Business › Courts Orders EFCC To Produce Innoson CEO, Innocent Chukwuma Over Forgery by BeeBeeOoh(op): 9:57am On Jul 05, 2018
Lagos – Justice Olusola Williams of a Lagos Special Offences Court, Ikeja, on Wednesday asked the Economic and Financial Crimes Commission (EFCC) to produce Innocent Chukwuma, the chairman of Innosson Vehicles Manufacturing (IVM) Company, for prosecution.

Williams made this pronouncement due to the absence of Chukwuma, who was to be arraigned for the forgery charge preferred against him by the EFCC.

The judge said: “I believe it is the job of the prosecution to bring the defendant to court because they are the executives.

“The judge is just to make an order that he should appear in court, but we cannot enforce the order; the responsibility still lies on the EFCC to make sure he is in court.”

Innoson’s non-appearance in court on Wednesday made it the sixth time he was absent in court after he had refused to appear before Justice Mojisola Dada of a Special Offence Court, Ikeja.

He had also been declared wanted by the court by Justice Dada on EFCC’s request.

Justice Dada was however withdrawn from the case on the recommendation of the National Judicial Council (NJC) responding to the February 12 petition of the automobile boss.

The matter was re-assigned to Justice Williams.

At the resumed hearing on Wednesday, Chukwuma was also absent in court when the matter was called.

Anselm Ozioko, counsel to the prosecution, informed the court that the defendant and his counsel were absent in court.

“My lord, it appears that the second defendant and my learned colleagues from the other side are not in court.

“He has refused to come for his arraignment for the sixth time, even when the matter was before your learned brother, Justice Dada, despite all efforts to bring him here.

“He has also filed seven different applications in-between the period he was supposed to be arraigned,” he said.

Ozioko said the application he submitted before the court earlier included: an application challenging the jurisdiction of court and an application to disqualify himself from the charge before the court.

Other applications include an order of stay of execution on bench warrant issued by the court and a stay of execution of warrant of arrest among others.

The prosecution also informed the court that the Innoson boss had refused to honour the court order by his continuous absence in court after he was granted an administrative bail by the EFCC. “My lord, in view of the absence of the defendant, we shall be asking for an adjournment date.”

Justice Williams, however, told the EFCC counsel to do all he could do to bring the defendant to court.

She further said that one of the court’s registrars informed her that someone came to file a motion on behalf of the defendant and the registrar made an attempt to serve him the hearing notice but the person refused to collect it.

“It is the prosecution’s duty to make sure the defendant is in court to answer his case. I can’t be issuing an order to a defendant that seems not to be existing.

“I will give you a date and anytime you are able to arrest the defendant, just inform the court registrars and bring him to court for arraignment.”

The judge thereafter adjourned the matter till October 10, 2018.

Chukwuma and his company, IVM, were to be arraigned on a four-count charge of conspiracy to obtain property by false pretence, obtaining property by false pretence, stealing and forgery in a transaction with Guaranty Trust Bank (GTB).

According to the charge sheet, the defendants committed the offences between 2009 and July 2011 in Lagos.

The EFCC alleged that the defendants, with intent to defraud, conspired to obtain by false pretence containers of motorcycle spare parts and raw materials, property of GTB, from Mitsui OSK Lines Ltd, Apapa, Lagos.

They are alleged to have fraudulently induced staff of Mitsui OSK and Maersk Line to deliver to them via their clearing agents the goods which were imported from China in the name of GTB by falsely pretending that they were authorised by the bank to clear the goods.

The prosecution claimed that the defendants, in order to facilitate the fraud, forged a bill of lading numbered 598286020 of Maersk Line Limited and 11007950841 of Mutsui O.S.K Lines by knowingly putting a false GTB stamp and signature of the bank staff.

The alleged forgery was in order that the forged documents be used or acted upon as genuine to the prejudice of any person within Lagos or elsewhere.

The alleged offences contravened Sections 1(1)(b), 1(3), and 8(a) of the Advanced Fee Fraud and Other Related Offences Act 2016 and Sections 309(9), 388, 465 and 467(1)(j) of the Criminal Code, Laws of Lagos State 2003.

Politics › Ancestral Attachment: Southern, Middle Belt Leaders Chide Femi Adesina.. by BeeBeeOoh(op): 5:41am On Jul 05, 2018
The Southern and Middle Belt Leaders Forum has vehemently protested the assertion by the Special Adviser to President Muhammadu Buhari on Media and Publicity, Mr. Femi Adesina, that it would be better for those that were opposed to cattle ranching to provide lands than to die in the herdsmen’s attacks.

Adesina, while speaking on an African Independent Television (AIT) programme on Tuesday, had told the anti-ranching protesters that they would on lay claim to ancestral attachment when they were still alive.

Reacting to Adesina’s comments in a statement signed by Mr. Yinka Odumakin (South-west), Senator Bassey Henshaw (South-south), Prof Chigoziw Ogbu (South-east) and Isuwa Dogo (Middle Belt), the forum described Adeshina’s position as “scandalous, reckless, insensitive and vexatious.”

“The attention of Southern and Middle Belt Leaders Forum has been drawn to the scandalous, reckless, insensitive and vexatious statement credited to Mr. Femi Adesina, Special Adviser, Media to the President that all communities opposed to Federal Cattle Territories (FCT) misnamed ranches should choose between their lands and their lives.

“Ancestral attachment? You can only have ancestral attachment when you are alive. If you are taking about ancestral attachment, if you are dead how does the attachment matter?” said Adesina.

“We take this ludicrous declaration as a death sentence on all those who oppose the imperialist agenda of the federal government to grab lands from communities in Nigeria and hand over to herdsmen for their private business.

“Adesina is close to the heart of presidency to know why it has treated killer Fulani herdsmen with kid gloves in the last three years and the arrogance with which he spoke showed they now assume their foot soilders have terrorised us into submission .

“This death threat is coming after the president told the governor of Benue State in January to learn how to live with murderers, the Inspector General of Police saying the killers are Nigerians, the Defence Minister claiming that blockage of cattle routes is the reason the herdsmen are killing and the same Adesina telling us the killings done under Buhari in three years have not equalled the number of deaths that occurred under PDP,” the leaders stated.

According to the forum, Adeshina’s statement is a confirmation of their earlier charge that the role of the president and the duty the president owes to the terror herdsmen are in conflict, adding that there is greater allegiance to the cows than the country.
“If Adesina keeps his job in the next 24 hours, all doubt would be removed over the statement Gen. Theophilus Danjuma (rtd) made that there is a working relationship between the killers and the security forces,” they said.

Politics › Reformed APC: "Be Patient" - Oshiomhole Begs Aggrieved Party Members.. by BeeBeeOoh(op): 11:02pm On Jul 04, 2018
Adams Oshiomhole, national chairman of the All Progressives (APC), has appealed to aggrieved members of the party to be patient with his leadership.

He said this shortly after news broke that a faction had pulled out of the ruling party.

The new faction, Reformed APC(R-APC), has many national assembly members and is led by Buba Galadima, a former ally of President Muhammadu Buhari.

Oshiomhole spoke after receiving the report of the party’s national convention appeal panel committee report.

“My appeal to all those who are aggrieved is to be patient,” Oshiomhole said.

“The assurance is that under my leadership, we will make honest mistakes and once our attention is drawn, we will find courage to make up for our mistake.

“Some people say how can people eat their words, for me, I will eat my words if it is nutritious enough and if that is what I have to do to have peace in the family.”

He expressed appreciation to members of the party for his election and for entrusting with him, the responsibility to pilot the party’s affairs at this time.

He acknowledged that he knew of the party’s challenges before accepting the task, saying it is a huge opportunity for him and other newly elected executives of the party to make a difference.

This, Oshiomhole said, was not only for the party, but for the country generally.

“So, I appeal to people to realise that a blind man can redeem his eyes if he applies the correct medication, but you can’t force it to open over night,” he said.

He added that forcing the eyes to open over night, would create more problems and damage the eye the more.

The APC national chairman maintained that he would do everything possible to sustain confidence and trust, adding that everybody was important in the party.

He also said that everybody in the party matters, adding that he would run an inclusive party.

“I pray for wisdom and courage and I believe that we have it and we will deploy it for peace within the APC family,” Oshiomhole said.

Politics › Abacha Loot: Reps To Probe Recovery From 1998 To Date.. by BeeBeeOoh(op): 4:37pm On Jul 04, 2018
The House of Representatives has resolved to set up an ad-hoc committee to investigate the total amount recovered from the Abacha loot from 1998 to date.

This is one of the four resolutions made by members of the lower chamber after a long deliberation.

The resolutions were sequel to a motion of urgent national importance sponsored by Karimi Sunday.

Mr Sunday had explained that the Abacha family in 2014 entered an agreement with the federal government, forfeiting public funds in several billions of dollars to the federal government, following a plea bargaining to drop charges against the late military ruler’s son.

He said the funds have been released to the Federation in several tranches by Switzerland Government but without much disclosure to the public by government.

Recently, the Attorney General of the Federation, Abubakar Malami, signed an agreement on behalf of the federal government on the release of the last tranche of $322million to Nigeria.

The Special Adviser to the President on‘ Justice Reforms, Juliet lbekaku-Nwagwu, was reported to have said that in line with the Memorandum of Understanding signed by the Switzerland Government and the Nigerian Government, the $322 million will be paid directly to the accounts of the poorest Nigerians without recourse to the National Assembly.

Mr Sunday, however, said by virtue of Section 12 (1) of the Constitution of the Federal Republic of Nigeria 1999 (as amended), no treaty between the Federal Government of Nigeria and any other country shall have the force of law except to the extent to which such treaty has been enacted by the.National Assembly.

“Consequently, no agreement or Memorandum of Understanding purportedly signed by the Federal Government with the Switzerland Government can have any force of law in Nigeria, except approved and enacted by the National Assembly,” he said.

He further said by virtue of Section 80 (1-3) and 81 of the Constitution of the Federal Republic of Nigeria (as amended) a revenue raised and received by the federal government shall be paid to the Consolidated Revenue Fund.

“Section 80(3) stipulates that no such monies raised shall be withdrawn from the Consolidated Revenue Fund unless the issue of such funds has been authorised by the National Assembly. As a result, no monies can be paid or expended without National Assembly approval,” he said.

He called on the federal government to come up with a Supplementary Appropriation Bill, earmarking the funds due to it from the Abacha loot for the completion of the Ajaokuta Steel Complex/Project.

Mr Karimi frowned at the decision of the federal government to distribute the money among poor families in the country, describing it as a breach of the constitution.

“How many poor families have been identified? Let’s follow the laws of the land. This is impunity and has to be stopped,” he said.

In his contribution, Hassan Saleh supported the motion as he urged the federal government to invest the recovered loot into the Ajaokuta Steel Company.

He described the government’s decision as corruption in disguise and said the money cannot be properly distributed among poor families. He also wondered what happens if the government cannot feed the poor families tomorrow.

Abdumumin Jibrin, on his part, said although he understands the federal government has the nation’s best interest at heart, “there is nothing wrong with consulting the National Assembly” as regards what should be done with the money.

He called for thorough investigation into the recovered funds and urged his colleagues not to politicise the issue.

While stating that money recovered be invested in the Ajaokuta Company, he also urged the House to “deal with the motion in isolation.”

The House thereafter resolved to establish sources of the money recovered and if at all, charges paid to lawyers and consultants.

It also resolved to find out if procedures were followed and identify if agreements entered aligns with Nigeria’s constitution.

Politics › Kwankwaso, Others Pull Out Of APC; To Sign MoU With PDP - This Day by BeeBeeOoh(op): 5:43am On Jul 04, 2018
• Say Baraje, Saraki-led nPDP tied down with endless talks with APC

• To sign MoU with PDP

Iyobosa Uwugiaren in Abuja

Apparently unable to deal with the Alhaji Kawu Baraje-led new Peoples Democratic Party’s (nPDP) slow pace of talks with the Peoples Democratic Party (PDP) and other smaller political parties in forming a coalition against the All Progressives Congress (APC), another group known as ‘Reformed APC’ has emerged from the aggrieved group within the ruling APC.

Led by former Governor of Kano State, Senator Rabiu Musa Kwankwaso and other top members of the APC, especially at the National Assembly, the new group were formally announce its departure from the ruling party by Friday.

A member of the group told THISDAY in Abuja yesterday, “It appears Baraje and Senate President Bukola Saraki and their group are tied down by their endless discussion with APC.’’

According to the source, one of the leaders of Kwakwansiyya, a political group of Kwankwaso, “I don’t think many of us are comfortable with the slow pace of their political activities. So we have decided to move on. We have less than seven months to the general election and we cannot engage in an endless talk with APC.

“The new group, the Reformed APC being led by Kwankwaso and others, has decided to set up an interim committee with representatives from other parties like the Social Democratic Party (SDP) and other smaller parties to sign Memorandum of Understanding (MoU) with PDP.’’

He disclosed that the emerging political group has completed the constitution of its interim committee and would be announced before Friday and early next week.

Asked whether the Baraje-led group has backed out of the conversation to form a coalition against APC or not, the close political associate of the former Kano State governor said, “I do not think so; we just noticed that they are too slow. And we do not have time on our side. They might still come to negotiation table with us and PDP, under the platform of nPDP.

“At the end of the day, we will all end up in PDP, with a strong understanding on how we should relate to defeat APC in the 2019 general election. But on our part, we have gone far with PDP, and the outcome of our discussion will be made known in the next few days.’’

THISDAY reported yesterday that members of the Baraje-led nPDP, an aggrieved group within the ruling APC, held a late night meeting on Monday to determine the way forward.

Among those said to have met included, Saraki; Governor of Sokoto State, Alhaji Aminu Tambuwal, and about 50 lawmakers from both chambers of the National Assembly.

Members of the group appeared to be divided over which party to move to. While majority of them agreed they should move straight to the PDP, others were said to have suggested that they should first and foremost form a coalition with SDP and others before they negotiate with PDP.

THISDAY gathered that the outcome of the conversation by the group was to be made known before Friday, with about 20 APC senators and many members of House of Representatives defecting.

Kwankwaso was in Ado-Ekiti, the Ekiti State capital last week, to inform Governor Ayo Fayose about his resolve to return to PDP.

He also met with former Vice-President Atiku Abubakar on the same issue.

Members of the former nPDP bloc within the APC had addressed a letter dated April 27, 2018 to the then Chairman of the APC, Chief John Odigie-Oyegun, where they informed the party of their grievances and expectations from both the party and President Muhammadu Buhari.

Following the development, the party invited them and they met with the leadership of the party.

But following the escalation of hostility by the federal government against leading members of the bloc, including Saraki, Governor Abdulfatah Ahmed, Senator Jonah Jang and Senator Peter Nwaboshi, who were confronted with criminal allegations by state security agencies, the nPDP pulled out of the peace initiatives.

Last week, Baraje said in a statement that the bloc would make its decision on its future with the APC known this week.

Politics › National Cash Transfer Programme: FG Distributes N10bn To 300,000 Poor Nigerians by BeeBeeOoh(op): 11:11pm On Jul 03, 2018
The federal government has since 2016 disbursed N10 billion to no fewer than 300,000 beneficiaries through its Conditional Cash Transfer (CCT) programme.

Temitope Sinkaye, the National Programme Coordinator of the CCT, disclosed this to the News Agency of Nigeria (NAN) on the sidelines of the National Cash Transfer Programme Mid-year Review in Ilorin on Tuesday.

She said that the programme started in 2016 with eight pilot states that met the condition set by the federal government.

The condition, Ms Sinkaye explained, was just for states to provide offices, personnel and equipment for the take off of the programme.

“All states are eligible to participate in the programme but upon fulfilling some conditions.

“So currently, we have only 20 states that have fulfilled the conditions.

“As at 2016 when we started the programme, only eight states met the condition and as at today, we have 20 states and we are still counting.

“The condition is that states will provide the programme with office, staff and equipment while the federal government takes it up from there.

“Once the state is done with that, the federal government takes up from there and train the personnel on what the programme is all about,’’ she said.

On the modality for selection of beneficiaries, the national coordinator said that they were selected through a process known as “community based targeting.’’

“There is a different government agency that is charged with the responsibility of identifying the beneficiaries and the agency is known as the National Social Safety Net Coordinating Office at the national office,” Ms Sinkaye said.

She noted that the community based targeting team of the office at the local government level move from one community to another in order to identify the poorest set of Nigerians through the help of members of those communities.

Ms Sinkaye, who said that every political ward in all states would have the same number of beneficiaries, however, said that those that were yet to key in could not lay claim to the benefit of previous years.

“The beneficiaries will be on it for three years; then we will assess their condition as to whether they are qualified to graduate out of poverty,” she said.
