The defence of the embattled Peoples Democratic Party, PDP, spokesman has finally commenced at an Abuja Federal High Court with the presentation of it’s first witness. The defence witness, Ike Abonyi, a journalist and Public Relations Consultant with a 28-years working experience in his testimony informed the court how former President, Goodluck Jonathan demanded for a corporate account from Metuh which some amount was paid into. Abonyi said, “the President told Metuh to bring a corporate account to him for immediate mobilization.” “I’m aware as a journalist that funding of publicity comes from the leader of the party mainly.” He said Metuh had engaged him and his services and that of a Public Relations consultant called CNC connect to repackage the image of the party. Abonyi said, “Metuh called me to work with him when he won the election to occupy the position of the National Publicity Secretary of the PDP, saying his new position has to do with the media and he had no knowledge of the media. “In a bid to repackage the image of PDP, Metuh informed me that he would be engaging the services of a consultancy firm called CNC connect and together we made presentation to Jonathan. ”CNC had worked with former Chairman of the party, Ekewesileze Nwodo but had to withdraw their services because they are being owned by the party. “Metuh, however told me that he had appealed to CNC connect that they would work with him due to their good job. He appealed to CNC connect that he would want them to continue where Nwodo stopped. They said they were willing to return but the party was owing them and this, Metuh agreed to push their case. “Following their presentation in a meeting, Metuh promised to meet them but at that time, there was no resources to engage them but we promised to get funds from the party. “Eventually, the general election was fast approaching and Metuh approached me as the Executive Director of New Telegraph and requested he would need my full services this time, saying he would like if I can come in and work as a consultant to help him on the new challenge of improving the image of the party which was in bad shape and by virtue of his position all eyes were on him to come up with strategies ahead of the upcoming general election. “When I joined him, Metuh told me that CNC connect will be needed and my response was CNC connect was too expensive as we can deal with other Public Relations firm but he insisted on CNC as the assignment was enormous and would rather go for the best. When I told him of funding, he said the general election was coming and the lack of fund in his department will soon be a thing of the past as the leader of the party will have no choice but to fund the party. “Even when I tried to lure Metuh out of CNC connect, he reminded me that he had made a commitment and would not go out of it. We eventually called CNC connect to join the team of journalists, where he informed us that he had been given an assignment by the leader of the party, former President, Goodluck Jonathan to come up with strategy that would help the party win the forthcoming election. “Metuh told us that the assignment given to him was also given to some other professionals and we should see it as a challenge and make sure that our own strategy prevails. The team anchored by CNC connect with PDP began the strategies meeting with Metuh presiding over most of the meetings. We all agreed that he had a good product to offer, but Metuh said we should wait for clearance from the Presidential villa for Presentation. “One afternoon, he called me that he had just received a call from the National Chairman of the party that the President would be ready for presentation that night and all those involved were resident in Abuja except the Managing Director of CNC connect whom I called to take the next available flight for the presentation. Because he was already expecting the presentation, he took the next available flight to Abuja. Because he was coming in from Lagos, other members of the team went in one vehicle while Metuh carried the Managing Director of CNC in his vehicle. Upon arrival at the villa, only Metuh’s car was allowed to enter but they waited for us at the clearance point where we were ushered to a waiting room where Metuh left and entered another room and 15 minutes later, Metuh ushered us into a large parlour with the President, vice Senate President , National Chairman of the party, former governor of Cross River state, Liyel Imoke and some media aides including Reuben Abati all seated. “When we entered, the MD of CNC connect was the first to speak from our team, after the presentation, the President requested for comments from the team which he later said were too hard on him, adding that he himself was not helping the matter with the way he was acting. “At a point, Reuben Abati who saw our presentation as an indictment on him told the President that the situation was not bad as we portrayed but was overruled. After the presentation, the President requested comments from those seated. Peter Obi urged the president to mobilise our team before the commencement of the campaign, if not it would be difficult to win the election giving the difficult situation of the government at that time. Following Obi’s comment, the President advised that all others that did presentation that night should collapse into Metuh’s team. At that point, the President commended Metuh but said the real job was out there. ” President told him to bring a corporate account to him for immediate mobilisation.” “I’m aware as a journalist that funding of publicity comes from the leader of the party mainly.” “After our presentation, we returned to our homes waiting to hear from Metuh on the outcome. One afternoon he told us that work will now start that the president said he should check his bank account that some money had been disbursed for the job.” Cross examination is still in progress. http://dailypost.ng/2016/04/11/armsgate-jonathan-demanded-corporate-bank-account-from-metuh-to-pay-some-money-witness-tells-court/

Former creek warrior, Chief Government Ekpemupolo, better known as Tompolo has approached the Federal High Court in Lagos seeking an order restraining the Federal Government and its agencies from further proceeding with the N45.9bn fraud charges filed against him. Tompolo, through his lawyer, Mr. Ebun-Olu Adegboruwa, is contending that sections 221 and 306 of the Administration of Criminal Justice Act, ACJA 2015, which prohibits him from seeking a stay of proceedings in his trial, are infringing on his constitutional rights to fair hearing. The defendants in the suit are the Federal Government of Nigeria, the Economic and Financial Crimes Commission, EFCC, the Inspector-General of Police, IGP, the Chief of Army Staff, COAS, the Chief of Naval Staff, CNS and the Chief of Air Staff, CAS. He is praying the court to nullify sections 221 and 306 of the ACJA and restrain the Federal Government, the EFCC and the IGP from deploying those sections of the law against him. Adegboruwa argued that sections 221 and 306 are in conflict with Section 36 of the Constitution which guarantees the right to fair hearing of his client. The embattled spokesman of the Peoples Democratic Party, PDP, Chief Olisa Metuh, on Monday urged the Federal High Court sitting in Abuja to allow his counsel more time to prepare to defend his company, Destra Investment Limited. Counsel to Metuh’s company, who is standing trial alongside the former as the second defendant in the ongoing prosecution, Toochukwu Onwuibufo made an oral application, seeking for more time and facilities to enable him prepare for defence. Onwuibufo sought for time and documents of court proceedings to enable him prepare, adding that he was only brought into the matter last week. Metuh, alongside his company, Destra Investment Limited are standing trial on a 7 count charge bordering on money laundering to the tune of N400m, the Economic and Financial Crimes Commission, EFCC, alleged he collected from the former National Security Adviser, NSA, Col. Dasuki Sambo. Quoting section 36(6) of the constitution, Onwuibufo said, “My lord, we are incapacitated to continue with this trial unless we are given facilities and time to prepare for trial.” The prosecution led by Sylvanus Tahir in his argument said that the court should dismiss the application. Counsel to Metuh, Emeka Etiaba, however, urged the court to grant the appeal of the counsel to the second defendant, adding that the embattled PDP spokesman is prepared “with his witnesses standing outside the court to open his defence but that doesn’t mean the second defendant is not entitled to fair hearing.” Matter has been stood down for 15 minutes. More details to come… http://dailypost.ng/2016/04/11/armsgate-my-lawyer-needs-more-time-metuh-begs-court/

Ade Adesomoju, Abuja A Federal High Court in Abuja on Monday fixed May 16 for the re-arrangement of a former Governor of Abia State, Mr. Orji Uzor Kalu, his co-accused for charges bordering on alleged diversion of N5.6bn belonging to the state. This followed the judgment of the Supreme Court delivered on March 18, 2016, dismissing the accused persons’ objection to the charges preferred against them and directing them to submit themselves for trial. The Economic and Financial Crimes Commission had in 2007 initially preferred 96 counts including money laundering, against Kalu, his company, Slok Nigeria Limited, and Jones Udeogo. Kalu and his co-defendants were accused of diverting the state’s fund while he was governor of Abia State between 1999 and 2007. The anti-graft agency on February 11, 2008 amended the charges and presented 112 counts against the defendants. Their objection to the charges were dismissed by the court, the Court of Appeal and finally by the Supreme Court on March 18. Kalu and Udeogo, who were represented by different lawyers, were present in court on Monday. The prosecuting counsel, Mr. Oluwaleke Atolagbe, who passed a copy of the judgment of the Supreme Court validating the trial to the judge, Justice Anwuri Chikere, during the Monday’s proceedings, said the prosecution needed time to take some steps before the re-arraignment Atolagbe said, “This matter is slated for mention. On March 18, 2016, the Supreme Court dismissed the appeals by the defendant. “I will urge my lord to adjourn the case to afford the prosecution some time to take some steps. We will need about two weeks. We seek an adjournment for the defendants to take their plea.” Counsel for Kalu, Chief Awa Kalu (SAN), and the lawyer representing Udeogo and Slok Nigeria Ltd, Chief Solomon Akama (SAN), did not oppose the request for adjournment. The judge then fixed May 16 for their re-arraignment. http://www.punchng.com/court-fixes-may-16-for-orji-kalus-re-arraignment/

The National Publicity Secretary of the Peoples Democratic Party, PDP, Olisa Metuh, again refused to open his defence at the Federal High Court sitting in Abuja. Metuh alongside his company, Destra Investment Limited who are standing trial on charges bordering on money laundering and benefiting the sum of N400m from the fund allegedly disbursed from the office of the National Security Adviser during the last administration had on five different occasions pushed for adjournment of his case. The slush fund, according to the Economic and Financial Crimes Commission, EFCC, was part of the money meant for the procurement of arms for the armed forces. At the resumed hearing today, the prosecution led by Slyvanus Tahir informed the court on the hearing of subsisting application filed by the defendant. Responding, the counsel to the second defence, Tochukwu Onwuibufo who is representing Destra Investment Limited, a company Metuh has stake in, asked the court for an adjournment, saying he was not prepared as he was just being brought in. Onwuibufo said, “I have no document regarding this case as I was only briefed yesterday. The first defendant is yet to fully brief me of the case.I have not read the court proceedings to enable me prepare for my case. “That is why the letter I addressed to the court is requesting a certified true copy of all proceedings so as to put me in a broader picture of what transpired in court to enable me represent the second defendant. “My lord, the second defendant is not ready to proceed, we will be asking for an adjournment.” He argued that the defendant has the right to several adjournments, a position which is at variance with the court’s earlier ruling that the defendant is no longer entitled to an adjournment after his case was deferred five times. Quoting Sec 36(6), Onwuibufo said, ” The defendant is entitled to several adjournments, thereby I asked the court to adjourn the matter to allow me prepare well.” Tahir in his reaction confirmed a letter was served on the persecution before the court sat. On the application for an adjournment that a new counsel has being brought in to take over, Tahir said, “Sec 349(A) of the Criminal Justice Act stated how a counsel in a matter should conduct its case and the procedure for disengagement, “No notice of disengagement has been served by the consultium of five Senior Advocate, namely Onyechi Ikpeazu, Adedipe, Emeka Etiaba,Chris Uche and Gordy Uche.” Tahir, therefore, urged the court to discountenance the appeal for an adjournment and order any available counsel to conduct the “business of the day.” Matter still ongoing… http://dailypost.ng/2016/04/08/armsgate-again-metuh-refuses-to-open-defence-requests-6th-adjournment/

The Senator representing Edo South Senatorial district, Pharmacist Matthew Urhoghide has affirmed that the ruling All Progressives Congress (APC) will be taught a bitter lesson in the ongoing drama surrounding Bukola Saraki’s political career. Urhoghide, who spoke with newsmen in his office in Abuja yesterday, said with the current configuration of the Red Chamber, the PDP stands a better chance of producing Saraki’s replacement. He alleged that the APC was naive by allowing the CCT trial “drag on for too long without any intervention.” “I see this thing as a misplaced priority. I see it as something strange in our political history. “It is a slight on the National Assembly. It is a pity that 109 Senators are not allowed to make their own free choices. What is going on in the court is just drama. “We in the PDP will support him till the end. Since he became the Senate president, Saraki has been able to dignify the Senate. “The turning point has been made. We must be able to choose our presiding officers without anybody interfering. Anybody thinking that they will have a chance of making a replacement choice when they remove Saraki is joking.” Explaining the current configuration and how PDP may likely produce the next Senate President, Urhoghide said: “The PDP will decide who will be the president.” At present, PDP has 46 seats while the APC leads with 57 members. Six seats are still up for grabs. He continued that: “Anybody they are thinking of will not succeed. The number has not waned. Saraki is getting more support from Nigerians. “The APC must not be unmindful of the fact that when we made Saraki Senate President, the PDP had the chance of producing the president. But, the APC is pushing its luck too far.” http://dailypost.ng/2016/04/08/well-teach-apc-bitter-lesson-pdp-will-decide-who-will-be-next-senate-president-urhoghide/
