed to technology on the regular mode and with special reference to OER (Open Educational Resources),” he noted. He noted particularly that skills and competencies of ODL are not peculiar to the mode, but are skills required for driving education in the 21st century. The two-day workshop, he explained, was meant for not only the drivers of ODL but all involved in the business of providing education, especially at the tertiary level. Also in his address, while declaring the workshop open, the vice chancellor, Professor Abel Idowu Olayinka, noted that the problem in the Nigerian university system is not just inadequate access but the inability to appropriate ODL tools into the conventional university resources. He thanked the President/CEO of the Commonwealth of Learning (COL), Professor Asha Singh Kanwar, for her presence at the workshop and for allowing the university to share from her wealth of knowledge. Both the pioneer vice chancellor of the National Open University of Nigeria, Emeritus Professor Olugbemiro Jegede, and Professor Kanwar presented papers at the opening day of the event. Jegede’s keynote paper was entitled ‘The Inevitability of ODL & Its Tools’. For more info about noun u can call or WhatsApp me 08185025045 |

Director, National Open University of Nigeria, Owerri Study Center, Dr Mrs Theresa Ettu, has just confirmed that www.nouonline.com is authentic and the correct portal reportedly launched recently by National Open University of Nigeria. Now, the most important development is that the portal is confirmed to be authentic and owned by the school. What then should be understood is that the development of the portal is still not complete. At the moment, though Remita could be generated and payments made, - the funds are not being reflected on the e-wallet, and therefore, courses and exams cannot be registered - Application forms for admission cannot be completed - Balance carried forward on the e-wallet are not reflected - We cannot view our past semester exam results - History of our e-wallet transactions are also not available All these lapses are just temporary. The school is working round the clock to rectify all these. Students are advised to start making payments, second week of February, 2017. Patience therefore remains the keyword here. |

The Vice-Chancellor of the university, Prof. Abdalla Uba Adamu, stated this at the weekend during a brief ceremony for the relocation of the NOUN study centre to its permanent site in Uyo, the state capital. The ultra-moden site was donated recently to NOUN by the state government in order to boost the activities of the institution in the state, especially in the area of enrolment of the citizens and other residents into the university. The erstwhile Special Study Centre, located at No. 3, Mbaba Afia Street, has formally moved to the new facility at Udo Udoma Avenue in the metropolis. At the ceremony to declare the centre open for occupation by NOUN staff and students, the Registrar of the institution, Mr. Felix Edoka, who represented the vice-chancellor, said, “The purpose of our visit today is to ask the director of the Uyo Study Centre, Dr. Angela Abaa, to move into this facility recently donated to the university by the government of Akwa Ibom state. I wish to seize this opportunity to express the gratitude of the university to the governor, His Excellency Deacon Udom Emmanuel, for this wonderful gesture." He revealed that the university has decided to make Uyo the operational hub of the university in the South-south region. “The reason the university is particularly interested in the Uyo Study Centre is that management of the university has decided that the Uyo Study Centre should be the hub of operation of the university in the South-South region,” he said. Also speaking on the occasion, the Director of NOUN's Learner Support Services (LSS), Professor Stanley Ngoa, described Governor Emmanuel as a large-hearted leader who is passionate about the education of his people. Ngoa explained that the choice of Uyo as the operational hub of the university in the South-South was informed by the fact that the state has a great potential for growth and is relatively more peaceful than any other state in the region. Earlier, the acting director, Uyo Study Centre, Dr. Angela Abaa, expressed delight and gratitude to God and the state government for resolving the endemic accommodation challenge that had plagued the study centre for years. The Director General of National Teachers’ Institute (NTI), Professor Garba Dahuwa Azare, has said that distance learning programme for primary and secondary school teachers will guarantee quality teaching in Nigeria. Speaking at the institute’s headquarters in Kaduna, he said that lack of continuous training for primary and secondary school teachers has become a common challenge at the state level, saying no state can afford to release 1,000 teachers for a two year training at a go. According to him, the only way out of the challenge is to constantly retrain teachers through distance learning, which they can undergo while they continue their work. Professor Azare further disclosed that his institute will soon begin to award degrees in affiliation with the National Open University of Nigeria (NOUN). A total of 12, 125 graduates received various certificates during the 6th convocation ceremony of the National Open University of Nigeria (NOUN) yesterday out of which 31 made first class in various disciplines. The vice chancellor of the university, Professor Abdalla Uba Adamu disclosed this during the convocation ceremony in Abuja. He said out of the number, the Faculty of Science had 2,087 graduates, Education, 2,038 and Health Sciences, 1956. In a message to the celebrants, President Muhammadu Buhari said any university council or management found wanting in financial mismanagement or gross moral and ethical violations would be made to face the full wrath of the law. The president, who was represented by the Executive Secretary, National Universities Commission (NUC), Professor Adamu Abubakar Rasheed said he had directed the Minister of Education, Mallam Adamu Adamu to demand quarterly reports from universities detailing their major financial and administrative activities. |
Buhari warns varsities against unethical practices President Muhammadu Buhari on Saturday warned that any university management involved in unethical practices would face the full wrath of the law. Buhari, who was the Visitor at the sixth convocation of the National Open University of Nigeria (NOUN) in Abuja, said universities would henceforth prepare quarterly financial reports. Represented by Prof. Abubakar Rasheed, Executive Secretary, National Universities Commission (NUC), Buhari said his administration was anchored on ensuring security of lives and property, fighting corruption and improving the economy. “As we move to address the existing needs of our universities, we demand that the leadership of these institutions reciprocate government’s gesture by untilising their funds with utmost integrity and probity. “Any university council or management found wanting in relation to financial mismanagement or gross moral and ethical violations will be made to face the full wrath of law. “I have directed the Minister of Education to demand quarterly reports from all universities, detailing their major financial and administrative activities. “A template for such report will soon be circulated to the universities by the Federal Ministry of Education through the NUC,’’ he said. Buhari asked NOUN to continue to lead and chart new directions in distance learning education through maximum use of Information and Communication Technology (ICT). According to him, NOUN should through effective use of ICT, research, instructional materials and other training aids, produce globally competitive graduates. He congratulated NOUN’s governing council, management, staff and students on the institution’s sixth convocation. In his address, Prof. Abdalla Adamu, NOUN’s Vice-Chancellor, said that 12,125 graduating students, across all disciplines, would be conferred with honours. He said that out of the number, 31 bagged first class degrees. According to him, NOUN is keying into the global trend in digital learning. “To improve our web rankings and raise the profile of our academic staff, NOUN has created a ‘NOUN Academics Online’ module where each of our academic staff is showcased to attract national and international collaborations in teaching and research. “Noting the trend in technology usage among our students and predilection towards smart phone and tablet devices, NOUN has started negotiations with key technology partners to migrate our study materials into ePub electronic format. “That will make our materials easier, friendlier and more interactively accessible on smartphone and tablet,’’ he said. He regretted that the Council for Legal Education (CLE) had consistently denied NOUN’s law graduates admission into law school due to wrong perception. Adamu, however, said that the Senate Committee on Tertiary Education and TETFund recently held a public hearing on NOUN Amendment Bill, which when passed into law, would address all outstanding issues. The vice-chancellor said that NOUN had outpaced other Open and Distance Learning (ODL) institutions in Africa in the Open Education Resources initiative. In his remarks, NOUN’s Chancellor, Lawrence Agubuzu, said that the yearly convocation was a testimony that NOUN was pursuing its mandate vigorously. He urged the new graduates to exhibit worthy qualities wherever they find themselves in the service of their fatherland. |
Nigeria Is Living In Denial Over It’s Challenges – Pat Utomi Prof Pat Utomi has said that the country is experiencing a huge challenge of living in denial about its problems. He said there is a certain conceit by Nigerians regarding the Nigerian condition and the place of Nigeria in the world and they think that Nigeria is too big to fail. Utomi, the two times Nigeria Presidential aspirant, who was the Guest Speaker at the 6th Pre-Convocation Lecture of the National Open University of Nigeria (NOUN), in Abuja, disclosed this during his lecture titled, “Political economy of education: “Issues and challenges of opening and distance learning in Nigeria.” According to him ” if we were not living in denial, one of the things we would have realised is that our country is in a rolling civil war.” He said many people are dying as a result of violent death than any other country in war situation. “We are struggling with Boko Haram, crisis in the north Central and in the South South, we are dealing with all kinds of issues llike militancy and so forth. “More people die in Nigeria, a violent death than many of the countries in war. What we have in Nigeria is an evrgreen civil war. ” How are we going to make progress when there’s so much violence everywhere? “We have a zero-sub mindset. People are struggling over things that they shouldn’t be struggling over.” Meanwhile, Utomi, who’s also the co-founder, Lagos Business School, has called on the federal government to prioritise education and health for its citizenry. He said education would help to ameliorate the poverty of Nigerians. In his speech, the Vice Chancellor, NOUN,Prof Abdallah Adamu, warned that the National Universities Commission (NUC) will shutdown any university that rejects degrees from students of the institution. He said this while responding to a question raised by a student about non admission of NOUN nursing graduates by some unnamed university in Nigeria at the 6th pre-convocation lecture. Adamu said NOUN degree had become acceptable globally. He said the NUC for a long time had hindered the growth of tertiary education in Nigeria through its regulations. According to him, it took the commission some time before it embraced private universities. The commission, he added, had refused to adapt to the rapid change of education globally. “This is a conversation into which the NUC has to be drawn. As guardians of the idea of a university in Nigeria the NUC has been traditionally slow to change. For the NUC a university was 100 hectares of condominium with many faculties and traditional teaching methods. “To be sure, it is changing but the pace has been slow. It took it long to accept the idea of private universities and even such methods of pedagogy as the case study method. But we must not blame the leadership of the NUC alone,” he said. Earlier in his response, the chairman of the lecture and registrar of the Joint Admissions and Matriculation Board (JAMB), Prof. Is-haq Oloyede, called on all institutions of the federal government to respect the law. “The Council of Legal Education is a creation of the law. The National Youth Service Corps is a creation of the law and therefore NOUN is created by the law. If we decide to be lawless there will be anarchy. “If anybody disagrees with a law the best place to go is the National Assembly not to take the law into his own hands. I therefore call on agencies of government to be law makers rather than law breakers,” he said. |
The Registrar of the Joint Admissions and Matriculation Board (JAMB), Professor Ishaq Oloyede, has called on all agencies of the Federal Government, especially the Council for Legal Education (CLE), and the National Youth Service Corps (NYSC), to respect the provisions of the law and stop the discrimination against graduates of the National Open University of Nigeria (NOUN). Oloyede said this yesterday at the 6th Pre-Convocation Lecture of the Open University held in Abuja. It would be recalled that for some years now, the Council for Legal Education has denied law graduates of NOUN, admission into law school, arguing that the Open University was a part time programme. Opposing arguments by the vice chancellor of NOUN, Professor Abdalla Uba Adamu, that the Open University was a full time programme, as well as the intervention by the National Universities Commission (NUC), under immediate past executive secretary, Professor Julius Okojie, failed to get the CLE to yield. Likewise, the NYSC has allegedly refused to mobilise graduates of the Open University for the one year national service on same argument. Professor Oloyede said yesterday, that the agencies are taking the law into their hands. He enjoined them to take the matter to the National Assembly, rather than deny the graduates their rights either into law school or into the NYSC programme. According to him, those who are castigating the Open University are ignorant, and the NUC should call them to order. |

He said: “If a prisoner wants to study in NOUN, it is free of charge. We feel that while they are there, they should not be denied education. But, once he or she is out of prison they will pay.” Adamu also said the law establishing the university would be amended by the National Assembly to expunge the phrase that says the university will provide knowledge through ‘correspondence’ and replace it with ‘Open Distance Learning.’ He said: “I can conveniently tell everybody that is worried about our students not being admitted into the Nigerian Law School. The Senate is holding public hearing on it.” Meanwhile, Osun state governor, Rauf Aregbesola who gave a speech during the 6th convocation ceremony of Fountain University, Osogbo, has advised university graduates to dump their certificates and go back to farm, urging them to see agriculture as viable alternative to white collar job. The President of the Senate, Dr Bukola Saraki, has called for the inclusion of Information Communication Technology (ICT) among courses offered by the National Open University of Nigeria (NOUN). Saraki said that if included, it would advance learning in the institution across the Nigeria. He made the call on Monday at the opening of a public hearing on “The National Open University Act amendment Bill 2016’’ organised by the Senate Committee on Tertiary Education and TetFund, in Abuja. The President of the Senate, who was represented by the Chief Whip, Sen. Olushola Adeyeye, said that the amendment of the Act would strengthen the capacity of the university to deliver on its goal. He said that the pivotal role of higher education as an underlined principle of moral education could not be over-emphasised, adding that the major thrust of the amendment bill was to improve on the existing legislation. According to Saraki, studies have shown that increase in students’ exposure to ICT through curriculum integration has significant and positive impact on their achievements, especially in knowledge and comprehension of skills. “It is on this basis that the establishment of the National Open University in July, 1983 as a springboard for open and distance learning in Nigeria was conceived.’’ He said that the university as it was currently ran depended on virtual learning and students individual research hence the need for improvement and introduction of helpful learning tools as presented by ICT. Senator Saraki He stated that so far, the success of the university was the most encouraging, adding that Nigerians must not lose sight of the fact that the global organisation of education was constantly evolving. Saraki explained that NOUN provided access and flexibility to those, who ordinarily would not have had the opportunity to get formal education. He therefore called for support from the legislators for the amendment of the bill. He also called for updating of laws and policies to give valuable support to Nigeria’s quest for improved quality learning. Earlier, Chairman of the Committee on Tertiary Education and TetFund, Sen. Jibrin Barau, said that the deployment of and penetration of ICT had eased the way of doing business and had modified the traditional means of communication. Barau explained that the introduction of a platform to provide online tuition as a method of instruction would bring efficiency and convenience in the Open University system. “As a foremost university that has brought education to the doorsteps of many individuals and has made learning easier for all, this amendment is apt, timely and in tune with the global best practices,” he said. He said that amendment of the bill would also help to reposition the institution for better services, and help in producing quality graduates for Nigeria. In his submission, Vice Chancellor of the university, Prof. Abdallah Adamu, said that the university was established to be technologically-driven. He said that though ICT had been incorporated in the new amendment, the biggest area of concern to the institution was the inclusion of “Correspondent’’ on the bill in reference to students of the school. “This gives the impression that we are not a full-time university, making us to be seen as part time. “They give us the impression of temporariness rather than permanence,” Adamu said. He disclosed that the institution had 78 study centres with a total of 254, 000 students’ enrolment across the country. “This is the only university that provides thousands of people opportunity to acquire university education without having to leave their work.” Adamu said that the new amendment should also include Open and Distance Learning (ODL) to clear the impression that the institution was not carrying out full-time programmes. Similarly, Executive Secretary, National Universities Commission (NUC), Prof. Adamu Rasheed, said that the challenges of access to conventional Nigerian universities were not new to Nigerians. Rasheed, who was represented by Dr Olamide Adesuwa, Director, Open and Distant Education of NUC, said that the low percentage of admissions into universities in the country necessitated the establishment of the NOUN. According to him, global best practices in distance education have shown that it had moved from correspondence to leveraging on ICT. He explained that distant education was “mediated learning’’, and that it was powered by ICT. “Open and Distant Learning is not part-time; it is flexible mode of learning. “It has to be seen as such in order not to misconstrue the efforts of the students who rather than waste time after work, now invest all of the time in learning.” The executive secretary said that the commission was in support of amendment of the proposed amendment. |
