Any offence that attracts the death penalty is generally known and termed a capital offence. This term was derived from the Latin word 'capitalis' which referred to execution by beheading. Although some countries have kicked against this form of punishment claiming that it is unfair, it is however still applicable in Nigeria. Section 33 of the Nigerian Constitution guarantees every citizen's right to life except where a court sentence has been issued in respect of a criminal offence that a person been found guilty of. In this article, we would examine the different examples of capital offence in Nigeria. Some include: 1. Murder: Also referred to as homicide, it involves the killing of another person in a manner not justified by law. Section 319 of the Criminal Code prescribes the death penalty as punishment for murder [color=#d7e0c9].[/color] There are certain situations where killing a person would not be unlawful. Where a police officer shoots an escaping suspect, or where the millitary kills terrorists, it will not be murder. 2. Armed robbery: This refers to committing the act of stealing by a person carrying a dangerous weapon. It does not matter if such weapon was brandished or used. Section 402 provides that a person guilty of armed robbery is to be sentenced to death. 3. Treason: An attempt by a person to overthrow a government he or she is subject to is called treason. Section 37 of the Criminal Code prescribes the death penalty as punishment for treason. 4. Conspiracy to commit treason: Section 37 of the Criminal Code also prescribes the death penalty as punishment for anyone who conspires to commit treason. This could be by supplying weapons to overthrow a government, giving information to an enemy of the government or by doing any other act against one's allegiance to the government. Other offences punishable by death include: 5. Fabricating false evidence leading to the conviction of death of an innocent person 6. Barcelona new manager, Xavi Hernandez, is reportedly set to get rid of three players in the January transfer window. Xavi was appointed as Barcelona’s new manager last Friday following the sacking of Ronald Koeman last month. The former midfield maestro was unveiled by Barcelona on Monday at Camp Nou. The 2010 World Cup winner signed a two-and-half-year deal with Barcelona after saying his goodbyes to Qatari side, Al-Sadd. According to Fichajes, the three players Xavi wants Barcelona to offload are Samuel Umtiti, Luuk de Jong and Neto, as he looks to bolster his squad. The report added Xavi has communicated his plans to sell the trio to Barcelona president Joan Laporta, hoping that their sales would create room on the wage bill to bring in a few players of his liking. Umtiti has been pretty much out of favour since last season, De Jong was Koeman’s signing and has struggled to contribute so far in his tenure at Barcelona, while Neto has no chance of usurping goalkeeper Marc-Andre ter Stegen at Camp Nou. The E naira is the first digital currency to be launched in Nigeria. Just days after the app was made available on the google play store, it has been reported to have been taken down. According to the Cable NG, the reason for the removal from the play store app was because it was said to violate policies. Many Nigerians gave negative reviews about the app after encountering problems during registration. These problems were what caused the poor ratings and eventual removal because the app couldn't meet the minimum functionality policy Although the E naira is a good innovation, seeing as it aims to facilitate digital transactions. However, there are some challenges that are bound to come up when trying to implement this digital currency. In this article, we would examine the likely problems likely to be encountered while implementing the app in Nigeria. These challenges include: 1. Cyber Threats: It is no news that the Nigerian cyber space is very vulnerable, and because of that it is easily susceptible to cyber attacks. According to Punch NG, Nigeria ranked 47th out of 182 countries on the Global Cyber Security Index for 2020 and occupied the fourth position in Africa. For the E-naira to be properly implemented, attention has to be drawn to issues of cyberspace. Otherwise, the digital currency stands at a risk of facing and falling victim of cyber attacks 2. Data privacy and protection concerns: Section 37 of the Nigerian Constitution provides for the privacy of individuals their communications, homes, etc. However, there haven't been many other laws that have been enacted to protect the personal data of Nigerian citizens. A lot of citizens are also ignorant of rights and laws concerning data protection and privacy, and the non enforcement of this worsens the issue. If steps are not taken to correct this, it will have an adverse effect on the implementation of the E-naira 3. Illiteracy: Although Nigeria has many literate citizens, there are also quite a number of people that are illiterate. Even among the number of literate people we have, not so many of them are tech savvy. This is bound to create problems in the use and enforcement of the digital currency. 4. Power supply: Many places in Nigeria have issues with electricity. For this reason, a large number of people have to opt for generators and solar electricity. This can pose a huge problem in the proper implementation of the E naira currency as it requires a need for constant power supply. 5. Internet Connectivity issues: Although Nigeria is one of the most populated countries worldwide, many areas in Nigeria have terrible internet connectivity issues. While we have quite a number of network providers, there is no guarantee that an outage will not occur. This is a major problem that can hinder the implementation of the E-naira. When a person commits an offence, it is definite for him or her to be punished. The punishment for a crime however depends on the type of offence in question, as well as the provision of the law prescribing punishment for an individual. Offences in Nigeria can be categorised into misdemeanour, felony and simple offences. Any offence that is considered to be serious and has an imprisonment term of 3 years or more is considered to be a felony. When a person is sentenced to life imprisonment for an offence, such offence is categorised as a felony. Some offences with life imprisonment prescribed as its punishment include: 1. Rape: Rape refers to the act of having unlawful sexual intercourse with a woman without her consent, or with her consent if it was obtained by fraud or misrepresentation as to the nature of the act. Section 358 of the Criminal Code Act provides that any person who commits the offence of rape is liable to an imprisonment for life, with or without caning. 2. Murder by a pregnant woman: Generally, the law provides that any person who commits murder is to be sentenced to death. However, Section 221 of the Child Rights Act provides that an alternative of a life imprisonment sentence should be meted out to her, in order to preserve the life of the unborn child. 3. Manslaughter: Manslaughter involves the killing of another person in circumstances except the ones contained in Section 316 of the Criminal Code Act. The punishment for this offence is prescribed in Section 325 of the Criminal Code to be imprisonment for life. 4. Kidnapping: As the offence of kidnapping has become very rampant in Nigeria today, the senate decided to pass a bill into law increasing the imprisonment term for kidnappers. In a recent decision of the Federal high court in Sokoto, 4 kidnappers were sentenced to death for kidnapping a business tycoon Late Abubakar Dankure in 2013. There were not many military leaders who were Generals in the Army before they became heads of states in Nigeria. Some were Colonels, Brigadier Generals, and only a sparse number were Major- Generals. Before going any further, it is necessary to be acquainted with senior ranks in the Nigerian army. Starting from the lowest, they are: 2nd Lieutenant, Lieutenant, Captain, Major, Lieutenant Colonel, Brigadier General, Major General, Lieutenant General, and General. During the Military regime in Nigeria, there were a total number of eight heads of state. They include: Aguiyi Ironsi, Yakubu Gowon, Murtala Mohammed, Olusegun Obasanjo, Muhammadu Buhari, Ibrahim Babangida, Sani Abacha and Abubakar Abdusalam. Listed below are the past Heads of states in Nigeria and their military ranks: 1. Major General Johnson Aguiyi Ironsi: Johnson Aguiyi Ironsi joined the Nigerian regiment in 1842 as a private with the seventh battalion. In 1965, he rose to the rank of a Major General. He became the military head of state in January 1966 and was killed during a coup in July that same year. 2. Lieutenant Colonel Yakubu Gowon: Yakubu Gowon was commissioned as a second Lieutenant in the Army on the 19th October 1955, his 21st birthday. He became a Lieutenant Colonel in 1966 before he became the head of state. However, by virtue of his political post, he was promoted later to the rank of General. 3. Brigadier General Murtala Mohammed: Murtala Mohammed was promoted to the rank of Brigadier General in October 1971. He was a part of the coup that brought in Yakubu Gowon, and although he wanted to occupy the post at that time, he was a junior. He became the head of state in 1975, until his assassination in 1976. 4. Major General Olusegun Obasanjo: Olusegun Obasanjo enlisted in the Nigerian Army in March 1958 due to his family's inability to send him to the university. He served as head of state in Nigeria from 1976 to 1979 before relinquishing power to civilian government. 5. Major General Muhammadu Buhari: In 1963, at age 20 he was commissioned a second lieutenant and appointed platoon commander of the second infantry battalion. He later became head of state in 1983. 6. Major General Ibrahim Babangida: During the regime of Muhammadu Buhari, Babangida became a Major General in the army. He later became head of state in 1985 until his resignation in 1993. 7. General Sani Abacha: Sani Abacha served as military head of state from 1993 until his death in 1998. According to Wikipedia, in 1993, he became the first Nigerian Army officer to attain the rank of a full military General without skipping a single rank. 8. General Abdusalaami Abubakar: He was initially in the Nigerian Air force before joining the Nigerian Army. He became head of state a day after the death of Sani Abacha in 1998. Former Premier League referee, Mark Clattenburg, has revealed that allegations made by former Chelsea midfielder, John Mikel Obi, almost made him quit. In 2012, Clattenburg was accused of racially abusing the Nigerian player.
