The Supreme Court on Friday ordered that old N200, N500, N1,000 notes remain in circulation till December 31, 2023.
The apex court also nullified the Federal Government’s naira redesign olicy, declaring it as an affront to the 1999 Constitution.
Justice Emmanuel Agim, who read the lead judgement, held that the preliminary objections by the defendants (the Attorney General of the Federation, Bayelsa and Edo states) are dismissed as the court has the jurisdiction to entertain the suit.
Citing Section 23(2)1 of the constitution, the court held that the dispute between the federation and states, must involve law or facts.
The apex court further held that President Muhammadu Buhari in his broadcast, admitted that the policy is flawed with a lot of challenges.
The court said the policy has led to some people engaging in trade by barter in this modern age, in a bid to survive. The court added that the President’s disobedience of the February 8 order, is a sign of dictatorship.
Sixteen states of the Federation instituted the suit to challenge the legality or otherwise of the introduction of the policy.
The suit initially instituted by Kaduna, Kogi and Zamfara states has been slated as the first case on the cause list for final verdict.
Justice John Inyang Okoro who led a seven-man panel of Justices of the Court had on February 22 fixed today for the court to make its decision known on the suit.
The 16 states led by Kaduna, Kogi and Zamfara are praying the apex court to void and set aside the policy on the ground that it is inflicting hardships on innocent Nigerians.
They accused President Muhammadu Buhari of usurping the function of the Central Bank of Nigeria (CBN) in the introduction and implementation of the policy and asked that the directive issued by Buhari be voided.
On its part, the Federal Government challenged the jurisdiction of the Apex Court on the grounds that the CBN was not joined as a party and that the dispute on the policy ought to be directed at the CBN so that the suit can be referred to the Federal High Court.
Governor Nasir El-Rufai of Kaduna State and his Kogi State counterpart, Yahaya Bello were in court to witness the judgement on Friday. The two governors were also in court at the last hearing. Also, Zamfara State Governor, Bello Matawalle was in court on Friday.
Back Story
The Central Bank of Nigeria (CBN) had extended the deadline for the swap of old N200, N500, and N1,000 from January 31 to February 10 following complaints by many Nigerians but the Supreme Court, after a suit filed by the states, held that the Federal Government, the CBN, commercial banks must not continue with the February 10 deadline pending the determination of a notice in respect of the issue.
However, President Muhammadu Buhari, in a national broadcast last Thursday, directed the apex bank to release old N200 notes into circulation to co-exist with new N200, N500 and N1,000 banknotes for 60 days — by April 10, 2023. He also said old N500 and N1,000 banknotes cease to be legal tender in Nigeria.
There has been a flurry of reactions and stark criticisms against the President’s directive including from governors of his party, the All Progressives Congress (APC).
Governors Nasir El-Rufai (Kaduna), Abubakar Badaru (Jigawa), Rotimi Akeredolu (Ondo), Umar Ganduje (Kano); Speaker of the House of Representatives, Femi Gbajabiamila; Minister of State for Labour and Employment, Festus Keyamo; and many stalwarts of the ruling APC have openly censured and faulted the President’s directive, arguing that it has not grounds because the case is before the apex court.
Leading Senior Advocates of Nigeria like Femi Falana and Mike Ozekhome have equally faulted the President’s move, saying he cannot overrule the apex court of the land.

OsisiAnambra: Lets face it, the opposition cannot produce the speaker. The Apc may strike a deal with the Wike’s faction of the Pdp which elected majority of the house of reps members in River state. Secondly the Sdp members from Nasarawa state who were members of the Apc prior to the 2023 election may be inclined to work with the ruling APC. In the alternative i see a dogara or tambawal scenario playing out where the ruling Apc may choose a candidate for speaker but another Apc rep may emerge as speaker with the backing of the opposition. Funny enough, this cannot happen under Tinubu's Presidency. Tinubu isn't like Buhari who doesn't care about his party. He'll make sure the APC is united. There's no way two APC house members would contest for the speakership position. |

donphilopus: I've been so busy so I couldn't create a thread for my prediction. To even do state to state analysis now, I'm finding it difficult because of the tight schedule today. But I'm predicting 32-33 million voter turnout today.
Tinubu will get 11.9m votes, Atiku 9.5m votes, Obi 6m votes while Kwankwaso would get 3.5 million votes. Others would share the remaining votes.
Tinubu will win the southwest, northwest and north central. Atiku would win northeast while Obi would win southeast. South South states would be shared into three. Either the top three candidates win two states each or they would share the states 1-2-3. Whoever wins the south south would win with a very little margin.
At the end Tinubu should win 18 states, Atiku 10 states, Obi 8 states and Kwankwaso 1 state.

The federal government has asked former President Olusegun Obasanjo not to “truncate” the ongoing electoral process in the country.
The presidential election results are currently being collated in the federal capital territory (FCT).
The results of some states have already been announced.
Dino Melaye, PDP’s agent, had on Monday walked out of the collation centre alongside LP’s representative and some other parties.
The group pulled out of the exercise after insisting that results uploaded to the portal of the Independent National Electoral Commission (INEC) must be displayed before the exercise could continue.
On Monday, Obasanjo said elections that have been marred with irregularities should be rescheduled.
In a statement on Tuesday, Lai Mohammed, minister of information and culture, said Obasanjo presided over the worst elections since Nigeria returned to Democracy in 1999.
Mohammed said the former president is not in the position to counsel President Muhammadu Buhari on elections.
“Though masquerading as an unbiased and concerned elder statesman, former President Obasanjo is, in reality, a known partisan who is bent on thwarting, by subterfuge, the choice of millions of Nigerian voters,” he said.
“As the whole nation waits with bated breath for the result of last Saturday’s national elections, amid unnecessary tension created by professional complainants and political jesters, what is expected from a self-respecting elder statesman are words and actions that douse tension and serve as a soothing balm.
“Instead, former President Obasanjo used his unsolicited letter to insinuate, or perhaps wish for, an inconclusive election and a descent into anarchy; used his time to cast aspersion on electoral officials who are unable to defend themselves, while surreptitiously seeking to dress his personal choice in the garb of the people’s choice. This is duplicitous.
“With a deployment of over 1,265,227 electoral officials, the infusion of technology to enhance the electoral process, and the logistical nightmare of sending election materials across our vast country, INEC seems to be availing itself creditably, going by the preliminary reports of the ECOWAS Electoral Observation Mission and the Commonwealth Observer Group, among other groups that observed the election.
“Therefore, those arrogating to themselves the power to cancel an election and unilaterally fix a date for a new one, ostensibly to ameliorate perceived electoral infractions, should please exercise restraint and allow the official electoral body to conclude its duty by announcing the results of the 2023 national elections.”

Whereas Tinubu has less than 5,000 votes in the whole Enugu. This is not rigged, but wherever Tinubu wins is rigged. 10. Atiku's VP is the GOVERNOR of Delta State. In Delta State, Obi has won 11 out of the 16 Local Government Areas annoinced so far. But his supporters are still shouting the election is rigged. Is that not madness?
