This has gone to court for years and they always lose. In as far as you're in US soil, you're subjected to the jurisdiction of the US because no foreign country can kill you in the US even if you're an illegal immigrant. Also, the law applies to you if you break the law obaidan: This is what section 1 of 14th amendment says "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."
interpretation of "jurisdiction" is the key battle here not constitutional amendment per say. In the context of citizenship, it means born in the US and subject to the authority of the US...so if both parents are not subject to the jurisdiction of the US, can it be said that their offspring is subject to the jurisdiction of the US. And really in matters like this, if the supremem court is right-leaning, trump may have his way. |
