JAMES IBORI,INDIVIDUAL PUNISHMENT OR COLLECTIVE JUSTICE? James Ibori,The former Governor of Delta State is being prosecuted and we are all celebrating the punishment of the sinner as we all know he his. many people on news papers and social media write all sort of things to quantify this achievement of persecuting this thieve. But i can't but ask,should we be celebrating the punishment of one or the collective justice to all? is Ibori being punished because he stole from our people or because he offended someone? Ibori was a governor since 1999 to 2007,he wasn't the only governor,we had 36 state governors. Is Ibori the only governor that stole from Nigeria? of course not, the 36 state governors stole our money simultaneously,but only one is being punished. Did Ibori stole more money than Bukola Saraki? did he steal more than Fashola,Idris,Oyinlola,Donald duke,orji kalu, and others? Did he steal more money than Obansanjo and the ministers? You would remember the case of obj's theft and the former US vice president Chiney. Is this an individual punishment or collective justice? Ibori did not steal more money than other state thieves and federal looters. Some would say it would be one after the other, but we all know it is one who offended the master. We should not celebrate the punishment of one man but the collective justice to all. Until we learn to do this,Nigeria shall remain a tool. |

This time, it is not different. I am also aware that some youths in Nigeria sees him as a role model. However, what role of Sanusi is worth imitating, other than being a role model for distorting the truth, twisting the facts, confusing the reality, misrepresenting godliness, diverting history, pride, having a chip on his shoulders, turning his nose up, insincerity and manifesting a hidden agenda. Their is no doubt that every man has a wrong side, this I believe is why the great philosopher said: No man is perfect including myself. Since Every one is prone to error, it would be unjust to condemn someone based on some errors he committed, which is why we must differentiate between error and intentional deceit. An error is a deviation from accuracy or correctness; a mistake, as in action or speech. it could also be defined as a wrong doing of someone which he did unintentionally. If such error is realized,the person in question would be willing to apologize for it and make corrections if possible. Deceit is the act or practice of deceiving; concealment or distortion of the truth for the purpose of misleading; duplicity; fraud or cheating. An intentional deceit is a planned action which is aimed to deceive others to achieve a desired end goal. This action would be achieved by intentionally misinforming others so as to shift their attention away from the hidden motive. This write up is not talking about the errors of our dearest CBN governor, Mallam Sanusi Lamido, but the deceit. WHO IS A ROLE MODEL? Let me start by defining a role model. According to wikipedia, the term role model generally means any "person who serves as an example, whose behavior is emulated by others", and According to the dictionary refernece.com,role model is a person whose behavior, example, or success is or can be emulated by others, especially by younger people. But according to wikihow: role models are important. They help us become the person we want to be and inspire us to make a difference. Choosing wisely means that you are influenced correctly and will help you be the best person you can be. Please take note of this particular definition. In other definition of a model, it was defined as a person or thing seen as an excellent example of a quality which is why i ask, Is Sanusi Lamido an example of a quality and truthful leader to be emulated? which would inspire we the young people to be what we want to be? This brings me to the question, what do we, the young people of Nigeria want to be or achieve for our country? Do we wish to achieve through political desperation, the sectionalism of our region, the tribalism of our heroes, hypocrisy of our leaders, or the sentiments of our fathers?. As for me, I want to bring positive change and transformation devoid of the sentiments of tribe, religion and region. On several occasions, I have expressed my displeasure with some of the actions of our leaders without fear of being castigated by their hardened followers,who not only consider everything they do as good and worthy of emulation but always defend their actions no matter how bad it is,and also do attack and condemned anyone with a different view. Before i proceed,I wish to categorically state that the aim of this writeup is not to discredit some of the good work of Mallam Sanusi Lamidu or tarnish his image as a person,but to air my view of his leadership style and pursuit and to point my fellow youths to a positive direction through carefully selecting a model and also having a limitation in supporting and copying, when some thing goes wrong with our choice of models. Like I used to say, I am not a follower of any leader but just a supporter. I support what you present when i consider it good and against it when i consider it bad. it is not about you as a person but what you present at a certain time. A follower may follow his adored model till death or pit,but as a supporter, I have limitations. Sanusi Lamido is no doubt an intelligent man who may have positively contributed in one way or the other to the banking sector,i can't but appreciate him for his intelligence and effort toward repositioning the Nigerian Banking sector. But despite that,I consider him a power monger who desire power at all cost,which explain his actions so far as the Governor of the Central Bank Of Nigeria. Please,Permit me to start from Mallam Sanusi's national Controversial life which affects not just those in the banking sector,but the country at large. The introduction and promotion of Islamic Banking. I understand that Islamic banking is based on Islamic Sha’riah Law which provides all solutions to financial problems, so should every Nigerian. We all should understand that Islamic banking is not here to damage our financial institution, but rather aimed to fix the existing damages. According to Islamic law, interest is totally prohibited in Islam because interest has lot of bad effects on the society such as their earning capacity, purchasing power and increase poverty, unequal distribution of wealth and credit crisis in an economy. According to Usmani (2005), the main drawback in interest based system is financier has no concern with money when he gives an interest bearing loan to a client. But in Islamic financial contract cash money is not given to client, first of all they purchase the commodity and transfer to client then all profit and loss will be distributed between parties according to agreed terms and conditions (Usmani, 2005). Despite this, it does not mean that Muslims cannot always deal in the normal banking system as their is different opinion from various scholars about interest. Islam Completely opposite riba (interest) but at the same time did not stop one from doing business and making profit. inceif.academia.edu I am aware that Islamic Bank (Jaiz bank) was first introduced to Nigeria without question in 2003, which means that when it goes through the right process,it was never criticized or condemned by anyone. This can be confirmed by mere typing jaiz bank 2003 on Google.com. what happened to the first Islamic bank in Nigeria which started in 2003? How is the same Jaiz bank which had received the permission to start operation in 2003 suddenly became a new bank enjoying the promotion of the same CBN in 2011? Ordinarily as a Muslim,i should support the Islamic Banking considering the fact that my religion discouraged us from the Interest based banking and this is exactly what the Islamic bank is all about. But i also know that the Christian Religion also discouraged Christians from Interest based banking, which automatically put both religion on the same page as far as the sermon of the None Interest banking is concerned. Listening to the promotion of Islamic Banking introduced by Mallam Sanusi Lamido,the loudest part of it, is the fact that Islamic banking is happening all over the world including USA and UK. So i ask, why should Islamic Banking be practiced in Nigeria because it's being practiced in USA or Uk? Just last year,The National Assembly made a law banning same sex against all the pressure from the Western World like USA and Uk,since same sex is being practiced in their country as a human right that should not be denied, they pressured and vowed to sanction Nigeria if we go ahead with the law,but because we consider it not good for our society,we said no to it. This is to explain that Islamic Banking should not be promoted based on it being practiced in other countries. Also,Mallam Sanusi Lamido admitted that he didn't initiate the idea of Non Interest Banking,which means that his predecessor,Charles Soludo had already been working on it before him,but he didn't tell us if Charles Soludo made any noise about it or named it None Interest Banking or Islamic Banking. That aspect was intentionally not clarified. Since both Christianity and Islam embraced the Non Interest banking, why the choice of Islamic banking as a name? of course, it has a reason. From my understanding,the first Official None interest Banking in the world was first experimented in Egypt,an Islamic state. which is why other countries practicing it retained the name,but if we feel the banking system is good for us and the name is just the problem due to the religious tension in the country,it is meaningful in my opinion to adopt another neutral name such as, Religious Banking or just None Interest banking which would give everyone security to participate in the it without fear or sentiments,but Mallam Sanusi Lamido hold on to the name Islamic banking for a reason. Point of note: Every one is in support of Non Interest Banking,the name Islamic banking is just the concern. A leader who truly want a national progress and convenience for the people would never bother himself with just a name,but Mallam Sanisu insisted for a reason. It was during the debate of Islamic banking that the Boko haram Sect started it's bombing around the north east region,we thank God that the Islamic banking have not been commissioned to start operation before that period,if the Islamic banking had been forced on those who consider it a way of Islamizing Nigeria,it would be difficult to say the new Islamic banking is not responsible for the funding of the Boko Harma Sect to complete the Islamization of Nigeria, which would result in serious crisis beyond what we have right now. If the name of the bank is just a religious bank or Non Interest bank, do you think such accusation would be leveled against the bank without any proper linkage? Despite knowing what this simple name could cause,Mallam Sanusi went ahead with it without minding what may happen even when their is other better and easy way to do it. Some people may claim labeling the Islamic bank a sponsor of such organization if it had started before Boko Haram begin their activities would amount to hate on the Islamic religion,but i ask such people,have you ever seen the kind of Boko Haram terror in Nigeria? it would be easy and physically connecting to say that the new Islamic banking made it possible. For example,If armed robbers robbed a house and went along with another man's id card,upon completing the robbery,they dropped the id card of this innocent man on the floor of where they robbed and the Police came for inspection after the robbery and found this innocent man's id card,who do you think is the robbery suspect? The owner of the Id card of course. In this case,Islam is the Innocent man and those robbers are the people hiding under it for their selfish reasons. Even though the innocent man, (Islam) is clean,he became the number one to receive the blame and punishment. Why did sanusi Lamido Insisted on Islamic banking when other names may be better for peace and progress? Only one reason may be responsible for this action. He wants to position himself before the Nigerian Muslims especially the north to rape our heart through religion, as someone that is worth supporting and loved for promoting Islamic ideas. This would place him in a better position to gain support and be considered for elective office when he stands as a candidate for governor,president or any other position in the future. Many may think otherwise,but the truth is,The Islamic banking is never for any purpose other than that in my opinion. He made a tactical loss to Nigeria to gain a strategic victory in the heart of the million of Muslims and northerners. Religion is said to be used to rape human heart,this is exactly what i consider happened in the case of Sanusi and the Islamic banking. The main concern of this man is not to promote Islam or make Nigerians enjoy the None interest banking,but to place himself in a better position for electoral victory. To understand me better,Permit me to take you to Zamfara State where the shariah Law is being practiced. Shariah law is no doubt a system of government that protect Human right and equity,In fact,It is the best form of government that can be practiced to prosperity. Though,this system is being misunderstood. For example,It is true that for stealing under the shariah law government,the hand of the culprit shall be cut off. But who is a thief under shariah law? A thief is not someone who steals because he his hungry or because he his in need badly,It is some one who steals out of greed and for luxury. If someone is caught stealing under shariah law,he would be investigated to know why he steals,if it is because he his hungry,shariah said such person must be given enough food so he could not steal again. But if he steals out of greed just like some of our politician and others,It is people like that whose hand shall be cut off,just like people calling for death penalty as the punishment for corruption. Don't you see that the Shariah law is not bad as it seems? Today,after shariah law was deceitfully introduced to zamfara and practiced in hypocritical manner,Sharia law is seen as bad before the people as a result of the activities of some Muslims,they give Islam bad image. The Zamfara state governor(Yerima) who introduced Shariah according to Wole Soyinka in the publication,the next phase of boko haram said,He had to use it to make the governorship position. In professor Wole Soyinka's word (Why do I use Yerima? Because in him, you also encounter the fusion of a credo in Northern ism and at the same time in Islamism. So you can see somebody like him as an opportunist. And I say this, you know, because he himself admitted to some of our people in NALICON during the immediate post-Abacha era, when he was asked why he decided to turn Zamfara into a theocratic state in a secular dispensation. He said, and I dare him to deny it, that it was the only weapon he had to snatch power. He said the PDP machinery was so strong that he needed something which would appeal to raw emotions, to mobilise and get the governorship.) He made the governorship and left Islam with bad Image of his wrong doing. This i believe is what the Islamic banking is all about. Furthermore,going around the world where Islamic Banking made success,the majority of its success can be attributed to the acceptability by the people. Islamic banking made success because it was peacefully introduced with education and manners,if it was forcefully introduced like the case of mallam Sanusi,we would probably not heard of any success of the Islamic Banking. How do we expect the sanusi's version of Islamic banking to make the required impact in Nigeria when it was not introduced with the most sincere intention? The bank would be perceived never with confidence or trust,but Constant suspicion which would affect its operation. Would it make the required impact? The Islamic banking not just divided Nigeria along religious line,but placed the unity of this beautiful entity on constant question. It has been said that the Islamic banking is for everybody both christians and Muslims,But how many of the Muslims asking Christians to participate in Islamic banking would participate in a christian Banking? yet they want Christians to accept what they themselves can not accept without following the teaching of prophet Mohammed (SAW) which says: never do to others,what you can not accept. If this Islamic Banking stays as it has,The Christians have promised to start Christian banking and i can't blame anyone for it, other than Sanusi. Some may say that is not a problem, but of course it just divided us. I am sure if the Christianity Banking is what came first,it would generate as much controversy as the Islamic banking did and the operation of both banks would not only bring religious competition but the challenges that would follow may be had to control. How is this Islamic Bank different? Alhaji Umaru Abdul Mutallab is said to be the chairman of the Islamic bank and others,the same people who had been operating the commercial banks. The same people who had milked the several banks through deals and interest.The chairman Alhaji Umaru Abdul Mutallab was described by The Times in 2009 as being "one of the richest men in Africa and by The New York Times as "among Nigeria’s richest and most prominent men. where did he made all those money other than through loans, interest and deals from the banks he chaired? How different would he run the Islamic bank? A former Executive Vice Chairman, Managing Director, and CEO of the United Bank for Africa (UBA) (1978–88).the former Chairman of Nigeria's oldest and largest bank, First Bank of Nigeria Plc (1999–2009).He was the same chairman of Jaiz bank which operated in 2003. Religion at some point of understanding has created peace and at other times created war for lack of understanding. What do you understand by religion became the question in my mind? Libya:Historical Background Who was King Idris of Libya? Who was Colonel Muammar Gaddafi? King Idris: His full name was Sidi Muhammad Idris Al-Mahdi As-sanusi (1889-1983). The first and only king of Libya, he reigned as Idris I from 1950 to 1969. His conservatism finally brought about his overthrow in a military coup under the direction of the controversial leader, Muammar al-Qaddafi. Libya's future king was born on March 13, 1890, in Jaghbub, an oasis in the eastern province of Cyrenaica. At the time, Libya was part of the Ottoman Empire. Idris I died in exile in Cairo, Egypt, in 1983. Leader in Exile When his father died in 1902, Idris became head of the Sanusiyah, an Islamic brotherhood. Still a minor, he did not assume active leadership until 1916. His main problem over the next few years was how to deal with the Italians, who had invaded Libya in 1922 in an effort to build a North African empire. Italy never established its rule much beyond the coast, and in 1917, Idris was able to secure a ceasefire and confirm his own authority in Cyrenaica while acknowledging Italian supremacy in the area. Given the title of emir, Idris established a parliament and secured financial grants from Italy. But when he proved unable or unwilling to disarm his tribal supporters, Italy invaded in the spring of 1922. Idris saw little point in resisting and went into exile in Egypt. The War Years Idris continued to direct his followers while in exile. Through the years, the Sanusiyah brotherhood had been changing into a much more organized political organization. Idris's support came from conservative tribesmen who were mainly concerned with restoring his rule to the province of Cyrenaica. But a younger faction in this area wanted a union of the Libyan provinces of Cyrenaica, Tripolitania, and Fezzan. Libya was the scene of heavy fighting in World War II, and Idris recruited guerrillas and scouts to aid the British, who eventually occupied Cyrenaica and Tripolitania. Fezzan came under control of the French. During World War II, Italy was Britain's enemy and Idris and the Sanusi became tools of the British. Idris returned to his homeland in 1947, but the issue of a Libyan union was not solved until two years later. In November 1949, the United Nations resolved that representatives of the three provinces in question should meet in a national assembly to decide their future. The assembly decided on a constitutional monarchy and offered the throne to Idris. Under Idris the throne had a preponderance of influence over the parliament and absolute control over the army. The government was an oligarchy of wealthy townsmen and powerful tribal leaders who divided the important administrative positions among themselves and supported the king. This situation, along with the external support of Western powers and the internal military support of his loyal tribesmen, enabled Idris to control the affairs of the central government. Independence and Exile Libya declared its independence in December 1951, with Idris I as king. Two capitals were established, one in Tripoli (Tripolitania), home of the parliament, and one in Bangasi, meeting place of the king and his cabinet. As the reigning monarch, Idris had complete control of the army and a good deal of influence over the parliament, which was mainly composed of powerful tribal leaders. In addition Libya, an arid, impoverished country with crop production limited to the narrow coastline, could not flourish without heavy "aid" from Western powers. In time, younger citizens, especially the military,grew tierd of the king's conservative policies and extreme dependence on the West. Many of the younger army officers and members of the growing urban middle class, however, resented Idris's socially conservative policies and his aloofness from the growing currents of Arab nationalism. In September 1969, while Idris was at a Turkish spa for medical treatment, the army, led by Col. Muammar al-Qaddafi, overthrew the government. Idris went first to Greece and then was given political asylum in Egypt. In 1974 he was tried in absentia on charges of corruption and found guilty. He remained in exile in Cairo until his death. Immediately following the 1969 coup, Idris I and his family fled to Greece. They then asked for and received political asylum in Cairo, Egypt. Idris had married his cousin in 1933 and, according to Islamic law, was allowed to take another wife. In 1955, Idris married the daughter of an Egyptian landowner. He remained in exile in Cairo until his death on May 25, 1983. -- Who was Gaddafi? On September 1, 1969 the pro-western regime that had ruled in Libya was overthrown by Colonel Muammar Gaddafi and his officers. At the time, Libya was home to the largest US Air Base (Wheelus Air Base) in North Africa. Agreements between the USA and Libya signed in 1951 and 1954 granted the USAF the use of Wheelus Air Base and its El Watia gunnery range for gunnery and bombing training and for transport and bombing stopovers until 1971. During the Cold War the base was pivotal to expanding US military power under the Strategic Air Command, and an essential base for fighter and reconnaissance missions. The Pentagon also used the base -- and the remote Libyan desert -- for missile launch testing: the launch area was located 15 miles east of Tripoli. Considered a 'little America on the shores of the Mediteranean', the base housed some 4600 US military personnel until its evacuation in 1970. With the discovery of oil in Libya in 1959, a very poor desert country became a very rich little western protectorate. Oil was discovered in Libya in 1959, but King ldris of the Senussi tribe allowed most of the oil profits to be siphoned into the coffers of the oil companies. US and European companies had huge stakes in the extremely lucrative petroleum and banking sectors, but these were soon nationalized by Gaddafi. Thus Libya overnight joined the list of US 'enemy' or 'rogue' states that sought autonomy and self-determination outside the expanding sphere of western Empire. Further cementing western hatred of the new regime, Libya played a leading role of the 1973 oil embargo against the US and maintained cooperative relations with the Soviet Union. Gaddafi also reportedly channeled early oil wealth into national free health care and education. Libya has a well tolerable human rights record and stands at 61 on the International Incarceration Index, comparable with countries in central Europe (the lower the rating, the lower the standing - the USA occupies the no.1 spot!). Iranloye (PRO 3) salary as approved by the senate council. • Out of the over 1.5 million naira claimed to have been collected by the financial director out of the projected over 7 million only N514,800 was approved by the senate for the associations various projects and N510,800 was released while the account balance as submitted by the Financial director shows that N18,000 is left in the account meaning close to a million naira has been withdrawn from the association account without approval from the senate. • The N10,000 donated to the senate council for its inaugural sitting paid into the association account was not remitted to the senate council to date. • The Unicef money was not accountable and was nowhere to be found and there is no documentations • Disclosing information of the Association to external bodies even without relaying the information to his fellow executives • Inability to produce evidence of deposit made for the proposed hall for the NAKSS programs. 6. JUSTICE OR INJUSTICE,WHERE IS THE JUSTICE? Almustapha was sentence to death by hanging and some people are celebrating and some hailed the judgment as good. So i ask,why are you celebrating? for Justice or injustice? I have always wanted justice to be done to the killer of kudirat Abiola and other,but in this situation,i feel the verdict passed on Almustapha is not the justice we demand. Almustapha is just a soldier who is under orders. According to the rule of the military,you don't question orders,if you do,you are dead. if Almustapha defy the order,he would pay for it and another person would still carry out the mission. I do not want to drag this issue into looking at the authenticity of Almustapha giving the order to assassinate Kudirat, what am saying is,If Almustapaha indeed ordered the shooting,he did so because he was given an order to order,which is irresistible. Sentencing a soldier who is under command to carry out an instruction,and obeying is order is to me not a justice. He didn't commit this act when their is an alternative law,and as far as the military law which was the law in Nigeria when this act took place is concerned,their is no crime committed by Almustapha,the crime is on the superior officer who ordered him. Is just like a Gay man who practice gay in the US,since the US law allowed him to do that,he has not committed any offense,how then would the Nigerian government sentence him for practicing gay in US? this is wrong even if the Nigerian law is against gay,provided he didn't practice gay in Nigeria, you cant convict him for the act he performed in US. Even if he was found guilty,i do not think this is the right time to pass this judgment,considering the fact that he has been kept in prison for over 13 years. This is a trying time for the nation which is putting the unity of Nigeria in coma. CORRECTING THE MISCONCEPTION,MISREPRESENTATION AND MISINTERPRETATION OF THE QURAN By: Abdulrazaq Oyebanji Hamzat discus4now@yahoo.com I decided to come up with this piece from the learned Islamic scholars who had previously explained the said challenge due to the challenge i was confronted with in some forums where Christians claimed the Quran supported aggression against non Muslims,this is a misinterpretation of the words of God and misrepresentation. this piece is for those people who wish to be enlightened and i pray that the almighty give you the understanding. The letter from the prophet which reads below is the truth(A message from Prophet Muhammad(PBUH) over 1400Yrs ago. In 628 AD, a delegation from St. Catherine’s Monastery came to Prophet Muhammed(SAW) and requested his protection. He responded by granting them a charter of rights. "This is a message from Muhammad ibn Abdullahi, as a covenant to those who adopt Christianity, near and far, we are with them. Verily I, the servants, the helpers, and my followers defend them, because Christians are my citizens; and by Allah! I hold out against anything that displeases them. No compulsion is to be on them. Neither are their judges to be removed from their jobs nor their monks from their monasteries. No one is to destroy a house of their religion, to damage it, or to carry anything from it to the Muslims' houses. Should anyone take any of these, he would spoil God's covenant and disobey His Prophet. Verily, they are my allies and have my secure charter against all that they hate. No one is to force them to travel or to oblige them to fight. The Muslims are to fight for them. If a female Christian is married to a Muslim, it is not to take place without her approval. She is not to be prevented from visiting her church to pray. Their churches are to be respected. They are neither to be prevented from repairing them nor the sacredness of their covenants. No one of the nation (Muslims) is to disobey the covenant till the Last Day (end of the world), not just the truth for the people living during the time of the prophet,but will continue to be true until the day of Judgement. In further supporting the above letter from prophet Mohammed (SAW) the Quran also has this to say, Not all these people are alike. From amongst the people of the book are those who stand in the night time, reciting the verses of God while prostrating. They truly believe in God and the Day of Judgment, they encourage goodness, admonish evil and take lead in doing acts of virtue; such are the righteous people. Whatever good they will do is not going to go waste. And God is aware of the pious people. (3:113-5) Indeed those who believe [– Muslims –] and those who are Jews, and the Nazarenes [the rightly guided Christians], and the Sabeans, whoever [amongst them] believes in Allah, the Day of Judgment, and does good deeds, for him there is going to be reward before his Lord: They will neither have any fear of the future nor sorrow of the past. (2:62). Here comes the verse of the holy Quran quoted as a command for muslim to attack the Christians,This is what the Quran says in, At-Taubah sura 9:29 " Fight against those who (1) believe not in Allah, (2) nor in the Last Day, (3) nor forbid that which has been forbidden by Allah and His Messenger (4) and those who acknowledge not the religion of truth (i.e. Islam) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with willing submission, and feel themselves subdued." Source from the Noble Quran. The Above verse is indeed from the holy quran, For every quranic verse, there is what we call asbabu nuzul,(reason for revelation.) In light of the historical context of this verse, it becomes very clear that the verse was revealed in connection with aggression initiated against Muslims. As Dr. Jamal Badawi very accurately concludes with regard to verse 9:29 and similar verses:All of these verses, without exception, if studied carefully, address aggression and oppression committed against Muslims at the time of the Prophet (peace and blessings be upon him), whether by idolatrous Arabs, some of the Jewish tribes in Madinah, or by some Christians.Some people have falsely concluded from verse 9:29, that Muslims are commanded to attack all non-Muslims until they pay money. In fact, such an interpretation is completely false and contradicts authentic Islamic teachings. Commenting on this verse, Shaykh Jalal Abualrub writes:These Ayat (Quranic verses) stress the necessity of fighting against the People of the Scripture, but under what conditions? We previously established the fact that the Islamic State is not permitted to attack non-Muslims who are not hostile to Islam, who do not oppress Muslims, or try to convert Muslims by force from their religion, or expel them from their lands, or wage war against them, or prepare for attacks against them. If any of these offenses occurs, however, Muslims are permitted to defend themselves and protect their religion. Muslims are not permitted to attack non-Muslims who signed peace pacts with them, or non-Muslims who live under the protection of the Islamic State. (Abualrub, Holy Wars, Crusades, Jihad) Likewise, the following fatwa points out that Muslims cannot attack a peaceful non-Muslim country: Question: Is it an obligation of an Islamic state to attack the neighboring non-Muslim states and collect ‘jizya’ from them? Do initiating from them?we see this in the example of the rightly guided Caliphs who fought against the Roman and Persian Empires without any aggression Answered by Sheikh Hânî al-Jubayr, judge at the Jeddah Supreme Court If the non-Muslim country did not attack the Muslim one nor mobilize itself to prevent the practice and spread of Islam, nor transgress against mosques, nor work to oppress the Muslim people in their right to profess their faith and decry unbelief, then it is not for the Muslim country to attack that country. Jihâd of a military nature was only permitted to help Muslims defend their religion and remove oppression from the people. The Persians and Romans did in fact aggress against Islam and attack the Muslims first. The Chosroe of Persia had gone so far as to order his commander in Yemen specifically to kill the Prophet (peace be upon him). The Romans mobilized their forces to fight the Prophet (peace be upon him), and the Muslims confronted them in the Battles of Mu’tah and Tabûk during the Prophet’s lifetime. May Allah guide us all. And May peace and blessing be upon our Prophet Muhammad. (SOURCE, emphasis added) The above fatwa refers to the historical context in which the Prophet Muhammad (peace be upon him) fought against other nations. The Prophet Muhammad did not initiate agression against anyone, rather he and his followers were under attack from all who sought to crush the new Islamic state. The first hostilities between the Muslims and the Roman empire began when the Prophet Muhammad’s messenger to the Ghassan tribe (a governate of the Roman empire), Al-Harith bin Umayr Al-Azdi, was tied up and beheaded (Al-Mubarakpuri, Ar-Raheeq Al-Makhtum, p. 383). The killing of a diplomat was an open act of war, and the Prophet Muhammad sent an armed force to confront the tribe, but the Roman empire brought in reinforcements and the resulting conflict, known as the Battle of Mut’ah, was a defeat for the Muslims. Only after this did subsequent battles between the Muslims and the Roman Empire occur, and the Muslims emerged victorious. Likewise, as mentioned in the above fatwa, hostiltiies between the Muslims and the Persians only began after the Persian emperor Chosroe ordered his governor in Yemen Badham, to kill the Prophet Muhammad pbuh, although his efforts were thwarted when the latter accepted Islam. Other non-muslim groups, such as those in Madinah, also initiated hostilities against the Muslims despite peace treaties as Shaykh Sayyid Sabiq writes: As for fighting the Jews (People of the Scripture), they had conducted a peace pact with the Messenger after he migrated to Madinah. Soon afterwards, they betrayed the peace pact and joined forces with the pagans and the hypocrites against Muslims. They also fought against Muslims during the Battle of A`hzab , then Allah revealed…[and he cites verse 9:29] (Sayyid Sabiq, Fiqhu as-Sunnah, Vol. 3, p. 80)herefore, the command to fight in verse 9:29 relates to those non-muslims who commit agression and not those who are committed to live in peace. The verse is subject to certain conditions that were apparent when it was implemented in the time of the Prophet Muhammad pbuh, as Shaykh Sayyid Sabiq writes: What we have stated makes it clear that Islam did not allow the initiating of hostilities, except to: 1. repel aggression; 2. protect Islamic propagation; 3. deter Fitnah and oppression and ensure freedom of religion. In such cases, fighting becomes a necessity of the religion and one of its sacred ordainments. It is then called, ‘Jihad’. (Sayyid Sabiq, Fiqhu as-Sunnah, Vol. 3, p. 81) The verse then proceeds to mention some issues relating to the Islamic state, and governing non-muslim citizens of the Islamic state. Dr. Maher Hathout comments on the regulations in verse 9:29: Freedom of religion is an essential aspect in an Islamic state. One of the five pillars of Islam is zakat (almsgiving). The People of the Book (Christians and Jews) are not obliged to pay the Islamic zakat that is spent by the state for social necessities and state affairs as defined in the Quran (see 9:60). But they must pay other taxes to share in the state budget. If they refuse to pay this tax to the state and rebel against the state, then it is the obligation of the state to confront them until they pay it. This is what Caliph Abu Bakr did after the death of the Prophet, when some people refused to pay zakat. (Hathout, Jihad vs. Terrorism; US Multimedia Vera International, 2002, p.53) The verse mentions Jizya, which is unfortunately misunderstood by some people. Like any nation, the Islamic government requires its citizens to pay taxes in return for its services. Since Muslims pay the Zakat, the non-muslim citizens are required to pay Jizya (for more information on Jizya, please refer to Jizya in Islam and Jizyah and non-muslim minorities). Dr. Monqiz As-Saqqar writes concerning the Jizya tax: The sum of jizya was never large to the extent that the men were unable to pay. Rather, it was always available and reasonable. During the reign of the Prophet, peace and blessings be upon him, jizya never exceeded one dinar annually and it never exceeded four dinars under the Umayyad rule. (SOURCE) Shaykh Abu’l-Hasan Al-Mawardi (d. 1058CE) explicitly points out that the Jizya should be exacted in accordance with the means of the people, and the Imam should judge the conclude the amount to the satisfaction of the leaders of those being taxed: The fuqaha (Jurists) differ as to the amount of the Jizya. Abu Hanifa considers that those subject to this tax are of three kinds: the rich from whom forty-eight dirhams are taken; those of average means from whom twenty four are taken, and the poor from whom twelve dirhams are taken: he thus stipulated the minimum and maximum amounts and prohibits any further judgement on behalf of those responsible for its collection. Malik, however, does not fix its minimum and maximum amount and considers that those responsible should make their own judgement as to the minimum and maximum. Ash-Shafi’i considers that the minimum is a dinar, and that it is not permitted to go below this while he does not stipulate the maximum, the latter being dependant on the ijtihad (judgement) of those responsible: the Imam, however, should try to harmonise between the different amounts, or to exact an amount in accordance with people’s means. If he has used his judgement to conclude the contract od jizyah to the satisfaction of the leaders of the people being taxed, then it becomes binding on all of them and their descendants, generation after generation, and a leader may not afterwards change this amunt, be it to decrease it or increase it. (Al-Mawardi, al-Ahkam as-Sultaniyyah, Ta-Ha Publishers Ltd. 1996, pp. 209-210) Hence, the laws of Islam forbid Muslims from opressing non-muslims and command them to treat others with justice and compassion. In fact, the Prophet Muhammad pbuh himself forbade Muslims from harming non-muslim citizens of an islamic state or any non-muslim with whom there was an agreement of peace, as he said, “The one who wrongs a covenanter or impairs his right or overworks him or forcibly takes something from him, I will be his prosecutor on the Day of Judgment. (Sunan Abi Dawud 170/3 no. 3052, Sunan an-Nasa’i 25/8 no. 2749, and verified by Al-Albani no. 2626). In conclusion, verse 9:29 commands Muslims to fight against only those who initiate agression as illustated by its historical context. Muslims may only fight under strict conditions, and are commanded to live peacefully with peaceful non-muslim neighbors. And also, on the term fight, FIGHTING NEED NOT ALWAYS BE PHYSICAL, IT CAN ALSO BE INTELLECTUAL Finally, people might now say well isn’t Islam violent because Muslims are commanded to fight those who do not believe in God and so on etc etc. Not really, because fighting in this verse does not explicitly mean physical violence. Observe the words in the above verses like “willingly”, “willing submission”, “readily” etc. Here it is spoken about bringing a change from within the hearts of people which is brought about intellectually. There are many ways in which you fight against somebody that does not involve a physical aspect. You can fight someone with the tongue, using your wisdom and telling him about the truth, you are fighting against the lies that person is propagating and eventually with your tongue you will speak the truth and crush his lies leading him to the truth.
