If they are truly bad, I am sure your government would have shut the door against them, so you saying they are criminals in your country is nothing but a lie and a sentimental statement.
And in my write up i spoke about knowing how to prevent themselves against the infection so comin there should not be a problem for them. But you could not understand that right? No wonder you were not practicing what you read because i doubt you finished from the law school you claimed you went.

1. You keep turning a blind eye on the statement that states that there's no specific law that criminalise spreading of HIV in SA... Underline the the term no specific law.

2. There are still arguments as to whether to illegalize it or not, hence the statement stated that the whole thing is still counterproductive, meaning there's NO SPECIFIC LAW that criminalise spreading of HIV, at least not yet.

3. You need to understand what is common law... Common law is a body of unwritten laws, meaning even if the laws are not written or recognized by the constitution, if as a citizen you feel like an injustice was done to you in anyway, you're free to approach the courts under common law because one thing about law is that there's no wrong or right... As long as you're willing to backup your claims, then the courts will give you a chance.

4. That screenshot that you posted about the Phiri case was also decided under common law, the court made a decision based on a general belief and not because there's a written law that specified spreading HIV to be illegal... The Court also considered the nature of Phiri's work, he was an HIV/AIDS counselor and his duty was to advice others on how to protect themselves from HIV and also advice those who are already HIV positive on how to take good care of themselves as to prevent infecting others... But he breached everything that went with his job and on top of that, he kept contradicting himself under oath.

5. General criminal laws were used to support his girlfriend's claims in a sense that, she was able to prove beyond reasonable doubt that Phiri had a duty to protect her since he was an HIV/AIDS counselor... It's just like a police officer, he has a duty to protect me and not harm me.

6. The Phiri case is the only HIV related case in SA that convicted a person for transmitting HIV and there was not even any proof that Phiri indeed infected his girlfriend with HIV, but she was somehow able to backup her claims and also used the fact that Phiri worked within the department of health.

I also think he got what he deserved, if he really did do it because it would mean he was reckless, despite being an HIV/AIDS counselor.

7. As long as you're able to put your facts right, then you can use common law for anything... Let me give you an example of common law offences:
- Let's say a guy was used a dumped by a girl that he loved so much to a point that he vowed to never ever love again, instead he's gonna impregnate and dump every girl he gets into a relationship with, one of his baby mamas can take him to court for it.

There's no specific law that states that it's illegal going around impregnating ladies with an intent of making them single mothers, but if the baby mama can backup her claims, she can take the guy to court and win.

- I can use common law on you for taking my pillow from my room and using it in your room to sleep without my knowledge... I can take you to court and argue that what you did was theft even though we live in the same house.

Because most common laws are not recognized by the Constitution and the court makes a decision based on a common belief.

6. I like the fact that you were able to post a link that supported your claims when you said deliberate infection of HIV is illegal in Nigeria, your link consisted of statutes supporting your claims, meaning there is a specific law that criminalise intentional infection of HIV in Nigeria and it's recognized by the Nigerian constitution.... But so far, you haven't shown me any statutes from the South African constitution that support your claims about deliberate infection of HIV being illegal in SA.

I also wish there could be a specific law within our constitution that criminalise intentional infection of HIV, but so far, there are still arguments as to whether it should be illegalized or not.
May be you were skipping classes in law school. With all these articles u wrote up there u still ended up saying nothing. it is under common law or not, if anyone does it, is it puunishable or not. I guess YES. It is punishable, they might not have specifically singled it out and make a law for it separately that's what they mean by saying, there's no specific law for it yet, but is it punishable? YES and a big YES.
On another note, what you said was there is no law for it, and now again you are saying it's just grouped under common law. Whether common law or not, it is punishable and someone can be sentenced for it.

According to your 3rd statement, if a citizen feels like injustice is being done to him/her the person can go to court so far he/she has claims to back it up court will take it up. That makes is a punishable offence. Why didn't the court say " oh! there is no specific law for this case we can't settle it." but the court did and sentenced the person to prison. Which still makes it an offence. So young lady what are you trying to prove.

And iy read very well, in the picture u sent, it was grouped under common law Crime that ranges from MURDER AND ASSAULT. So why are you trying to so hard to make sound we cannot hear.

Let's assume you have home with kids and me a as a person, i am aware of something going on your home that i can prevent myself against by wearing condoms and all, but each time i come into your home, i kill things that are precious to you, i steal things that are precious to you, things of high value and already you know i am a serial killer by damaging of the womb of people in your home. Each time i come i protect myself against whatever disease going on in your home. what would you do as the home owner?

Would you allow me to keep coming to destroy and kill more people in your home by damaging their womb when you know the population of people in that home is very small compared to people living in my home and keep looking at me thinking the disease in your home would kill me also one day when knowing fully well i know how to protect myself against it?

If you can answer this, then you'll see reasons why i blame your government or maybe they love you people being killed.

A good government protect it's country from outside danger, not wait for somebody on the outside stop the outside danger. If truly Nigerians are criminals like you claim but of course i know your government does not see Nigerians the way you are seeing them, that is why your government keeps taking them in. If you have issues with that write a letter to your government so that they can shut their doors.

It was indeed a good read. Those part that I marked, is it that you didn't not understand the English there or what? If you studied law and you're showing this as a proof to defend yourself that Spreading of HIV legal, I'm telling you your lecturers have failed you o perhaps they taught you well, then I'd say maybe you were skipping classes

However in principle such behaviour falls under the scope of common law crimes that range from attempted murder to assault

Second paragraph says a report argues; argument means that, they've not settled for the decision yet and the report argues because someone on treatment even if when (+) posseses lower transmission risk than someone that's not been diagnosed and people might not want to get themselves tested. That's the summary of that.

Third, paragraph already concluded that line with it's last sentence starting from The end result is that the law tends to punish people for merely having sex if there's a risk of transmission
