That u were convicted, jailed or paid fine does not change the fact that money got missing under your watch. And since the law does not believe that things disappear and since you agreed that the money got missing under your care, it is assumed that you know the whereabout of the money but decided to play smart. But in a criminal proceeding, punishment other than recovery is their main aim, that's why you were not told to pay back but punishment meted on your. Don't mind those asking you to appeal, you will put yourself in more trouble. Since you agreed with your employer that the money got missing under you, its an admission of guilt, hence sentence was given. Nothing wrong there. Through civil claim, your employer can get his money back and you will be also asked to pay the legal fees. I suggest you meet with your employer, explain to him how all happen and make arrangement how to pay back if he insist. Unless you are sure he doesn't have any plans to pursue a civil case against u... |

I have a case in court, its a fraud case and trial has began. The accused confessed to the crime when they were arrested but pleaded not guilty in court. The wanted to settle out of court but what they are offering is not even up to half of what they defrauded. Now I want to go ahead with the full trial because with the evidences and their confessional statements, I believe they will be convicted. My problem now this that I am hearing that the court will only convict them and sentence them to prison, that part of the sentence will not be for them to refund the money that they defrauded. Please house, if such thing happen, how will I recover my money back? Although some of their properties were seized. Please I need advice, I made a mistake falling into their hands in the quest to make out something out of live. Thanks |
