PoliticsHow Can One Sue FG And Shell - Please Advice by DeCleff(op): 9:46am On Sep 12, 2012
I've been thinking on how i can successfully sue FG/Shell for invading our family land without any compensation.

Sometime in the 90s, the Federal Govt & Shell under the regime of Late Gen. Sani Abacha, laid a pipeline from Port Harcourt Refinary to an unknown destination. But unfortunately, the pipeline was to pass through our farmland, and atleast 20 plots of land was taken from us without any form of compensation.

So am asking if there's any constitution that gave FG/SHELL the right to intimidate Nigerians and take away their lands without any compensation? Can the family demand for compensation by suing FG/SHELL to court?

Please i need sincere advice from the lawyers in Nairaland.
Thanks.

asha 80: Ijaw rejects six zonal structure
September 9, 2012 by Allwell Okpi 131 Comments

The Ijaw nation has proposed the restructuring of Nigeria along ethnic lines, rather than the current six geopolitical zonal structure.

The Chairman of the Ijaw National Congress, Joshua Benamaisia, told SUNDAY PUNCH that Ijaw people were spread across six states — Bayelsa, Rivers, Akwa Ibom, Edo, Delta, and Ondo — in two geopolitical zones — South-South and South-West.

Benamaisia said the Igbo nation were entirely within the South-East geopolitical zone, there was need for the Ijaw nation to have its own separate territory.

Benamaisia said the prime aspiration of the Ijaw nation was the establishment of true federalism, where every ethnic group would control the resources in its area.

He said the Ijaw nation had suffered injustice under the current structure and would not drop its demand for the abrogation of the Land Use Act, and other laws that removed the rights of the people over their land and natural resources.

He said, “If not that our constitution does not recognise referendum, there would have been a referendum on how the country should be structured. Since that is not possible, a national conference should be convened so that people can decide how they can continue within sovereignty of Nigeria. But the issue is after the national conference, the resolution will still have to be ratified by the National Assembly; that is what the law says.

“If it is in places where the will of the people is respected, then we can be sure that the National Assembly will pass the resolution of the people. But here we cannot be sure of that.”

Benamaisia said the Ijaw nation would keep pushing the right to control their resource until they get it.

He said, ‘We are not interested in all these talk about revenue sharing formula. Our position is total resource control. It is only when people are allowed to control their resources that they would decide what to do with it.

“For instance, if you are driving on the East-West Road, the roads are so bad and we have resources here and it is used to develop other places. We don’t have infrastructure in our place; neither do we have federal presence in our area. So, we need to control our resource. It is our right.”

Supporting Benamaisia, the spokesperson of the Ijaw Republican Assembly, Ankio Briggs, said Nigeria’s federalism was faulty in not recognising the different ethnic nationalities as units.

“It is not that we do not accommodate other ethnic groups. The Ijaw people have suffered much injustice in this country that we are now looking at the country’s structure based on ethnic grouping. The Ijaw people in Ondo State, which is in the South-West, are not strangers. So there is need for them to be associated with Ijaw people in the other states in the South-South,” she said

Where are the Ikwerres that denied their brothers ( Igbos ) claiming Niger Delta with the Ijaws? Can they (ikweres) now see that they're left alone because the Ogonis will never accept the Ikwerres neither will the Ijaws.

The Ogoni people & the Ijaws sees the Ikwerres as IGBOS.
RomanceRe: My Family Wants Me To Marry For Money. by DeCleff(m): 6:27pm On Sep 06, 2012
septua: Hi.i am young woman in my early 20s. I have been seeing a young man of 30 for about a year now and about 2 months ago he started talking about marriage plans although he hasn't proposed but i took that as one.

He has rented a 3 bedroom apartment and promised to take me to his parents towards the end of the year. Long story short we planned to get married next year.

I trust him although i fear he might disappoint me as he is still struggling. But 3 weeks ago my people called me home from were i was doing my service to meet a man that has come for my hand in marriage. The man is handsome and wealthy but he is 16 years older than me and that alone makes me uncomfortable. Plus i dont really like him.

we seem not to have much in common, But my mum and my aunty have been begging me to marry him as we are sort of going through financial breakdown and they see him as a kind of saviour. Plus my mums pastor says he has seen the marriage in vision before now.

The marriage will be done in less than 4 months if i say yes, And if i say no then i will have to wait for my man till mid next year.

So i ask please will you consider your family and go into the marriage or wait for your love.
LEARN FROM THIS STORY.

I was dating a young girl (Edith) and we really loved each other. But along the line while she was in Port Harcourt, her parents called her to come home for an important meeting and she went.

When she came back from Umuahia, she told me that HER PARENTS ASKED HER TO MARRY ONE OPPRESSOR ( A WEALTHY GUY) Who based in Lagos and haue come to ask for her hand in marriage. I couldn't stop her because she came from a poor home and her parents wanted the money without considering their daughter's happiness.

Three days to her tradhtional marriage, she came to invite me, passed the night with me and we made love. But i didnt attend the ceremony. Though everything went on well.

But a year later the man died and she already had a daughter for the man and THE FAMILY OF THE MAN CHASED HER AWAY WITH THE DAUGHTER.

Now the poor girl who was forced against her will, is suffering with no one to help. I have search for her but couldnt find her.

SO ASK YOURSELF IF YOU ARE READY FOR IT BEFORE GIVING IN TO YOUR PARENTS DESIRE.

PoliticsStay In Bauchi For Seven Years And You Become Full Citizen-yuguda To Non Indigen by DeCleff(op): 9:47pm On Aug 24, 2012
Any Nigerian who stays in Bauchi State for seven years or more becomes an indigene of the state with all attendant rights and privileges, Governor Isa Yuguda assured yesterday as he vowed to uphold the provision of the Nigerian Constitution which confers such rights on non-indigenous inhabitants of states in the country.
Speaking during a courtesy visit, the Governor boldly declared that there are no non-indigenes or settlers in Bauchi State because even those who have not stayed for up to seven years in the state are regarded as being “in transition” to indigenous status.
Governor Yuguda, who emphasised the sanctity of the oath of office, vows to protect and uphold the import and contents of the Constitution while also citing his administration’s accommodation of up to 2 million refugees - almost half of the state’s 4.6 million population- displaced from troubled areas of neighbouring states who are not herded into makeshift camps in mosques or schools but provided with land where they can put up shelter and carry on with their lives.

He said the national emergency service officials were highly impressed with his unique approach to resettlement of displaced persons from outside the state compared to the practice in other states.
The orphans and vulnerable children in the state were also catered for under a law enacted by the state legislature which raises a special fund from 2% deductions from the salaries of all workers in the state the proceeds of which are spent on meeting the needs of the disadvantaged children.
All these developments were in furtherance of his constitutional responsibility for the welfare of all inhabitants of the state as well as his dogged pursuit of the enthronement of harmony and peaceful co-existence among the diverse people who inhabit the state.

Laments sabotage of Kafin Zaki Dam project
Governor Isa Yuguda of Bauchi State yesterday lamented the undue politicization and systematic sabotage of the realization of the Kafin Zaki Dam project which has the potential to create more than two million jobs from various agro-allied ventures that would thrive on 120,000 hectares of arable land for production of wheat, sugar, rice and vegetables.
The governor narrated how the project which was conceived in the aftermath of the1972-1974 drought had been intermittently stalled by vested interests including environmentalists protesting its negative impact on the migratory birds’ sanctuary in the Nguru wetlands in Yobe State and others claiming the dam would drain the Lake Chad and deny them irrigation for their farmlands.

“Now that the dam has not been constructed see the disaster it has caused by flooding and destroying vast areas of farmlands and numerous settlements creating poverty and spreading misery instead of the food sufficiency, employment and prosperity envisaged”, Governor Yuguda stated.
He pointed out that the Nguru wetlands have since been heavily silted and overgrown by grasses and shrubs thereby reducing the presence of the migratory birds apart from the fact that it the wetlands last only four months annually before drying up.
Lake Chad too had shrunk from about 25,000 square miles to a meager 5,000 square miles most of which is no longer within Nigerian territory even though only 1% of water from the Jama’are River flows into the lake.

Governor Yuguda who said if he had the N60 billion required for the project he would execute the project described the situation as an example of how we allow trivial sentiments to becloud our vision and divert attention from important issues of general economic progress while the people in advanced countries of the world exhibit unwavering commitment to the sensible utilization of their God-given resources to develop and progress.
He urged journalists to rise to the challenge of guiding and motivating our people in the direction of economic progress and political enlightenment rather than fanning embers of parochialism and sectarian intolerance.

The proposed dam would be of zoned earthfill construction and would be 11 kilometres-long. It would be designed with the potential to install a hydroelectric plant. The reservoir would have a storage capacity of 2,700 million cubic meters, and would be the second largest in Nigeria after the Kainji Dam.
It would irrigate 120,000 hectares of arable land on which cash crops could be grown. Potentially the project would support production of one million tonnes of sugarcane annually and provide over one million jobs in industries related to agriculture.

Project history
In 1984 the contract was terminated, but it was reinstated in 1992 by the Ibrahim Babangida regime. In 1994 the Sani Abacha regime terminated the contract again, and set up a judicial committee of inquiry into all aspects of the project. In 2002, funding was allocated for the project, but then abruptly withdrawn.
In 2008 Governor Isa Yuguda of Bauchi State awarded a contract to the Dangote Group to restart the abandoned dam project, a move that was supported by Abdul Ahmed Ningi, a Bauchi state representative who was House Leader in the National Assembly when the project was cancelled in 2002.

The federal Government should stop the contract given to former top Niger Delta militants Dokubo-Asari, Tompolo and others to guard pipelines or else Boko Haram members should be invited and given such contract, National President of African Youths for Conflict Resolution and Prevention Dr Suleiman Shuaibu, said in Kaduna yesterday.
Tompolo, Dokubo-Asari, Boyloaf and Ateke Tom are being paid respectively N5.1bn, N1.44bn, N608m and N608m yearly by the Nigerian Na-tional Petroleum Corporation (NNPC) to protect the pipelines from oil scooping.
“It is obvious that President Goodluck cannot handle the mantle of leadership of Nigeria because he cannot maintain justice. If Asari Dokubo, Tompolo and others can be given N6.32bn to guard pipelines that they are ones destroying and which is an offence punishable under the constitution of the federal republic of Nigeria, that shows the high level of injustice”, Shuaibu said.
Northerners, he said, are tired of Jonathan’s inhumanity and insincerity and therefore called on the northern elites to wake up from their slumber.

“Already, they have killed the northern states; we don’t have power, money, foods, our markets, business centres are all gone; Kano, Maiduguri, Kaduna, Yobe, Sokoto, Bauchi, Gombe, Plateau are all gone. Are we not Nigerians?,” he asked.
On his own part, the President of Civil Rights Congress of Nigeria (CRC), Shehu Sani, said the “widely revealed payment of billions of tax payers’ money to leaders of the Niger-Delta militants stands condemned”, saying it clearly exposes the facade and the inherent fraud in the truce and the amnesty program. However, what Sani forgot to mention is that the monies paid to the militants in security contracts are not "tax payers" money, but are oil money sourced from the Niger Delta. Sani also forgot to mention that ol money is what is sustaining EVERY state in the North which are literally not contributing much to the federal purse but are being sustained by the oil money sourced from the Niger Delta. Without federal allocation which is sourced from oil receipts, no northern state ccann Stan on its own.
Sani also said the “huge and scandalous” payment to pacify the militants clearly demonstrate that the agitation in the Niger-Delta was not about the plights of the suffering people there but a machantile and bogus approach to state extortion and blackmail.

PoliticsBoko Haram Breaks 700 Year Old Tradition by DeCleff(op): 7:06pm On Aug 16, 2012
The Kano Emirate Council announced on Wednesday that it would not observe the Durbah activities during this year’s Eid-el-Fitr coming up this weekend.
Media learnt that this would be the first time the Sallah Durbah would be cancelled in its over 700 years history.
Traditional Sallah Durbah and other activities have been practised in Kano since the advent of Islam to the ancient city.

A source close to the Emirate council told our correspondent that the suspension of all traditional Hawan Sallah activities was done mainly because of the prevailing security situation in the state.
However, the council said it was due to the health condition of the Emir of Kano, Alhaji Ado Bayero, who is the custodian of the tradition of the people of the state.
A senior councillor in the emirate, Alhaji Abbas Sanusi, on Wednesday briefed newsmen in Kano after the emir’s meetings with all the district heads of the Emirate council, including the Dan Majen Kano, Mallam Lamido Sanusi.
He said, “The Emir of Kano, Alhaji Ado Bayero, has directed me to inform all district heads and all other traditional rulers that traditional Sallah activities have been cancelled and everybody should stay indoor to celebrate the Sallah.’’

He said already, the council had taken steps to ensure that the Sallah was celebrated without any problem.
“The emir will only attend the Eid prayer on Sallah day,” he said.
Sanusi, who also holds the traditional title of Wamban Kano, added, “All other celebrations during Sallah from Sallah homage, visit to the state governor and the traditional Hawan Nassarawa where he interfaces, with his subjects were cancelled in view of the health condition of the Emir”.
It would be recalled that the Emir had recently undergone medical treatment in the United Kingdom from where he returned about five weeks ago.
Sanusi urged the people to pray for improved health of the royal father and for continuous peace in the state and the country.

Politics$3m Bribe: House Makes U-turn, To Give Otedola Open Hearing by DeCleff(op): 5:19pm On Jul 10, 2012
LAGOS — The House of Representatives Committee on Ethics investigating the $3 million cash for clearance scam involving Rep. Farouk Lawan and business mogul, Mr Femi Otedola, has been directed to reverse the decision to hold its hearings in secret.
The directive from the House leadership, weekend, came as it emerged that the Ethics Committee is to invite the Director General of the State Security Service, SSS, to shed light on the scam.

The decision of the ethics committee to hold its sittings in camera came as a major reversal to the transparency and accountability profile that the Speaker Aminu Tambuwal-led leadership had itself sought to portray in its actions.
The ethics committee which is investigating the alleged bribe offered by Otedola to Lawan to clear his name from the list of indicted beneficiaries of the administration’s subsidy regime got enmeshed in controversy last Tuesday after Otedola insisted that he must be heard in public and not in secret as the committee wanted.
Following the refusal of Otedola to submit to the secret hearing, Chairman of the House Committee on Ethics, Rep. Musa Gambo had described Otedola as “stupid,” saying the businessman abused the committee members in the short period he was with them in the secret session last Tuesday.

Otedola responded the following day, denying that he abused the committee members, insisting that he acted in decorum.
The ethics committee insistence on hearing Otedola in secret, itself, raised controversy in the House last Thursday as some members insisted that the conduct of the ethics committee violated their privileges as it sought to portray the House in a negative image.
A member of the House from Kaduna State, Simon Arabo, had at that sitting, in seeking to condemn the action of the committee on ethics in bringing the House into disrepute said: “What will it cost the committee if Otedola testifies in the open? There is nowhere in the House rules that says that Otedola must be

House sources disclosed that in a bid to reverse the negative impressions brought by the ethics committee, the House leadership, weekend, directed the committee to reverse its decision and hold its sessions in public.
Sources disclosed last night that the Chief Whip of the House, Isiaka Bawa, had conveyed the decision to the committee.
Similarly, the Director-General of the SSS, Mr. Ita Ekpeyong, is to be invited to brief the Ethics Committee on the Farouk issue.
The SSS reportedly issued the $620,000 allegedly offered by Otedola to Lawan as bribe money.
Lawan has said the money received by him was collected as evidence of the pressure from the oil marketers, while Otedola said that it was marked money to show the dishonesty of the ad-hoc committee.

PoliticsFG Declares Showdown: Subsidy Looters To Face Prosecution From Next Week by DeCleff(op): 4:42pm On Jul 10, 2012
This is coming just as president Goodluck Jonathan held a crucial meeting with heads of the other two arms of government, including the Senate President, David Mark; Speaker of the House, Alhaji Aminu Tambuwal and the Chief Justice of Nigeria, Justice Dahiru Musdapher to mull the way forward on the war against corruption.
Attorney General of the Federation and Minister of Justice, Mohammed Adoke who disclosed federal government's readiness to prosecute alleged looters of the country's funds meant for fuel subsidy in the country said: "The report was not discussed as an issue, but assurances were given that as soon as the EFCC finishes its assignment which is very soon, you will begin to see prosecution probably in the next one week.
"We will begin to prosecute because the EFCC has gone very far. So, Nigerians should be rest assured that this is not an issue that will be swept under the carpet. We have gone this far because we want a proper and painstaking investigation done so that when we charge people to court there will be no lapses or loopholes for lawyers to explore", the AGF added.

Adoke who spoke to State House Correspondents immediately after the meeting of heads of the three arms of government admitted that the meeting was to review strategy on fighting corruption, saying, "Yes, we are coming out with a national strategy on the fight against corruption, and that strategy will involve the three arms of government".
Also present at the meeting from the executive's side were the Vice President, Secretary to Government of the Federation, the Head of Service, Central Bank Governor, Chairman of the Economic and Financial Crimes Commission (EFCC) and the Chairman of the Independent Corrupt Practices and other Related Offences Commission (ICPC).

PoliticsTime To Decide If We Can Remain As One Country- Northern CAN by DeCleff(op): 3:59pm On Jul 10, 2012
The Christian Association of Nigeria (CAN) in 19 Northern States and the Federal Capital Territory (FCT) yesterday in Kaduna condemned the persistent killings of Christians in the North and asked for a Sovereign National Conference.
In a statement yesterday reacting to last Sunday’s murder of Senator Daylop Dantong representing Plateau North Senatorial District of Plateau State, Hon. Gyang Danfulani, Majority leader in the Plateau State House of Assembly, among estimated 63 people killed in Barkin Ladi Local Government, northern CAN said: “Those people who want to live by the swords and bombs can have their own country and kill themselves. Those who want to live in peace and catch up with development that is going on in some other parts of the world can have their country and make progress”.

Also the Arewa Consultative Forum (ACF), has condemned the killing, and called for a halt to the violence.
The statement from Northern CAN signed by its Public Relations Officer, Mr Sunday Oibe reads: “We Christians in Northern Nigeria are calling on President Goodluck Jonathan to demonstrate enough political will to bring an end to the activities of terrorist groups in the north.
“The President once declared that there are some Boko Haram members in his government; we can now see the manifestation of this, especially in the activities of the Special Task Force in Plateau State which failed to respond to distress calls during the massacre of rural communities in Barkin-Ladi Local government Area the state.

“This time around, the President should stop at nothing until he brings the activities of terrorists to an end.
“We will not accept a situation where only one tribe in Nigeria is trying to bring the entire country to its knees. This is absolutely unacceptable.
“It is activities of some members of this tribe that is undermining the National Youth Service Scheme (NYSC) which seeks to integrate us as a nation.

“One tribe must not be seen to be lording it over the rest of Nigerians. Nigeria is bigger than any tribe or religion. We must, as a people with conscience, sense of patriotism and sense of justice and fair play resist these mindless, barbaric killings. We call on the National Assembly to forget about their personal interests and convoke a National Conference to determine whether we should continue to live together.
“We urge all peace loving Nigerians who want to live freely and make progress to demand the convocation of a National Sovereign Conference so that we will bring an end to these killings and destruction of property.”
This is the only way we can peacefully bring an end to this madness so that those who want to develope can make progress and those who want to be killing can go on killing themselves when they are in their own country.

“We urged the Christians in Plateau state not to lose hope and faith in the Lord Jesus Christ in the midst of these unprovoked mass killings including the killing of Senator Gyang Dantong and the Majority Leader of the Plateau state House of Assembly, Hon. Gyang Fulani.
“We want to state categorically that we are not accepting the usual condemnation by government which has become a mere slogan. The Government must not just condemn it, it must fish out the perpetrators and sponsors of this wickedness and bring them to justice for the sake of peace and stability.
“We believe that there are some powerful elements who are behind the activities of these so called herds men. We want to ask pertinent questions: Has the government of Nigeria legalised possession of arms by unauthorised individuals? If the answer is ‘no’, how did the Fulani herds men in the north come to be in possession of sophisticated weapons, including military uniforms and bullet proof vests?

“Who supplied them these weapons and the uniforms? Where were the Special Military Task Force deployed to Plateau State when this massacre was going on? Why did it take them five hours to get to the scene of the incident?
“Reports reaching us said the Special Task Force was contacted by 4: am. It was about 9:30 am that the task force went there. We understand that it was the mobile police that went to the scene of the incident. Whose orders is the Special Military Task Force carrying out in Plateau?
“If the Barakin-Ladi Local Government chairman called the Task Force and they promised they were coming, why did the Task Force fail to go until after they terrorists had finished their operation?
“Our stand as Christians in the North is that, we have lost confidence in the ability of the Special Task Force in Plateau to protect the lives and property of Christians in the state. We will not accept any intimidation of Christians by security agencies over this issue.

“If the government wants peace to reign in this country, then it must go beyond the usual condemnation and rhetoric by exposing the sponsors of these so called Fulani herds men that have continued to caused havoc to Christians in Plateau, Benue, Taraba and the Southern part of Kaduna state.
“It is becoming very dangerous for Christians to go about their legitimate businesses in the north as a result of terrorists’ activities.
On its Part, the National Publicity Secretary of the, Mr. Anthony Sani ACF in a Statement sent to Journalist by e-mail said: “the news of the killing of innocent people in some villages in Barki Ladi of Plateau state, Nigeria, has come to Arewa Consultative Forum with great shock.
“Tremendous shock not only because the killing included women and children, but also because they have occurred just after the recent reconciliatory meetings between the wary factions, as well as after the recent visit by the new National Security Adviser to Plateau state in continuation of his search for how best to address the security challenges across the country.

“More depressing has been the following killing of Senator Dantong and the Chief Whip of Plateau state House of Assembly as well as the wounding of a member of the House of Reps.
“It is, therefore, with heavy heart that ACF wishes to call on all those who derive pleasure in violent killing of neighbours as their own ways of addressing grievances to stop such drift to the stone age when communal violence was the deed in fashion. In the twenty first century, such approach is certainly primitive and barbaric, especially when regard is paid to the fact that under democracy there are due process of addressing any perceived grievances.
“ACF also calls on the governments and security agencies to prosecute perpetrators of such heinous crimes against humanity as deterrence for future occurrences.
“And finally, the forum commiserates with families of those killed, and prays to God to provide them with the fortitude to bear the irreparable losses .May their souls rest in perfect peace”.
