The Bamanga Tukur- led Peoples Democratic Party has openly condemned what it called an attempt by Rivers State governor, Rotimi Amaechi , to frustrate the police from securing the state as well as keeping law and order.

The condemnation came just as the Abubakar Baraje- led PDP splinter group described the sack of nine ministers last Wednesday by President Goodluck as an exercise meant to victimise those ministers supporting the group.

A statement signed by PDP national publicity secretary, Olisa Metuh, on Friday blamed Amaechi for allegedly frustrating the police in the state and further creating the impression that his rights as governor were being violated. Metuh’s statement reads in part: “The PDP condemns in its entirety, the manipulation of the Nigerian press by certain individuals who consider themselves above the law.

Of particular concern is the manipulation of the media by the Governor of Rivers State, His Excellency, Governor Chibuike Amaechi to mislead Nigerians and create an impression that he was barred by the Police and the Federal Government from entering the Rivers State Government House, Port Harcourt. “This distortion of facts is totally unacceptable and unbefitting of a state governor.

It is indeed condemnable that Governor Amaechi has continued to distort facts and interfere in the lawful activities of the police and security operatives ensuring law and order in Rivers State only to manipulate the media and portray himself as the victim.

“Governor Chibuike Amaechi was fully aware that based on the ruling of the courts, the police had sealed off a secretariat illegally opened by some individuals under the name, flag and colour of the PDP, consequent upon which the route leading to the structure was also closed.

“Governor Amaechi must understand that the Nigeria Police is a sacred institution which should not, in any way, be dragged into politics. In the same vein he must understand that facts are sacred and should not be distorted under any guise,” it added.

Similarly, another statement signed by the national publicity secretary of the PDP splinter group, Eze Chukwuemeka Eze, alleged that those ministers were victimised for no just cause.

He said, “The truth of the matter is that these innocent ministers were sacked because they were either nominated by us or sympathetic to our cause. We are aware that these ministers had been under surveillance and denied the necessary tools to work with – in short, they were programmed to fail immediately they were indentified with us.

“Sadly, these innocent ministers have been sacked while the most corrupt ministers whose atrocious activities are well known to Nigerians are retained.

The most pitiable case of these sacked ministers is that of our mother, the Minister of Housing, Ms Ama Pepple, whose crime was approaching Mr. President to plead with him, even kneeling down to beg him to forgive Gov. Amaechi for whatever sins he is assumed to have committed against him.

“We wish to assure these victimised ministers that their travails are temporary. They have nothing to be ashamed of; their fate is in the hands of God and their future is very bright.

“Therefore, rather than being sad, they should count themselves lucky for being part of the struggle to salvage our party and country from the hands of opportunists who are using a political party which they do not know how it was formed to torment and haunt the founders of the party and their supporters.”

The blame game between a former Federal Commissioner of Information, Chief Edwin Clark and former President Chief Olusegun Obasanjo, continued on Sunday with the former accusing Obasanjo of laying the foundation for the action of the seven Peoples’ Democratic Party (PDP) governors.
Clark, a rabid proponent of President Goodluck Jonathan’s second term ambition, was reacting to the emergence of a faction of PDP on Saturday even while the special national convention of the ruling party was ongoing at Eagle Square, Abuja.
He said, “Obasanjo is the one encouraging them; he is pushing governors (Sule) Lamido and (Rotimi) Amaechi to run in 2015, that’s where the trouble started.
“Amaechi thought because Senator Bukola Saraki used the Ni”eria Governors’ Forum (NGF) chair to contest to be President, he could also use it to become Vice-President and we have said in the South-South that we want President, not Vice-President. So, the group of governors which Amaechi has joined believes only a Northerner can be President.”
On the involvement of former Vice-President Atiku Abubakar in the walk-out and eventual formation of the ‘New PDP’, Clark said, “Abubakar said he is in PDP, not PDM but all his men are in PDM. Is that a loyal member of the party? All his followers have left. PDM was created   by Abubakar.
“Even Governor (Murtala) Nyako had boasted that they would bury the PDP. Let them go, but I can tell you that PDP will remain stronger.  They will soon know that they are alone. Abubakar has always been a disloyal person; what he is doing now is what he had done to Obasanjo.”

The new faction of Peoples Democratic Party (PDP) has been formally recognized by the Godspower Ake-led faction of PDP in Rivers state which described the emergence of the Alhaji Kawtwittere-led national leadership of the party as ‘highly commendable’.
While pledging loyalty to the new faction, the Rivers PDP stated that the coming of the new executive signaled an end to “the dark days of impunity, recklessness, confusion and division among party members.”
A statement issued in Port Harcourt, the Rivers State capital and signed by the state Publicity Secretary, George Ukwuoma-Nwogba, reads in part:
“The Peoples Democratic Party, Rivers State under the able leadership of Chief Godspower Umejuru Ake, MFR rejoices with our National Chairman, Abubakar Kawu Baraje, Dr. Sam Sam Jaja and Prince Olagunsoye Oyinlola, National Deputy Chairman and Secretary respectively. We, as a party, affirm our total support and loyalty to you and all the members of your new executive committee. Your pedigree speaks volume as true party men.
“Therefore we believe that your tenure will usher in quality and purposeful leadership in our great party. Gone are the dark days of impunity, recklessness, confusion and division among party members. Your coming at these challenging times in the life of our party is highly commendable becausethere’ss no better time than now when our party and nascent democracy is constantly drifting into anarchy.”
Meanwhile, the faction of Rivers PDP led by Felix Obuah, has called for the arrest of Governor Rotimi Amaechi for joining a parallel faction of the party.

National Chairman of the Peoples Democratic Party, Alhaji Bamanga Tukur, has sworn to deal decisively with former Vice-President Atiku Abubarkar, seven governors and other top party leaders for their roles in the formation of a parallel executive of the party. The National Chairman told journalists at the Eagles Square last night: “The PDP does not recognise any parallel party.

Those who staged the walk-out and organised a kangaroo meeting are all self-seeking and treacherous individuals pursuing neither regional nor religious agenda except their own agenda, except their own personal interest.

“Their attempt to create parallel party is illegal, unlawful as there are no crisis within the PDP whatsoever.

They were all active participants in the setting up of this convention. And many of them were with the President and rode with him to the convention venue and joined them in the salutation of all the delegates including their state delegates. “The PDP is studying the situation as it unfolds and will deal decisively as the situation warrants.

“It is obvious that they are creating crisis where there is none to give the impression that the party is divided. This in their thinking will allow them persuade loyal members of the National Assembly to cross-carpet with them.

We will resist this.” Meanwhile, the Special Convention returned five members of the National Working Committee after the counting of the votes last night.

Among the NWC members returned to their former positions are Deputy National Secretary Onwe Solomon Onwe who polled 2051 votes while Chief Olisa Metuh polled 1966 votes.

Others are National Woman Leader (2011), National Organising Secretary Mustapha Abubarkar (2125), National Legal Adviser, Victor Kwom (2053).

Other newly elected officers are Uche Secondus who is now the new Deputy National Chairman. He takes over from Dr. Sam Sam Jaja whose disqualification triggered off a walk-out by the Rivers State delegates. Dr. Jaja has joined the faction of the PDP still retaining his position.

Two other former members who could not make it at the poll are former National Treasurer Engineer Bala Kaoje who did not contest because of his academic deficiency in accountancy as required by the party constitution. Also, Alhaji Garba Umar Chiza, the former Youth Leader whose offence is said to be his relationship with his state governor, Governor Babangida Aliyu of Niger State.

THERE are strong indications that the Peoples Democratic Party (PDP) may pull out of the November 16 governorship election in Anambra State, should the court and Independent National Electoral Commission (INEC) insist on recognition for Senator Andy Uba.
The Guardian gathered Saturday that the leadership of the party has insisted on Mr Tony Nwoye, not Uba, as candidate of the party in the election, stressing that, “as far as it is concerned it has no business with Uba at least for now.”
Senator Uba, his brother Chris Uba and Ejike Oguebego were on Thursday suspended from the party by the leadership following the parallel primary, which they conducted leading to the emergence of guber candidates in Nwoye and Uba. Uba had since his rejection also by the PDP secured court orders asking the INEC and the party to recognize him as the “authentic governorship candidate,” as well as quashing his suspension from the party.
However, it was gathered that the leadership of the party, which had sent Nwoye’s name to INEC as her candidate in the election is considering ‘withdrawing from the exercise should INEC refuse to accept the name.”
A source told The Guardian, “the party is supreme than any individual; it is the responsibility of the party to present her candidate in any election and not the court or INEC. We have made our choice in Nwoye, who emerged after a thorough primary held in Awka; we cannot go back no matter what the court or anybody is saying. The worst that can happen is that we can withdraw from the election and let us see how the people who feel they own the party in the state can be governor.”
He added, “if we did it in Imo state in 2007, we can still do it now. There should be discipline in the PDP and no matter what anybody is saying, we must respect the party, not individual.”
It was further learnt that the party might be moved into expelling those who conducted the primary as a last option should they continue to disrespect the party.
On Wednesday, the leadership of the party in the southeast unanimously affirmed the candidature of Nwoye for the governorship election after her zonal meeting in Enugu. Those that attended the meeting presided over by the National Vice Chairman, Col Austin Akobundu (rtd) were the Deputy Senate President, Ike Ekweremadu, Deputy Speaker, Emeka Ihedioha, Governors Theordore Orji of Abia state and Martin Elechi of Ebonyi state.
Also in attendance were former National Chairman of the party, Chief Vincent Ogbulafor; Enugu Speaker, Eugene Odo; Senators Hope Uzodimma; Gilbert Nnaji, House of Reps member, Offor Chukwuegbo; Kema Chikwe and others.0
Zonal Publicity Secretary, Ali Odefa, said after the meeting that the party decided to adopt Nwoye based on the report of the committee it set up to conduct the primary, stressing that it had no parallel candidate for the election.

RIVERS State is back in the trenches with a fresh wave of controversies following Governor Chibuike Amaechi’s appointment and swearing in of the President of the state’s Customary Court of Appeal, Justice Peter N. C. Agumagu, as Acting Chief Judge (CJ) of the state.
Setting the tone for what to expect in the current battle, the state’s Peoples Democratic Party (PDP) chapter, led by Felix Obuah, has urged the national leadership of the party to expel Amaechi over the appointment. But a legal practitioner, Ken Atsuwete, has urged the party and others to stop politicising the appointment.
He claimed that Amaechi, acting on the apt advice of the Rivers’ Attorney General, Mr. Wogu Boms, did well in helping to sustain the profession’s ethical tradition of seniority and thereby complying with the provisions of Section 271(4) of the 1999 Constitution as amended.
On their part, however, the League of Rivers Lawyers in Abuja said that Agumagu’s swearing-in as Acting Chief Judge instead of Justice Daisy Okocha, who the National Judicial Council (NJC) recommended for appointment, was a slap on the NJC.
Chairman of the league, Mr. Timi Briggs, gave warning Wednesday in a press statement in Abuja that the judicial arm of government is independent and that its functions and processes should not be left in the hands of another arm of government for fear of abuse. According to him, this is what “Amaechi’s inordinate ambition will cause the judiciary unless he is put under check.”
Meanwhile, the Rivers State Government, through its Attorney-General and Commissioner for Justice, Worgu Bom, has exonerated Amaechi from breach of any law by the appointment, stating that it was in order because Agumagu is the most senior judge in the state’s judiciary.
He argued that Amaechi followed legal procedure in filling the vacuum that existed when the immediate past Chief Judge, Justice Iche Ndu, retired.
Media Adviser to the Rivers PDP, Jerry Needam, in a statement accused Amaechi of disregard of the rule of law and due process in the appointment, stating that it was “in clear violation of the express provisions of Section 271(4) of the 1999 Constitution.”
“We therefore totally, completely and unequivocally condemn the appointment,” the statement read. “Section 271(4) of the 1999 Constitution does not admit of discretion. It limits the position of the acting Chief Judge of Rivers State to the most senior Judge of the High Court of Rivers State, which Justice P. N. C. Agumagu is not.”
Meanwhile, the Obuah-led faction has appealed to the party’s national leadership to see the governor as a danger to democracy and the sustenance of rule of law, and therefore must be expelled from the party.
But Atsuwete faulted the PDP’s stance, contending that appointments in the bar and the bench are procedural and the first point of procedure is seniority, hence the popular use of the word “Senior” in the legal profession. According to him, the implication is that a junior lawyer/judge cannot be appointed to lead or preside over a senior.
He explained: “Justice P. N. C. Agumagu was called to the bar in 1975 while Justice D. Okocha was called to the bar in 1979. Clearly, Justice Agumagu is senior to Justice Okocha with over three years.
“It is also factual and we beg to be contradicted that Justice Agumagu was duly appointed as a judge of the High Court of Rivers State in 1991 and he had successfully discharged the duties of a High Court Judge for well over 12 months before Justice Okocha was appointed a judge of the same High Court.”
Bom agreed with this, saying: “Justice Agumagu is the oldest judge (in terms of service) now in Rivers State. There is no judge older on appointment than he is and he was appointed a High Court Judge, never a Customary Court Judge. I sit as a member of the state Judicial Service Commission, the papers there reveal that he was seconded to go and establish the Customary Court of Appeal and the law establishing the Customary Court of Appeal states clearly that the President of that court comes after the Chief Judge of the state. So whichever way you are going to look at it, he is the oldest judge now in our judiciary.
Nevertheless, Briggs argued that, “the decision of the NJC is almost sacrosanct and must be respected. This is the minimum that Amaechi needs to do to show that he is democratic and has no ulterior motive.”
He added if it was difficult for Amaechi to secure the ratification of the parliament, the least he could have done is to appoint Okocha, who the NJC has already recommended, pending ratification.

THE Rivers State government officials Monday shunned the valedictory ceremonies in honour of retiring Chief Judge, Justice Ichechi Nwenenda Ndu.

At the event, Justice Ndu noted that the judiciary is facing a perilous time ahead of 2015 and has urged judges to remain fearless.

Top state government officials, including Governor Chibuike Amaechi, his Deputy, Tele Ikuru, the Attorney General and Commissioner for Justice, Mr. Worgu Boms, Speaker of the House of Assembly and others were conspicuously absent at both the church service and court session held respectively in honour of the retiring CJ in Port Harcourt yesterday.

The absence of state officials might not be unconnected with the political crisis rocking the state since April and the politics of appointment of the acting Chief Judge, Justice Daisy Okocha.

During the valedictory court session held at the conference hall of the state judiciary, the moderator of the ceremony skipped the address that ought to have been delivered by the Attorney General and the goodwill message by Governor Amaechi. Both officials who were listed on the programme of event did not send representatives.

An official at the Government House in Port Harcourt told The Guardian that he was not sure if the judiciary had invited the government officials.

Those present at the ceremonies were the Minister of Youth Development, Inuwa Abdulkadir, Minister of State for Education, Nyesom Wike and the Chief Judge of Anambra State. Others are representatives of the Chief Judges of Bayelsa, Delta, Abia, Akwa Ibom, Enugu and Cross River states.

Justice Ndu observed that ahead of 2015, the courts across the country are already inundated with political matters. Describing the times are perilous, he cautioned judges against granting ridiculous exparte motion which are aimed at an applicant springing surprises on a respondent.

He noted that the country has experienced 14 years of uninterrupted democratic governance, “regrettably, the impunity of those in authority has continued to increase.” He therefore urged judges to rise to the occasion and do justice to all especially the downtrodden who are likely victims of abuse of power.

Justice Ndu implored his colleagues to imbibe the spirit of judicial activism in a bid to curb the excesses and impunity of those in government, reminding them that courts are naturally not expected to do the bidding of those in power.

He lauded Amaechi for ensuring the independence of the judiciary and prompt release of financial allocations that enabled him to accomplish most of the capital projects executed during his 12-year reign.

On his part, the President of the Nigerian Bar Association (NBA), Mr. Okey Wali (SAN) said appointment of judges should be based on intellectual acumen and professional competence rather than political consideration, which is responsible for corruption of the justice system.

Wali lamented that judicial appointments are now getting politicised irrespective of the salient fact that the duties of judges are sacred and such should be insulated from political considerations. According to him, political inference in judicial appointments remains one of the reasons for corruption in the justice system.

He stressed that while corruption can be tolerated in, for instance, the executive arm of government, this social menace remains antithetical to judiciary which has the divine power of life and death.

He explained that it was in recognition of the fact that corruption has become a cankerworm in the judiciary that the NBA has decided to work in collaboration with the Chief Justice of Nigeria to rid both the Bench and the Bar of corrupt persons. According to him, about six lawyers have been debarred.

Speaking on behalf of the Body of Senior Advocates of Nigeria, Ifedayo Adedipe (SAN), described judiciary as a stabilising factor in Nigeria. He noted that while other arms of government create a mess in the system, they have always expected the judiciary to clear it up.

He decried the seeming high handed of the Judicial Service Commission for recently suspending a judge without pay for one year.

TO douse the controversy over the chairmanship of the Nigeria Governors’ Forum (NGF), Rivers State helmsman, Chibuike Amaechi, has offered to resign.
But this is with a condition: If the 19 governors who voted for him asked him to quit.
Amaechi like Plateau State Governor Jonah Jang is claiming to have won the election for the chairmanship of the NGF.
The position of Amaechi was disclosed yesterday by his Commissioner for Information and Communications, Mrs. Ibim Semenitari.
According to the governor, those who are accusing him of nursing a vice presidential ambition are mischievous since there has not been any formal declaration by him in that regard.
Semenitari told journalists in Port Harcourt Wednesday that Nigerians were aware of the democratic process in which Amaechi emerged as the chairman of the NGF and that the governor is someone who does not treat a democratic process with levity.
According to her, Amaechi remains the authentic chairman of the NGF, but if his colleagues, especially those who voted for him insist that he should step down in a bid to pave the way for peace in the forum, he will step down.
“If all the governors decide, especially those who voted for Governor Amaechi, that he should step down, naturally, he will concede to his colleagues,” she said.
On the issue of reconciliation between President Goodluck Jonathan and the governor, the commissioner stated that there had been meaningful discussion between both leaders.
She denied an allegation that Amaechi was planning to leave the Peoples Democratic Party (PDP) because of his difficulties within it. According to her, irrespective of the governor’s suspension which is now before a court, he remains a bonafide member of the PDP.
To Semenitari, the speculation that the governor is nursing a vice presidential ambition is the work of mischief-makers who are bent on creating disaffection between him and the Presidency. She said that the governor had never told anyone that he would be vying for vice presidency in 2015.
Meanwhile, Deputy Speaker of the Rivers State House of Assembly, Leyii Kwanee, has urged youths to support Amaechi in what he described as a critical moment of his political career.
He advised the leadership of PDP at the national level to disregard those who were feeding it with the wrong information that they could do without the governor.
According to him, the option left for PDP if they are interested in Rivers State is to intervene and have an amicable solution because the people that are deceiving them are mere paper tigers in the state’s politics.
He said that the House leader, Chidi Lloyd, was psychologically tortured while in police detention. He disclosed that Lloyd’s doctors were working to stabilise him, after which the necessary arrangements would be made to fly him abroad for proper medical attention.
“Honourable Chidi Lloyd was in a very bad state of health and there is the plan to fly him out of the country. Currently, the leader’s health is still unstable, that is why we have not been able to do anything as it relates to taking him overseas. The leader was not just physically tormented, he was also psychologically tormented. So, he is not in a stable state. We do hope that the physicians that are currently handling him will be able to stabilise him,” he said.
He added: “As soon as that is done, like I said before now, we intend to approach the same judge that has granted him bail to look at the issue of his international passport which he was ordered to deposit with the court and there is likely going to be a waiver because we need to get him out of this country so that he can be properly taken care of medically,” Kwanee said
