A Federal High Court in Lagos on Tuesday, fixed Oct. 16 for further mention in a suit seeking the winding up of the sponsors of the Big Brother Naija Show, Payporte Global System Ltd. The petition was filed by Vacant Board Ltd. Justice Ayokunle Faji fixed the date for further mention of the suit, which was earlier fixed for mention on Tuesday. Mr Ogedi Ogu appeared for the respondent, while Mr Yemi Fajuyitan is counsel for the petitioner. The case will now continue on the next date. The petitioner had filed a debt recovery suit against Payporte, before a Lagos High Court in 2015. The Court had in its judgment delivered on May 27, 2016, awarded the sum of N23.1 million against Payporte, in favour of the petitioner. The petitioner, however, contends that on Feb. 27, 2017, the respondent made a part payment of N5 million, leaving a balance of N17.1 million which it has failed to liquidate till date, inspite of several demand letters. It therefore, filed a winding up petition before the Federal High Court on Dec. 29, 2017, asking it to wind up the comoany. Meanwhile, In its notice of preliminary objection on April 25, the respondent is challenging the jurisdiction of the court to entertain or even hear the petition Respondent counsel, Mr Ogedi Ogu contends that the said petition for winding up, failed to comply with the provisions of sections 5 and 6 of the Companies Winding-Up Rules, 2001. He argues that no summons was filed by the petitioner, issued or sealed in respect of the said petition, adding that the failure rendered the petition null and void. Cross River State Governor, Senator Ben Ayade, has accused the Niger Delta Development Commission (NDDC) for neglecting the state and called for a review of the commission’s master plan if the oil-rich region is to witness real growth. Ayade stated this in Calabar when the management of the commission led by its acting Managing Director, Professor Nelson Brambaifa, paid him a courtesy call, recently. According to the governor, very little has been achieved by way of development under the current master plan, explaining that the current master plan even as inadequate as it is, has not been “implemented in truth, kind, action and in words.” He, therefore, called for a major review of the master plan to reflect the realities and the needs of the states. The governor also urged the commission to deviate from the culture whereby governors in the region are not carried along when contracts are being awarded by the commission. “As governor, I have the superintending and overriding power over the land in Cross River, which I hold in trust for the people. Therefore, by the provisions of the law, I have the powers to stop any project in this state. It is part of the constitutional provisions under the NDDC Act that the NDDC will have regular meetings with the various stakeholders including the governors that form part of the governing board. “As I speak, I’m not aware of, nor have I received any official letter inviting me and my colleagues for a meeting. We are not interested in deciding who gets the job but we would ask our works department to be part of supervision to ensure that quality is adhered to at all times. “I say this so that you don’t make the mistakes of the past” and decried the treatment of Cross River State by the Commission, saying the story of the state “has been that of melancholy. We have been reduced to want in body, soul and spirit. “In sociology, any child who has very little and the other one has more, a mother is allowed to take from the one that has more and give to the one that has little. “In NDDC, it is the states that have more money that are allocated bigger projects. It is not African. It is inhumane and inconsistent with the core principles of Kantianism that I know. In all honesty, we have structured a society for aggressive rebellion.” He, therefore, pleaded that the state be treated fairly, especially “when one considers the fact that we have a land mass of over 21,000 square kilometres, larger than the entire Niger Delta. Connecting two local governments is larger than any state in the Niger Delta with international boundaries to over four countries with its attendant challenges. We have been excluded by the NDDC from its original philosophy of making a prosperity agenda for the region. “It is so sad that at the height of kidnapping and all the criminality in the Niger Delta, Operation Delta Safe was mobilized to all the states except Cross River. So, all the militants now found Cross River a safe haven. “This once peaceful, beautiful state suddenly became safe haven for militants and kidnappers to inhabit and distort our complete sight. The basis was that there were no pipelines in Cross River. So, as a government, we now place premium on oil over blood. The Yoruba Council of Elders (YCE) has kicked against establishment of the proposed Ruga settlements in any of the Southwest states. It said none of the Yorubaland will be available for such project. YCE described the move by the Federal Government as “dead on arrival,” according to a statement by its President, Dansaaki Ade Agbede in Ibadan on Monday. Agbede wondered how a group of people seen as threats to peace and security of others would own settlements in places outside their domains. According to him: “To now think that the Federal Government that should be concerned and worried about the untoward activities of such people is the sponsor of Ruga is worrisome. “Such a project is not at all in the best interest of this country as well as PMB’s presidency and the earlier the Federal Government listens to the voice of the people by disembarking on the project, the better. “Virtually all the states outside of the domains of the Fulani herdsmen are against the project and Yoruba speaking states are no exception.” Insisting on rejection of the project in the entire Yorubaland, the YCE also known as ‘Egbe Igbimo Agba Yoruba’ maintained that the recent experience of the people in the hands of herdsmen “leaves much to be desired with our spirit of openness and accommodation being eroded. We can’t fold our arms and allow our land to be overrun by strangers.” He charged Governors of the six states of Lagos, Oyo, Ogun, Ondo, Ekiti and Osun to be on guard and let the Federal Government know the stance of their people on the matter. He said: “This is not about politics or political party affiliation. The Abundant Nigeria Renewal Party (ANRP), on Friday, countered the claim by the Chairman of the Independent National Election Commission (INEC), Prof. Mahmood Yakubu, that INEC is the “most improved public service institution in Nigeria”. Mr Sesugh Akume, ANRP’s national spokesman, told the News Agency of Nigeria (NAN) in Lagos that INEC’s performance in the 2019 elections did not show that there were improvements on what happened in 2015. Yakubu had on Wednesday, stated during the review of the conduct of the 2019 general elections with the second batch of Electoral Officers from southern states of the country that INEC had significantly improved from where it used to be in 1999. It would be recalled that the People’s Democratic Party (PDP) had on Thursday lambasted Yakubu over the boast. Akume, however, said: “It is not true that INEC is an improved public service institution, except perhaps in a negative sense. “In 2019, INEC got worse than 2015. It was expected that 2019 would be an improvement on the 2015 elections, but that is not the case. “For instance, INEC performed poorly from mobilising the electorate to come out and vote, many registered voters were disenfranchised as they did not get their cards, all the way to failing to announce results clearly,” he said. Akume, who contested for House of Representatives, Sankera Federal Constituency in Benue State, said that a Freedom of Information request he made to INEC since November 2018 was yet to be answered. He stated that there were many flaws during the 2019 elections. “We experienced a situation whereby it took three days for election results to move from one part of town in Sankera constituency to the other where the INEC office is,” Akume said. He also claimed that local Electoral Officers in his constituency were ignorant on basic election processes, which had implications on the exercise. Akume advised INEC to stop boasting about its performance and face the reality of negative feedback of the “very poorly conducted elections” which he said, had resulted in the number of election petitions and upturned results. “What INEC needs to do is to get off its high horse and reflect soberly on making things right,” he said. Senator Rochas Okorocha has given the Imo State government seven days to substantiate allegations that his wife and family members made away with 67 vehicles belonging to the state. Okorocha challenged the government to publish the particulars and list of the vehicles, as well as the N50 billion allegedly diverted by his family when he was governor. The Imo State Committee on Recovery of Government Property, headed by Jasper Ndubuaku, on Wednesday accused the former governor and his wife of making away with 67 vehicles belonging to the government. A statement by Okorocha’s media aide, Sam Onwuemeodo, said: “The media quoted the Chairman of the Committee on Recovery of Government Properties, Jasper Ndubuaku, as claiming that former Governor Rochas Okorocha and wife Nkechi left with 67 vehicles and N50 billion. They also made similar claims against appointees of the former governor and other related bodies that worked with the last administration. “We challenge Governor Emeka Ihedioha and his appointees to publish the list and particulars of these 67 vehicles, as well as details of the N50 billion the former governor and wife made away with vis-à-vis other items thereto. And we give them seven days to do the publication or bend their heads in shame. “We also challenge them to publish the properties the former appointees must have left with, either as a group or as individuals. The burden to publish evidence of all these claims is now on Governor Ihedioha and his appointees. “We equally ask that they harmonize their claims because almost all the key appointees of the government have made their diverse claims on these issues, to the extent that nobody knows who among them should be believed. House Speaker Femi Gbajabiamila, has set up a nine-member committee to review the contentious House Rules of the 8th House. The House Rules Review Committee, which is headed by Hon. Prof. Julius Ihonvbere and is a mix of old and new members, has been given three weeks to wrap up its assignment. The term of reference for the committee is a wholesome review of the House Rules, with emphasis on contentious aspects which had set members against one another other in the past. The committee is to align the House Rules to conform to global legislative best practices. Recall that the 8th House had been embroiled in contention over some aspects of the House Rules, which empowered the then Speaker, Yakubu Dogara to suspend indefinitely any member whom he “thinks” is walking towards the Mace with malevolent intent. Hon. Aliyu Madaki (APC Kano) with 10 others had headed for the court, urging it to declare the House Rules null and void and of no effect. According to them, the new House rules were draconian. The existence of the committee was said to have been shrouded to allow its members work without pressure and other impediments. Gov. Yahaya Bello of Kogi State has promised to improve upon his present performance if given another term to serve the state as governor. Governor Yahaya Bello of Kogi State Governor, says his administration has made the state safer even though he inherited a chaotic security apparatus. The governor said that both citizens, residents, travelers, investors, and tourists in the State have continued to enjoy peace under his administration. The governor says his claims are hinged on verifiable national data coming out of credible institutions. The governor said this at the University of Abuja on Wednesday, during a Two-day colloquium organised by The Sultan Maccido Institute for Peace, Leadership and Developments Studies (SMIPLDS) where he featured as a keynote speaker on issues bothering curbing insurgency and insecurity in the country. Bello who was represented by Navy Commander Jerry Omodara, his State Security Adviser said Kogi state before he came on board had suffered insecurity, due to sheer laxity, corruption, and non-commitment of resources over the years. He said nothing was put on the ground to secure infrastructure and manpower in the State as the security agencies found themselves trailing the highly mobile and logistically superior criminal franchise. Bell noted that killing, bank robberies, jailbreak by Boko Haram insurgents, attack of offices of security agencies, kidnapping and other forms of criminality categorized the previous government and there was no political will and opacity in the use of security votes. The Governor also added that Kogi under the previous administration suffered the most terrifying periods of extended and unrelenting insecurity the state has ever witnessed since inception. Since he came to power, Bello said the state which was initially bedeviled with all these criminal vices, in April 2018, ranked as the 2nd most peaceful state in the country after Osun and the most peaceful in the North of Nigeria by the Nigerian Peace Index. The State was also ranked as the State with the second lowest crime statistics in the country after Kebbi by the National Bureau of Statistics, he noted Bello, who made the promise on Thursday in Lokoja during a stakeholders meeting of the All Progressives Congress ( APC), also appealed to the people of the state not to lose hope in his administration. According to him, the recent reconciliation of the two factions of the party in the state is also a pointer to a better tomorrow for the state. Bello said his outstanding achievement was in the area of security where he said he was able to banish armed robbery, kidnapping and thuggery from the state. “I confronted these ugly incidents headlong, and today the story has changed. ” We were able to institute infrastructure and integration of people into the administration that has been operating without sentiment. He called on party members to remain committed and dedicated to its ideals, saying that this was the only way for it to emerge victorious in the coming governorship election. Two serving governors and a former governor attended the meeting where party members reiterated their preference for indirect primary to pick a candidate for the Nov. 16 governorship polls. The two serving governors in attendance were Alhaji Bagudu Atiku of Kebbi state and Alhaji Mala Bunni of Yobe State. The immediate past governor of Bauchi State, Alhaji Mohammed Abubakar, was also present. Speaking in behalf of the visitors, Bagudu, who is also the Chairman of APC governors forum, commended members for their efforts which made President Muhammadu Buhari to win the presidential election in the state by a wide margin. The National Youth Council of Nigeria (NYCN) has called on President Muhammadu Buhari to ignore the misguided advice on the next Chairmanship of the Niger Delta Development Commission (NDDC) and do what is right. A statement issued in Abuja by the National Secretary of the NYCN Blessing Akinlosotu, said that the President could not be misled by those wrongly advising him to go against the NDDC Act. Reacting to a publication in the media on June 22 tagged ‘Yoruba elders make u-turn, advise Buhari on next NDDC Chairman, the group stated that it was wrong for the Elders’ Forum to want the NDDC Act jettisoned. The NYCN appealed to President Buhari to take a critical look at the matter, stressing that Ondo state was next in line for the Chairmanship of the NDDC. “According to Section 4 of the NDDC Act, the office of the Chairman shall rotate amongst the member states of the Commission in the following alphabetical order: Abia, Akwa Ibom, Bayelsa, Cross River, Delta, Edo, Imo, Ondo and Rivers and shall continue in that order throughout the life of the Commission. “Consequently, since the establishment of the NDDC, the Chairman of the Governing Board has been appointed in accordance with the principle of rotation as outlined in the NDDC Act. “That of the Managing Director was captured in Section 12 (1) of the NDDC Act which states inter alia, “There shall be for the Commission, a Managing Director, and two Executive Directors who shall be indigenes of oil producing areas starting with the member state of the Commission with the highest production quantum of oil and shall rotate amongst member states in order of production”. “This clear and unambiguous provision of the NDDC Act means that every member state shall produce the MD of the Commission in a rotational manner following a sequential order that uses the quantum of oil production starting with the state with the highest production at the time of the establishment of the commission. FIFA on Wednesday defended its Video Assistant Referee (VAR) review system, saying referees had reached a 98 Percent accuracy rate in decision-making during the group stage of the ongoing women’s World Cup in France. FIFA said it has no plan to end the use of VAR but was only implementing the laws of the game. VAR system has made a controversy-filled debut in the women’s game at World Cup level, baffling players and coaches, and frustrating fans. Scotland and Nigeria exited the tournament after their opponents were awarded penalty retakes when VAR ruled their goalkeepers had stepped centimeters off their line. When France knocked out Brazil in the last 16, three goals were disallowed following reviews. Cameroon’s players were so indignant at the VAR interventions during their match against England that they appeared to stop playing on several occasions. A competitive Japan side went out in the last 16 after a controversial penalty decision. “VAR cannot be blind, cannot ignore,” said Pierluigi Collina, Chairman of FIFA’s Referees Committee. “If you have a tool that offers you the possibility to check, you have to check.” Although it has no power of adjudication, VAR’s viewing ability enables minor infractions — sometimes imperceptible to the human eye, Collina admitted — to impact a game. FIFA says that without VAR the group-stage accuracy rate would be a less impressive 92.51 percent and officials have expressed surprise at the anger directed at the system. “We can never be perfect. No one player, no one coach is perfect,” Massimo Busacca, Head of FIFA’s Refereeing Department, said on Wednesday. “We are not perfect. The Peoples Democratic Party (PDP) has accused the Independent National Electoral Commission (INEC) of allegedly sponsoring an “amorphous group” to support the denial by the Commission of the existence of a server. Recall that a group, under the aegis of Forum of Presidential Candidates of the 2019 Elections and National Party Chairmen on Tuesday, faulted the claim by PDP and its presidential candidate, Atiku Abubakar, that electronic server was used during the 2019 presidential election. The group backed the denial by INEC of the existence of the server. This was in response to the decision by the presidential election petition tribunal on Monday rejecting the request by the candidate of the PDP in the February 23 presidential election, Atiku Abubakar and the PDP, to allow them access to the INEC server. But a statement released on Tuesday by the spokesman for the PDP, Kola Ologbondiyan, said its investigation revealed that the group of political parties was “conjured” by the leadership of INEC and the All Progressives Congress (APC). According to him, the main objective of the group was to assist INEC in distorting facts and making misrepresentations on a matter that is already subjudice. The statement read, “The PDP invites Nigerians to note that the press release by this nebulous group emerged after INEC’s several blunders while the Presidency has already admitted that the claim by the PDP and millions of Nigerians that INEC had a server wherein it stored results of the 2019 elections, constitutes the fulcrum of contention in the Presidential election. “Nigerians are already aware of the existence of the server, which was duly budgeted for, set up in various INEC offices and in which data from the elections, including results, were stored. “Moreover, the ruling of the Court of Appeal preventing the PDP from inspecting the server does not in any way obviate the existence of the said server. “Furthermore, PDP counsels that instead of engaging in this unnecessary media trial, INEC should have listed its nebulous group as a witness in the election tribunal. “We also challenge INEC to confront the indictment contained in the reports of the European Union and other international agencies which showed evidence that the 2019 general elections were marred by irregularities and violation of rules by the Commission. The President of the Senate, Dr. Ahmad Lawan, says the National Assembly is planning a separate budget for adequate funding of the 36 commands of Nigeria Police. Lawan said the move was to enable officers and men of the police force perform optimally and tackle insecurity in the country. He disclosed this on Tuesday when the Inspector General of Police, Muhammad Adamu, led the police management team to pay him courtesy visit in his office. Lawan assured the IGP on the early passage of the Police Reform Bill, Police Academy Bill and smooth implementation of the Police Trust Fund. He added that “the police need to be restructured, including the separate appropriations being canvassed for the state police commands by the Inspector General of Police. “I can assure you that the Senate Committee on Police Affairs, when constituted, will work with your management on the separate funding for the state police commands. “This is necessary, because we want you to spend your resources prudently and economically. The National leader of the All Progressives Congress (APC), Sen. Bola Tinubu on Tuesday met with President Muhammadu Buhari at the Aso Villa. Tinubu accompanied part of the Afenifere delegation to the Villa. Those who attended the meeting were Asiwaju Bola Ahmed Tinubu, Chief Segun Osoba, Sen. Abiola Ajimobi, Sen. Adedayo Adeyeye, Chief Kemi Nelson, Laoye Tomori, Solomon Akindele, Elder Yemi Alade, Mutiu Are, among others. Speaking after the meeting, Tinubu said the Yoruba will continue to support Buhari because of his track record. He further urged Nigerians to stay together in peace and avoid conflicts. “Nigerians should be united and avoid conflicts in order to ensure speedy development and progress of the country. “The Yorubas will continue to rally behind Buhari because of his track record and good will for Nigeria,” Tinubu said.
