*Senate vows to take action on power rates hike on resumption About 24 hours after raising the electricity tariff for premium customers by over 230 per cent, Vice Chairman of the Nigerian Electricity Regulatory Commission (NERC), Dr. Musiliu Oseni, yesterday, defended the decision, stressing that it will bolster electricity supply nationwide. Oseni insisted that the move will help reduce incidence of national grid collapses as well as encourage increased investment in the power sector.Speaking during an interview on Arise Television, Oseni, however, added that the commission was implementing measures to prevent any exploitative practices by distribution companies towards customers. He stressed that a situation room will be established to collect and address customer complaints from those impacted by the tariff adjustment. Equally yesterday, NERC made available the key indices that led to a review of electricity prices for Band ‘A’ customers from N68 to N225 per kilowatt hour.In its “Supplementary Order to the Multi-Year Tariff Order (MYTO) 2024”, seen by THISDAY, NERC listed a rise in Nigeria’s inflation by 12 per cent between January and April this year, US inflation upsurge by three per cent, and Nigeria’s exchange rate increase by 59 per cent within the four months of 2024 as some of the reasons. NERC also stated that there had been a 63 per cent rise in generation cost, 34 per cent rise in transmission and administration cost, as well as 11 per cent hike in the price of gas-to-power, saying they are other justifications for the move.But speaking on the poor electricity supply in recent times due to the national grid collapse, Oseni said it had to do with the reduction in gas supply to some power plants and lack of maintenance of facilities by the generation companies.He stated, “One factor that was responsible for this last one had to do with the reduction in gas to one of the power plants and also you have the issues of a lack of maintenance by the generation companies.“The question is what contributed to that were both dip in the supply of gas as well as generation companies’ inadequate maintenance, which boils down to money. “Any investor will not invest when there is no path to recovery. For instance, the generation invoice for January stood at N240 billion. So, based on the current Distribution Companies (Discos) charges before yesterday, they can only be mandated to pay about 10 per cent of that.“That means the market will only do about 10 per cent of the invoice and how do you operate such a market and you expect quality service? So, those are part of the issues that we need to address. “The factors responsible for grid collapse, if there is no liquidity, has serious implication on the quality of supply. Generation Companies (Gencos) not being able to pay for gas supply, not being able to maintain their machines as expected or as required is a recipe for poor quality of supply and grid collapse.“So, it is part of the issues, that we believe if the market is liquid enough, definitely will be addressed.”Oseni acknowledged potential short-term inflationary effects of the decision, but expressed confidence that tariff adjustments would lead to long-term improvements in service quality and market stability. He added that NERC remained committed to addressing industry challenges and promoting transparency in the electricity market.Oseni added that the establishment of a complaints department underscored the commission’s dedication to consumer welfare and service excellence.He said, “The commission has a number of mechanisms in place for monitoring the performance of the distribution companies. First and foremost, the distribution companies were directed some months back to install smart meters on their feeders, and on the basis of that, they get data being streamed into the data system. “And initially, we developed an application protocol interface to extract the data from the system and stream the data from the system into the commission. However, we realised that there are some challenges with that because sometimes the technology also fails.“So, we now mandated them to grant access directly to the commission into the meter data management system so that as they get information, we are also getting it directly. And as part of the system being put in place, NERC has a call centre that any customers that feel exploited can naturally call. So the call centre has been put in place to ensure that customer’s complaints are addressed.“In the next few days, the commission would release contacts of the situation room for people who feel exploited or probably have poor service delivery, starting with the 15 per cent that would be affected by this review.”In addition, in the supplementary order by NERC, it said, “The Discos shall set up a rapid response team to ensure effective service delivery on the committed minimum hours of supply to each service Band commencing with Band A feeders effective from April 3, 2024.“The team shall ensure timely response to customers’ complaints, fault clearing and alignment with TCN regional teams for effective load management and optimised dispatch to respective feeders.“Disco’s shall publish the contact numbers of the service rapid response team for each customer cluster/business unit on its website and circulate the same to the customers via bulk SMS, commencing with Band A clusters no later than 12 noon, Friday April 5, 2024.“Discos are obligated to publish daily on its website a rolling seven-day average daily hours of supply on each Band A feeder no later than 09:00 am of the next day.”The order stated that where the Disco failed to deliver on the committed level of service on a Band A feeder for two consecutive days, the Disco shall on the next day by 10am publish on its website an explanation of the reasons for the failure and update the affected customers on the timeline for restoration of service to the committed service level.It stated, “Where the Disco fails to meet the committed service level to a Band A feeder for seven consecutive days, the feeder shall be automatically downgraded to the recorded level of supply in accordance with applicable framework.“The Disco is mandated to continuously ensure upward migration of customers from the lower service bands to Band A service level in line with the target on improvement in quality of service.”However, Socio-Economic Rights and Accountability Project (SERAP) said it was suing the government of President Bola Tinubu over the “arbitrary” increase in electricity tariff.SERAP, in a post via its official X account, asked the Tinubu government to reverse the “unlawful” tariff increase.The rights group urged the president to reverse the increase pending the hearing of the suit it instituted against the increase.SERAP stated, “We’re suing the Tinubu administration over the arbitrary increase in electricity tariff from N66 to N225, despite the difficult economic realities in the country, and the pending lawsuit on the matter.“The Tinubu administration must reverse the apparently unlawful increase in electricity tariff from N66 to N225 pending the hearing and determination of the suit we filed on the matter, to protect the integrity of the judicial process and the rule of law.”The Senate also pledged to take action that will favour Nigerians regarding the increase in electricity tariff on its resumption plenary on April 16.Chairman, Senate Committee on Media and Public Affairs, Yemi Adaramodu, gave the assurance while speaking with journalists in Abuja.According to NERC, Band A customers are those who enjoy 20 hours of electricity supply daily. It was also revealed that customers under this classification represented 15 per cent of the 12 million electricity customers in Nigeria.The NERC vice chairman clarified that the review would not affect customers on the other bands.However, the senate spokesperson said relevant committees of the upper chamber were watching the situation and would take a position favourable to Nigerians on its resumption.Adaramodu said, “The relevant senate committees on power are studying the situation. You know we are on recess now. When we resume, they will present their findings to Senate at plenary. ASABA — The Chief of Defence Staff, CDS, General Christopher Musa, has given reasons residents of Okuama in Delta State are yet to have access to their homes days after the military took over the community. The CDS spoke on a day the chairman of the Okoloba community in Delta State, Mr. Clement Koki, alleged that the people of Okuama hired the mercenaries who killed the military men in the riverside settlement. Recall that Okuama and Okoloba communities have been embroiled in a communal clash which preceded the killing of the military personnel. Speaking on Arise TV, Gen Musa said troops were currently conducting a cordon and search operation in the community (as arms and ammunition of the killed in-action troops have not been recovered). It would be recalled that irate youths who are suspected residents of Okuama working with some other suspects on March 14, ambushed and murdered the Commanding Officer of 181 Army Amphibious Battalion, two majors, one captain and 13 soldiers The Defence Headquarters had said the troops were attacked while responding to a distress call, arising from a clash between Okuama and Okoloba communities, both in Delta State. Eight suspects have since been declared wanted in connection with the brutal murder of the military personnel by Defence headquarters. Gen Musa stated that Governor Sheriff Oborevwori of Delta State and residents of Okuama where the attack took place, have no access to the community because the security agencies were carrying out a “cordon and search” operation in the area. He also said the Nigerian Army was not taking laws into its own hands by declaring wanted, some persons wanted over the killing of the 17 officers and men. “We are currently conducting a cordon and search in the community. Cordon and search operation means we are searching every nook and cranny within the community because they have a lot of illegal funds from crude oil theft. “They have bought a lot of weapons. It is for us to thoroughly clean the community to ensure that no weapon, no explosive is left in the community. I can tell you that at the end of the operation, residents of the community will always go back,” he said Meanwhile, Okoloba community has accused Okuama of being behind the killing of officers and men of the Nigerian Army in their domain. Gen T. A. Lagbaja, at the Nigerian Army’s Civil-Military Cooperation Media Chat for the first quarter of 2024, in Asaba, capital of Delta State, yesterday, urged the media to refrain from inadvertently amplifying the activities of undesirable elements. What prompted Okuama to hire fighters – Okoloba leader, Koki Koki told Vanguard: “We are the people that have been tolerating their excesses for decades, and now, they are taking our friendly disposition for foolishness. We are no fools. We are just being friendly and hospitable, acknowledging that they are our brothers, Akugbene’s strangers, and have been accommodating them all this while. “But instead of appreciating our benevolence, they sought to embark on a reckless journey of territorial expansion to take over our God-given heritage. And it is that inordinate ambition and sheer recklessness that prompted them to hire mercenaries to kill the 17 soldiers on that ill-fated day, March 14, 2024. “We, the people of Okoloba, have always been calling on the state government to intervene in the brewing crisis before the evil act of killing the soldiers on a peace and rescue mission at Okuama. “The state government, the army (JTF), the Police, the DSS, and NSCDC, the local government authorities as well as other well-meaning members of the public can attest to that. Therefore, no amount of falsehood can exonerate them from the dastardly killing of the 17 soldiers. “The lies against Okoloba and her indigenes in the said publication on April 2, 2024, are not well-cooked and are baseless, which exposed their evil agenda against us from the onset. More so, the said publication is self-embarrassing and and indictment. “We unequivocally state here that Okoloba community did not encroach into Okuama land, and that we have always maintained the peace before and after the Peace Pact both communities signed at Government House, Asaba. Aggressor “For the records, Okoloba community has never encroached into Okuama land, it is all fallacies. Okuama has been the aggressor, even as they are now. “The assertion of the blood-letting by Okuama people that Okoloba people encroached on their land is even an aberration because the Okoloba Federated Community maintains a boundary originally with Akugbene community, not Okuama. “Perhaps, Okuama people have suddenly forgotten that they are ‘Akugbene visitors’. When they ran for a haven from the onslaught of the traducers because of kingship installation in Ewu Kingdom, they ran to Akugbene, our brothers, who gave them land to farm and fish. “But suffice it to say that they (Okuama) even trespassed on Akugbene land (their benefactor), and that led to several court cases, notable among which is the 1945 judgment that pinpointed their settler’s status. “In the same vein, they trespassed into Okoloba beyond the land Akugbene gave them magnanimously, and are now claiming that we, Okoloba, trespassed into their land. “The question we, Okoloba, ask is ‘can you give what you do not have?’ They, the Okuama people, do not own any land. How can settlers that were running for safety and our brothers, Akugbene, gave them their land to fish and farm, now claim that they own land that we encroached on? It does not add up.” DIAG absolves Ijaw leader accused by Okuama However, the Delta Ijaw Advocacy Group, DIAG, in a statement by its chairman, Augustine Okporu, said: “Our attention has just been drawn to an article trending online with the caption, ‘The Real Cause of the Crises at Okuama Community in Ughelli South LGA of Delta State that Led to Military Invasion’. “We have taken the liberty to address some misinformation in the publication regarding the recent crisis in Okuama community. It is crucial to separate facts from falsehood. “First, we would like to emphasize that the publication circulating in the media space is fake and should not be taken seriously. The publication has no identifiable author and, therefore, lacks any credible source. “However, it was confirmed in the said publication that Okuama people killed Nigerian soldiers, and members of the community have not denied this aspect of the publication until this moment. “The faceless author in promotion of his hatchet job accused a former Director General of NIMASA of instigating an attack on members of Okuama community and that human sacrifice takes place at Egbesu Shrine in Okoloba community. “We wish to state clearly that the said former NIMASA boss is a responsible and respectable Ijaw leader, who has never been known to engage in violent and senseless actions. He has over the years, in the public service record and private life, promoted peaceful coexistence among different ethnic nationalities. “Ijaw tradition is against engaging in human sacrifices for whatever purpose, such actions are alien to Ijaw people and the publication is a deliberate falsehood. “Therefore, the negative remarks made against the former NIMASA boss are the handiwork of those who are promoting senseless inter-communal crises and killing of military officers to divert attention. “Again, there was no time members of Okoloba community, led by the former NIMASA boss, attacked indigenes of Okuama community and killed anyone. “All the allegations are unfounded, which are aimed at attributing blame to the wrong persons for the senseless killing of military officers in Okuama community. “We, therefore, call on security agencies to investigate the source of the fake publication. Soldiers never burnt the Egbesu shrine “Additionally, the publication alleges that the Nigerian Army went to Okoloba community to burn down the Egbesu Shrine. “We say there was no such incident and there is no reason to do so. That is the handiwork of the bloodthirsty and warmongering Okuama people. “The claim that the tradition in some Ijaw communities requires that the mother of a king must be of Urhobo origin is a big lie! This is false and far from the truth. There is no such tradition in any Ijaw community. “We, however, unequivocally condemn the gruesome killing of the 17 soldiers and joined the call for a comprehensive investigation to bring the perpetrators to justice.’’ Speaking at the media chat, the Chief of Army Staff, Lt. Gen T. A. Lagbaja, said the actions of non-state actors aiming to undermine the security, welfare, and overall prosperity of the country would be significantly diminished, and almost nonexistent without the collaboration of certain unpatriotic and unscrupulous individuals. Lagbaja, who was represented by the General Officer Commanding, GOC, 6 Division/ Land Component Commander, Joint Task Force, South-South Operations, Delta Safe, Major Gen. Oborevwori should speak to Deltans on Okuama/Okoloba incident – Dr Ughwanogho In a similar development, former governorship candidate in the state, Dr. Ovie Ughwanogho, has urged the governor, Sheriff Oborevwori, to address the state on update around the Okuama and Okoloba boundary dispute that resulted in the killing of 17 soldiers Ughwanogho, on his Facebook wall, said: “The governor of Delta State should, without further delay, address the people of the state on the security situation in the state, particularly as it relates to the crisis in Okuama and Okoloba. “The state belongs to all of us, and in a crisis like this, the leadership must keep the people informed of what is happening and the efforts being made to resolve the issues. “A state-wide broadcast by the governor will be reassuring and will have the effects of reducing misconceptions and anxieties. •Says it is worse than corruption The Founder and President of Anap Foundation, Mr. Atedo Peterside, has urged Nigerians to rise up against perpetrators of state capture who according to him, had deprived over 200 million Nigerians the opportunity to enjoy a Nigerian that could work for their advancement and progress. Peterside, made the call yesterday, in Lagos when he delivered a keynote address at the 4th Nigerian Leadership Colloquium in Honour of Pastor Ituah Ighodalo’s 63rd Birthday with the theme “Mistakes Nigeria Made.” He described perpetrators of state capture as public officials and business elites that believed that it was their divine right to corner all the resources of the country and leave the rest of the citizens with handfuls of crumbs. He stated that the dangerous thing about state capture, which made it worse than corruption, was that it could be achieved and sustained through legal and constitutional instruments. Peterside said: “We must not give up. Those of us who are not beneficiaries of state capture must make it a priority to fight for the rights of 200 million Nigerians. “In the meantime we must hold every public officer accountable. Think about it, if we just leave them alone, no whistle blowing, no pressure on them; they will even capture more of the state. “The rest of us who are not part of that state capture must constantly get involved in whistle blowing and shouting to the high heavens. It is like holding their feet to the fire. If we do not hold their feet to the fire there will be no change. “The real enemies are those that are involved in state capture. You can be in APC, PDP or Labour Party and still be my enemy if you are involved in state capture. “In 2012 when the economy was buoyant they bought Toyota Camry. But in 2023 when the economy has tanked they went for luxury SUVs. It is the same mindset of state capture of people believing that they can capture what they can and the rest of us cannot do anything about it. “The point I am making is that those who are enemies of state capture must organise the opposition to be genuinely against state capture.” He added: “Our task is to seek and encourage the few leaders whose sense of patriotism goes beyond seeking their share of the spoils. “Indeed we must identify and celebrate the handful who continue to insist that their priority will remain seeking the greatest good for the greatest number of Nigerians. “We must learn to put our trust in persons who still exhibit genuine belief in social justice and encourage them to deploy both modern and traditional tools to expand their networks and spread across the nation.” The Chairman of the occasion, General Ike Nwachukwu (rtd), posed 38 questions that required genuine attentions in considering and proffering solutions to the “Mistakes Nigeria Made.” Some of these questions included, “was our unwillingness to renegotiate Nigeria’s continued existence as a country a mistake?” Nwachukwu added: “I believe that the solutions to Nigeria’s and its people’s problems will emerge when we candidly address and answer these questions and many more that will emerge from this colloquium. “And I also believe that from these answers will come, quite easily, the will to do right by all manner of peoples and interest groups that form the main ingredients of the Nigerian state and country. “The 2014 National Conference did. That is why all the delegates by consensus made the crucial recommendations to salvage Nigeria. And I strongly recommend that we do not set them aside. “Only by courageously facing the truth can Nigerians and Nigeria begin to heal from the mistakes and hurts of the past and commence the transformation to a better future.” In his contribution as one of the discussants, Dr. Reuben Abati of ARISE TV News, said Nigeria needed to capture its youths via education in order to have youths that could compete in the future. Abati said: “We need to capture the youth population via education in a world that has become competitive. This should be a national priority and a national emergency so that we can have youths that can compete in the future.” Another discussant, Professor Olubukola Oyawoye, said Nigeria’s greatest mistake was that, “we have not outlined our vision and our mission.” The Celebrant, Pastor Ighodalo, said honest conversation was the only thing that could change Nigeria. Chairman of the Economic and Financial Crimes Commission, EFCC, Ola Olukoyede, has dismissed insinuations that the agency is only going after internet fraudsters, popularly known as “Yahoo boys’. Olukoyede assured that he will lead a broad-based and holistic anti-graft war that would not spare anyone linked with any form of economic and financial crimes. The EFCC boss stated this in a statement by the agency’s spokesperson, Dele Oyewale, on Monday in Abuja. He gave the assurance in Abuja at an Anti-Corruption Concert organized to create greater awareness and public involvement in the fight against internet crimes. Olukoyede reaffirmed his commitment to an all-embracing, fully-integrated war against corrupt practices. “We will not spare anyone. We will not spare the mega thieves. As we are doing the mega, we will also do those at the lower end. “In the last two months, we have arraigned two former governors. So, it is not true that we are only focused on internet fraudsters. “Of course, internet fraud is bad enough but our focus is on every form of economic and financial crimes,” he said. But the clearest indication yet that the quest may translate into reality is a ‘Bill for an Act to Alter the Provisions of the Constitution of the Federal Republic of Nigeria to Provide for the Establishment of State Police, and Related Matters’ currently in the works in the House of Representatives. Meanwhile, the Bill is stoking controversy even as insecurity across the country continues to worsen. No fewer than 500 people including schoolchildren were abducted in Borno, Kaduna and Sokoto states over the past three weeks but some of them have been freed and reunited with their families. Only last week, Governor Dauda Lawal of Zamfara State lamented that his state was under siege and solicited President Bola Tinubu’s assistance. Lawal spoke during a visit to the Presidential Villa in Abuja. Whereas the Bill gives sweeping powers to the President to direct the Inspector General of the Federal Police in enforcing security, in what amounts to a bombshell, governors won’t have such sweeping powers over State Police if the Bill passes the Senate hurdle and becomes law after the President’s assent. The Bill provides that the Commissioner of Police of a state, notwithstanding that he is the appointee of the state governor, may refuse to carry out the governor’s order if he deems the order to be unlawful. In such circumstances, however, the Bill provides for intervention by the State Police Service Commission whose position shall be final. The decision of the President and governors in favour of State Police was in response to the increasing wave of insecurity in Nigeria occasioned by the activities of kidnappers, bandits and terrorists. Promoters of State Police believe that putting the police under governors’ control in their respective states would give them the leeway to stem insecurity. Anarchy But critics say that may be the road to anarchy as partisan governors could turn the police under their control into a political machine and use them against their opponents. There is, however, a counter position: A partisan President too under the current dispensation can politically deploy the police and use them against his opponents; so if that is the case, analysts argue, there is nothing wrong in having State Police so long as insecurity is gone. Under the 1999 Constitution (as Amended), the police are on the Exclusive List, that is, only under the control of the Federal Government. Analysts say the central control of the police from Abuja impinges security in so far as the Commissioner of Police takes directives from the Inspector General of Police (IGP) in Abuja and not the Governor of his state. In essence, they want the police in the Concurrent List. Discussion Information Minister and National Orientation, Mohammed Idris, who disclosed Tinubu and the governors’ favourable disposition to State Police after their meeting in Abuja, late last month, said they considered “the possibility of setting up State Police.” “Now, there is also a discussion around the issue of State Police. The federal and state governments are mulling the possibility of setting up State Police,” Idris said. According to him, attendees at the meeting agreed on the need for State Police but more discussions are still needed on how to implement it”. The ‘Bill for an Act to Alter the Provisions of the Constitution of the Federal Republic of Nigeria to Provide for the Establishment of State Police, and for Related Matters’ recently passed second reading in the House of Representatives. The Bill, sponsored by Hon. Benjamin Okezie Kalu and first introduced in the House on November 7, 2023, is co-sponsored by 13 other lawmakers spread across the nation’s six geo-political zones. The co-sponsors are Hon. Julius Ihonvbere, Hon. Onanuga A. Oriyomi, Hon. Joseph Bassey, Hon. Ibe Olwara-Osonwa, Hon. Thaddeus Attah, Hon. Joshua Audu Gan, Hon. Hassan B. Shinlmfi, Hon. Chinwe Clara Nnabuife, Hon. Obed Paul Shehu, Hon. Fatima Taiba, Hon. Tolani Shagaya, Hon. Abubakar H. Nalaraba and Hon. Blessing Onuh. Clause 13 Clause 13 of the Bill provides that Section 215 of the 1999 Constitution as amended be altered to give the President the power to appoint the Inspector General of the Federal Police on the advice of the National Police Council from among serving members of the Federal Police, subject to confirmation by the Senate, while State Police shall be headed by a Commissioner of Police who shall be appointed by the Governor of the State on the advice of the Federal Police Service Commission from among serving members of the State Police subject to confirmation by the State House of Assembly. But while giving sweeping powers to the President to direct the Inspector General of the Federal Police without question, it provides that where the Commissioner of Police of a state has reason to question the legality of any directive by his governor, the State Police Service Commission shall intervene and its position shall be final. Clause 13 of the Bill reads: “Section 215 of the Principal Act (1999 Constitution as Amended) is amended by deleting the existing provisions and inserting the following instead thereof as the new: “Appointment of Inspector-General of Police and the Commissioner of Police of a State: “215. (1) The Federal Police shall be headed by an Inspector-General of Police who shall be appointed by the President on the advice of the National Police Council from among serving members of the Federal Police, subject to confirmation by the Senate. “(2) The Federal Police shall be under the command of the Inspector General of Police, including contingents of the Federal Police stationed in a State. “(3) The President or such other Minister of the Government of the Federation as he may authorise on that behalf may give to the Inspector-General of Po1ice such lawful directions concerning the maintenance and securing of public safety and public order as he may consider necessary, and the Inspector-General of Police shall comply with those directions or cause them to be complied with. “(4) A State Police shall be headed by a Commissioner of Police who shall be appointed by the Governor of the State on the advice of the Federal Police Service Commission from among serving members of the State Police subject to confirmation by the State House of Assembly. “(5) The Governor or such other Commissioner of the Government of the State, as he may authorise on that behalf, may give to the Commissioner of Police such lawful directions concerning the maintenance and securing of public safety and order as he may consider necessary, and the Commissioner of Police shall comply with those directions or cause them to be complied with Provided that where the Commissioner of Police feels that the direction given under this subsection is unlawful or contradicts general policing standards or practice, he may request that the matter be referred to the State Police Service Commission for review and decision of the State Police Service Commission shall be final”. Clause 12: Creation The major highlight of the Bill in Clause 12 is the amendment of Section 214 of the 1999 Constitution of the Federal Republic of Nigeria (as Amended) to create a State Police and give it roles separate from the Federal Police. The Clause reads: “Section 214 of the Principal Act (Constitution) is amended by deleting the existing provisions and inserting the following instead thereof as the new: Section 214 – ‘Establishment of Federal and State Police’. “214. (I) The following bodies are established: (a) The Federal Police; and (b) State Police. (2) The National Assembly shall by an Act prescribe for the structure, organisation, administration, and powers of the Federal Police and provide the framework and guidelines for the establishment of State Police. (3) The Federal Police shall – (a) Be responsible for the maintenance of public security, preservation of public order and security of persons and property throughout the Federation to the extent provided for under this Constitution or by an Act of the National Assembly; and (b) Be responsible for the maintenance of public security, preservation of public order and security of persons and property within a State to the extent that the State has power to make laws under this Constitution. (4) Subject to the provisions of this Constitution, the Federal Police shall not interface with the operations of any State Police of the internal security affairs of a State except- (a) To contain serious threats to public order where it is shown that there is a complete breakdown of law and order within a State and the State Police is unable to contain the threat; (b) Where the Governor of a State requests the intervention of the Federal Police to prevent or contain a breakdown of law and order in the State; and (c) Where a State Police is unable to function owing to administrative, financial or other problems which render it inoperative at a given time: Provided that any intervention under this subsection shall only be made after approval by two-thirds majority of the Senate”. Removal from office Clause 14 of the Bill also proposes the amendment of Section 216 of the Constitution to outline the process through which the Inspector-General of the Federal Police and the Commissioner of State Police can be removed from office. It says: “Section 216 of the Principal Act is amended by – (a) Deleting the existing provisions and inserting the following instead thereof as the new Section 216 – ‘Removal of Inspector-General of Police and the Commissioner of Police of a State” “216 (1) An Inspector-General of Police shall only be removed by the President upon the recommendation of the National Police Council praying that he be so removed on any of the following grounds – (a) Misconduct in the discharge of his official duties; (b) Breach of Police Act, Regulation, Code and Code of Conduct; (c) Conviction of any offence involving fraud or dishonesty by a court of law or tribunal; (d) Bankruptcy; or (e) Mental incapacity. (2) The removal under Subsection (1) of this Section shall be subject to approval by a resolution of a two third majority of the Senate. (3) A Commissioner of Police of a State shall only be removed by the Governor upon the recommendation of the Federal Police Service Commission praying that he be so removed on any of the following grounds- (a) Misconduct in the performance of his official duties; (b) Breach of policing standards, law, Regulation, Code and Code of Conduct; (c) Conviction of any offence involving fraud or dishonesty by a court of law or tribunal; (d) Bankruptcy; or (e) Mental incapacity. (4) The removal under Subsection (3) of this Section shall be subject to approval by two-thirds majority of the House of Assembly of the State.” Challenged police In his introductory remarks to the Bill, the sponsor, Hon Kalu, had said: “In recent times, our collective security has been greatly challenged. “Nigeria, a federation of 36 States and the Federal Capital Territory, with 774 LGAs, over 250 ethnic nationalities, more than 200 million citizens and a vast terrain spanning over 920,000 square kilometres, still sadly operates a single, centralised police system that employs less than 400,000 police officers and men. “There is no gainsaying that the nation’s security architecture is under immense pressure and always overwhelmed. “We must acknowledge the fact that the fabric of any democracy is woven with the threads of constant adaptation to the evolving needs of its society. “At this point in our nationhood, State Policing is not only inevitable but urgently desired to tackle the mounting challenges of insecurity. “This Bill emerges as a necessary response to several calls for a decentralized and community-oriented approach to law enforcement. “It seeks to navigate the complex landscape of security challenges by empowering our states with the means to address issues unique to their localities. “This proposed alteration represents not just a legal adjustment to our ground norm, but a visionary leap towards a safer, more secure, and harmonious Nigeria. Key provisions “The Bill, which comprises 18 clauses, seeks to alter Sections 34, 35, 39, 42, 84, 89 and 129 of the Constitution of the Federal Republic of Nigeria 1999 (As Altered). “It also seeks to alter Sections 153, 197, 214, 215 and 216 of the Constitution. Furthermore, the Bill seeks to alter Chapter VI Part III, Second Schedule, Part II of the Third Schedule and Part Ill o f the Third Schedule of the Constitution as well. “Among others, some of the key innovations of this proposed alteration include – (a) The transfer of ‘Police’ from the ‘Exclusive Legislative List’ to the ‘Concurrent Legislative List”, a move that effectively empowers States to have State controlled policing; (b) The introduction of a comprehensive framework to ensure cohesion as well as accountability and uniform standards between the Federal Police and State Police; (c) The provision of prescribed rigorous safeguards preventing unwarranted interference by the Federal Police in State Police affairs, emphasising collaboration and intervention only under well-defined circumstances; (d) The establishment of State Police Service Commissions as distinct from the Federal Police Service Commission with clearly defined roles and jurisdictions; (e) A re-calibration of the National Police Council to include the Chairmen of the State Police Service Commissions, emphasising the collaborative and consultative nature of policing in our federal system; (f) A recognition of the possible financial challenges which may be faced by States Police, by empowering the Federal Government to provide grants or aids subject to the approval of the National Assembly, thus ensuring adequate resources for effective policing, etc”. The Director of Banking Services, Central Bank of Nigeria (CBN), Hamisu Abdullahi has said Remita was selected to provide an electronic platform essential for facilitating payments from Ministries, Departments, and Agencies (MDAs) to beneficiary accounts across commercial banks. Abdullahi made this assertion when officials of the apex bank appeared before the House of Representatives Public Accounts Committee Thursday, to respond to queries about Remita’s operation of the Treasury Single Account (TSA) platform. The hearing was presided over by Bamidele Salaam, Chairman of the House Committee on Public Accounts. Salaam had said, “The investigation is not a witch-hunt targeting any company but rather a crucial step towards transparency and ensuring accountability for the federation’s revenue.” According to Abdullahi “The CBN was directed to provide an electronic platform that would facilitate payments on behalf of MDAs to beneficiaries accounts in the commercial banks. “CBN deemed it fit to source for an alternative way of doing this and engaged two companies and out of the two, Remita, was selected based on merit and based on the fact they had been rendering similar services to commercial banks.” In a previous report, Salawu Zubairu who was Director of the Office of the Accountant General of the Federation (OAGF) had said that Remita was chosen as the preferred platform to manage the TSA after a rigorous evaluation process that included other candidates like the Nigerian Inter-Bank Settlement System (NIBSS). The selection, steered by a joint evaluation committee’s competitive presentations and deliberations, was based on Remita’s superior capabilities in handling TSA’s electronic payments and collection of government receipts, satisfying all the stringent requirements of the Office of the OAGF, the CBN, and their external consultants. The Managing Director of Remita Payment Services Limited, Mr. ‘Deremi Atanda, also highlighted the previous system’s shortcomings, where government agencies independently received funds and arbitrarily decided the timing and amount of operating surplus to remit, a practice that has been streamlined by the TSA. “There has been an evolution and it has been positive for the country on account of TSA. Some things that started manually have now become automated. What MDAs were doing was that they were receiving inflows and at their instance determine what is operating surplus when to they remit,” he said. Mr Atanda said the “TSA initiative is designed to create a single window through which all inflows and outflows of government can be monitored in real-time for transparency and accountability and especially for the effective management of the government’s cash assets”. The Director-General of the Bureau of Public Service Reforms, Dr. Dasuki Arabi, had in the past reported that the TSA has been instrumental in uncovering and removing approximately 70,000 non-existent employees from the civil service payroll. Nationwide darkness hit Nigeria as the national grid collapsed for the fourth time in 2024 amid the Easter holidays. According to sources from electricity distribution companies in Nigeria, the grid collapsed around 4:30 pm on Thursday. Kunle Olubiyo, the president of Nigerian Consumer Protection Network confirmed the grid collapse to DAILY POST. DAILY POST learnt that power went off around 4:30 pm on Thursday in Apo, Dawaki, and Utako. The implication is that millions of homes and businesses centrally managed by Osogbo, Osun State, are without power from the national grid. As of the time of filing this report, Discos said their feeders were rendered inactive, resulting in widespread blackouts nationwide. As of 6 pm, the Azura Power Plant was the sole facility contributing to the grid, albeit with a modest output of 54 megawatts. Major power generation plants such as Egbin, Afam, Geregu, Ibom Power, Jebba, Kainji, Odukpani, and Olorunsogo, among others, remained dormant, further exacerbating the electricity deficit nationwide. The grid’s output, which stood at 2984 megawatts as of 4 pm, plunged to zero within an hour, with all 21 plants connected to the grid ceasing operations by 5 pm. DAILY POST recalls that the grid collapsed on February 4, 2024. Nigeria’s national grid, managed by the Transmission Company of Nigeria, TCN, collapsed 46 times between 2017 and 2023. President Bola Tinubu on Wednesday established a 31-man Presidential Economic Coordination Council comprising himself, the Vice President, Senate President and the Chairman of the Nigerian Governors Forum, among others. Tinubu also established a 19-member Economic Management Team Emergency Taskforce which he mandated to meet twice weekly and submit a six-month comprehensive plan of economic interventions for 2024. The Economic Management Team Emergency Taskforce was approved by the Federal Executive Council on Monday The plan, covering the next six months, would be due for immediate implementation within two weeks of the EET’s inauguration, the President directed. The EET comprises ministers, four governors and some members of the economic management team as well as the private sector. The EET is to report to the Presidential Economic Coordination Council headed by Tinubu. The PECC comprises 13 ministers, the Central Bank of Nigeria Governor, Yemi Cardoso, and the Chairman of the Nigeria Governors’ Forum, Governor Abdulrahman Abdulrazaq of Kwara State, among others. The council also includes 13 persons drawn from the organised private sector including Chairman of Dangote Group, Aliko Dangote; UBA Chairman, Mr. Tony Elumelu; BUA Founder, Abdulsamad Rabiu, among others. The members of the organised private sector would serve on the council for a one-year tenure. Tuesday’s move is “in furtherance of his administration’s efforts at re-engineering the nation’s economic governance framework,” the Presidency said in a statement signed by Tinubu’s Special Adviser on Media and Publicity, Ajuri Ngelale. The statement is titled ‘President Tinubu establishes comprehensive economic coordination and planning system for Nigeria.’ It comes weeks after the President created an economic advisory committee comprising the federal government, sub-nationals and the private sector, on February 25. Upon assuming office 10 months ago, the Tinubu administration discontinued subsidies on petrol, which, he said, would save the government monies for infrastructural expansion. He also unified the foreign exchange rates to curb currency arbitrage. However, these moves sparked major instability in the value of the naira and heaped hardship on Nigerians as food prices soared. In February 2024, N1,900 was exchanged for one USD in the black market. The naira has recently seen a steady climb against the US dollar, exchanging N1,300/$ at the official market on Wednesday. Ngelale who announced the economy-focused initiatives said the setting up of the PECC and the EET was a strategic move to ensure robust and coordinated economic planning and implementation to tackle the challenges head-on. On the operations of the EET, the Presidency said “Over the next six months, the EET will focus on the rapid implementation, monitoring, and evaluation of critical initiatives, strengthening the Tinubu-led administration’s collective approach to advancing Nigeria’s economic objectives.” It also revealed that the Economic Management Team, established in October 2023, and chaired by the Coordinating Minister for the Economy and Minister of Finance, Wale Edun, would serve as the working group under the PECC, “playing a crucial role in the economic governance structure established by the president.” Consequently, the Economic Management Team, which traditionally meets monthly or as required, will suspend all meetings for the duration of the EET’s six-month mandate. The EMT comprises the Coordinating Minister for the Economy and Minister of Finance, who served as its Chairman, Governor of the Central Bank of Nigeria, Minister of Budget and Economic Planning, Minister of Industry, Trade and Investment, Minister of Communications, Innovation and Digital Economy, Minister of Works, and Minister of Labour and Employment. The crisis rocking the Labour Party, LP, took a dangerous dimension last week, with members of the Nigeria Labour Congress, NLC, picketing the party’s national secretariat and some of its state offices. There are also indications that the presidential candidate of the party in the 2023 election, Peter Obi and his supporters known as Obidients have abandoned the party’s National Chairman, Julius Abure to his fate. This is not unconnected to the internal crisis that has been rocking the party structure since the 2023 general elections was concluded. After a series of legal battles with the factional chairman of the party, Lamidi Apapa, Abure has been in the news over alleged financial impropriety and other disturbing issues. Abure’s unending alleged financial scandals DAILY POST recalls that Peter Obi in February 2024, called for a thorough and forensic investigation into an embezzlement allegation level against the party’s chairman, Abure. The call by the former Anambra Governor was in response to allegations earlier made by Oluchi Oparah, the national treasurer of the party, accusing Abure of allegedly misappropriating N3.5 billion. Oparah also alleged that the Abure-led National Working Committee, NWC, was working hand-in-hand with the Edo State Government and the opposition Peoples Democratic Party, PDP, ahead of the September 2024 governorship polls. Similarly, in a letter signed by Comrades TItus Amba and Chris Uyot, the chairman and the secretary of NLC Political Commission, the party expressed concerns over recurrent scandals and pending cases of fraud. Labour Party administration under Abure Abure was recently accused by some stakeholders of the party, including the Nigerian Labour Congress, NLC, of running the LP as a “sole administrator.” DAILY POST recalls that the Deputy President of the NLC Political Commission, Dr Theophilus Ndubuaku, who spoke when the workers occupied the Labour Party headquarters in Abuja recently, said the decision to picket the party’s headquarters was taken to express workers’ grievances against Abure’s style of leadership. He said,”Now, it is in the hands of this usurper, he is looking for N30 million, N40 million, and so on to buy forms, excluding the people who founded the party. Enough is enough, Abure must go,” said the acting General Secretary of NLC, Comrade Bello Ismail on the cost of governorship interest and nomination forms. Similarly, in a letter issued by Comrades TItus Amba and Chris Uyot, the chairman and secretary of NLC Political Commission, respectively, the union also knocked Abure for not being committed to the ideology of the Labour Party. Controversial national convention The embattled LP Chairman was in the news recently again over his alleged plan to hold National Conversation without due processes. DAILY POST reports that the Abure-led National Working Committee, NWC, was accused of planning to hold the national convention of the party in Umuahia, Abia State capital on March 27. The planned convention was captured in a notice issued to the Independent National Electoral Commission, INEC, on March 13. The move was, however, rejected by critical stakeholders, such as the House of Reps Caucus and the NLC, leading to the recent picketing of the party’s secretariat last week. Recall that the Nigeria Labour Congress Political Commission – the political wing of the NLC, had in an open letter dated March 15, condemned the planned convention. While demanding for the immediate resignation of Abure, the commission described the plan as illegal, noting that it would not allow any form of illegality in the affairs of the party to stand. A source who spoke to DAILY POST on Saturday on condition of anonymity, alleged that Abure’s intention was to impose leadership on the party. He said major stakeholders in that party were against the March convention, stressing that the party needs more time to select its leaders. “Everybody in the party including our leader, Peter Obi is tired of Abure’s leadership. If we are not in court today, we will be in the news for one allegation or the other. “The time we need to use to prepare for elections like the ones coming up in Edo and Ondo is used in settling disputes. “Abure knows that everyone wants him out and the next thing he wants to do to remain relevant in the party is to impose a chairman on the party. “How can you be talking about conventions and stakeholders of the same party are not even aware? The Labour Party is not Abure’s personal company”, he said. Search for new chairman begins DAILY POST gathered on Saturday that a former Deputy National Campaign Manager to Peter Obi/Dati Presidential Campaign, Comrade Isaac Balami from the Northern region may take over from Abure. An insider told DAILY POST that some party leaderships and chieftains have had a meeting and suggested Belami as the next National Chairman of the party. When contacted, Balami told our correspondent on the phone that he was “under pressure to run for the chairmanship of the party”, but that there are issues on ground still stopping his declaration. According to him, he doesn’t even know whether the convention will be held as scheduled as “there are forces fighting against the unity and progress of the party”. “But then, I can’t refuse or turn down a request coming directly from the youth constituency of the party. “You know they were instrumental to the change in the political narrative and advancement of the Labour Party in the last election, so we can’t joke with their position. “I truly appreciate their commitment to the success of our party and I won’t take their call for granted. ”In a couple of hours, we shall make our final decision on this matter.” DAILY POST reports that the former All Progressives Congress, APC, chieftain had prior to the 2023 general elections, dumped his party for the LP, saying he believed in the ideology of the party and its candidate, Mr Peter Obi. Speaking on the controversy surrounding the convention, Dr Yunusa Salisu Tanko, Chief Spokesperson for the Labour Party Presidential Campaign Council for the 2023 election, told DAILY POST on Saturday that Abure failed to carry the stakeholders of the party along in the planned convention. He said, “all we want is for us to build a political party we all will be proud of. A part that will represent the interest of everybody. “We have all that it takes to build the structure of the party. That is the best thing that can happen to us as a party. “We don’t want a closed convention like the Chairman is trying to have. Because it is likely going to be a closed convention instead of an open convention and that is not good for us. “Many people did not even know that there was going to be a convention. I was not aware of the convention too. I saw it in the newspaper just like any other person. “This is what NLC is also saying. Nobody is against any particular person but for us to have a convention that all of us will be proud of. Peter Obi has also said that the convention should be open for everybody.” Asked to clarify the viral report purporting Peter Obi’s decision to dump the Labour Party ahead of the 2027 presidential elections, Tanko simply said, “It is not true. A former Minister of Information and National Orientation, Alhaji Lai Mohammed, has recounted how fake news circulated on social media nearly destroyed his 40-year-old marriage. The ex-minister shared his story during an event in Lagos commemorating Prof. Wole Soyinka’s 90th birthday, where he discussed “The Media in the Age of Disinformation.” The text of Mohammed’s presentation was made available to the News Agency of Nigeria (NAN) on Saturday. Mohammed, also serving as the Managing Partner of Bruit Costard, a lobbyist and public relations firm, reflected on one of the significant challenges he encountered during his tenure as minister: the rampant spread of fake news, misinformation, and disinformation. Mohammed emphasized that fake news, disinformation, and misinformation nearly destroyed his marriage, highlighting their extensive consequences. He said, “Permit me to share publicly with you today for the first time, how social media threatened the foundation of my 40-year-old marriage. “It was sometimes in 2018 when I came to Lagos from Abuja for an official assignment. “As usual, I retire to bed about midnight, but about 3 am., my wife gently roused me from my slumber. “At first, I panicked, fearing that there had been a security breach, but my wife’s mien belied that possibility, for she was calm and composed.” He continued: “Solemnly, my wife asked me if I was fully awake as there were some serious issues to discuss. “I could not fathom what was that urgent or serious to warrant being woken up at this time of the night. “My mind immediately did a kaleidoscope of my rascalities and escapades in the last few months”. Mohammed said the accusation from his wife was “a bombshell” and was narrated to him in Yoruba language. He presented the narration as follows: “Daddy, death can come knocking at any moment, please let me also, as your wife, be a signatory to your overseas account in Ali Financial which contains 1.3 billion dollars.” The ex-minister expressed disbelief that his wife fully believed the false story circulating about government officials, including himself, supposedly having large sums of money in overseas accounts during former President Muhammadu Buhari’s administration. “I spent the next two hours or so, sweating to convince my wife that there is no iota of truth in the allegation. “I had to fetch a calculator and reproduce the Federal Appropriation Act for 2015, 2016, 2017 and 2018 in the middle of the night and explain to her why it is simply p reposterous for me to have 1.3 billion dollars in a foreign account. “I explained to her that there is no year my capital budget exceeded N5 billion, which then, at about N400 to a dollar, was just 12.5 million dollars. Mohammed added: “My wife insisted that the whole world believed the story and that her friends had, as a result, besieged her with all kinds of requests. “She said every effort on her part to deny the existence of this foreign account only succeeded in depicting her in the minds of her friends as a selfish, greedy and uncaring friend. “Is my wife truly convinced of my innocence? The answer is in the wind!. “ Mohammed reiterated that social media remained the platforms of choice for the purveyors of fake news, anti-state groups, anarchists, secessionists, terrorists and bandits. During his time in government, Mohammed remembered that his ministry uncovered 476 online publications solely dedicated to disseminating fake news against the previous administration of President Buhari. Mohammed specifically remembered the fake news claiming that the former president had passed away while undergoing treatment in a London hospital and had been replaced by a clone named “Jubril from Sudan.” According to Mohammed, the problem of fake news persisted through the campaigns leading up to the 2023 general elections, during which President Bola Tinubu became a target. Videos and speeches attributed to him were manipulated and distorted to spread false information. He mentioned that those spreading fake news were persistent in their attempts to undermine the commendable policies and programs of Tinubu’s administration. Mohammed highlighted how fake news had grown drastically due to the use of Artificial Intelligence and deep learning techniques, enabling the creation of highly realistic fake or manipulated videos, audio recordings, or images. “The consequences of disinformation and misinformation are far-reaching. “They undermine democratic processes, sow discord within communities, and pose significant threats to public health and safety. “Today, even the media is at risk of losing its credibility because of the proliferation of fake news on Social Media “Therefore, the media, as custodians of the public trust, must take decisive action to combat the scourge of disinformation and misinformation,” he said Mohammed asserted that social media platforms and other intermediaries, accountable for amplifying disinformation and misinformation, should bear responsibility. He advocated for the implementation of robust regulatory frameworks to monitor and curb the spread of false information while preserving freedom of expression. He urged social media platforms to prioritize the integrity of information above profit motives.
