That's just it by Nigerian Law you're innocent until caught in the act, so by all standards bobrisky hasn't broken any law either by cross dressing or acting all feminine. Till he's been caught in the act or proven to belong to a gay association, bobrisky is a free confused persona.

Yes you are correct about the position of precedents and their use by the honourable courts of law.

However, before a precedent can be considered it must first be on all fours with the matter, it is sought to be applied to which in this case doesn't apply, the reason being as follows.

Retd. Hon. Justice Ayo Salami was first and foremost suspended by the NJC the body whose decision was then acknowledged by then president Goodluck Ebele Jonathan based on their recommendation as at that time.

This has not been followed in this case as President Muhammadu Buhari has acted unilaterally without resort to the NJC nor the senate majority and as such he has acted contrary to constitutional powers and made a clear abuse of the principle of separation of powers.

This is not a matter or religious or ethnic sentiment, it is an issue that bothers on whether the law was followed intoto in arriving at a concise decision.

Let me school you a bit.

In law there are legal precedence to much of what the judiciary accepts ad legal positions on issues or arguments.

Goodluck Ebele Jonathan gave a legal precedence when he suspended Justice Salami and was backed by the AGF and this was recognized and nobody grumbled even in the slightest.

This same precedence has been borrowed by Buhari in a case involving the CJN who by the honorable profession should have stepped aside pending the outcome of his CCT case but he rather chose the path of Judicial rascality by suspending the meeting of the NJC till further notice and then wanting to go ahead and swear in the electoral tribunal members.

That is Judicial rascality in all ramification and since the law is silent about the suspension of the CJN, the executive reserves the right to suspend him by law via an executive order which is what buhari has done.

Let that sink in

Permit me to school you a bit my dear friend. There is what is known as rules of interpretation. E.g the literal, golden and mischief rule.

The mischief rule acts primarily as a safeguard against flagrant abuse of powers or in cases where there's no provision of a rule against an act.

Now the constitution on its own doesn't in anyway provide for the suspension of the CJN by the president but the the law expressly grants that power to suspend strictly to the NJC.

Bringing it to home, it can be deduced that even if the president intended to act in any capacity against the CJN which in this case is suspension, although not provided for by the constitution, an understanding of the mischief rule (the reason for the creation of the statute) should tell him and his officials that he cannot act alone without a resort to either of the prescribed offices of the national assembly or the NJC.

The law was specific when it declared what buhari needed to do in terms of REMOVING the CJN.

However that law said nothing about SUSPENSION.

A suspension is not a removal. Under law those are two different things.

He is still the CJN but on suspension. While an Interim CJN would take his place pending the outcome of his case at CCT.

Buhari has not only flouted the position of the law, he has also in doing this explicitly told Nigerians that he doesn't need their votes to stay in power.

At this point we had better start petitioning foreign authorities to intervene in the forthcoming elections because the way I see it The JIhadist has no intention of vacating that seat come February.

From a concise reading of the constitutional provision stipulated by the OP above, it can be validly deduced that President Muhammadu Buhari has absolutely no powers whatsoever to remove nor suspend the CJN without the recommendation of the prescribed offices.

Fellow Nigerians this is the change APC has brought to us. A recourse to military rule and a show of daylight gangsterism.

It is also sad to note that the VP is an authority in constitutional law matters and kept mum over the issue.

We Nigerians should not take this, it is up to us to ensure that the Fulani control of our nation is demystified come February....

Festus Keyamo is just no match for Showumi. Keyamo is a product of quota system. Showunmi is way smarter than him and actually believes in his candidate (or appears to be). But i swear if them pay me good money to defend Buhari ( and if my conscience was dead), I would do a better job than Keyamo.

Some questions can be better handled by admitting the simple truth, telling half truths, using your imagination and humour to make light of a serious situation. In attack mode you poison the well, use red herrings, destroy the credibility of your opponent while appearing to praise him.

But the only weapon in the APC arsenal is lies. Big lies, small lies, white lies and blatant lies...foolish set of people.

Buharis sickness could be defended by this story line :

Yes Buhari made that statement and he really meant it. Nevertheless when he made that statement he was not sick but as life happens to anyone, he fell sick and when he noticed some symptoms like any reasonable person, the first thing he did was to go to a Nigerian hospital.

After about 3 months of running various tests the cause of the illness could not be diagnosed.But the Doctors kept saying it might be related to after effects of exposure to harmful chemicals during his military service to the country in his youth. They recommended that he goes to a particular hospital in London.

Buhari vehemently refused ,citing his earlier promise to Nigerians and his desire to lead by example. When the symptoms worsened and after much pressure from family, friends , party leaders and even one or two opposition party governors he accepted in the interest of the greater good.

Their argument was that he had the vision , charisma and will power to fight corruption so as to lay a solid foundation for the return to greatness of the country. They said the country cannot afford to loose him or else the vandals and yam eaters will take over. Moreover only a living person can lead Nigeria to greatness.

So in the interest of the country and patriotism, Buhari agreed to go for test and treatment in three phases.

1. Diagnose and contain the spread of the illness.
2. Treat an destroy it completely.
3. Recuperate and rejuvenate to youthful vigor

And even the blind can see that the treatment has worked to the extent that people are saying " this cannot be Buhari but Jibrin " because to the glory of God he is now looking fresher, healthier and even moves like a 50 year old man.

Therefore after experiencing first hand what a good healthcare system is, Buhari strongly believes that all Nigerians deserve first class health care services.

Therefore Buhari has decided to make Health Care Services a priority by:

1. Waiving and removing import duties for any Hospitals or Clinic bringing in medical equipment from abroad...just buy from manufacturer and ship thats all.

2. Full scholarship plus stipends for any young Nigerian below the age of 25 who wants to study in any medical field in the " Catch Them Young" initiative.

With this sort of defense, you have diffused a negative situation and turned it into a positive campaign weapon for APC

..but na lie , APC spokespeople and their BMC crew on social media have no strategy except to lie, blame PDP and insult people.
