Recovered N3b: I’ve no case to answer, ex-NNPC boss, Yakubu tells court Eric Ikhilae, Abuja by Eric Ikhilae, Abuja December 5, 2018 …Court to hear no-case submission, Jan 17 Former Group Managing Director (GMD) of the Nigerian National Petroleum Corporation (NNPC) Andrew Yakubu has said he has no case to answer in relation to his trial before the Federal High Court in Abuja. Yakubu is being tried on a six-count charge brought against him by the Economic and Financial Crimes Commission (EFCC), in which he is charged with failure to declare assets and money laundering. Read Also:NNPC loses over $800m revenue to contract breaches The EFCC had, on February 3, 2017 raided Yakubu’s house, located on Chikun Road, Sabon Tasha area of Kaduna South Local Government Area of Kaduna State, from where it claimed to have recovered $9,772, 800 USD and £74,000.00, a recovery which informed the charge. It is the ex-NNPC’s contention, in the no-case submission he filed on November 6 this year, that he has no case to answer. Yakubu argued that the essential elements of the charge brought against him, was not proved by the prosecution to warrant his being called to enter defence. According to the defendant, the evidence led by the prosecution’s seven witnesses did not establish a case against him to require him to defend himself. He is praying the court to strike out the charge and discharge and acquit him. Prosecuting lawyer, Ben Ikani announced the closure of the prosecution’s case on October 17 this year, at the conclusion of the testimony by Suleiman Mohammed, an official of the EFCC (who testified as 7th prosecution witness), following which the court adjourned to December 5 for the defence to open its case. In his testimony, Mohammed explained how a team of EFCC’s investigators, which he was a member, recovered the money, estimated at N3 billion, which comprised of $9.7 million and ?£74,000. Led in evidence by Ikani, Mohammed said the money was hidden in a fireproof safe, allegedly belonging to Yakubu. The huge safe has since been tendered in evidence in the proceedings. The prosecution’s 7th witness said the recovery process and the counting of the money were recorded and saved in a 32-gigabyte memory card and in another two mini disks, which were admitted as exhibits by the court on October 17 this year. Yesterday, Ikani was absent in court. There was no reason why he was not in court. Defence lawyer, Anone Usman told the court that the case was adjourned to December 5 for the defence to open its case. Usman said, upon the closure of the prosecution’s case, the defence filed a no-case submission on behalf of the defendant, as provided under the Administration of Criminal Justice Act (ACJA) 2015. He said the no-case submission was filed on November 6, 2018 and served on the prosecution on the same date. Usman later applied for a date for parties to adopt the processes in respect of the no-case submission. Justice Ahmed Mohammed adjourned to January 17 next year for adoption of written addresses on the no-case submission. How EFCC recovered $9.8 million from Yakubu, Ex-NNPC GMD February 10, 2017 A special operation conducted by operatives of the Economic and Financial Crimes Commission on February 3 on a building belonging to a former Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), Andrew Yakubu, in Kaduna, yielded the recovery of $9,772,800 (Nine Million, Seven Hundred and Seven Two Thousand, Eight Hundred United States Dollars) and another sum of £74,000 (Seventy Four Thousand Pound Sterling) cash. The huge cash was hidden in a fire proof safe. The spokesperson for the EFCC, Wilson Uwujaren, said in a statement that the surprise raid of the facility was sequel to an intelligence which the commission received about suspected proceeds of crime believed to be hidden in the slums of Sabon Tasha area of Kaduna. On arrival at the facility, the caretaker of the house, one Bitrus Yakubu, a younger brother to Andrew Yakubu, disclosed that both the house and the safe where the money was found belong to his brother, Andrew Yakubu. When the safe was opened it was discovered that it contained the sum of $9,772,800 (Nine Million, Seven Hundred and Seventy Two Thousand, Eight Hundred United States Dollars) and another sum of £74,000 (Seventy Four Thousand Pound Sterling). On February 8, 2017, Mr. Yakubu reported to the Commission’s Zonal office in Kano and made statement wherein he admitted ownership of the recovered money, claiming it was gift from unnamed persons. ‘I handed over $5m to him’ — Obanikoro testifies against Fayose in court January 21 Musiliu Obanikoro, a former minister of state for defence, on Monday testified against Ayodele Fayose, ex-governor of Ekiti state, before a federal high court in Ikoyi, Lagos. Obanikoro said he gave various sums of money amounting tp $5 million to Fayose in the build-up to the 2014 governorship election in Ekiti. The Economic and Financial Crimes Commission (EFCC) arraigned Fayose alongside his company, Spotless Investment Limited, on an 11-count charge bordering on fraud and money laundering, in October 2018. The ex-governor is facing trial in connection with N1.299 billion and $5.3 million allegedly allocated to him by the office of the national security adviser (ONSA) from N4.65 billion “slush fund allegedly shared by ONSA”. According to Obanikoro, Fayose called him in 2014, asking if there was a message from ONSA. He explained that he received a sum of N200 million on June 5, 2014, and another sum of N2 billion on June 16, 2014, out of the imprest from the ONSA. A total of N560m, he said, was transported through the Murtala Muhammed Airport in Ikeja, Lagos, to Ekiti and delivered through one Biodun Agbele to Fayose. “In June 2014, when we were approaching the gubernatorial election in Ekiti State, I received a call from Mr. Fayose wanting to know if there was any message from the office of the then National Security Adviser, NSA, Col. Sambo Dansuki (retd). But I said ‘no’ and promised to get back to him,” Obanikoro said. “I later confirmed to him that a message had come from the Office of the NSA. Prior to that time, I had a responsibility of maintaining the account for the security of Lagos State. “I called Mr. Fayose to ask him how he wanted the money to be remitted. Mr. Fayose told me that I should change the Dollars into Naira. “I actually wanted to say that Diamond Bank should remit the Naira equivalent to their Bank in Ekiti. But the manager said they could not do that in Ekiti because they did not have such capacity. “On June 17, 2014, a sum of N560 million was transferred to him. I instructed the bank manager to bring the money to Akure, and it was brought through the private wing of Ikeja, Lagos Airport. “The money was loaded into two aircraft. Mr. Fayose had earlier informed me about Mr. Biodun Agbele, whom he described as his contact person to take delivery of the money. “Then, I sent Mr. Agbele and the Bank manager to Spotless Hotel in Ekiti.” In November 2018, Damola Otuyena, head of cash and transit services of Diamond Bank, serving as a witness in the trial, said N1.2 billion was moved to Ekiti for Fayose using three aircraft. Obanikoro further told the court there was a phone conversation on another occasion to deliver another huge sum of money to Fayose three days to the state election. He added that he wrote a statement to the EFCC while he was out of the country on the transactions. “The money, again, was from the NSA imprest,” he said. “There is a young man called Kareem Taiwo, who was working for the government on security issues. “He was the one I told that we had a very serious security issue in Lagos around that time. But I don’t think I want to divulge the reason for the security account through which the monies were issued. “I was outside the country for about one year. I was in the United States of America, USA. Anambra monarch donates campaign vehicle to Buhari January 19, 2019 His Royal Highness, Igwe Dennis Ezebuilo, an Anambra monarch on Saturday in Abuja donated a Toyota Hilux vehicle to President Muhammadu Buhari for his campaign. Ezebuilo said that he made the donation in appreciation of the sterling performance of Buhari since he assumed office. The paramount ruler of Amanuke kingdom, Awka-North, Anambra State, said that the re-election of President Buhari would consolidate his achievements.
