No armed conflict can be sustained without the support of the local populace. If the government refuses to obey the judgment, there are judicial processes that can be used, issue contempt proceedings against the Attorney general, he does not have immunity. No need to cut off the nose to spite the face |

Until politicians have no say in the appointment and promotion of judges, this is what we will continue to experience. The process of subjecting the appointment of judges to confirmation of the senate or house of assembly brings politics into the process. As we know, Governors control state houses of assembly. The appointment of judges should strictly be between the National Judicial Council and the Nigerian Bar Association. |

The new suit, filed solely by the PDP as the petitioner/plaintiff, is different from the one filed at the Federal High Court in Abuja by members of the PDP in Zamfara State, seeking to the removal of the governor. The suit is supported by a 26-point affidavits deposed by the National Secretary of PDP, Senator Umar Tsuari. The party, in the suit filed by Mr. Emmanuel Ukala (SAN), joined Senate President, Dr. Ahmad Lawan; the Speaker of the House of Representatives, Hon. Femi Gbajabiamila; the Chief Judge of Zamfara State and the Speaker of the Zamfara State House of Assembly, as defendants. Other defendants are the APC and the Independent National Electoral Commission (INEC). Matawalle, who last month joined the APC, became governor after the Supreme Court had annulled the victory of the APC, which won the 2019 general election in the state, and declared the party (PDP) with the second largest lawful votes as winner. Others on the PDP legal team include Mr. Edward Obiokor, M.S. Agwu, Miss O.J. Iheko, Dike Udenna, Okechukwu Omeodu and Reginald WB Nnwoka. The first defendant in the new suit is the INEC while the APC is the second defendant. Lawan is the third defendant and Gbajabiamila is the fourth defendant. The speaker of the state House of Assembly, Matawalle and the state chief judge are the fifth to seventh defendants respectively. In the suit, the PDP asks the Supreme Court to declare vacant the seats of all its members in the National Assembly and Zamfara State House of Assembly that defected to the APC. The party sought accelerated hearing of the suit, saying the matter should be determined within 30 days after the service of summons on them, inclusive of the day of such service. It said the apex court should cause the defendants for an appearance to be entered for them upon the receipt of the summons. In court documents obtained by THISDAY at the weekend, the PDP is seeking a declaration that “sequel to the decision of the Supreme Court in SC. 377/2019: All Progressives Congress (APC) and Another v. Senator Kabiru Garba Marafa and 179 others (2020) 6 NWLR (Pt. 1721) 383, only members of the Peoples Democratic Party (PDP), the plaintiff herein, are entitled to occupy or hold the office of governor, deputy governor, or member of the House of Assembly of Zamfara State or occupy any position or seat as a senator or a member of the House of Representatives of the Nigerian National Assembly for the purpose of representing any senatorial district or electoral constituency in Zamfara State for the period beginning from May 29, 2019 and ending on May 28, 2023. “A declaration that the Supreme Court of Nigeria, having expressly held in SC. 377/2019: All Progressives Congress (APC) and Another v. Senator Kabiru Garba Marafa and 179 others (2020) 6 NWLR (Pt. 1721) 383 at 433 that “a party that has no candidates in an election cannot be declared the winner of the election”, that all the votes credited to the alleged candidates of the All Progressives Congress “in the 2019 general elections in Zamfara State are wasted votes” and having “ordered that candidates of parties other than the 1st appellant (the 2nd defendant herein) with the highest votes and the required spread stand elected into the various offices that were contested for in Zamfara State in the 2019 general elections, members of the All Progressives Congress (APC) are foreclosed and debarred from occupying or holding the office of governor or deputy governor of Zamfara State, or the membership of the House of Assembly of Zamfara State or senator in respect of any senatorial district of Zamfara State or membership of the House of Representatives in respect of any constituency in Zamfara State for the period of May 29, 2019 until May 28, 2023. “A declaration that in view of the decision of the Supreme Court of Nigeria in Faleke v. INEC (2016) 18 NWLR (Pt. 1543) 61 at 158, all the votes cast for the candidates of the plaintiff in 2019 general elections in respect of the offices of governor and deputy governor of Zamfara State, in respect of membership of the House of Assembly of Zamfara State, in respect of senatorial seats in all the senatorial districts in Zamfara State and in respect of membership of the House of Representatives for all the constituencies in Zamfara State, are votes cast for the plaintiff and the said votes are transferable at the instance of the plaintiff to its candidates.” The PDP, based on its submissions, is seeking “an order of mandatory injunction “compelling the 1st defendant by itself or by its servants, or agents to accept the list of the plaintiff’s candidates issued by the plaintiff for the purpose of holding and occupying the office of governor of Zamfara State, members of the House of Assembly of Zamfara State, members of the Senate in respect of the senatorial districts in Zamfara State and members of the House of Representatives in respect of constituencies in Zamfara State and to issue certificates of return to each of the said candidates for the purpose of holding and occupying the said offices now purportedly occupied by members of the 2nd defendant in defiance of the decision of the Supreme Court in SC. 377/2019: All Progressives Congress v. Senator Kabiru Garba Marafa and others for the unspent electoral term of office of May 29, 2019 to May 28, 2013. The main opposition party also wants the apex court to issue “an order of injunction restraining the 3rd defendant by himself or by his servants or agents from recognising or continuing to recognise any member of the 2nd defendant (All Progressives Congress), claiming title to or purporting to represent any senatorial district in Zamfara State for the term of office of May 29, 2019 to May 28, 2023 or in any manner whatsoever denying recognition to or withdrawing recognition from the plaintiff’s candidate representing the senatorial district. “An order of injunction restraining the 4th defendant by himself or by his servants or agents from recognising or continuing to recognise any member of the 2nd defendant (All Progressives Congress), claiming title to or purporting to represent any House of Representatives constituency in Zamfara State for the term of office of May 29, 2019 to May 28, 2023 or in any manner howsoever denying recognition to or withdrawing recognition from the plaintiff’s candidate representing the constituency. “An order of injunction restraining the 5th defendant by himself or by his servants or agents from recognising or continuing to recognise any member of the 2nd defendant (All Progressives Congress) claiming title to or purporting to represent any constituency in Zamfara State for the term of May 29, 2019 to May 28, 2023 or in any manner howsoever denying recognition to or withdrawing recognition from the plaintiff’s candidate representing the constituency. |
Odichukumma Kelvin Igweani Sodiq Oyeleke with agency report 5 July 2021 Police in the United Kingdom have said that a Nigerian-born footballer, Odichukumma Kelvin Igweani, was gunned down after killing a neighbour. UK-based newspapers, DailyMail and TheSUN quoted the police as alleging that the 24-year-old Nigerian also held a toddler captive. The police said Richard Woodcock, a 38-year-old council highways officer had raced to help after hearing screams during a domestic dispute at the first-floor property when he was killed by the footballer. The security agency also claimed that Woodcock’s body was found on the floor of Igweani’s flat in Milton Keynes, Bucks. David Bannister from The Independent Office for Police Conduct told Milton Keynes Coroner’s Court that the young footballer was shot four times and a taser was also discharged. Igweani, known as Kelvin, was pronounced dead at the scene and Mr Woodcock died of head injuries. “The toddler remains in a life-threatening condition in hospital,” the IOPC said today. Detective Chief Inspector Stuart Blaik told a linked inquest into both deaths that officers had been called by neighbours to an “ongoing disturbance” at about 9.40 am on Saturday, June 26. He said, “Neighbours reported hearing a female screaming and shouting for help. A female and young child managed to flee the address prior to police arrival. “Richard Woodcock from the neighbouring property had gone to the address to help save a young boy as it was believed he was still in the property and at risk of significant harm.” He added: “Having had to force entry, the officers immediately saw a deceased male, who has now been identified as Richard Woodcock, on the floor and were also aware of a distressed young child within the address.” DCI Blaik told the brief hearing, attended by Richard’s widow and family members: “As entry was gained another male, now known to be Kelvin Igweani, immediately became aggressive towards the officers. “A Taser was discharged but this was ineffective, and Igweani barricaded himself within the main bedroom. “A child could be heard crying along with sounds of an ongoing assault. Entry was gained to the bedroom at which point a police firearm was discharged. “Police officers and ambulance staff gave immediate first aid but Kelvin Igweani was declared deceased at 10.33hrs.” A postmortem examination performed by Dr Lockyer showed that Mr Woodcock died from traumatic head injuries. DCI Blaik added that Kelvin Igweani was suspected of his murder and the serious assault of the young male child within the address. “It is understood that Kelvin’s mental health had been deteriorating in the weeks preceding this incident,” he said. The sportsman’s devastated parents were in court, accompanied by a lawyer, to hear how their son was slain by officers in his home in Milton Keynes, Bucks, on Saturday morning. Mr Bannister told how police had been called to a “domestic incident” at about 9.40am on June 26 at a block of flats in Denmead, Two Mile Ash, on the outskirts of the town. He said, “Thames valley Police received a 999 call after reports of a domestic incident. A double armed auto response was deployed to the scene. “On their way they were informed that another male was injured and a child was at risk. “Officers forced entry and they immediately came across a deceased male. They were confronted by Mr Igweani. A taser was deployed but it was ineffective. “Mr Igweani moved into another room and closed the door. He was in the room with a young child. Officers believed Mr igweani was harming the child and forced entry. “One officer fired four shots at him and a taser was also discharged. He was pronounced dead at 10.39.” Igweani died from gunshot wounds to the chest. His body was formally identified by his family. In a statement, his family said, “We have always been so proud of Richard and everything that he has achieved in life. “We are devastated that Richard has been taken from us in such circumstances, but we are also so immensely proud of the sacrifice that he has made to try and save a little boy’s life. “His actions on Saturday morning were the type of man he was and that is how we would like him remembered. “A lot of people loved Richard, probably more than he ever realized, and he will be a huge loss to all of his friends, family and work colleagues.” His wife, who has not been named, said, “Richard, it has been a blessing to share my life with you, my dearest friend, my biggest love, my soul mate. My kind, generous, funny, clever, cheeky husband. “Thank you for loving me and being the best father to our children.
