Hi visa officer.
I need your help with my situation please. My husband came for interview on 3rd of may 2017 in which he was told that he will be on administrative processing for 60 days after the 60 days was over he sent an email to request update but to our utmost surprise the response was shocking
Below wad the response we received then

Thank you for your inquiry.
 
You were notified during your IV interview in 2014 and again in your 2017 IV interview that you were ineligible for an immigrant visa based on you having materially misrepresented yourself. You properly applied for a waiver through USCIS and in 2015, were notified that your waiver was denied. As such, you remain ineligible for an immigrant visa and your file will be destroyed and no longer remain at our post.

Afterwards i keep seeing that the status is being updated everytime as refused, so last month he submitted a new waiver to clear off the ineligibility and sent email to lagosiv letting them know that he has started waiver on his case, but got a reply that the case is no longet at the post that enquiry should be forwarded to USCIS. I called USCIS today they dont have no information about the case, i called NVC too they told me the case was not return to them either and the last update on the ceac is today july 12th. So i am confused on what to do. Please have pity on me and put me through please. We really want to know what happened to the case after the interview.

Thanks for the good job you are doing here, my husband has his interview on the 3rd of may, he was given a paper that his case has to go on administrative processing that will last for 60 days, my question now is can he send mail to lagosiv to ask for the update? Does it mean 60 business days because the last update on CEAC was June 1st.

Thanks for the good work you are doing here, my husband had his interview on the 3rd of may and he was told that he is going to be on administrative processing for like 60 days, I just checked the status on the ceac.gov today and the status changed to Refused it was updated on Friday 26th of may. I'm totally confused now though we have not heard anything from the embassy but please could that means that it's been refused.His case number is LGS2015795026.

Thank you so much for the good work you are doing here. My husband had his interview on may 3rd and he was told by the consular officer that his case needs further administrative processing which will take like 60 days.
Now my question is this, is the 60 days includes weekends or is it 60 business days?
I'm just so curious to know please because I got pregnant when I came to see him last November and I will be due soonest.
That's why I want him here before I deliver because it's not an easy task to be a single mom here.

My husband had interview today and he told me he was given a white paper by the consular that his case require administrative processing which would last for about 60 days and his passport was returned to him.
My question now is, can the administrative processing be less than 60 days and what is the fate of the applicant after the process is complete.
I'm just somehow worried about the administrative processing issue.

Hello VO,
I'm so glad that we have a new VO to answer our questions, I won the 2014 dv lottery but my husband visa was denied when they called us for second interview due to the fact that he used different name and date of birth to apply for student visa in 2002 so I came to United states with my daughter we filed a waiver but it was denied and the reason that was explained in the denial notice was that the dv fiscal year has ended.
Now the i-130 has been approved and we are the NVC stage but our priority date is still far, my question now is can we go ahead and file waiver now or we should wait till after his interview?
I need your professional advice please.

Because my niece responsibility lies on my sister since the Father died and the mother is not with her.

Please I need you to help me with this question even though it's a non immigrant question though, my sister want to adopt my niece she is 11 years old because my brother who happened to be her father died 2 weeks ago and there's no one to take care of her again because the mom is not with her too.
Now, she is thinking of inviting her first for visitation and then go back to nigeria to start the adoption process.
Now, my question is Wil she attend interview since she is just 11yrs old or is it drop box that should be done for her? Awaiting ur answer ma'am.

I was just notified of the waiver denial myself. Yes, you should file for him if you want him to join you, but he will still need a waiver.

I am back again in respect of my hubby case, hope you can still remember my case?
Uscis sent a mail today that they denied the waiver on the ground that he is a diversity visa applicant and that the fiscal year for dv has ended Sept 30th 2014.that dv Visa category has ended.
Now my question is this, should I go ahead and file for him?
If yes, will the issue of material misrepresentation not going to come up again when he is invited for interview?
Please I need your professional advice right now I'm so confused.i need you to advice me on the next step to take.

I hope the waiting period will not be too long.myself and his daughter are really missing him honestly.

I think you should send a mail to lagosiv@state.gov.but extension of dv visa? I think they don't do it but send the mail and hear their response. All the best!.

Thanks ma.he is still an LPR, He's one of the dv 2014 winners.so just one form for all of them I mean the wife and the three kids. I have told him the wife should be ready for questions and be ready to convince the consular officer about the relationship.

Welcome back ma'am.please I have a question concerning a family friend, He told me that the person that helped him to play dv lottery played for him as single but this man is married with 3 kids . Unfortunately for him he did not correct this error when he sent back the ds 230 form to Kentucky. Now, he is in United States.please is it possible for him to file petition for his wife and the 3 kids? If possible which of the forms can he file?
If that is not possible please what can he do for his family to be able to join him here.

Greetings! You should file the I-130 and then the I-601. Right now the waiting time for the F2A (spouse of an LPR) visa is around a year and a half, so the sooner the better!

Normally I would tell you to wait until his interview is scheduled to file the I-601, but I remember your case well and know that the I-601 is the right form to file. You do need to file the I-130 first, but if you file the I-601 soon after, his waiver will likely already be in place when he comes to his interview.
