he's not at fault! he was retreating even when he had no duty to retreat. they were on a train together. he's not breaking a law by being on that train.

well if the number of people affected is irrelevant phrases like 'public violence','genocide' and 'terrorism' wouldn't exist. its not public violence because he hit her back, like I said it became public violence when other people who had nothing to do with the fight were involved.

he hit her back in self defence. the state of new york permits the defender to fight back and use any level of force. he got whacked in the head & he musta felt his life was in danger. his safety was the top priority at that moment, not the other passengers.

That's the reason why if you engage in a fight at a club, all of you will be locked up regardless of who threw the first punch.

only for people who don't know their rights. if i get punched in the club & i retaliate, the first puncher would get locked up, i would walk away easy. CCTV cameras would do its job, i don't even need to make any statement.

the dude simply exercised his rights. getting whacked with skating shoes to the head could lead to concussion - serious bodily harm. the dude then used the appropriate level of force to stop his attacker.

if you can prove that innocent passengers were not hurt or affected while he was "defending" himself then only then can you say that he wasn't at fault. it became a public violence when his actions adversely effect on the public (other passengers) who had nothing to do with the attack, which took place in a public space

innocent passengers getting hurt in the melee was the girl's fault. she started being physical with him. her verbal abuse went on for more than 2 minutes & the dude didn't even flinch.

he was walking away from the situation when he got hit by the girl. he retaliated in self defence. america has a stand your ground policy - the number of people that got hurt or affected is irrelevant. the dude stood his ground!
