And I am not harping on the alleged shooter being a fake medical doctor. At no time did the suspect openly parade himself as a medical doctor rather it was the EFCC that declared him as one.

But we must consider the excuse by the suspect for opening fire on EFCC agents who stormed his home.

Did the EFCC properly identify themselves before breaching his home? This is what the suspect's lawyers must argue in defense of their client and not the raid itself or time it was carried out.

Get a regular Police officer to show you his or her ID and you will see that overleaf there is a caveat that states that every police officer has the right to detain, arrest and carryout a search warrant on suspicion.

The timing of the raid is irrelevant as the security authorities can carry out a raid when and whenever they deem fit to apprehend a suspect either randomly profiled or under intense surveillance with or without a search warrant.

That's the empowering act which the security outfits enjoy .


As per the suspect firing the sawed-off shotgun, here is where it gets really dicey.

The gun was under licence in the name of the suspect's father. This same license does not cover the shooter. If your father has a driving licence and a vehicle registered under his name , that does not excuse you as a son to go about driving the same vehicle without a license of you own. Gun ownership universally are individual specific and not transferable. Ned Nwoko handing his double barrel gun to his wife to fire is a breach of that license. So the issue of the firearm being licensed is null and void as the suspect was not the one given the authority to bear and use that weapon.

Another thing to consider is the weapon being manipulated to serve as a concealed weapon or handgun. The shotgun/double barrel has been altered from a long barrel shot gun to a handgun by being deliberately altered in its original design to serve as a handgun. Handguns of any make or manufacturer are banned for civilian use in Nigeria. Gun licence for civilian use are limited to double barrel 2 round chambers. Any violation of the original design and or modification of the aforementioned specification for civilian use is a serious offense. In the gun crazy US, there are laws that make it a serious federal offense to alter a civilian issued firearm . Sawed-off shotguns remain highly illegal just as bump-stocks for pistols that convert them to riffle firing mode are highly illegal.

Now, back to the raid itself. The EFCC guys always go on a raid in their red flannel jackets . Even before venturing to the home of the suspect, their movements were so conspicuous that it drew the attention of the regular Police who intercepted their convoy to demand why the police within the jurisdiction were not informed of the raid. It's important I let you know that the EFCC is basically a subsidiary of the Nigerian Police Force as the governing act mandates that the head of the EFCC must be a serving senior Police officer. Majority of their field and case investigators are drawn from the NPF with a sizeable number of prosecuting officers from same NPF.

With that aside and my earlier narration of the wide and extensive powers given to the NPF to carry out raids and arrests, and the fact that the suspect had no business operating that firearm and the fact that the weapon had been altered in its original use as a long arm weapon, I dare say that out fake doctor who shot and killed a law enforcement officer carrying out a raid within their jurisdiction is going to have a very hard time justifying firing and killing the EFCC officer going about his lawful duty.
