The Federal High Court Sitting in Lagos has ruled that the Fundamental Rights Enforcement Suit filed by Suspected Billionaire Kidnapper, Chukwudumeme Onwuamadike popularly known as ‘Evans’ can proceed.
Justice Abdulaziz Anka dismissed the objections of Emmanuel Eze, the counsel for the third and fourth respondent and agreed with Counsel to Evans, Olukoya Ogungbeje that service on the Ist and 2nd respondent had been properly effected.
The first and second respondents in the suit are the Inspector General of Police, the Nigeria Police Force. The other respondents are the Lagos State Police Commissioner and the Special Anti Robbery Squad, SARS.
In his ruling, Justice Anka also held that leave was not required for the matter to be heard during vacation as Order 4 Rule 5 of the Fundamental Rights Enforcement Procedure Rules of 2009, enjoins the court to pursue speed and justice on issues of fundamental human rights.
In the application, the suspected Kidnapper, ‘Evans’ is challenging his continued detention since June 10 without arraignment.
He claims that his parade on June 11 before journalists at the Lagos police command headquarters in Ikeja, without a court order, is unconstitutional and illegal.
Evan wants the court to award him N300m as exemplary damages for his alleged illegal detention and the alleged harm caused by his media trial.

Justice Yusuf Halilu of the Federal Capital Territory (FCT) High Court has issued an ex-parte order directing that the Paris-London Club Refund bank accounts of Abia, Cross River, and Delta states be frozen. The accounts to be frozen are listed as follows: Abia state Paris and London Club Debit Refund, 1019892950, UBA Bank Plc; CRS Paris and London Club Debit Refund, 101989719, UBA Bank Plc; and DTSG CRS Paris and London Club Debit Refund, 1012906702, Zenith Bank Plc respectively.
The court gave the order amidst allegations that the governors of the three states preferred payment to family members, friends, and cronies in the guise of settling the fees for consultancy services at the expense of the real consultant progenitor of the Paris-London Club Refund.
Abia state government reportedly owes the real consultant progenitor the sum of $11,325,000 and N1.72bn; Cross River state government owes the sum of $8,050,000 and N1.2bn; While, Delta state government owes $27,274,135 and N3bn. According to documents exclusively obtained by DAILY POST, the court order was sequel to an affidavit in support of ex-parte originating summons sworn to by Dr. Maurice Ibe, the Chairman and Managing Director of Mauritz Walton Nigeria Ltd, and filed before the court by his Counsel; Alex Marama, Charles Ude, and Kenneth N. Esq. Ibe averred that there is an urgent need for the court to direct the third defendants (United Bank for Africa (UBA) Plc and Zenith Bank Nig. Plc) in the suits CV/2470/17, CV/2536/17, CV/2469/17 and motions M/8777/17, M8780/17, M/8784/17 to, in the interim, stop further disbursement of the money already in or accruing to the respective Paris-London Club Refund accounts domiciled with them which belong to the three states respectively. The Court also ordered the banks to set up an escrow account where the said funds will be deposited pending the hearing and determination of the Motion on Notice. Abia state government led by Theophilus Orji had engaged Mauritz Walton Nigeria Ltd on the 3rd of November, 2014 to pursue the refund of excess deductions on foreign loans and miscellaneous charges in exchange of 30 percent of any fund recovered. Similarly, Cross River government engaged the same consultancy firm on the same date for the same purpose in exchange of 20 percent of any fund recovered. Delta state government under governor, Emmanuel Uduaghan also engaged the services of Mauritz Walton Nigeria Ltd in exchange of 30 percent of any fund recovered. The leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has alleged that the leaders of the apex Igbo organization, Ohanaeze Ndigbo, were behind the gunman attack on worshippers in St. Philips Catholic Church, Ozubulu in Anambra state.
He made the allegations while addressing IPOB members who paid him a visit at his Umuahia residence yesterday.
According to him, Ohanaeze leadership allegedly accepted financial inducement from anti-Biafra individuals and organization to divide the opinions of South-easterners through various media statements so that terror could be unleashed on the people already divided in thoughts.
He further dismissed the reports that claim the shooting was a product of on-going feud between two overseas-based drug barons of Igbo origin.
Kanu said: “They have killed our people in Onitsha. They have been to the church to massacre our people in Ozubulu.
“When we ask you not to vote, people don’t understand. Those you are voting for cannot protect you. I warned you four years ago that a time will come when they would come into your house, your villages to massacre you and nobody will protect you. It has happened. Hasn’t it?
“They want us to vote in Anambra where they are killing our people; where they cannot protect us.
“The only reason why they want you to vote is because of the monthly allocation so that they can keep sharing money every month.
“They don’t care about you. They don’t give a damn about you.
“Do you know why they killed people at Ozubulu?
“The enemies are very clever. Since, I came out of prison they could not attack. They were waiting to drive a division between us and the politicians in Abuja; and your governors; and Ohanaeze Ndigbo.
“When they saw that we (Igbos) were together, they couldn’t do anything. They kept waiting. They kept giving them (South-East governors and Ohanaeze leadership) money to attack IPOB.
“The moment they started doing what they were told, the enemies knew it was the time to strike.
“Our people are not reasonable enough to understand the threat facing them.
“Tell me where in this world you have a governor like you have in Anambra, and the enemy will come and strike.
“The killing in Ozubulu is an example of how the enemy works. They first of all come and try your resolve and when you resist them, they use subterfuge to divide you. Once they see any space, they strike. Ohanaeze must know this.

The National Chairman of the ruling All Progressives Congress (APC) , John Oyegun has been allegedly accused of planning to dissolve the APC structure in Kogi state on Tuesday during the National Working committee Meeting of the party. The Vice Chairman of the All Progressives Congress (APC) Kogi West, Chief Gbenga Ashagun made the allegation in a statement issued and made available to DAILY POST on Monday in Lokoja. Ashagun said this development is contrary to Chief Tony Momoh-led committee recommendations that strongly evolved a blueprint for reconciliation between the Audu/Faleke faction and the Yahaya Bello led faction. He explained that the latest move by John Oyegun is directly creatuing a glaring line of selfish interest which is now at the point of selling the Audu/Faleke faction of the APC to the Yahaya Bello’s faction of the APC. According to the Kogi APC Chieftain, “It was observed that the National Chairman of the APC, Mr John Oyegun may have been offered a Greek gift amounting to the sum of 150 million naira to be disbursed among the high-ranking members of the APC NWC in the party secretariat, Abuja.” He further hinted that the National Chairman of the party will also get a contract for the rehabilitation of Kabba township road at a highly exorbitant amount as a compliment for effecting the shady deal. “Going by the above insight, it is obvious that the Audu/Faleke led faction with Haddy Ametueo as the state chairman of the party may be losing the battleground to the money bag faction of the Alhaji Yahaya Bello, a development that may mark the obituary for what can be tagged as the remainder of the APC in Kogi state,” he stated. However, Ashagun maintained that the Audu/Faleke faction will resist this gruesome decision because they are ready to fight the battle to any length. “John Oyegun whose tenure is almost coming to an end may have nothing to lose considering the fact that the APC is a mere shadow of itself, though the PDP in Kogi state may be the largest beneficiary, should John Oyegun accept the ‘Ghana Must Go’. This will dampen the hope of the Audu/Faleke led faction in their quest for justice. “It is baffling to note, that the APC that came to power with a strong message centered on anti-corruption campaign slogan is now caught in the web of corruption.
