The Federal High Court in Abuja on Wednesday gave the court bailiff five days to serve former President Goodluck Jonathan with the subpoena compelling him to appear in court with respect to the trial of a former National Publicity Secretary of the Peoples Democratic Party, Olisa Metuh.

The court also ordered the counsel prosecuting Metuh, Mr. Sylvanus Tahir, to persuade the Economic and Financial Crimes Commission to explore administrative means of ensuring that the Department of State Service produced the detained former National Security Adviser, Col. Sambo Dasuki, in court on October 31.

Upon applications by Metuh, the court had issued two separate subpoenas on Jonathan and Dasuki, compelling them to appear in court on Wednesday.

But both men were, however, absent from court on Wednesday.

Justice Abang noted in his ruling on Wednesday that without the two summoned witnesses appearing, the court might not be able to make any progress in the case.

He also noted that while Dasuki had been served with the court subpoena, Jonathan had yet to be served so could not be blamed for failure to attend court on Wednesday.

But the judge noted that singular attempt by the court bailiff to serve Jonathan personally with the witness summon at his home in Abuja, was not sufficient.

He therefore directed the bailiff to take further steps to ensure personal service on Jonathan within five days from Wednesday.

He said if after five days, the bailiff was unable to serve Jonathan personally, Metuh, who was the one who applied for the subpoena, should kick-start the process of serving the ex-President through substituted means.

Politics[BREAKING] Metuh’s Trial:Court Strikes Out Dasuki’s Application Against Subpoena by DONSMITH123(op): 11:07am On Oct 25, 2017

The Federal High Court in Abuja has struck out an application by the detained National Security Adviser, Sambo Dasuki, seeking an order setting aside the subpoena directing him to appear in court to testify on behalf of a former National Publicity Secretary of the Peoples Democratic Party, Mr. Olisa Metuh.

The trial judge, Justice Okon Abang, ruled that having been ordered by the Court of Appeal in Abuja on September 29, 2017, he lacked jurisdiction to hear and determine the motion on merit.

He held that determining the motion on merit would amount to an attempt to review the judgment of a higher court, the Court of Appeal.

He held that all issues raised by Dasuki, through his lawyer,Mr. Ahmed Raji (SAN), had become academic since the court lacked jurisdiction to hear the complaints.

According to the judge, it would amount to “judicial anarchy” to hear Dasuki’s application on merit.

“If the applicant(Dasuki) is dissatisfied, he should know what to do and where to go, but certainly not this court,” the judge ruled.

But Dasuki, despite the subpoena issued on him upon Metuh’s application directing the Department of State Service to produce the detainee, is absent from court on Wednesday.

Former President Goodluck Jonathan also ordered by the court to appear in court upon an application by Metuh was also absent.
But a court registrar confirmed to the judge on Wednesday that Jonathan had yet to be served with the subpoena by the court bailiff as of Tuesday.

But the Department of State Service in whose custody Dasuki is detained has yet to produce the ex-NSA in court.

The judge had announced in court on Tuesday that he had, on Monday, issued a subpoena to be served on Jonathan.

But the judge, who fixed Wednesday (today) for his ruling on Dasuki’s motion, had ordered that both the ex-NSA and Jonathan must appear in court on Wednesday(today).

The two men were summoned by the court upon an application by Metuh requesting that they be ordered to testify in his defence with respect to the sum of N400m which he was said to have received fraudulently from the Office of the NSA in 2014.

President Muhamadu Buhari on Tuesday in Niamey, Republic of Niger, urged member countries of the Economic Community of West African States to to tread carefully in pushing for a single currency in the sub-region by 2020.

He cited the challenges faced by the European Union in realising the same goal to buttress his position.

According to a statement by his Special Adviser on Media and Publicity, Mr. Femi Adesina, the President made his position known in his speech at the fourth meeting of the Presidential Task Force on the ECOWAS Currency Programme.

Buhari said the necessary economic fundamentals among countries continue to differ over the years, making it more difficult to pull through with the project by 2020.

“Nigeria advises that we proceed cautiously with the integration agenda, taking into consideration the above concerns and the lessons currently unfolding in the European Union.

“To that end, Nigeria will caution against any position that pushes for a fast-track approach to monetary union, while neglecting fundamentals and other pertinent issues,” the President was quoted as saying.

Buhari noted that some of the obstacles to realising the roadmap for the implementation of a single currency include diverse and uncertain macro-economic fundamentals of many countries, unrealistic inflation targeting based on flexible exchange rate regime and inconsistency with the African Monetary Co-operation Programme.

The President said domestic issues in ECOWAS member countries relating to their constitutions and dependence on aids continue to affect the framework for implementing the single currency in the sub-region

He said, “Although the ECOWAS Commission has anchored its pursuit of the new impetus to monetary integration on the information presented to the Heads of State which were the basis for their recommendations, we are concerned that we have not properly articulated and analysed a comprehensive picture of the state of preparedness of individual countries for monetary integration in ECOWAS by 2020.

“In previous meetings, we had specifically raised observations on the state of preparedness of the member states, the credibility of the union if anchored on watered down criteria, and the continuing disparities between macroeconomic conditions in ECOWAS countries, amongst others. And I would like to reiterate this concerns.”

The President told the Heads of State that the conditions that pushed Nigeria into withdrawing from the process in the past had not changed.

According to the Senate, the committee is to investigate the circumstances of how Mr Maina got into the country, how Mr Maina was reinstated into Public Service and how Mr Maina got promoted to the level of Director.

President Muhammadu Buhari has ordered the immediate disengagement of the former Chairman of the Presidential Task Force on Pension Reforms, Mr. Abdulrasheed Maina, from service.

The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, disclosed this in a statement on Monday.

Adesina said Buhari has also directed the Head of Civil Service of the Federation, Mrs. Winifred Oyo-Ita, to submit a report on the circumstances surrounding Maina’s reinstatement to his Chief of Staff, Abba Kyari, before the close of work.

The statement read, “President Muhammadu Buhari has directed the immediate disengagement from service of Mr Abdullahi Abdulrasheed Maina, former chairman of the Presidential Task Force on Pension Reforms.

“In a memo to the Head of the Civil Service of the Federation, the President equally demanded a full report of the circumstances of Maina’s recall and posting to the Ministry of Interior.

“The report is to be submitted to the office of the Chief of Staff to the President, Mallam Abba Kyari, before the end of work today, Monday, October 23, 2017.”

A former National Publicity Secretary of the Peoples Democratic Party, Chief Olisa Metuh, told the Federal High Court in Abuja on Monday that he would subpoena as his defence witness former President Goodluck Jonathan.

His lawyer, Dr. Onyechi Ikpeazu (SAN), told Justice Okon Abang that he had written Jonathan to that effect but that the former President did not reply.

Ikpeazu said his intention was to apply for subpoena to be issued on Jonathan after the detained former National Security Adviser, Sambo Dasuki, earlier summoned to testify as Metuh’s witness ended his testimony

He said, “We have another witness on subpoena, and at the end of the evidence of this another witness, we will take a decision on whether or not the first defendant (Metuh) will testify.

“The other witness we want to subpoena is Goodluck Jonathan, former President of the Federal Republic of Nigeria.”

Responding to further questions from the judge, Ikpeazu said, “We wrote him a letter but he did not respond and our plan will be to apply for the subpoena after the first application (for subpoena to be issued on Dasuki).”

Although Ikpeazu said Dasuki was scheduled to be the next to testify for the defence, the ex-NSA was absent from court on Monday.

Dasuki’s lawyer, Mr. Ahmed Raji (SAN), was however in court to oppose the request to compel the ex-NSA to testify as Metuh’s defence witness.

The court session is ongoing.

The Court of Appeal in Abuja had on September 29, ordered the Department of State Service to produce Dasuki before the court in Abuja to enable him to testify as Metuh’s witness.

In a unanimous judgement delivered by its three-man panel, the Court of Appeal ordered the trial judge, Justice Abang before whom Metuh is being prosecuted, to immediately sign the subpoena filed by the ex-PDP spokesperson and same be served on Dasuki, who has been the
custody of the DSS since December 2015.

Justice Peter Ige, who prepared and read the lead judgement of the three-man panel of the appellate court,directed Justice Abang to indicate the date which the DSS must produce Dasuki in court and other subsequent dates when the ex-NSA’s court attendance would be required.

Other members of the panel, Justices Emmanuel Agim and Mohammed Mustapha, agreed with the lead judgment.

The Economic and Financial Crimes Commission, had in January 2016, arraigned Metuh and his company, Destra Investments Limited, on seven counts of money laundering involving alleged cash transaction of $2m and fraudulent receipt of N400m meant for procurement of arms from the NSA office on November 22, 2014.

The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, on Friday said Nigerians did not protest when the present administration increased the pump price of petrol to N145 per litre because of the trust they have in President Muhammadu Buhari.

Adesina stated this on his Twitter handle, @femadesina, in apparent response to a statement credited to former President Goodluck Jonathan that those who criticised him for leaving the pump price of fuel at N87 are not speaking out now that his successor had jerked up the price to N143.

The presidential spokesman said the difference between the two scenarios painted by the former President was trust.

“When petrol went to N145 under PMB, Nigerians held their peace, unlike when they shut the country in 2012. The difference is trust. Simple,” Adesina tweeted.

Jonathan’s administration had in 2012 increased fuel price from N67 to N97 per litre but reduced it to N87 in January 2015.

Speaking on Thursday when a chairmanship aspirant of the Peoples Democratic Party, Tunde Adeniran, visited him, the former President had expressed surprise that those who criticised his moves on fuel price had remained silent under Buhari.

“My government was severely criticised for increasing the pump price of petroleum from N67 to N97 at a time that global crude price was going for over $100.

“The pump price was later reduced to N87 when the price of crude oil dropped and they attacked us that it was supposed to be lower.

“Those who criticised my administration are not talking again now that the global crude oil is about $53 per barrel and the pump price of petrol is N143,” Ikechukwu Eze, Jonathan’s spokesman, had quoted him as saying in a statement.

Benue State Governor, Samuel Ortom, on Tuesday said there was no other credible candidate for the 2019 presidential election that has the capacity to move Nigeria forward apart from President Muhammadu Buhari.

Ortom, a governor elected on the platform of the ruling All Progressives Congress, said this in an interview with State House correspondents shortly after he met with Buhari at the Presidential Villa, Abuja.

While saying he is happy seeing Buhari “bouncing every day,” the governor prayed that God will help the President to lead the nation till 2023.

Ortom said, “I came to appreciate the President and to encourage him to be steadfast and committed to his leadership.

“I believe that what God brought him to achieve in this country, he will definitely achieve it.

“Now we see him bouncing every day to the glory of God. We appreciate this and we look forward that God will help him to take us through 2015 to 2019 and then 2019 to 2023.

“That is our prayer because for now, there is no credible candidate as far as I know that has the capacity to take Nigeria out of where we are today.

“I believe Mr. President has the capacity and let God sustain his health and consummate his healing so that Nigeria can be on the right path.”

A former President, Chief Olusegun Obasanjo, has vowed never to return to the Peoples Democratic Party.

This was what he told journalists after he met with the National Caretaker Chairman of the party, Senator Ahmed Makarfi, behind closed-doors.

The meeting was held at the Olusegun Obasanjo Presidential Library, Abeokuta, which lasted for one hour.

The former president said, “I will never return to the PDP, just like a dog would never return to its vomit.”
