A lawyer and businessman, Uche Obilor, yesterday told the Federal High Court in Lagos that three of his companies got N905,800 million from the Nigerian Maritime Administration and Safety Agency (NIMASA) without bidding for any contract. He said the firms – Seabulk Offshore Limited, Southern Offshore Limited and Ace Prothesis Limited – were paid for a contract they never executed. He was testifying in the trial of a former NIMASA Director-General, Patrick Akpobolokemi, who is accused by the Economic and Financial Crimes Commission (EFCC) converting N2.6billion. He was also accused of defrauding the Federal Government of 795.2million. Akpobolokemi was arraigned before Justice Ibrahim Buba along with three others – Captain Ezekiel Agaba, Ekene Nwakuche, Governor Juan – and three companies – Blockz and Stonz Limited, Kenzo Logistics Limited and Al-Kenzo Logistic Limited. Led in evidence by EFCC prosecutor Rotimi Oyedepo, Obilor said he was approached by NIMASA to provide vessels for the implementation of an ISPS Code project. Oyedepo asked: “Did you bid for the contract?” The witness said: “We did not officially bid for the contract.” The EFCC lawyer asked: “Did you execute the unofficial contract?” Obilor responded: “The contract was not executed.” According to the witness, the companies received letters of award of contracts although they did not submit any bids. He said the monies were paid before they got confirmation that they had been awarded the contract. “When we had the letter of award, by then the monies had been paid upfront. “We were later approached that we should stay action, and that we should remit the money to certain companies and individuals,” he said. He said his companies got the following sums: Seabulk Offshore, N437million; Southern Offshore, N402million and Ace Prothesis, N66.8million. Obilor said they neither issued requests for payment, nor submitted any invoices. When he was showed a request document for the payment of a particular sum, he said: “We did not issue this document.” The witness said he received instructions from Captain Agaba, and that they discussed verbally. Under cross examination by Akpobolokemi’s lawyer Dr Joseph Nwobike (SAN), Obilor said he never dealt with or met the former NIMASA boss. “I did not meet the first defendant,” he said. When Agaba’s lawyer, Edoka Onyeke, showed the witness a document signed by his executive directors, Obilor denied that any of his staff signed any papers bidding for the contract or demanding payment. “I am very much aware of what happens in my companies. If the documents had emanated from the companies I would have known. I am unaware that my directors signed the documents,” he said. Obilor said he took steps to confirm if indeed his workers signed the documents, but admitted there was no documentary evidence showing their denial. “I am not aware of any statements from them denying the documents. I didn’t take them along to the EFCC to deny those documents,” he said. Adjourning, Justice Buba joked that he had to force himself to sit for the trial even though he was treating malaria. “My temperature was very high yesterday (Monday), but I forced myself to be here so that the press will not write a bold headline that ‘judge’s absence stalled trial,’” he said. The Supreme Court on Tuesday validated the elections of Oyo State Governor, Abiola Ajimobi; Delta State Governor, Ifeanyi Okowa; and Yobe State Governor, Ibrahim Gaidam. They were all taken to court over the outcome of the April 11, 2015 governorship elections. The court fixed February 15 to give reasons for its unanimous judgment in the election. The Rivers State Government has approved January 27 of every year as a public holiday to mark the survival of the state from the forces of political conspiracy who attempted to subvert the mandate of the people. The Supreme Court delivered her judgment validating Governor Wike’s election on January 27, 2015. Also on Tuesday, Rivers State Governor, Nyesom Ezenwo Wike reiterated his warning to those planning to rig the rerun elections in Rivers state, noting that they will be treated as armed robbers by the people. Addressing thousands of civil servants at the State Civil Service Secretariat in Port Harcourt , Governor Wike said that the public holiday signifies God’s intervention in the affairs of Rivers State. He said: “Every January 27 will be observed as a public holiday in this state because that is the day God came down to save Rivers State. What people must understand is that power comes from God. We know God speaks last and he has spoken.” The governor also announced that Friday, February 5, will be observed as a public holiday to enable all Rivers people prepare for the rerun elections. Governor Wike urged civil servants and other Rivers people to ensure they vote for PDP candidates in the re-run elections to promote harmony in governance and sustain the development agenda of the state government. He pointed out that the defeated APC in the State plans to use the rerun elections to enter the political arena through the window , having been shut out by the people and the Supreme Court. Governor Wike said: “When someone cannot come through the door, he may want to come through the window. Rivers people must not allow them. Our people must stop them from entering through the window to obstruct the good works of this administration. ” Speaking further on the rerun elections, Governor Wike said that the will of Rivers people will prevail, adding that the use of security forces and other electoral officials to rig the process will fail woefully. According to him, the people believe in the transformational leadership of the PDP, stressing that it was exhibited in Bayelsa State, where the use of force by security agents failed to deliver electoral victory. He said: “Anyone who plans to rig an election is an armed robber and should be treated as such. If you are coming to rig an election in the state, first, prepare your will before embarking on the journey. Inform your wife or husband and go ahead to say your last prayer. “When they used the security forces in Bayelsa State, it didn’t work. It will also not work here in Rivers State. Rivers State is a peaceful state and our people are peace loving. We want to remain so”. The governor assured civil servants and pensioners that his administration will continue to pay their salaries and pensions. He said all welfare issues will be given top priority. He, however, stated that steps will be taken by the administration to verify the actual number of civil servants and pensioners to stop payment to non-existent beneficiaries. The governor added that the administration will work out modalities to improve the state’s Internally Generated Revenue, IGR. Earlier, Head of the State Civil Service, Barrister Rufus Godwins commended the governor for being up to date in the payment of salaries and pensions. Ade Adesomoju, Abuja The trial of the immediate past National Security Adviser, Col. Sambo Dasuki (retd.), and his co-defendants for alleged diversion of N13bn, part of funds said to be meant for procurement of arms, was stalled before Justice Peter Affen of the Federal Capital Territory High Court in Maitama, Abuja, on Tuesday. Tuesday’s proceedings could not go on due to the failure of the operatives of the Department of State Service to produce the ex-NSA in court on time and the need for the other co-defendants to respond to an application by Dasuki to stop the trial. The DSS only produced the ex-NSA in court on Tuesday at the point when Justice Affen was adjourning the case. The judge adjourned till February 26. Others who are being prosecuted along with the former NSA with respect to the 22 counts of N13bn fraud charges are a former Director of Finance and Administration in the Office of the NSA, Shuaibu Salisu, a former Minister of State for Finance, Bashir Yuguda; a former Governor of Sokoto State, Attahiru Bafarawa, the ex-governor’s son, Sagir Attahiru, and a firm, Dalhatu Investment. A development similar to what transpired in court on Tuesday had stalled the ex-NSA’s trial before Justice Baba Yusuf of the same Maitama Division of the FCT High Court on January 22. Justice Yusuf had then adjourned Dasuki’s trial till February 4. Dasuki is being prosecuted before the court on 19 counts of diversion of N32bn arms fund, along with a former Director of Finance and Administration in the Office of the NSA, Shuaibu Salisu and a former Director of the Nigerian National Petroleum Corporation, Aminu Baba-Kusa. Aminu-Kausa’s two firms – Acacia Holdings Ltd and Reliance Referral Hospital Limited – are also part of the accused. In the applications filed before the two judges, Dasuki’s lawyer, Mr. Joseph Daudu (SAN), argued that the prosecution lacked the right to continue to prosecute him. Dasuki was re-arrested by operatives of the DSS on December 29, 2015 shortly after he was released from prison upon fulfilling the bail conditions granted him by Justice Yusuf on December 18.
