To think this guy studied at the private Harrow college in the UK, of which he subsequently attended Cambridge University to study law is shocking. https://en.wikipedia.org/wiki/Femi_Fani-Kayode#Background_and_education

I think Nigeria as a country changes your lifestyle, way of life, reasoning, accent, relationship with other and your total views about life.

Travel / Re: The Adventures Of A New UK Migrant by babaskool(m): 1:09pm On Dec 21, 2017
UKmigrant:
So I am finally begining to settle into my new job. I have had my orientation, IT training, gotten a smartcard to access the organisation's records relevant to my work and have also gotten my ID card which doubles as a security door pass. I am in the part of England known as East Anglia, it is a beautiful place, layed back and free of the congestion and razzmatazz of London. I deliberately chose this place for many reasons, some being what the organisation is offering me and the low cost of living in this region. If I don't like it after a while, I might decide to move to get a position in a bigger city, but for now I am loving every bit of it.

Everyone around here seems nice and ready to help. This region of England is dominated by whites/natives unlike big cities like London, Birmingham, Manchester. I have managed to meet a few Nigerians though and other African nationals.

I am staying at a temporary accommodation arranged by my employer and I've already started meeting agents to get a small place for myself close to my work. They all require some form of deposits and references. Working on that...
See grace, OP I tap into your blessing ooo,I remember that me despite the fact that I done college in the UK,(got 3 A's ) went to university to study law (graduated with a 2:1) looked for a job for around 6 months to no avail. I had to be on job seekers throughout, even cleaning jobs I was been rejected talkless of corporate jobs all in the UK.

yet you dey Naija, an English company just offered you an employment like and begin to treat you like a king, see how you even excited about your job and being in England for the first time, which part of East London do I not know the bus route to since I had been living there for the last 7 years or so.

GOD pls help me like you helped this OP.

written agreement is the best,

Written is the best. However, the video evidence still amounts to good evidence which can be tendered in court in the absence of a written agreement
Properties / Re: I Want To Sue My Landlord For Breach Of Contract by babaskool(m): 11:09am On Dec 21, 2017
Dear Nairalander,
Sorry that you have experienced such a traumatic experience but firstly may I ask did your landlord sign any agreement with you be it on a sheet of paper of any kind with regards to the 70k you paid him.
If your answer to the above question is NO, then there is still a way out. You mentioned you recorded the process of you making the payment. The video evidence can be and would be tendered as an exhibit in court when your case is being heard against your landlord. Section 84 of the Evidence Act 2011 makes this possible

In the meantime, can you trick your landlord into acknowledging that you had initially paid him 70k before. You will tell him you don't mind paying him the remaining 80k balance but he should please help you sign any agreement stating that you have paid him 70k before and would still pay him another 80k in the future.

Also from now henceforth try and make silent recordings (video or audio) of the conversations you have with your landlord on this particular matter, it would be good evidence in court.

Depending on how experienced your lawyer is taking into account the legal advice I have indicated above, you would get your 70k back and even substantial damages by way of special damages ( your legal fees, Court costs) E.T.C

I sincerely hope the legal advice above is sufficient for you at this point in time

Feel free to contact me should you require any further information

Career / Re: Non Remittance Of Pension Deductions; Position Of The Law? by babaskool(m): 7:53am On Dec 20, 2017
Dear Mr cents,
1. Is your polytechnic a private run insituton or publicly owned. This information is important so as to work out your minimum rate of the contributions that had been made for you by virtue of the Pension Reform Act 2014.

2.Do you have any information as to whether your employers elected to bear the cost of both the employer and employees contributions.

3. Do you still have a copy of your contract of employment handy, the position of the law is that an application of pension contributions to the total emolument of the employees as indicated in the employees contract of employment. Your monthly emolument from your polytechnic is simply your total emoluments as stated in your contract of employment provided this amount is not lower than the sum of your basic salary, housing allowance and transport allowance.

4.Do you remember opening a retirement savings account with a pension fund administrator since you started work with your polytechnic.

5.The legal means available to you if your pension funds had been misappropriated, is that apart form suing your employers for the due sums, you can apply for the forfeiture of the assets of your employers to the federal government

Pls feel free to message me should you need further information about your pension rights

Why would you advice NIGERIANs to take their investments outside the country. I really don't encourage capital flight.

As things stand, an investor only wants to make more money from his capital investments so If he does this in another jurisdiction, it really doesn't matter
Properties / Re: Frequently Asked Questions About Real Estate In Lagos by babaskool(m): 7:00am On Dec 18, 2017
I personally think Real estate in Lagos is over saturated and over priced. Especially on the island where some houses are over priced and consequentially overrated.

Nigerian properties as a whole have a low investment yield. Investment yield is calculated by working out the percentage as per the income a property would generate every year against the price at which the property was bought. I am yet to see a Lagos property with an investment yield of more than 10 percent

My opinion is anyone willing to invest in real estate and has more than 100 m as capital should look outside Nigeria in other countries like Uk, UAE, Caribbean islands and others.
100 million naira is (200,000 pounds) it will get you decent properties outside London with an impressive investment yield. Besides pounds is triple the value of the naira so why won't you take these investments outside

Does this apply to me a Muslim getting a bank loan and being exempted from paying the interest cause it infringes on my freedom of thought , conscience and religion too ?

Yes technically it might apply to you as a Muslim getting a bank loan and not wanting to pay interest on it. However the court might decide your case lacks merit as it might be very difficult to prove bank loans with interest have or will in the real sense Infringe your right to freedom to practice your religion. The point is that you must be able to prove on the balance of probabilities your right has been infringed

SMH...why da fuq should the body of benchers feel offended ?you mean their feelings is above he law.where is the law sef..injustice everywhere .

The body of benchers comprises of the Chief Justice of Nigeria and the 36 other Chief judges of the federation. Tbvh there is nothing you can do against these people, so it's better to go against the lesser bodies council of legal education ( Nigerian Law school ) and the Nigerian Bar Association

This matter is actually very simple and straightforward than it is being made to be.
Firstly Miss Firdaus get yourself a good lawyer, instruct him to bring an application for enforcement of your fundamental rights via the FREP rules 2009.

One of the prayers you would be seeking as a relief is that the actions of staff of the council of legal education on the day of your call to bar infringed on your right to freedom of thought, conscience and religion

Please remind your lawyer to be reasonable and only ask that you may be called at the next call to bar which is April 2018.

Also please tell him to institute your case in the Federal High court and should only make a case against the council of legal education and not the body of benchers (the body is the highest supreme body in the land ) they might feel offended

Kind regards

This is meant to be a good development but I'll advice those who wants to register their businesses to seek some legal guidance because there's enough technicalities out there in which you can't bypass yourself except you are properly guided and I'm sure that's the reason they were used in the first place

Anyone know how I can go about registering one?? I plan on starting something soon

Hello sir are you still interested in registering a business name or incorporating a company
Travel / Re: Moving Back To Nigeria From USA by babaskool(m): 9:08am On Dec 09, 2017
Agbaletu:

Quite apart from this, how much will it cost to complete a Ltd company registration that has a reserved name with CAC?

Thank you for the question, having reserved a name firstly I'm pretty sure you are therefore aware the reservation of your company name would last for just 60 days, of which secondly the standard pratice us lawyers do is to charge you 10% of your authorized capital as the legal fees for incoporating your company

so the price of getting a certficate of incorporation is directly proportional to the proposed worth of how much money the company is starting, but I personally can incorporate your company for a fixed 50k sum regardless of what your authorized share capital is or how many subsidiaries companies you may wish to have.
Please also feel free to contact me on the other advice you may need on pre or post incorporation of a company such as the corporate taxes, the reliefs, registration with Nipc, no tap, free zone trade, filling of company returns to the CAC,annual returns, statutory meetings, details on how directors may be appointed or removed, same with secretaries.. In fact ask me anything you are unsure of I would be wlig to answer in here

Which kind of snake oil salesman advice were you by plucking figures out of the air?

An investor battens down the hatches with seed capital of N9m; procures land/space and equipment therefrom for a service/filling station and pronto! makes a daily profit of N400k?

The land matter is an over flogged issue I'm tired of talking abt it but beware that in some places except major cities land is still as cheap as buying the owner a bottle of wine ...

Yes some filling stations make a profit of up to 400k daily... I would the example I used earlier I was at the filling station nd bought fuel worth 15k the guy in front of me filled up his tank before me, the time that day was still 7am in the morning

Do you know how many people drive in and patronize a filling station per day, especially when they know ur pumps gives accurate readings of fuel bought. Sit down there brother just sit down there,
