A Federal High Court in Lagos on Friday assented to a request by the Economic and Financial Crimes Commission, EFCC, to seize all but one of the assets belonging to the former General Officer Commanding, GOC, of the Movement for the Emancipation of Niger Delta, MEND, Chief Government Ekpemupolo, alias Tompolo. The presiding judge, Justice Ibrahim Buba gave this order after Tompolo again failed to appear in court to honour a summon on an alleged fraudulent land contract for the construction of the Nigerian Maritime University. It would be recalled that the anti-graft agency had on Wednesday filed a motion before the court, seeking to freeze Tompolo’s assets. This was after the commission declared him wanted in a newspaper advertorial, following two bench warrants issued against him by the court. The EFCC is accusing Tompolo and nine others of diverting and converting N46bn belonging to the Nigerian Maritime Administration and Safety Agency, NIMASA. But Tompolo has denied the allegation, accusing the Federal Government of coming after him because he refused to join the ruling All Progressives Congress, APC. On Friday, counsel to the EFCC, Mr. Festus Keyamo told the court that the efforts by all security agencies to arrest Tompolo had yielded no result, as they were yet to get hold of the first accused person. His words, “The accused person Tompolo failed to appear again and we brought and application for the seizure of all his properties as provided for by law. “If an accused person continues to abscond from court and conceals himself from court after a warrant of arrest has been issued, he should be auctioned by the federal government. That’s what we have done and the court granted our prayers to seize his properties. “We are going to separate the charge; we are going to keep his own until we get him or until we have auctioned his properties. We are just going to separate them so that he will stand alone from the other accused persons, because he is delaying the trial of the other accused persons.” The presiding judge consequently granted the application for the EFCC to “seize all the properties belonging to Tompolo except all properties of Global WestVessel Specialist Ltd”. http://dailypost.ng/2016/02/19/court-grants-efccs-request-to-seize-tompolos-properties/

The Federal Government on Friday filed an application before the Federal High Court in Abuja seeking the protection of prosecuting witnesses against the embattled leader of the Indigenous Peoples of Biafra, IPOB, Nnamdi Kanu. The application which was filed by the Director of Public Prosecution, DPP, Mohammed Diri before the Justice John Tsoho-led court also sought for a secret trial. Diri said, “Our application is to allow our witnesses who are civil servants residing in the geographical entity of the defendant. “We take judicial notice that since the arrest of the defendant, there has been one form of protest and violence.” The DPP informed the court that the witnesses have already indicated fear of insecurity for testifying against Kanu. “They categorically informed us that unless they can be guaranteed some form of protection by the court, they are unwilling to come and testify.” Diri also prayed the court to order the media not to reveal the identity of of the prosecuting witnesses. The application was vehemently opposed by the defense counsel, Chuks Mouma who asserted that: “We do not want the court to grant the application.” Mouma argued that the constitution has no provision for masquerades to testify against an accused person. The defense counsel also informed the court that all cases cited by the prosecution are related to terrorism which are not applicable to on-going proceedings. Following Mouma’s objection, Justice Tsoho stood down the matter till 2 pm for ruling. Peoples Democratic Party (PDP) leaders are still quarelling over the choice of Senator Ali Modu Sheriff as Acting National Chairman. Some former ministers and members of the Board of Trustees (BoT) have raised a committee to meet with ex-President Goodluck Jonathan, who is to be told —reject Sheriff or face a mass exodus. The deadline is March. Sheriff barged into a BoT session yesterday but members only promised to get back to him on his plea for acceptance. The BoT resolved not to endorse Sheriff. It may advertise the job, a source hinted. But the anti-Sheriff forces in the party and some members of the National Working Committee(NWC) are pushing for the tenure of the acting chairman to end in March. Sheriff succeeded Adamu Mu’azu whose tenure ought to end in March. The team will tell Dr. Jonathan of the “grave implications”of picking Sheriff to lead the PDP. The former ministers and BoT members pledged not to attend any meeting with Sheriff or his representatives. A source said: “We have asked a team to meet Jonathan and draw his attention to the grave implications of having Sheriff as PDP national chairman. “We believe the ex-President was ill-informed.We want Jonathan to withdraw his backing so that Sheriff can step aside in March. “ We have weighed all options and the only midstream approach now is to prevail on Sheriff to complete Muazu’s tenure and quit in March. “So Jonathan has to choose between the larger interest of the party and Sheriff.” An ex-Minister said: “Well, at our session, some of us made it known that we cannot even wait till the end of March to determine our stay in PDP. Once Sheriff is in charge, we will abandon PDP for another party. “The truth is dawning even on some of the governors and NWC members that Sheriff’s selection was unpopular among Nigerians. We now have deficit in the opposition politics we are playing because we have to seek equity with clean hands. This is why he should step down in March.” A party source said Sheriff is thinking of completing his tenure in 2018 – when PDP would have been in good stead to confront the All Progressives. Congress (APC) at the polls in 2019. The source said: “Pro-Sheriff governors and leaders want him to stay till 2018 in line with the “secret agreement” which led to his selection as the new PDP chairman. “They said they will not allow any subtle plot to force Sheriff to step down in March. This is the situation we are now. No doubt, there is tension in the party. We are sharply divided.” Despite the opposition against Sheriff, two former Ministers( Bala Mohammed and Ibrahim Shekarau) have visited to congratulate him. “At our meeting, some members expressed reservations on these ex-ministers’ visit to Sheriff,” another source said. Sheriff continued his peace drive yesterday when he stormed a session of the BOT. He pleaded with BOT members to give him a chance and vowed that “PDP will bounce back”. A BOT member said: “Sheriff came to our meeting, unaccompanied by the NWC members. He virtually begged us to give him a chance to lead the party. “We listened to him but we were unanimous that he is not the one needed to lead PDP. He wanted our endorsement but we hold him that we will get back to him. “We did not make any commitment to Sheriff.
