I only oppose cremation on one ground, it forecloses any possibility of forensic discovery as to cause of death in the future. Thus, If a persons death is not natural(eg where he may has been poisoned) and there is subsequent cremation, the evidence may have been burnt for life. I have forgotten the name of this popular case in America which happened in 90s where a wife poisoned (lead poison) his husband to death. Police went and arrested the co-workers of the man(the man worked in a plant where lead exposure was high) for negligent(exposing the deceased to lead)unknown to everybody that the wife actually poisoned him(in order to inherent his estate) knowing fully well that the possibility of police looking her way was slim. 20 years later, there was medical development to that direction. When police opened the closed file they saw some evidence which pointed accusing fingers on the woman. The corpse was exhumed and another autopsy conducted. It was discovered that the deceased got more dosage of lead even when in the hospital( the wife had been with him throughout his stay in hospital) than while he was at his work place. The wife was arrested and she confessed.

My brother under Chapter IV (Fundamental Rights) of the 1999 Constitution as amended, there is only one right which is absolute in the constitution which is section 36 of the constitution (i.e the right to fair hearing), apart from it, no other right is absolute. Not even section 33 which is the right to life. The meaning is that every other fundamental or human right can be derogated from any person subject however to complying with the constitution. This is exactly what happened in Baba Suwe's case. His right to liberty was derogated in line with the law (kindly read section 35 of the constitution thoroughly and see for yourself). It was quite unfortunate that it played out like this, but as you said, NDLEA ought to have apologised to him so that sleeping dog can lie peacefully. I however salute Baba Suwe for his doggedness in trying to enforce his right and enriching our law on this topic.

It's a pity he had to go through that ordeal, but it was a necessary evil. Thank you my brother. I think it is high time we had a legal section in this forum. I feels so nauseous when laymen make puerile arguments on a pure legal issue like this. Bamidele Aturu(Counsel to Baba Suwe) will just finish his money prosecuting this appeal to no avail unless he is doing that on a pro bono basis. Baba Suwe's right to liberty was derogated from him pursuant to an order of a court of competent jurisdiction granting NDLEA the power to detain the alleged suspects(Baba Suwe) for more days to enable it conclude its investigation. There was nothing unconstitutional about Baba Suwe's detention. The Lagos State High Court Judge was definitely high on weed when he awarded such outrageous damages. What NDLEA did was its statutory function. The highest it owe Baba Suwe was a public apology

I think it is quite emotional to expect this man to get any money from NDLEA after an encounter in their line of duty. If NDLEA pay Baba Suwe, then police will need to pay even those that were arrested, detained and later proven innocent in the court. NCAA will also pay airlines for stopping them from taking off on schedule for any reason. The courts will also pay the accused eact time he is confirmed innocent after judgement. Oni should be paying Fayemi and companies will be paying those that attended their jon interviews but never got the job.

I have always reasoned that the Judge of the Lagos State High Court who made that order in the first place was totally drunk. He was influenced by public opinion and emotion and not the law. The scanners installed on the airport suspected Baba Suwe of drug injection. In line with this reasonable apprehension of a crime, the NDLEA officials detained Babe Suwe for thorough examination. In order not to breach his fundamental right, NDLEA went to court and obtained an order which empowered it to further detain the alleged suspect for some days. At the expiration of the days contained in the order, the suspect (Baba Suwe) was released after the examination showed he was clean. Where then did the NDLEA foul the law? Going by the facts of this case, what Baba Suwe was entitled to at that time was SORRY (public apology) in line with the constitution. The learned trial judge totally goofed in law in awarding the complainant(Baba Suwe) damages of N25,000.000.
Thank you the learned Justices of Court of Appeal for this sound judgment. Baba Suwe can go to the Supreme Court but I honestly don't see him winning this one.

This is poor journalism at its worst.
Firstly how can one grant amnesty to an already convicted criminal serving his sentence? This is legally impossible rather what the Governor can do is to grant pardon. Amnesty denotes that the accused person was never convicted by a court of competent jurisdiction in the first place. Pardon on the other part denotes that there was a conviction but the convicted person was subsequently forgiven by the State. These two legal terminologies never meant the same thing. Is this newspaper house trying to tell me that it does not have a lawyer-journalist who can make contribution on legal matters?
Secondly where did the Governor of Anambra State get the power to grant "amnesty" to a person in Enugu prison? This is totally unknown in our legal jurisprudence. cry cry cry

I did not graduate from IMSU, but for those of you saying all manner of things about the school, always remember that in every school there are serious and unserious students. Also recall that a product of IMSU (A lady) was the best graduate of Nigerian Law School last year.

I wish to let Nairalanders know that the best female graduate of the Nigeria Law School in 2010/2011 session by name theodora Elendu finished from the school. Also the Best overall Male Student in the Nigeria Law school in 2011/2012 session by name Kema Cosmos Chinedu also finished from the school. Kema also took the award for the overall best graduating student with Damilola Otedola. This is IMSU bagging award of excellence back to back.
So the fact that some students of the school have chosen to be unserious does not by that mere incident make all of them unserious.

I have observed for quite some years now that one hardly finds black goal keepers in top European leagues expect French league. In fact the last time I recall seeing a black goalkeeper in Premier League was Shaka Hislop of Portsmouth that was about 5 years ago or more. Does it mean that blacks are not good in being shot stoppers?
