Alleged $11mn Fraud: Obinwanne Okeke accuses F.B.I. of illegally searching his phones, laptops

Obinwanne Okeke, the 32-year-old Nigerian arrested in the United States last August, has accused the Federal Bureau of Investigation of accessing his mobile phones and laptops illegally, a development he said was enough ground for the charges against him to be dismissed.

Mr Okeke, through his lawyers, said in a preliminary objection filed in the U.S. court in December that his phones were seized by the F.B.I. agents that arrested him and searched without proper procedure.

The lawyers said when Mr Okeke was arrested at the airport while waiting to depart for Nigeria in August 2019, federal agents asked him to unlock his iPhone and Macbook Pro without first reading him his Miranda rights. The rights involve telling a suspect under arrest they have the right to remain silent and not cooperate with authorities, especially when the suspect has not contacted a lawyer.

Mr Okeke’s lawyers, The Iweanoges Firm, said the Nigerian businessman was not told he had a right not to provide passwords to his devices to F.B.I. or other American authorities, which made him assume he had no choice but to give them the codes.

In the preliminary objection, the lawyers further argued that all evidence obtained from Mr Okeke’s phones and laptops should fall under the ‘fruit of the poisonous tree’ doctrine and subsequently removed from admissible evidence in court during trial.

In the December 15, 2019 filing, the Iweanoges Firm said the F.B.I. held on to Mr Okeke’s devices for more than two weeks after they arrested him and allegedly coerced him to release their passwords before obtaining a court warrant to search them.

This procedural mishap should render any evidence obtained from the devices useless, they said.

In their response, filed on January 24 in the United States District Court for the Eastern District of Virginia, where Mr Okeke is facing two counts of computer and wire fraud, the prosecutors said the defence lawyers were being frivolous with their allegations.

They said Mr Okeke was read his Miranda rights at about 11:35 p.m. on August 6, 2016, moments after he was taken into custody at the Washington Dulles International Airport and handed over to the F.B.I. airport command.

The prosecutors said Mr Okeke was informed he could remain silent, but he willingly agreed to let authorities search his devices by providing passwords to them.

The prosecutors further argued that even if it were true that Mr Okeke was not read his Miranda rights as his lawyers claimed, the evidence collected from his phone cannot be dismissed because they only corroborated evidence already collected in the year-long investigation into his alleged involvement in the $11 million fraud.

They also said since Mr Okeke is an educated adult with both undergraduate and graduate degrees, who has travelled extensively across the world over the years, then it cannot be argued that he did not know the implication of submitting his passwords for federal agents to collect information.

Mr Okeke became a prime person of interest after F.B.I. received complaints from Caterpillar, an American heavy equipment manufacturer, that some unscrupulous individuals had swindled its U.K. subsidiary, Unatrac, of $11 million. The fraud was allegedly committed through business email compromise, a trending fraudulent scheme involving the use of a company email to spoof other officials in the same organisation.

The F.B.I. said months of investigation exposed Mr Okeke as the principal suspect that executed the fraud. The agency later obtained a warrant for his arrest when he visited the U.S. and was about to return to Nigeria on August 6, 2019.

A few days after his arrest, Mr Okeke was indicted by a grand jury of committing the fraud based on preliminary evidence submitted by the F.B.I. But he later argued that he was not guilty, dragging the matter to trial.

A judge had previously fixed February 18 for the commencement of trial in the matter, but it was adjourned after preliminary objections from the defence team forced both parties to seek another date. Mr Okeke, however, remained in custody.

Ahead of the February 18 date initially scheduled for commencement of trial, the defence team began raising preliminary objections to get the matter dismissed and for Mr Okeke to return to Nigeria.

In the first objection, they argued that the F.B.I. had no powers to arrest Mr Okeke because he did not commit the offence on American soil. They also said no American victim, either as individuals or groups, was identified by authorities.

But prosecutors dismissed the lack of jurisdiction argument as frivolous because Mr Okeke visited the U.S. and stayed in Virginia during the period he allegedly committed the $11 million fraud, which spanned several months.

They also said more victims who are Americans may still be introduced during trial, saying their indictment filing was only to show enough grounds for a judge to issue a warrant for Mr Okeke to be arrested.

The second defence argument bordering on coercion of Mr Okeke was also rejected by the prosecutor. But both parties agreed that the court should approve additional time for preliminary matters to be resolved and Mr Okeke to remain in custody until trial evential begins.

The Adamawa Council of Nigeria Union of Journalists ( NUJ) has declared a one week mourning for late Maxwell Nashon, a journalist who was murdered on Wednesday in the state.

Nashon was a reporter with Fombina FM, Yola, before he was killed.

Mr Ishaku Donald, the state NUJ Chairman said this in a statement on Friday in Yola.

The NUJ, Adamawa Council has declared one week mourning and prayers for the repose of the soul of our great member, late Maxwell Nashon.

“His killing was not only inhumane and barbaric but unpardonable injury meted on the union.


“While the union condoles with the family of the deceased, management and staff of the FRCN Fombina FM Yola, it calls on the State Government and security agencies to step up measures to stem the current insecurity challenge,” Donald said.

He said that the council would continue to remember Nashon for his commitment and sacrifice to duty.

The national grid on Thursday experienced its first collapse in 2020 resulting in blackout across the country.

The Transmission Company of Nigeria (TCN) confirmed the development in a statement on its Twitter page.

“There was system disturbance which occurred at about 12.34 p.m affecting some parts of the country.

“As at 1:10 p.m, supply was restored to Abuja and most parts of the affected areas. TCN is still working to completely restore and stabilise the nation’s grid,” it said.

Ikeja Electric (IE) which also confirmed the grid collapse in a statement on its Twitter account, said another collapse of the grid occurred at 2.15 p.m after the previous incident.

“Dear customers, the outage you are experiencing is due to a system collapse of the grid which occurred this afternoon at 12:36 p.m. All parts of IE’s network are affected.

“Another system collapse was recorded at 2.15 p.m today. Restoration efforts are ongoing. Kindly bear with us,” the electricity distribution company said.

A first Champions League trophy in 14 years, lifting the FIFA Club World Cup for the first time in their history and building an astonishing lead at the top of the Premier League table this season made last year one that will live long in the memory of Reds fans.

But while last year may be done and dusted, there are still plenty of records to chase.
Jurgen Klopp's merry men are riding a sizeable wave and it shows no signs of slowing down. A 13 point lead at the top of the Premier League table with a game-in-hand puts the Reds in a commanding position as they bid to lift the illusive Premier League trophy.

The thought of retaining the Champions League isn't a bad one and, with others across Europe enduring their relative falls from graces, it isn't a ridiculous one either.

The only way is up for Liverpool at the moment and with that in mind, here are some of the records they can break between now and the end of the season.

1. Best Start After 21 Games
​If ​Liverpool can find a way to beat a Harry Kane-less ​Tottenham at the weekend, the Reds will have the made the best start any Premier League side has made after 21 matches. The record is currently held by competitors Manchester City who earned 59 points from their first 21 games back in 2017/18.

Liverpool only need a draw away at the Tottenham Hotspur Stadium to match that tally, but three points would see them snatch the Sky Blues' record.

2. Most Consecutive Premier League Wins
Unsurprisingly, the current record of 18 consecutive victories was set by Manchester City, and Guardiola. The Citizens managed this feat from August to December in 2017, something that previously hadn't been achieved in the ​Premier League era.

However, the Reds have the opportunity to claim another Guardiola record. Currently sat on 11 straight wins, Liverpool will need to win their next nine matches to surpass City, eventually claiming the record away to Watford on 29 February. While it may seem unlikely, the Reds have won 19 of their 20 matches so far this term, so eight more isn't too hard, surely?

3. Most Consecutive Home Wins
Anfield has been a fortress for some time now, with the Reds having not lost a Premier League game at home since April 2017. Yet again, the record is held by City who won 20 consecutive games on their own patch during the 2011/12 season.

The Reds currently find themselves two short of that mark, with home games against bitter rivals Manchester United, Southampton and West Ham coming up in their next three at Anfield. If Klopp's side can win all three games, they would set another impressive milestone.

4. Most Away Wins in a Season
This will be a tricky one indeed. The Reds will have to win all but one of their remaining away games this season to steal this one off ​Man City - including a trip to the Etihad in April. Liverpool have won eight of their nine away league matches this term, only dropping points to Manchester United at Old Trafford.

If the European champions could secure victories in nine of their ten remaining games on the road, they would have claimed 17 victories on their travels, one more than Man City achieved in 2017/18.

5.Most Home Wins in a Season
​If you're noticing by now that the Reds can pretty much claim every Premier League record, then you're more or less right.

Liverpool have won 11 home games this season - that's all of them by the way - meaning they can surpass the current record of 18 home wins in a season. Three teams have managed this including Chelsea, Man United and Manchester City twice during the Premier League era.

This means Klopp and his team will have to win all their remaining home games to break the record but when you consider the home games they have left are against Manchester United, Southampton, West Ham, Bournemouth, Crystal Palace, Aston Villa, Burnley and Chelsea, it doesn't seem like an impossibility.

6. Most Wins in a Season
​Now this one seems a little more realistic. Liverpool have currently won 19 games this Premier League season, meaning that if they can be victorious in 14 of their 18 remaining matches, then they will break Man City's record of 32.

Given the Reds have only failed to win one league game all term, they can afford to drop points in four more matches and still achieve the feat.

7. The Invincibles (Mark 2)
Disclaimer: Liverpool cannot claim the record for being the only team to go a Premier League season undefeated.

However, the Reds can match ​Arsenal's 'Invincibles' season of 2003/04 if they avoid defeat in any of their remaining games. While the Gunners seemingly have found little joy in this campaign, maybe beating Liverpool at the Emirates to maintain their record would be enough to earn Mikel Arteta a knighthood.

8. Longest Time Unbeaten
While the Reds cannot surpass Arsenal's unbeaten record, they can still steal a title off the north London club.

Liverpool have gone over a calendar year unbeaten since losing to Man City in January 2019. If they can continue this unbeaten record until the end of the season, Liverpool will overtake the Gunners for the most days without defeat in the Premier League. Arsenal currently have the record at 537 days, something Liverpool can surpass on 23 June 2020.

9. Most Points in a Premier League Season
Having not lost a single game this campaign, Liverpool are strong favourites to claim this record too. Man City are the holders of this feat with a whopping 100 points earned in the 2017/18 season, somehow only three points clear of the Reds' total from last season, despite Klopp's side not winning the league.

If Liverpool win all their remaining games then they would smash the record, claiming a staggering and unprecedented 112 points. However, Liverpool could afford to lose three and draw one of their remaining 18 matches and still surpass City's tally.

10. First Premier League Trophy
​Of course Liverpool will not be the first team to win the Premier League, but it will be the first time they have lifted the trophy. It has eluded the Reds for what feels like an eternity, and is the prize craved most on Merseyside by far.

The Reds are on course to achieve this, and in some style too, but many in Liverpool won't be counting their chickens just yet.

Ceramic phones aren't commonplace in North America, though that's about to change with the Galaxy S10+. Phones that have used ceramic, like the Essential Phone or Xiaomi's Mi Mix series, look and feel amazing.

When you think of ceramic you might be picturing your grandmother's antique china, but that's not the whole story. Sure, ceramic can look beautiful and delicate but it doesn't have to be — ceramic is harder than glass or plastic, almost completely corrosion resistant, lighter than metal and it's an insulator so there is no heat transfer.

Ceramic is also expensive. that's why we don't see low-end watches, dishware, or phones made from the material. It's costly to mine and manufacture because of the special equipment needed, not easily formed like metal or plastic, and requires better handling along the assembly floor to keep the unassembled parts from shattering. Still, once you feel it, there's no denying it's nice.

Pros

1. RF transmission. Like glass, ceramic allows radio waves to pass through fairly easily. This means your LTE signal, Wi-Fi, and Bluetooth will be stronger without any long antenna cutouts.
2. They stay cool. Ceramic is what your power company uses to insulate the transmissions lines from their metal brackets. that's because it's non-conductive in regard to both heat and electricity. your ceramic phone isn't going to get hot in your hand.
3. They feel so good. Ceramic can be highly polished after it's formed to a completely smooth finish, and then take a clear coating to remove every surface line. Without any irregularities that your hand can feel, it's like holding a piece of ice. Except it's not cold because it doesn't absorb or give off any heat dues to the magic of its insulatory properties.

Cons

1. Ceramic breaks. Ceramic (the type used in something like a phone) is tough, but it's still breakable. With the right amount of abuse, it will break before metal or plastic will.
2.The coating can scratch. Ceramic is tough, and so are the polymers used to clear-coat it, but it can scratch. It's not as easy as scratching glass or even metal, but if it does scratch, you'll hate feeling even the tiniest blemish on that otherwise baby-smooth finish.
3. Ceramic is slippery. Wet hands? That might mean an oopsie because smooth ceramic is pretty slippery when your hands are wet or your fingers are cold and hard. Keep that in mind and take a bit of extra care.

Ceramic phones look and feel gorgeous. they also stay nice and cool because of ceramic's insulatory properties. There is a reason some of the finest watches you can buy are made from ceramic.

We started seeing glass phones with the iPhone 4 and Nexus 4. They aren't completely glass, of course, but there are plenty of phones with full glass backs to go with the full glass front. They can be beautiful and give a look that compliments a great design. They can also be fragile; phone screens break all too often and so do glass backs.
Using glass also adds to a phone's price. Cheap pieces of soda-lime glass you may find at the hardware store aren't suitable for a phone. Instead, specially made ultra-clear low-expansion glass and composites like Gorilla Glass are used and can add a lot to the final price. Exotic materials like synthetic sapphire can be exceptionally clear for the wavelengths of light a person can see, and very scratch-resistant. They are even more expensive, often prohibitively so.

Pros

1. RF transmission. Glass is dense, but still allows radio waves to pass through fairly easily. This means your LTE signal, Wi-Fi, and Bluetooth will be stronger without any long antenna cutouts.
2. They look great. Phones with a glass back can have a feeling of depth if anything is under the glass. Glass can also shimmer and give the illusion of being wet. Both of these effects together can make for a stunning look. Samsung is a total pro at this, and its recent glass-backed Galaxy phones are simply beautiful.
3. They feel good in your hand. Glass can be polished until it's very smooth. Because it's inert it will also feel solid and cold like metal does. When you hold a glass-backed phone in your hand it just feels like a luxury product. Everyone loves luxury products, even if it's only an illusion.

Cons

1. Glass breaks. There is nothing any company can do to make thin glass unbreakable. That means when you drop your phone (and you will) you have to worry about breaking both sides.
2. Glass scratches. Everything will scratch, but glass seems to be the best at doing it. No matter what a company tells us about the Mohs scale or hardened polymers, glass will scratch. Scratches on a phone with the wet and deep illusion like a Galaxy S9 look terrible when they have a big scratch across the back.
3. Glass is slippery. When your hands are damp, holding a glass phone is like squeezing an ice cube. It can pop right out of your grip and when you consider that glass breaks and glass scratches, you have a recipe for disaster.
4. Glass-backed phones can look amazing. That silky wet look of a Galaxy S10 or the disco ball look of the Nexus 4 makes for a beautiful looking piece of gear. We want our expensive things to be beautiful.

Unfortunately, glass is also a really risky material to use in a phone. It needs to be thin (glass is heavy!) so when you use hardened treated materials like Gorilla Glass the risk of breaking increases because hardened glass is more brittle. It's a catch-22 situation that we gladly put ourselves in because of how great it looks.

Plastic comes in all shapes, colors, and sizes. Man-made materials have that advantage. That means plastic can also come with a number of different finishes, and phones can feel slimy or even soft when made of plastic. Plastic is also cheap and very workable which means curves and design elements can be used with plastic that isn't feasible with other materials.
Some plastic phones look and feel great. Of course, others don't. Consumers can be influenced by their experience enough to think all plastic phones are a slippery, glossy, slimy mess even when they're not and the general perception is that plastic phones are cheap. But a plastic phone can be great, too.

Unfortunately, it's becoming difficult to find phones made of plastic. Even inexpensive brands like Nokia and Motorola are moving on to metal-bodied phones, and that makes me a little sad.

Pros

1. Cost. Not the cost to the consumer, but the costs of making the phone from beginning to end. Using plastic means manufacturing equipment is easier to tool, which means designers have more freedom to work with the shape, which means phones don't always have to look like a flat slab and still be reasonably priced. We love things that look nice and things that are reasonably priced. We love it more when they are both.
2. Resilience. Plastic is tough. Like football helmet tough. You might be able to break plastic but it will take a lot more abuse than metal or glass, and for the most part, it will snap right back into shape if it gets bent or dinged.
RF transmission. Plastic can be designed to be tough but still allow radio waves to pass through with very little signal loss. When you're building or using a phone, this is important.
3. Millions of colors. You can make plastic that's any color imaginable. Companies like Nokia (the Nokia of old, R.I.P.) and Sony have put this to the test and orange, lime, pink, yellow and even brown phones have all been offered and had their fans. Black is also a color for folks who like to keep things tamer.
4. Plastic gives a manufacturer the freedom to build a phone that's tough and beautiful. And we've seen some very high-end phones from almost every manufacturer that were plastic, and nobody complained that they were plastic.

Cons

1. They feel bad. At least, they can. One of our favorite phones was LG's G2. One of the phones we always complained about when it came to the finish of materials was the LG G2. It was the phone that coined our use of slimy when talking about bad plastic. Don't even get us started on the Galaxy S III.
2. They can stain. The plastic on the phone can be stained by a colorful case or spending too much time in a cup holder in Florida-style weather, and some plastic finishes can stain you or your clothes. Remember the orange red Nexus 5? It did both.
3. They look cheap. Not all of them, of course. HTC, as well as that Nokia of old, built some gorgeous phones that were plastic. The LG Optimus 3D was not my favorite phone. Not even close. But it was plastic and the body, the build, and the finish were stunning. But for every good plastic phone, you can buy there will be four or five bad plastic phones in equally bad plastic clamshells on a hook at Walmart. That makes people equate plastic with cheap.
All the plastic phones that were tough, looked good and came in a plethora of colors have to compete with the bottom-of-the-barrel plastics used in phones that have none of those qualities. It's not fair to compare things this way, but you usually won't find a phone you think is plain ugly or that feels slimy that's not made of plastic. Stereotypes are sometimes real.

Phones all look the same once you scrape away a few details. They're rectangles designed to fit (mostly) into one's hand and a display where we can tap and poke the things we see to find other things poke and tap. You can even make phone calls with them!

It's those details, though, that makes the difference. Speakers, bevels, buttons and the physical size are the things that make a Galaxy Note different from a Moto E4. They also are a big part of the price and what we use to decide which one is better for our uses. One of those details that's always a point of discussion, and sometimes a point of detraction is what the body of a phone is made of. Oddities like wood or gold phones aside, you'll find three different materials are being used to make phones is all sizes: metal, plastic, and glass.

Which one is best?

METAL

Plenty of phones use a metal band or a faux-metal finish over plastic trim, but there are also plenty that are made of metal. Usually, that means some manner of aluminum alloy that's very thin and light because the buying public is in love with thin and light. Nobody wants a 3-pound phone built from cold forged steel to lug around all day.

Metal screams premium.
For many, metal equals premium. Seeing an aluminum phone polished or anodized with a crisp finish does make a phone look good, so naturally, a lot of people associate them with high-quality, even if only subconsciously. But this isn't always the case as aluminum can be cheaper than other materials. Blame our perception here.

A metal phone can be a great phone. It can also be a bad phone. Let's look at the pros and cons.

Pros

1.That premium look. As mentioned, a phone that's well built will always look good with a metal design. Metal is beautiful and we can't help but feel that anything beautiful is automatically premium. For many, having a premium phone is important.
2. It's "modern". Metal is a big part of the industrial design school of thought. Minimal markings and no extraneous parts to take away from a single piece of metal with a certain shape is a complete design aesthetic, and it often ties in well with a premium look. There are plenty of fans of this type of design.
3. Heat transfer. That way a cold metal phone feels when you first pick it up provokes a thought. It doesn't have to be a good thought, but if you ever noticed that your phone felt cold you were thinking about it. Touch is one of our senses, and it's an important one.
All of these "pros" work together to give the impression that the small metal object you're holding is simply a superior product. Some people feel differently, but most people can't say a phone like a Pixel 2 or a Nokia 7 Plus felt bad or was built poorly.

Cons

1. Bends and dents. Metal deforms fairly easily — especially light, malleable metal like aluminum —and tends to keep its new shape, at least the types used to build phones. We're not talking about people on YouTube bending phones for a living; we're talking about sitting on your phone and bending it or dropping it and putting a big dent in that premium shell. (Buy a case?)
2. RF transmission. This means your LTE, Wi-Fi, and Bluetooth signals. Radio frequencies of the safe variety have a tough time transmitting through dense material. This can mean your phone needs to have antenna lines or glass cutouts for the antennas and probably won't support wireless charging if it's made of metal.
3. Heat transfer. The same thing that makes a metal phone feel solid and cold when you first pick it up will also make it feel hotter after you've used it for a while. Heat sinks and heat pipes (also made of metal) try to offset this, but a metal phone will always have a hot spot where the chipset is. And sometimes they can get uncomfortably hot.
The same material that can make a phone feel premium can also stop it from having premium features, like smooth lines without antenna bands or wireless charging. And they look a lot less premium when you dent or bend them.

What Atiku is trying to achieve is tantamount to CHASING AND CATCHING THE WIND. This is a futile quest.


My honest advise to Atiku, "Please forget about the tribunal and everything about 2019 general elections because you are fighting that has been lost before it began. Winning in court is like MISSION IMPOSSIBLE and a waste of funds."
