How Supreme Court’s verdict affirmed CCT’s powers by Joseph Jibueze January 17, 2019 Chief Justice Walter Onnoghen, who is challenging the jurisdiction of the Code of Conduct Tribunal (CCT) to try him for alleged non-declaration of assets, had given judgments affirming the Tribunal’s powers. In one of the judgments delivered on July 12, 2013, he held that the CCT had exclusive jurisdiction to deal with all violations contravening any of the provisions of the Code of Conduct Bureau. He also held that the provisions “expressly ousted the powers of ordinary regular courts in respect of such violations.” Chief Justice Onnoghen’s lawyers are arguing that the charges against him should first be decided by the National Judicial Council (NJC). Can the NJC not be considered an “ordinary regular court” in the circumstance? The judgment was in a suit numbered SC.279/2012 before Justices Onnoghen, Christopher Mitchell, Chukwuma-Eneh, Olabode Rhodes-Vivour, Clara Bata Ogunbiyi and Kumai Bayang Aka’ahs. The case was between Ismaeel Ahmed and Alhaji Nasiru Ahmed, Congress for Progressive Change (CPC), CPC Kano State Chapter chairman and the Independent National Electoral Commission (INEC). Interpreting Paragraph 12 of the Fifth Schedule of the 1999 Constitution (as amended) as regards CCT’s jurisdiction, Justice Onnoghen held: “’…the said paragraph 12 provides as follows: ‘Any allegation that a public officer has committed a breach of or has not complied with the provisions of this Code shall be made to the Code of Conduct Bureau.’ “The foregoing provisions are clearly unambiguous and so construed literally mean that any breaches of any provisions of the said 5th schedule or matters of noncompliance with any provisions of the Code shall, (meaning that it is mandatory i.e. must) be made to the Code of Conduct Bureau that has established its Tribunal with the exclusive jurisdiction to deal with any violations of any provisions under the Code. “If I may emphasise, any violations shall be made to Code of Conduct Bureau. The provisions have made it mandatory to take any matters so covered by the 5th schedule (supra) to the Code of Conduct Bureau and not to any ordinary regular Courts as has been done in this instance. “If I may repeat, the Code of Conduct Tribunal has been established with the exclusive jurisdiction to deal with all violations contravening any of the provisions of the Code as per paragraph 15(1). This provision has expressly ousted the powers of ordinary regular courts in respect of such violations. “The Tribunal to the exclusion of other courts is also empowered to impose any punishments as specified under sub-paragraphs (2) (a), (b) & (c) of paragraph 18 as provided in sub-paragraphs 3 and 4 of paragraph 18 while appeals shall lie as of right from such decisions to the Court of Appeal. “Simply put, to tackle any violation of the Code starts before the Code of Conduct Bureau Tribunal to the Court below on appeal and on a further appeal therefrom to this Court. Read also: CCT trial: Fed Govt freezes Onnoghen’s five accounts “As can be seen, the lower Court exercises appellate jurisdiction over the Code of Conduct Tribunal and no more.” In his contributory judgment in Ahmed V. Ahmed & Ors (2013) Lpelr-21143(SC), Justice Onnoghen said regarding breach of public conduct: “It is the contention of the cross appellants that the initiation of the appeal process etc by M.K. Dabo esq is in violation of the Paragraphs of the 5th Schedule thereby rendering the actions so taken and the processes null and void. “The real important question to ask at this stage is, what is the consequence of the violation of the aforesaid paragraphs of the 5th Schedule to the 1999 Constitution? “The answer to the above question is to be found in Paragraph 12 of the said Part 1 of the 5th Schedule which enacts as follows: -‘Any allegation that a public officer has committed a breach of provisions of this code shall be made to the Code of Conduct Bureau.’ “It is my considered view that the above provision is very clear and unambiguous. It provides a remedy in the event of any alleged breach of the provisions. You know the social media for what they are now. It is not true. His Excellency hasn’t gone anywhere,” he said. Patience Jonathan Tenders Video Evidence To Explain How She Got $8.4m And N7.4bn BY SAHARAREPORTERS, NEW YORKJAN 16, 2019 Patience Jonathan, a former First Lady of Nigeria, has presented to the court some video clips as evidence that the $8.4 million and N7.4 billion claimed to be proceeds of unlawful activities, were generated through legal means. The video clips were presented to Justice Mojisola Olatoregun of the Federal High Court in Ikoyi, Lagos, on Tuesday during the forfeiture hearing of the sums filed by the Economic and Financial Crimes Commission (EFCC). On April 20 last year, Justice Olatoregun had given an order for interim forfeiture of the funds. Mrs Jonathan, alongside Globus Integrated Services Ltd, Finchley Top Homes Ltd., Am-Pm Global Network Ltd, Pagmat Oil and Gas Ltd and Magel Resort Ltd and Esther Oba, were accused of unlawful activities and conspiracy. N1.085billion and N226.3million discovered in Finchley’s Ecobank account, N39.4million also in Finchley’s Diamond Bank account, N55.9million discovered in Pagmat Oil and Gas Diamond Bank account are part of the funds handed over in the interim to EFCC. Rotimi Oyedepo, counsel to EFCC called on the court to grant final handover of the funds to the Federal Government. However, Chief Ifedayo Adedipe (SAN) countered the EFCC’s request saying hard evidence were not given by the anti-graft agency to convince the court that its application be granted. Adedipe said the claims by EFCC that the funds are illegal proceeds does not hold water, noting that the agency failed in calling Patience to its office to reveal the source of the funds and the agency did not charge her for any offence. Joining the defendant, Chief Mike Ozekhome (SAN), counsel to the companies involved in the case told the court that according to the provisions of the Advanced Fee Fraud Act, EFCC’s submission for the final handover of the funds was too early. Ozekhome said that if the companies’ affidavits to show cause are deliberated upon and the court finds no merit in them, then the EFCC’s request could prove to be reasonable. Ozekhome said an affidavit to show cause was filed by his clients, one of the companies displayed its certificate of incorporation, its board agreement that Patience Jonathan be made co-signer, and bank documents to show that accounts were signed by other individuals who are co-signers. According to him, one of the companies implicated in the case rolled in income from the sale of groceries, drinks, lighting, among others, and that there was video evidence to back this claim up. EFCC invites Fani-Kayode, Odumakin over fake news on CJN Onnoghen January 16, 2019 Samuel Ogundipe The Economic and Financial Crimes Commission (EFCC) said on Wednesday that two politicians who circulated a fake news on Tuesday would be questioned today. Tony Orilade, a spokesperson for the anti-graft office, said the news could injure the country’s interest and said Femi Fani-Kayode and Yinka Odumakin would have to explain their action. Mr Fani-Kayode, a former aviation minister, posted a tweet Tuesday afternoon that EFCC operatives had surrounded the residence of the Chief Justice, Walter Onnoghen. Mr Odumakin, an Afenifere chieftain, also posted a video saying he had learnt of the EFCC’ move against the top jurist. Both claims turned out false by Tuesday night, with Mr Onnoghen himself denying the claim. Mr Onnoghen is facing allegations of false asset filings with the Code of Conduct Bureau. Mr Orilade, who spoke at the conference of Online Publishers Association of Nigeria which is underway in Abuja, said if both men failed to disclose useful information, they may not be released on time. Ilorin locked down for Buhari’s re-election rally By Romoke W. Ahmad, Ilorin Published Date Jan 9, 2019 Ilorin, Kwara state capital, was on Wednesday locked down by scores of All Progressives Congress (APC) women and youth who staged a peaceful rally in support of President Muhammadu Buhari’s re-election. The rally which was organized by Making A Different (MAD) for Kwara and Kawu Modibbo Group saw the procession affecting human and vehicular traffic on the popular Muritala Mohammed way, as vehicles were forced to move at snail pace. The rally started around 9.30 am around the popular Post Office Roundabout in the metropolis and ended at the campaign office of a former APC governorship aspirant Ishaq Modibbo Kawu in Sango area. In his remark at the event, the state APC Chairman, Hon Bashir Bolarinwa, urged aggrieved members of the party to forget their grievances and work for the success of the party at polls. Represented by his vice chairman Abdullahi Samari, he said “don’t sell your permanent voters’ cards to them. Your PVC is your power. If they bring money, collect the money. After all it is our money.
