Court sacks Dangote as NSE boss The Federal High Court in Lagos, has nullified the election of Alhaji Aliko Dangote as President of the Nigerian Stock Exchange (NSE). Dangote, business mogul and chairman of the Dangote Group was elected as the president of NSE in August last year. But in a reaction after the verdict was handed down, his counsel said he will appeal against the ruling. Trial judge in the matter, Justice Lambo Akanbi, ruling on an application by some shareholders of African Petroleum Plc, who had sought to set aside Dangote’s election as NSE president, on the ground that the said election was held in clear disregard of an order of court, after reviewing the facts of the matte, said, “it is the case of the applicants that this court in the enrolled order of April 8. 2009 granted an interim order, when it ordered parties to maintain the status quo, pending the hearing and determination of both the interlocutory application and the preliminary objection. “NSE resisted this claim and submitted that the application for an interim order was refused by the court. From the extract of the proceedings quoted earlier in this ruling, I find nowhere therein where the court refused an application for an interim order. Rather, the court made it abundantly clear that the oral application of counsel for the applicants for an order to maintain status quo was granted”, the court said. Condemning the conduct of NSE and Security and Exchange Commission, SEC, the court said: “The conduct of all officials of the NSE and SEC, who organised and/or participated in the purported election of Dangote is reprehensible and highly condemnable. They perhaps look at the court and think that it can only bark but cannot bite. This court will make them see that our teeth are not only sharp, they can be poisonous when they choose to bite. The court will not allow them to treat the court orders as useless by refusing to obey them, lest anarchy may set in.” The court also noted that: “The government should also look inward for a way to sanction, domestically, any government functionaries found in disobedience of court’s order. This is the only way the “big boys” and those claiming to be close to power and who are laws unto themselves can be checkmated so that the genuine desire of the present administration to enthrone true and genuine democracy can be attained. “[b]The integrity of the court is at stake here in this application. There is a direct affront on the authority of the court. The court must therefore rise to make the lawless elements in the 13th and 14th defendants see how sharper it is than a serpent tooth to have disobedient and lawless executives in government establishments. “I will bite them with my sharp teeth by sustaining the application of learned counsel for the applicants with the following order: An order is hereby made nullifying, vacating and setting aside all steps taken by NSE in purporting to elect Dangote as the President of the Nigerian Stock Exchange”, the court held. The court further said, “like every judicial official, I feel troubled and tremble each time I see any Chief Executive of a government agency or establishment and their minions spurn and treat the order of court with levity, leaving the impression that since the courts have neither the police nor guns nor the army to enforce whatever orders they make, they should treat such orders with impunity. Jos: Jang, others didn’t call me – GOC By Jude Owuamanam, Jos, Published: Friday, 12 Mar 2010 Plateau State Governor, Jonah David Jang THE General Officer Commanding, 3rd Armoured Division, Maj.-Gen. Saleh Maina, on Thursday denied allegations that officials of the Plateau State government contacted him before the invasion of three villages in Jos North Local Government Area on March 7. Maina told journalists that no government official called him prior to the killings at Dogo Na Hauwa and other surrounding villages, adding that his men only acted on the text messages received concerning the violence. The GOC was apparently reacting to allegations by Governor Jonah Jang that he ignored all calls and security reports prior to the pre-dawn invasion of three villages in Barkin Ladi and Jos South Local Government Areas of the state. “No government official called me prior to the mayhem at Dogo Na Hauwa and other surrounding villages, they all have my numbers. Some of the text messages we received gave us wrong direction,” he said. Maina, who, however, admitted receiving text messages that some people were about to strike, said that a captain led a troop to the scene of the mayhem at Dogo Na Hauwa at about 2:45am while another larger troop also arrived the village by 8:00 am. He said that at about 11:00am on Sunday, the military arrested five of the invaders and immediately handed them over to the police. He condemned what he described as the tarnishing of the image of the military over its operation in the state, stressing that the task force should not be seen as an enemy or as being partisan in the unfortunate development in the state. He said, “Members of the task force should not be seen as enemies or as being partisan. I personally supervised the operation in Maiduguri to restore normalcy and order and there was no sentiment whatsoever on the part of the military.” But, despite attempts to extricate himself from the allegations, Maina continued to receive more knocks. The latest call came from a group, the Voice of Truth and Reason, whose coordinator, Mr. Joseph Fadeyi, said that Maina abandoned his patriotic calling as an officer of the Nigerian army. He said that instead of engaging in circumlocution, Maina should come out to explain in clear terms why there were more killings and burning after the Plateau State government had declared a 24-hour curfew and the army had effectively taken over security. In a statement in Jos on Thursday, Fadeyi said, “Since the aftermath of this recent crisis, accusations and counter-accusations have been running from all parties in the conflict, especially, regarding the military. Already, relevant authorities have stated irrevocably, that there was a military involvement, the military has denied same. “Whether the officers involved did so as ordered or wilfully, is a subject of investigation, the General Commanding Officer of the 3rd Armoured Division, Maxwell Khobe Cantonment, Rukuba Barracks, Maj.-Gen. Saleh Maina, personally has not answered the citizens of this country and Plateau State in particular.” Fadeyi questioned why some people who had been indicted by various panels on past Jos crises were still appointed into the present presidential panel. He asked that no more panels be set up since they had served no useful purpose, adding that certain individuals only used the platforms provided by the panels to make inflammatory statements and insinuations. He also called to question the use of sophisticated weapons and wondered why ordinary herdsmen should be so professional in handling sophisticated weapons. However, the Commissioner for Information in the state, Mr. Gregory Yenlong, in a reaction, said the governor would not like to join issues with the GOC or the Nigerian Army, since the preoccupation of the government was the restoration of peace in the state. He said, “The governor would not like to join issues with the GOC. He has made his point clear. The major preoccupation of the government now is the restoration of peace and building the confidence of the people in the peace-building process.” But, the Assistant Director, Army Public Relation, 3rd Armoured Division, Lt.-Col. Galadima Shekari, maintained the position of the GOC that no official of the state government called him in respect of the crisis. He said on the telephone, “The GOC made it clear that no official of the Plateau State Government called him in respect of the attack on Dogo Na Hauwa. “The text message he received from some government officials misdirected the GOC about where the incident was taking place.” Also on Thursday, hundreds of Plateau women marched half-dressed round the Jos metropolis and demanded the immediate removal of the GOC. Traffic crawled to a standstill as the women, who wore black attire, led by Mrs. Esther Nbanga, stormed the State House of Assembly at about 10:30 am to register their grievances. They then marched half dressed to the Government House, with many of them carrying placards denouncing the military operation in the state and calling for the withdrawal of the military from the state. Speaker of the Plateau State House of Assembly, Mr. Istifanus Mwansat, who received the women, stated that the government was not sleeping over the unfortunate development . At the Government House, Ray Field, the women were received by the state Deputy Governor, Mrs. Pauline Tallen, who prayed along with them for a total restoration of peace to Plateau State and Nigeria as a whole. Meanwhile, the Plateau State Coordinator of the National Youth Service Corps, Mr. Nurudeen Baba-Ahmed, has said that the number of corps members posted to the state has been reduced by half. He said that the number was reduced from 2,400 to 1,200. He spoke at the passing out ceremony of the 2010 batch of corps members posted to Plateau State on Thursday. He said that the reduction was to ensure that corps members were kept safe as a result of the recurring crises in the state. He assured parents of the safety of their wards during the service year. Also, the Director-General, NYSC, Brig.-Gen. Ismaila Tsiga, has said that he will grant the request of any corps member in Plateau State seeking re-deployment if the crisis in the state persisted. The DG said this when he visited the NYSC camp in Plateau State, on Wednesday. He assured the corps members that none of them would be posted to rural areas. “Your security in the camp is guaranteed. Soldiers will be deployed here to stay with you in the camp for 24 hours a day, but you must not leave the camp if you are not authorised to do so. Security is a collective responsibility".He said. |
Jos crisis: Why we struck –Fulani Settlers ., Jang causing more trouble Five days after the massacre in Jos, the Fulani settlers alleged to have carried out the attack have given a detailed explanation as to why the sad incident occurred. Speaking to journalists yesterday in Abuja, the Fulani leader and secretary Sultan’s Farmer/Cattle Rearers Conflict Committee, Sale Bayari, said the recent mishap was caused by failure of both the Plateau State Government and the Presidential Committee on Jos Crisis to clearly address the losses of the Fulanis in past crisis. Bayero, who claimed to be a none stakeholder in the crisis, also said it was unfair for the police to continue to hold the 49 Fulanis arrested so far, adding that what happened was a complete case of jungle justice. He said: “Some of us have been forced to live like outlaws in Jos. Why would a government turn its own responsibility upside down? Under the circumstances of what has been happening in Plateau State, some people just have to die. “Any society that refuses to be just and fair shall become a jungle where only jungle justice shall operate like the case in Plateau State today. There are some people who are very conversant with the jungle. They sleep with snakes, gorilla even at night. So if you turn your state to a jungle state, this is what you get. So far, we have suffered most. Indeed, majority of our killings were carried out in areas where there was strong government presence.” Bayeri further noted that it was completely unjust for government and the media to be silent when the Fulanis lost hundreds of their kinsmen most of whom were children and women, only for everyone to hastily condemn them now. “When our people were killed or were being killed, we can’t remember seeing Governor Jang, the Gbong Gwom, the Information Commissioner, members of House of Assembly of the areas, neither did anyone of them say a word about what happened to us. Up till today, they are behaving as if nothing ever happened to us and you expect this to just pass away and forever? In Kuru Karama when Aljazeera was beaming the corpses of 150 children and women strewn into the village streets, where was Governor Jang and Gyang Buba? Who has been arrested? Who provided the five Hilux Jeeps that brought the killers? Who has made any effort to fish out the killers. Haba! “The herdsmen have been at the receiving end for no reason whatsoever and it is, therefore, most baffling to hear government now exaggerating the figure of those who lost their lives in what is called reprisal attack at Dogo Nahauwa in order to give the world the impression that those who lost their lives in this incident outweigh any other that happened to other people such as the Fulani “We observe with great dismay and outright taking of sides by the government through its spokesman, Mr. Gregory Yenlong, Commissioner for Information, by saying that 500 were killed while the Police Commissioner was categorically saying 109 people were confirmed killed. Why is the Government denying our own casualties and the loss of property, which we have documented and published in the media while trying to convince the world to accept their own speculation as fact? “Why didn’t the government challenge us to prove the loss of 215 people in the January 17 Jos crisis? Why didn’t the government respond to our petition to the Federal Government through the force CID that we wrote to only to deny that what took place was a reprisal attack as stated by the police. Whether it was a reprisal attack or not, between 2001 to the recent crisis, the Berom have killed over 365 herdsmen in cold blood in Jos South, Barkin Ladi and Rayon Local Gocervment Areas. “Because the Fulani are local herdsmen who are not beneficiaries of the state, national and international media, deaths of our children, women and men never occurred and were never reported and the purported reprisal theory was never justified. If, we may ask, why then this attack took place where it happened and nowhere else outside the three Berom local government areas that we alleged we lost 215 people? We want an answer from Jang. Bayeri, therefore, called on the Federal Government to halt the indiscriminate arrest of herdsmen in the country, cautioned that if these acts of injustice to the Fulanis continue there would not be a way out of the crisis. “The Fulani abhor injustice and they shall seek justice through any means legal.
