Let me explain some things in lay man terms.
When you asked a lawyer to sue someone on your behalf, he files let us a say a process asking the court to help you recover money- this is called the Substantive suit.
Now while you are trying to recover the money, you heard that the person wants to sell all his properties. If he does that you won't be able to recover nothing. So your lawyer rushes to the Court to file what we call interlocutory application to stop him from selling his properties pending the determination of the substantive.
Now, you cannot have interlocutory if you don't have substantive. In this present case, the interlocutory was filed on January 9, 2019 while the substantive was filed on January 11, 2019. How is that possible? It is like you have a house and you are now putting a foundation on it.
Now to the Order, when a court gives an Order, it is usually like , Upon the motion on Notice/Ex Parte dated .... And upon hearing Ojike Ebere Esq (that is the lawyer that came to court to argue ) for the plaintiff, It is hereby Ordered....
Now the Order did not satisfy this rule. Then go and challenge d order in court of appeal. But until that is done and the appellate overturns d order, it remains 100% valid! The Peace theorist; and Conflict Prevention, Management and Resolution expert asserts that “the present Federal Working Document also know as the 1999 Constitution of the Federal Republic of Nigeria (as Amended) is a mere Federal Working document concocted by past military government to benefit the government at the centre to the detriment of the federation units. This aberration of fundamental Principles of Federalism, Constitutionalism, Rule of Law, Democracy and Human Rigts; is the underlying cause of massive underdevelopment, high and low intensity violent conflicts, hunger, poverty and untimely deaths in Nigeria in general and Eastern Nigeria in particular.”
In conclusion, the international scholar and political technocrat advised that “failure of the APC leadership to zone the office of President of Senate to the South East will further feed the perception of oppression, marginalisation, repression and exclusion of the South East from access to political and economic participation in Nigeria. [s] AlexReports: The Kano State Governor, Abdullahi Ganduje has collapsed, reports in Kano say.
Ganduje, who is a Governor under the platform of the All Progressives Congress, APC, and is seeking re-election collapsed in Nasarawa part of Kano shortly after 1am Monday morning after final figures of the State Governorship election was received in his office.
Although only 33 out of 44 local governments had been officially released by the State’s Independent National Electoral Commission, INEC, the calculation in the Governor’s office showed he had lost the election and frantic efforts were being made to turn the loss.
The development a source said led to the Governor collapsing in his bid to stand up when one of his aides told him of the development.
The governor was rushed to an unknown hospital.
This was shortly before his Deputy Governor, Nasir Yusuf Gawuna was arrested alongside the Commissioner for Local Government, Murtala Sule Garo while allegedly trying to disrupt collation of election results.
INEC had declared the results of 43 local governments out of the 44 in the state while awaiting the submission of the Nasarawa local government result with news that the result was being tampered with.
The deputy governor, the commissioner and chairman of Nasarawa local government Lamin Sani were said to have allegedly attacked the collation centre at about 1.30am on Monday morning with political thugs that unleashed terror on the people before the security agents over powered them and took them to Bompai Police headquarters.
Ganduje who was nicknamed gandollar for obtaining bribes and stuffing them into his traditional attire fell out with his political godfather, former governor of the State, Rabiu Musa Kwankwaso.
The bribe videos went viral as it happened few occasions with citizens in the state vowing to vote him out.
Ganduje eventually sacked the contractors whom he alleged necessitated the videos to embarrass him.
A non-bewildered President Muhammadu Buhari said he didn’t “know the technology that was used to video him,” and described Ganduje as a personal friend.
