An appeal court sitting in Lagos has adjourned for judgement the appeal filed by star actress and former beauty queen, Ibinabo Fiberesima challenging the judgement of a Lagos High Court which sentenced her to five years imprisonment for causing the death of a Lagos medical doctor, Giwa Suraj.
The embattled actress was sentenced to five years imprisonment for reckless driving which caused the death of one Dr. Giwa Suraj in an auto accident along Lekki-Epe expressway, Lagos State. The deceased was a staff of one of Lagos state owned hospitals. Fiberesima was fined N100,000 by an Igbosere Chief Magistrate Mr. O.A. Isaacs but the then Lagos State Attorney-General and Commissioner of justice, Olasupo Sasore (SAN), felt unsatisfied with the judgement and appealed. This prompted the state government to take its case to the Lagos High Court. At the Lagos high court, Justice Oluwayemi set aside the option of fine imposed by the Magistrate’s Court and sentenced Fiberesima to five years imprisonment for dangerous and reckless driving. In her judgment, Justice Oluwayemi held that the trial Magistrate exercised judicial recklessness when he gave the convict an option of fine. The court held that the option of N100,000 given to the convict did not serve the purpose of justice in the matter and subsequently ordered that the N100, 000 should be returned back to Ibinabo Fiberesima.
Dissatisfied with the judgement of the high court, Fiberesima came before the Court of Appeal and urged the court to set aside the five year sentence and restore the decision of the Magistrate Court. At the hearing of the appeal yesterday, the appellate court presided over by Justice U.I. Ndukwe-Anyanwu (Mrs.) adjourned for judgement in the appeal after counsel adopted their written addresses. Salam Alaykum. Let's all ponder on this hadith. On the authority of Abu 'Abdullah al-Nu'man bin Bashir, radiyallahu 'anhu, who said: I heard the Messenger of Allah, sallallahu 'alayhi wasallam, say: "Truly, what is lawful is evident, and what is unlawful is evident, and in between the two are matters which are doubtful which many people do not know. He who guards against doubtful things keeps his religion and honour blameless, and he who indulges in doubtful things indulges in fact in unlawful things, just as a shepherd who pastures his flock round a preserve will soon pasture them in it. Beware, every king has a preserve, and the things Allah has declared unlawful are His preserves. Beware, in the body there is a flesh; if it is sound, the whole body is sound, and if it is corrupt, the
whole body is corrupt, and behold, it is the heart."
[Al-Bukhari & Muslim] From this hadith we can deduce that it's best we steer clear of whatever that is not cleared in terms of being lawful or not.

Undoubtedly, there is a great difference between a believer and Muslim or Iman and Islam, in other words. Iman is both verbal and actions. Meaning, the heart and tongue confess with Iman while the heart and other sense do actions. Islam, on the other hand, means to submit oneself to Allah and obey His commands. Allah Almighty says,

The Bedouins say, "We have believed." Say, "You have not [yet] believed; but say [instead], 'We have submitted,' for faith has not yet entered your hearts.[Al-Hujurat: 14].

Based on this, scholars consider Iman as the inward deeds, while Islam is the outward actions. This is because Iman principally is the belief instilled in one's heart and Islam is to submit one's senses to it.

Therefore, the true Muslim is not reluctant in submitting himself in humiliation to Allah obeying His commands, hastening to fulfill the obligations of Islam, abandoning its prohibitions and believing that what Allah commanded us to do is in our best interest and what He prohibited entails evil.

Here, it is worthy to mention that both Iman and Islam are frequently interchangeable. The Arch angel Jibril (peace be upon him) differentiated between Iman and Islam in the well-known hadith [tradition] where he asked the Prophet (peace and blessings be upon him): "Oh Messenger of Allah! What is Iman? He replied: it is to believe in Allah, His Angels, Books, Messengers, the last Day, and destiny whether good or evil. And what is Islam? The Prophet replied: It is to testify that there is no god but Allah and that Muhammad is His Messenger, perform prayers, pay zakat [obligatory charity], fast the month of Ramadan and go for Hajj upon having the means."

In the above hadith, Iman is mainly associated with inward actions or the deeds of the heart, while Islam is associated with outward actions or deeds of the senses. Even when the testimony of faith is counted among the verbal actions of Iman; it is, however, reflected in the explicit acts of worship of Muslims including prayers, fasting, zakat and Hajj.

On the other hand, the Prophet (pace and blessings be upon him) defined Iman as Islam in the hadith narrated by ibn 'Abass on receiving the delegates of the tribe of 'Abdul-Qays. The Prophet (peace and blessings be upon him) said:"I order you (to do) four (things): to believe in Allah, that is, to testify that there is no god but Allah and that Muhammad is His Messenger, offer prayers, pay Zakat and to pay the Khumus (i.e. one-fifth) of the war booty to Allah." Here, the prophet (peace and blessings upon him) explained Iman likewise Islam.

To conclude:

Islam is interpreted in its absolute sense through the explicit acts of worship: saying the two testifications of faith, offering prayers, paying zakat, fasting and performing Hajj and so forth. These acts are considered the five pillars of Islam.

Iman includes verbal deeds, actions and strong belief: the heart and tongue admit with faith while the heart and senses work for it. Verbal deeds include remembering Allah [Dhikr], reading Qur'an, supplicating Allah, enjoining what is good and urging others to do it, forbidding what is evil and warning others against it, teaching and guiding those who go astray to the right path, sending or answering back greetings and the like.

On the other hand, one's actions spring form his heart and are reflected upon his senses. Meaning, the heart loves or hates for the sake of Allah, satisfaction with Allah's destiny, patience in times of afflictions, fearing and seeking His pleasure, putting our trust in Him and asking Him for forgiveness. The actions of senses include: bowing, prostration, standing and sitting before Allah in prayers, Tawaf [circumambulating the ka'ba] in Hajj, Jihad [fighting in the cause of Allah] and so on and so forth.

If there was any khair in celebrating the Mawlid, do you think the Prophet ﷺ would have remained silent on this?

And were not the Sahaabah who loved the Prophet ﷺ the most?

Also, there is no report from the Prophet’s own daughter, Faatimah رضي الله عنها. There is no report from `Ali رضي الله عنه. Then are we better than them or do we know better than them?

Abu Dharr رضي الله عنه said:

The Prophet صلى الله عليه وسلم left us (in such a state) that there was not a bird flapping it wings in the air except that he صلى الله عليه وسلم would teach us about it.

He (Abu Dharr) said: the Prophet صلى الله عليه وسلم said:

❝ THERE IS NOTHING LEFT WHICH WOULD TAKE YOU CLOSER TO THE JANNAH AND DISTANCE YOU FROM THE FIRE, EXCEPT THAT IT HAS BEEN MADE CLEAR TO YOU.”

Al-`Irbaadh bin Saariyah رضي الله عنه said:

The Messenger of Allaah صلى الله عليع وسلم delivered a moving speech to us which made our eyes flow with tears and made our hearts melt.
We said: 'O Messenger of Allaah صلى الله عليع وسلم! This is a speech of farewell. What did you enjoin upon us?'
He صلى الله عليع وسلم said:

❝ I AM LEAVING YOU UPON A BRIGHT (PATH) WHOSE NIGHT IS LIKE ITS DAY. NO ONE WILL DEVIATE FROM IT AFTER I AM GONE BUT ONE WHO IS DOOMED. Whoever among you lives will see great conflict. I urge you to adhere to what you know of my Sunnah and the path of the Rightly-Guided Caliphs, and cling stubbornly to it. And you must obey, even if (your leader is) an Abyssinian leader. For the true believer is like a camel with a ring in its nose; wherever it is driven, it complies.”

Adding new ibadats to Islam is called bid'at, and it is haram. Then the question turns into Is there an ibadat in Islam for celebrating the birth day of the nabi?. The answer is no. There is no birthday celebration for the nabi in Islam. Nabi's followers had never done any kind of celebration or birthday party for him when he was alive.

Birthday celebration for the nabi is definitely bid'at. Even those who intensely claim that it is not haram accept that it is a bid'at. But they say that it is a good kind of bid'at (bid'at-i hasene). Every bid'at is haram, there is no kind of "good bid'at".

The nabi Muhammad was born in year 571. But, the first mawlid was celebrated in 1232 in Egypt. These celebrations are done mostly by mushriks of the type that are defined in Quran as the ones who are obedient to the pat which they find their fathers on. They defend themselves by saying "These celebrations are being done for centuries. Did all those people do wrong all those years? There were many scholars and omniscient among them. How do you know better than them?".

وَإِذَا قِيلَ لَهُمْ تَعَالَوْاْ إِلَى مَا أَنزَلَ اللّهُ وَإِلَى الرَّسُولِ قَالُواْ حَسْبُنَا مَا وَجَدْنَا عَلَيْهِ آبَاءنَا أَوَلَوْ كَانَ آبَاؤُهُمْ لاَ يَعْلَمُونَ شَيْئًا وَلاَ يَهْتَدُونَ
And when it is said to them, "Come to what Allah has revealed and to the Messenger," they say, "Sufficient for us is that upon which we found our fathers." Even though their fathers knew nothing, nor were they guided?

The number of people doing something can not be used to prove that that thing is rightful. There is no such celebrations in Islam. They are injected inside Islam many years after the death of the nabi. Christians celebrate birthday of a certain nabi, we Muslims don't have such a sunnah (convention).

There was this lady called Nike in my neighborhood who I'd been scoping for a long time, as a matter of fact, it's been over four months 'cos I can remember vividly that it all started on one cool saturday evening, 5th of January to be precise.
