The discussion about death is one which everyone abhors, especially their own. But if you don't make plans on how you want to distribute your worldly wealth while you're still alive, you can leave a host of problems and hardships for your grieving family to sort out. Take the billionaire aviator turned recluse, Howard Hughes. It took 15 years of legal wrangling before his fortune was handed out among surviving family members because he hadn't bothered to make a will. Maybe he, like many other people, felt daunted or even afraid by the process - or was it the cost? But in reality, the business of making a will can be quite straightforward and it won't cost the earth provided you are aware of the major pitfalls. Here are our top ten tips on how to end up with the perfect will. 1. Choose who draws up your will wisely You can make your own will but this process is full of pitfalls and errors are easy to make. Lawyers make a lot more money sorting out badly drafted wills and dealing with claims against those wills, than they make for drawing up wills. It’s always advisable to employ the services of a reputable lawyer. 2. Choose your executors well Executors are responsible for exercising your estate in accordance with your instructions after you have died. It is a responsible and demanding role, and involves handling large sums of money. And don't forget to check that the people you choose are happy to take on the role. 3. Appoint a default or substitute executor If you are married, you will probably want your spouse to be your executor, but don't appoint them as your sole executor. If you both died together in a plane crash or a car accident, neither of you would have an executor living. Always appoint a default or substitute executor as a fall-back position in case your spouse is unwilling or unable to act. 4. Appoint guardians If you are the last living parent and you die leaving children under age 18, a guardian will be appointed by the court if you have not specified who this should be in your will. If you are unmarried but you and your partner have children, you might not even get guardianship of your children. If an unmarried man dies, his female partner automatically gets guardianship of their children, but if an unmarried woman dies, her male partner does not. You should appoint each other as guardians in your wills to overcome this problem. 5. Appoint trustworthy trustees This might sound obvious, but if you are setting up a trust in your will or if your beneficiaries could be aged under 18 when you die, you will need to appoint trustees. Trustees will be responsible for managing and investing money, or looking after property until it passes to the beneficiaries, so make sure they are people with a good grasp of financial matters - and that they are still young enough so they don't die before you do. 6. Make specific legacies If you want to preserve family heirlooms or items of special sentimental value, (for example, a grandfather clock, or a wedding or engagement ring), you should leave these items as a specific legacy to a named beneficiary. 7. Make sure you leave a residual legacy The 'residue' is what is left over in your estate after you have made any specific legacies. You must specify who this goes to, as if you fail to do so, you will create a partial intestacy in your will. In other words, the small gifts and legacies would pass according to the will, but the residue would be subject to the laws of intestacy. 8. Save tax with a trust Inheritance tax is becoming a burden for many families, particularly where the value of a property pushes the value of an estate above the nil rate band for inheritance tax. If you are married, you can include a discretionary trust in your wills, which could save your children millions of naira in inheritance tax at current rates. 9. Sign your will It's all very well having your will drafted, but if you don't sign it in front of two independent witnesses, it will not be valid. A witness cannot be anyone mentioned in the will or anyone married to anyone mentioned in the will. 10. Get it stored safely Once your will has been correctly signed and witnessed, have it stored in a proper safe storage facility. This will protect it from fire, flood, damage, or loss. Your executors will be provided with a certificate showing them where your will is stored and how to get hold of it if you die. Whatever you do – don't hide your will. The Nigerian oil and gas sector presents one of the most profitable areas of business interest in the country. Many who have been privileged to do business in this sector have always attested to the abundant profit inherent in this business. The major problem hindering many from venturing into this sector is because of its strict regulations. In fact, crude oil or petroleum and its derivatives are essential commodities that are consumed on daily basis. Despite the demands for the adoption of alternative renewable energy resources, oil still remains the number one because over 97% of all vehicles and machines in Nigeria use either PMS (Petrol) or AGO (Diesel). Here are some business and investment opportunities in the oil and gas sector. 1. Oil Drilling and Exploration Oil and gas exploration is the most risky but lucrative business in the petroleum industry. To start, you will need a large amount of capital, heavy machinery, a highly competent technical team and an approval from the government. In Nigeria, such approval is called an “Oil Prospecting License (OPL).” Companies operating at this level include Exxon Mobil, Texaco, Chevron, Conoil, etc. 2. Equipment Leasing If you don’t have large capital to venture into oil exploration, you can still make money by setting up an equipment leasing company to serve the petroleum sector specifically. Here, you’ll need to purchase equipments that are needed in the oil and gas sector. Money will be made by leasing those equipments to oil firms in need of them. 3. Petroleum Refining Another lucrative business in the oil and gas industry is petroleum refining. It is possible to setup your own small private refinery and compete with the big players in the industry, since oil is a commodity that actually has no unique selling point. For instance, with the deregulation of the downstream sector in Nigeria, and the current upstream deregulation plus the planned subsidy removal; setting up a private refinery is the next business that will kick off in Nigeria. 4. Crude Oil Exportation 5. Fuel Importation 6. Offshore Trading Some oil shipping tankers don’t have the permission to sail through the waterways of certain countries, so what they do is to sell off their oil at the border to a merchant whose ship has the right to enter the country. If you have the capital and logistics to buy these products offshore at a bargain, you can make some profit from the deal. 7. Oil Depot You can also setup a tank farm and sell petroleum products to distributors and retailers. In this case, you will need to build massive tank farms or reservoirs to store your products as you will either import your own products, or source your products from the local refineries or buying from the oil tankers. 8. Fuel Haulage and Logistics If you want to avoid the stress of getting a license and the strict compliance associated with starting an oil company, then you can purchase trucks and haul petroleum products for marketers from the depots to their desired destinations. 9. Filling Stations You can also setup a fuel station and retail petroleum products such as PMS (Petrol Motor Spirit), AGO (Diesel), DPK (Kerosene) to domestic and commercial users. 10. Petrochemicals refining You can start the production of petrochemicals such as Benzene, Ethylene, Ammonia, Toluene, etc. 11. Domestic DPK Retailing Just recently, I have started seeing mini fuel stations with just a pumping machine; within some streets in Lagos and some others states. These mini fuel stations are simply retailing kerosene to households. If you don’t have the funds to purchase motorized pump-machines, you can start by using big barrels. But remember that you must be licensed by the local government before you can start this business. 12. Gas Wholesaling and Retailing You can also setup a gas plant, or a wholesaling point. Or better still, you can retail domestic gas like ethane and butane, etc. 13. Petroleum Supply on Contract Basis You can also supply AGO (Diesel) to companies that run heavy duty power generators like banks, manufacturing firms, telecom companies, etc. You can also supply aviation fuel to airlines on demand-and-supply basis. 14. Oil and Gas Consulting Have you being employed in the oil and gas industry for a long time? Do you have the skill and experience? Do you understand the modus operandi of some specific oil businesses? Then you can become a consultant with expertise in the oil and gas industry. Your duty here is to offer advice and guidance to entrepreneurs and investors seeking to venture into the oil and gas industry. You can also help them scale the hurdles of the oil industry. 15. Oil and Gas Brokerage Services Even if you have no money to venture into the oil and gas business, you can still profit from the industry by offering brokerage services between buyers and sellers of petroleum products. 16. Blogging You can also start a blog profiling oil and gas companies; and keeping the stakeholders abreast with the happenings in the oil and gas sector. 17. Publish a Magazine Just as in the case of blogging, you can start a hard cover magazine focusing on the oil and gas sector. 18. Start a TV Show production You can also launch a TV show targeting the oil and gas sector. You can profile and interview entrepreneurs in the oil sector, review the challenges in the petroleum sector, etc. 19. Oil and Gas services You can also start an oil and gas services company. Your company can choose to offer services such as safety, hazard control, pipeline installation, other installations, pipeline monitoring and security, etc. 20. Invest in Oil and Gas companies Now if you lack the capital or the entrepreneurial prowess to venture into the oil and gas business, you can still make money off the industry by investing in a reputable oil and gas company with proven track record. Though she might be trying to pass the impression of "How To Treat A Maid" to the millions of Nigerians out there maltreating theirs but I think her constant use of the term "maid" in reference to the said girl is a bit uncool to me considering the local emotions that word evokes amongst Nigerians (blacks). She should remember that the girl will one day grow into a lady and consequently, a wife/mother/grandmother. Displaying her picture with that "maid" tag might not be a good idea in the long-run. It can even lead to some sort of social stigma. In the western world, it would have mattered less but over here our understanding of that word is different and often misrepresented.
