N255m Car Scandal: Ministry Denies Granting Waiver

The federal ministry of Finance has denied allegations that it granted waivers for the importation of the N255 million armoured cars allegedly purchased for the embattled minister of aviation

A statement from the ministry signed by Paul Nwabuikwu, Special Adviser to the Coordinating Minister for the Economy and Minister of Finance said the ministry only granted waiver to the Lagos state government for its National Sports Festival.
The ministry said it did not grant any exemption for the importation of armoured cars.

According to Paul Nwabuikwu, “reports which claim that the Federal Ministry of Finance granted a waiver to Coscharis Motors Nigeria Ltd for the purchase of armoured cars are totally false and without foundation.”
Rather, he disclosed that “on June 23, 2012, the Lagos State Government applied for Waiver of Destination Inspection Charges and Duty Exemptions for Coscharis Motors Nigeria Ltd, the official Automobile Partner for the National Sports Festival (“EKO 2012”), to purchase 300 vehicles on its behalf for the event. Since the Lagos State Government met the laid down criteria, the waiver was granted.”

He emphasised that “the waiver granted to the Lagos State Government for the event did not include the purchase of armoured vehicles.”

A Deputy Comptroller of Customs in charge of Modern Research and Economic Relations, Manasa Daniel Jatau had disclosed at the House of Representatives public hearing on the scandalous purchase of two armoured vehicles for the minister of aviation for N255 million, that N10,133,505.74 which should have come to the federal government was waived for Coscharis.

In 2012, the Lagos state government was granted waiver by President Goodluck Jonathan on import duty, value added tax, ETLS, CISS and other port charges to import 300 units of BMW, Ford, Land Rover, Range Rover, Lexus, Mercedes, Escalade, Jaguar and buses for use during the 18th National Sports Festival (EKO 2012) to be imported through Messrs Coscharis Motors Nigeria Limited.

Taxes can be shifted forward, backwards and all what not, as long as the right value for the tax is paid.
Tax is money and not an item, so you are twisting the issue. Your Umbrellas and computers do not cut the analogy at all.

We are talking of cars. If Govt. gave you a waiver of specific value on some cars, and you instead paid the taxes before the waiver was granted. There is nothing stopping you from using the waivers to import replacement stock with the waiver, as long as the value of the waiver was not exceeded.

The cars supplied were stocked by Coscharis, before the contract was even concluded. I see someone asking about it above, feeling smart like he raised a difficult question.

A company can claim tax relief granted say on infrastructural item, and use it to satisfy tax on another item which was not relieved, only to the extent of the value of the first. That is when such a relief was not claimed on the initial item. Like i told you earlier, there is no confusion since tax is money and tax waivers have values.

You have written trash. One of the taxes paid on imports is VAT which is based on the value of the good imported.

If I get a waiver to import a specified good of N10 million and I end up importing an entirely different good and still seek to apply the waiver, that is evasion and an attempt to cheat the tax man.

These people got a loan from FBN for these cars but then lied in their statements that it was a finance lease.

As you can see, we are dealing with hardened criminals. You will need Sergeant Rogers to torture these people to make them say the truth.

I honestly think Nigeria must amend its tax laws to stop such abuses.

If you get a waiver to import for a specific purpose, then that asset must be used for a certain number of years or scrapped by you for the waiver to apply. Where you go ahead to sell same asset within a short period of time and make a gain on it, then the appropriate import duty as well as the capital gains tax must be paid on that asset.

What we see in this whole import regime is a sham. People cheating the system.

Waiver to pay duty given by the Fed Ministry of Finance exempts coy from paying duties on imported goods that already have a tariff bar.

It's been bastardized in Nigeria because of its indiscriminate use for political patronage...


If you don't know something ...ask questions or keep quiet.

Look to import and get a waiver for a particular purpose and then use it for another is criminal.

For example, if I import a cloth as a gift for my mother and then go ahead to sell same cloth, that is criminal on its own.

The guy you replied clearly understood that there is difference between avoidance and evasion....he just doesn't know the definitions of the two terms..

A criminal man. For example, I may opt to receive more shares from a company in place of dividends so as to avoid personal income tax. That is clearly me using the tax regime to my advantage which is avoidance.

But where I underdeclare what I have received, it is clearly evasion.

Maduka got waivers to import ordinary cars. He then applied same waivers to specialised vehicles which are 10 times above the price of the cars which the waivers apply to. That is criminal and a theft from the treasury.

How does underdeclaring your import fall into avoidance?

"Approved do the needful". So the rogue approved an expenditure above a statutory limit and she claims innocence? If I approve a fraudulent transaction without due diligence, am I not guilty as well?

This woman is a rogue and one can see from the multiple statements being released. It is the characteristic of a hardened criminal. Her spokesman issued a statement, after how many weeks, she comes out to say it was inaccurate. Did he not seek her approval before releasing the statement?

He got a waiver for a particular event but then diverted the car for use elsewhere. To top it up, he does not seem to understand that he has confessed his being a criminal.

I tell you what, showing these people any form of respect is absolute stupidity. These people have no respect for our country and should be cursed for what they have turned this country to.

Earlier on Monday, the South-East and South-South Professionals Forum had called on Oduah to step aside in the face of mounting protests over her role in the purchase of the bulletproof cars.

It expressed disappointment over the scandal rocking the Aviation industry which is under Oduah’s watch.

The forum’s President , Emeka Ugwu-Oju, spoke at a stakeholders’ meeting organised to marshal their position on the national dialogue in Benin, Edo State.

Ugwu-Oju said, “We are not saying she is guilty but for what has happened in the ministry under her watch, it is clear the ministry could afford such money for some frivolous purposes. It is a wrong thing to do and somebody has to take responsibility.

“We are of the view that the current minister of aviation should go. She is going not because she is found culpable but we are looking at the overall picture of values.

“The honourable thing for her to do is to step aside and go.”

Another line of defence from the hardened criminals.

If I make a budget to purchase and I go on with a finance lease to acquire the same asset, what I have done is to violate that budget as finance lease is like taking a loan. It must be stated explicitly in a budget and in subsequent years lease payments must be included, in the budget till all your liabilities are fulfilled.

What the hardened criminals have done here is even to put them in more soup. They are rogues and you will need to torture them before they say the truth.
