Wait till the notes comes before considering changing his course. But during the wait, he may choose to play around schools in Canada offering management in health care/system.

If possible, the search should begin from Universities offering Graduate Diploma. I think Memorial offers Graduate Diploma in Toxicology, Pharmacology and the likes before moving forward to Colleges.

From the post, I see no issue that reflects the VO's concerns in regards to the Personal Asset & Financial Status.

From close observation, its just a blinded generic refusal for many January 2021 intake. When it happens like this, the only thought that comes to mind is the quota limit for the number of visa approval has been exhausted.

I really don't know how to proffer any advice at this moment in regards to this situation until the arrival of notes.

Writing a letter of consideration to the VO that handled the application is highly supported and is a good alternative for those that can't secure the service of an immigration lawyer.

Between, your spouse should have gone for any health management in business courses than a pure business management course.

Let's wait for the notes!

The reason he isn't going for a master's is his BSc degree result. He doesn't have a 2.1

Didn't think the Polytechnic made a difference as long as it was a post graduate course. And from the past threads, it's only a PGC course in business that he can get with his current result.

Please let me know if there are other better choices. Would it be better to find a college with same course? As I noticed that Universities hardly do PGCs/PGDs.

Referencing the attached note.

What the VO simply meant was, how can someone with BSc go for a programme in a polytechnic. That's a negative factor in the first instance. He might not even check the attached documents to read the LOE, if he did he would have noted that he plans to assume a position inline with the course of study.

1. I think to apply, the first thing to consider is a BSc holder should go for MSc ( their view)
2. Having HND should go for PGD( their view also)

So if they see an application of someone with Bsc going for a lower degree course, it usually raises an eyebrow as to intention of the applicant. He'll just conclude without checking letter of intent.
That's to the best of my knowledge, other gurus can add too..

I'm relatively new here but I've read from part 17 upto this point but I'm still confused about how to handle this.

Below is my spouse's timeline. Please feel free to ask me for anymore details I might have missed.

We are using an IRCC registered immigration consultant located in Saskatchewan.

We had already started with her before we found nairaland. Would have done this on our own if we had this much info.


SPOUSE'S TIMELINE


Age: 43 currently

Bsc: Microbiology

15 years study gap

Work history: Worked as the Lab microbiologist for 3yrs or thereabouts (2008-2011)

Started as Administrative Manager From 2012 (family run business) owned by his Dad.

Going for : BUSINESS MANAGEMENT POST GRAD CERTIFICATE (Saskatchewan Polytechnic...paid school fees in Full).. $17,100 (right from first application and school fees receipt was attached). Chose PGC course of his past result and the easiest admission to get was in management which seemed to fit into his current need. And the Bus mgt course in saskpoly is specifically designed for those with no prior formal training/degree in business.

He applied alone (leaving myself and my son back home as home tie)

1st delay: purpose of visit

2nd delay: personal assets and financial status (yet to see the letter to know if there were other reasons)

He applied for the first time on June 15, 2020. was refused in September.

He applied for his GCMS notes (see attached below). Tried to tackle the VO's complaint by making a detailed study plan written by him and a letter of explanation from the immigration consultant (which we proof read and agreed was fine). Explained that a higher managerial position (director of operations) was curated in the company and he was offered that position but to fully qualify, he needed a formal training in business to fill in the role properly.

He reapplied on November 26.

2nd Application was refused on 29 January based on personal assets and financial status



Next line of action: 1) Immigration consultant apply for reconsideration (if we are lucky, the application will be reopened )

2) Apply for GCMS note (same time with the consideration so they can run side by side to save time)...done already.

3) May consider a judicial review or reapplication depending on what the GCMS notes say but as very last resort cos this is way too expensive



Documents submitted:

SOP(study plan by spouse)
LOE (by the IRCC immigration consultant)
Resume
Transcripts and degree certificate
IELTS result (Band 9)
Letter of acceptance from school
Fees receipt (fully paid)
Mybankstatement certificate(showing funds of about 31,000 CAD)
Reference letter from bank (to confirm account owner)
Memorandum of association (showing he is a major share holder) and CAC of hospital
Job offer letter ( for new role as director of operations)
Study leave approval letter(one year study leave)
Marriage certificate
Son's birth certificate
Police clearance certificate
Stamped Passport pages (to show travel history to US and China)
All required forms for study permit as well as signed representative forms (since we are using an IRCC agent)
Wife's payslip (to show she can fend for herself and son while spouse is on study)
Etc.

• I started this journey mid-2019, so I applied in Dec 2019
• 22nd of Jan 2020, I was refused [Reason—Purpose of visit]
• Remark: In my application, I made a blunder of wrongly applied for a wrong course [Ordinary diploma]
• Then I changed my school and course [Post graduate program]
• Re-applied in March 2020 [ Then covid19 lockdown activated and the waiting period started……]
• 14th August did upfront medical and passed 10th September
• 20th September got AIP
• Then, no update again [Webform enquires and emails activated]
• 10th December BVL dropped [Then no update again, another session of emails activated]

Hello, I read your questions. Please note that career change happens and nothing is wrong with a change in career path in as much as it shows logical progression and its objectives are realistic. Remember that everyone will have different circumstances, hence I will suggest that you read my earlier comments in unison.

In your Spouse's situation there are many positives, all I see is a need to be a bit more objective and realign the facts based on the peculiarity. In specific response:

Your Spouse's current workplace is a Hospital (medical services), he is not working in a Bank (financial services) or any other sector. In this case, your Spouse holding a Bsc in Microbiology is a positive, all he needs to do is to show continuous work activities that makes his Microbiology progressive as well as he taking on managerial functions because he is a part owner of the business being a Shareholder. This gives you an opportunity to tweak his previous CV and SOP to align as a Microbiologist who is involved in administration/management of the hospital. Whereas, he is seeking the managerial skills to be better at his work. I do not think being designated strictly as an Administrative Manager has helped this either, he should have been designated with a role that accommodates both his academic qualification and future plan, e.g. I had suggested Director of Clinical Services and Administration (for instance). It shouldn't be a change of career for him but rather supplementing his Bsc in Microbiology with Business Management to improve his managerial skills and to support the growth of the business. Since you pointed out that he genuinely wants to study management.

I also noted that someone suggested to you to consider a specialised management in healthcare, I agree that this will also align better in addition to my earlier suggestions.

Please note that this is a personal insight and suggestion based on only the information you have provided, as I cannot have the full picture, hence the decision lies with you. I wouldn't be making further comments on this situation so that you can take your time to make an informed decision. My best wishes.

I dunno how to pitch in the loving microbiology part or how he is still utilising the BSc in microbiology. Or are people not allowed to change careers? Pardon my too many questions.
In Nigeria you have microbiologists/geologists/lawyers etc working even in banks.

In his SOP he clearly stated why and how he needs more professional training in business to be able to run the hospital better. And wanted a short course (1yr) so he could go back and assume the new position of director of operations (job offer letter was included too as well as study leave approval from the company)

He applied alone. I'm a doctor and I'm staying back as his spouse with my son. And we already added my payslips to show I can fend for my son and I while he's away. I work in a federal hospital.

Business Management is a good skill that Investors, Entrepreneurs or Managers need to improve their business. So, putting this into your Spouse’s situation, my opinion is that since the business is Hospital (Medical Services), his current work activities will be nice to show the continuous utilisation of his education as a Microbiologist, while he is also taking up administrative roles. In a Hospital organogram for instance the Chief Medical Director is usually expected to be a Doctor and he or she also takes up administrative functions. There is nothing wrong if the CMD pursues business management professional knowledge.

What I am suggesting is that you may reapply, whilst being consistent with your previous profile, however, make your Spouse present himself as a Microbiologist, who is still in love with his microbiology but requires business management skills to support and improve the family business. The business management education will provide management skills which did not form part of his first degree or education.

Also, I do not know if he is being accompanied by you, in any case it is important you also add your work and finance related documents to show that his family will be fine whilst he is studying.

He actually worked for a few years in the same hospital lab (microbiology section, he pointed that out in his resume). Before he was made the administrative manager after about 3yrs.

Now his father (the Medical director) is due for retirement and needs him to become the hospital administrator/director of operations. And he felt the need to get some professional training in business as this now has a much larger scope and it's a requirement to completely qualify for the position (he put in his new job offer letter to prove that, as well as a study leave approval)

Please kindly suggest how he can improve his career path to fit in with the business management. He's really not interested in furthering along that microbiology route.

Hello, I have been silent on the thread, however I felt a bit concerned about your situation and thought I should at least offer my insight based on the VO's comment in the GCMS note you posted.

My understanding is that there seems to be a concern regarding your Spouse's academic background versus his employment situation and career plan. Your spouse studied microbiology, while his current employment (though being a shareholder in the Hospital) is Administration Manager. I think this is where the main concern is, it appears that given the fact he is a Microbiologist, he works and has invested in the hospital, he should not be working as the Administration Manager. The question is, where is the utilisation of his education in Microbiology? It would have been sufficient if he was employed or designated as the Director/Manager of Clinical Services and Administration (for instance), and he is going to study PGC in Business Management to improve his work output in the area of administration due to the fact that his educational background would not have covered for the business management aspect, however, his work experience and daily activities have necessitated the need to invest in such professional education.

I usually support Judicial Review where there are no holes that can be argued or capitalised on by the Defence Counsel. In this your case, my genuine opinion is that you may reconsider working on the career path. The recent refusal reason of Personal Asset and Financial Status is still flowing from this employment situation and not the excess amount you have which clearly meets the financial sufficiency requirement.

Concerning the refusal of qualified applicants, there are other factors that one should consider apart from sheer mistakes on the part of the VO. I've started to realize that Canada allocates a limited number of study permits every year. It's a technique they use in controlling immigration to Canada. Just as there are PR limitations (i.e. They may issue a specific number of PR visas each year and every country gets a certain quota of that), so too do they restrict the number of study permit approvals. Apart from this, they also give higher quotas to more populated countries and they favour those from certain countries too.

Beyond the politics of quota, they also aim to evenly distribute international students across the nation. The implication of this is that those applying to study in Ontario are bound to have more issues than those applying to study in Manitoba. If they allow every student to study in just one province, that won't be good for the economy of the other provinces.

Furthermore, they assign specific quotas for students applying to study in colleges, and at various levels in Universities. This is why PhD students may likely get better approval rates than those applying for a Masters (because there are fewer PhD applicants). The higher you go in the academic ladder, the easier it becomes to get the permit (especially if there is a logical progression in your career).

Another factor is that in some countries, like Nigeria, applicants submit fake documents. This adds to an overall suspicion of everyone's application. In a bid to verify documents, the VOs can misjudge the real facts of the matter. Sometimes, because of the high number of applications, they won't have the patience to do in-depth verifications and will simply reject the applicant so that his/her next application would clear those doubts.

Note that what I've said are based on my personal observation of the process. The lessons to learn from these are:

1. Submit your application for a study permit as early as possible. Don't wait till the last minute before you do so. It may backfire.

2. Apply to study in other provinces like Manitoba, Quebec, New Brunswick, Nova Scotia, North West Territories, etc. It shouldn't always be in Ontario. I have a strong hunch that Quebec bound applicants get higher approval rates than those headed to Ontario.

3. As much as possible, apply to programmes that are logically cognate with your previous educational or work experience.

4. Save the VOs the stress of verification and submit authentic documents. Some VOs can know if a document has been tampered with via Photoshop or other apps. Others see certain documents frequently and can easily detect if something is awkward about a specific document. They are trained to find faults, especially in applications from certain countries.

5. If you're rejected, the best advice is to defer your admission to the next intake and apply at the point when many people would not have submitted their applications.


My people usually say "misiagware o" when we have exhausted our thoughts.!

The company is worth over a 100 million even though we didn't put the property value.

He paid his full fees too so not included in the 30,000 CAD in his account.

My company has been running for over 15 years and I am the majority share holder yet I was refused for personal assets and financial status

My spouse got a 2nd refusal today for exact same reasons.. personal assets and financial status. Meanwhile we had about 9.5 million in his account and we submitted 12 months banking history via mybankstatement. Plus showed he is a member of a board of a company that has been running for over 35yrs. (Family business)

Seems judicial review is the only way out now. Cos there's nothing more to add.

First refusal was based on purpose of visit in September. Reapplied November now this....it's heartbreaking.

So sorry about the 2nd refusal.

I think you need an immigration lawyer for this.
It should be done within 60days of receiving your refusal if you applied from outside canada and 15 days if you are inside Canada.
Lawyers charge anywhere from 3500-5000 dollars for this Service.

Has two steps... applying for leave then if that is approved, apply for judicial review


Before you choose Judicial Review make sure your original application has a strong case for approval....

So apply for your GCMS notes and ensure the visa officer refused you in error or did not review all the documents you sent appropriately

So sorry about your refusal.

How much was in your account for mybankstatement and what was your inflow and outflow like? Did you pay in a lump sum? Can the source of the 70,000 CAD be explained?


How much of it was in the mutual funds?

Maybe you need to see your GCMS notes for a more details and a clearer picture so guys here can advice you better

Sorry for the refusal. I got refused today also based on the exact reasons, personal assets and financial status. I am self sponsor and submitted proof of fund of over C$70,000 both MBS and mutual fund as well as company documents but I did not attach any landed property. It is well

I switched from my undergraduate major to a new one.

The fonts look funny, not like the older AIPs we saw. And I'm wondering if they've gone back to giving AIPs again.


But if you received it via your GC key then it should be genuine.

Yes, if your previous admission is more than 150 days before May then you should. Use a webform

About your baby, I'll allow gurus answer that.

I deferred my admission till May 2021, is there need for me to send the new admission letter?
Also, I am now a father do I need to raise a webform notifying IRCC of this change of status?

Same with my spouse. Submitted in late November after a refusal in September.

Submitted all the NSE requirements(IELTS, mybankstatement, medicals) with 2nd application so didn't get any NSE request.

Eligibility and background check have been ongoing for a while. Medicals passed since Nov 30.

No BVL or PPR yet.

Phewwwww! I hope this week is our week

Submitted end of Nov. Did not get an NSE request but submitted both IELTs, Medicals & MyBankStatement alongside the application.

Medical passed on 10th October and ever since no update from the nairobi.

Should I be worried? Started online class already at the university of Victoria.
