Femi Falana in a communique sent out on Thursday, advocated for election petitions to be handled by retired Judges as serving judges have been overburdened, leaving all matters pending in their courts to carry out national assignments. The human rights activists pointed out the adjournment of court cases by over 350 Judges of the State High Courts, Federal High Court, and National Industrial Court, for a 'national assignment' which was never within their jurisdiction. Femi Falana pushed for a review of preference given to election petitions and appeals, and further stated that such cases are not handled by regular courts in neighbouring countries but by constitutional courts. The statement reads “Over 350 Judges drawn from State High Courts, Federal High Court, and National Industrial Court and handling election petitions have adjourned all matters pending in their courts’ sine die. Their Lordships and Ladyships are said to have left their jurisdictions for “national assignment” in other parts of the country. “Apart from appeals arising from pre-election cases and election petitions, both the Court of Appeal and Supreme Court are adjourning all pending appeals till 2020 and 2021. The vacation of the Justices of the Court of Appeal has been cancelled to enable them to handle election-related appeals. “Since all litigants are equal before the law it is high time the preference given to election petitions and appeals by Nigerian courts was reviewed. In some neighbouring African countries, election petitions are not handled by regular courts but by constitutional courts. “It is therefore suggested that the Constitution be amended to allow retired judges to handle election petitions and appeals arising from them. If our retired judges can handle arbitral matters and participate in judicial commissions of enquiry they should be saddled with the responsibility to handle election petitions and appeals arising from them. “The injustice meted out to litigants whose cases are not political by the legal system should stop forthwith in the interest of justice”. Today, the Independent National Electoral Commission described the 48-compact disc evidence tendered by the Peoples Democratic Party and its presidential candidate, Atiku Abubakar, as empty and lacking in probative value According to reports four of the video clips played at the Presidential Election Tribunal court hall included ‘countdown of Osun Decides,’ a production of Channels Television, with Seun Okinbaloye as host. In the production dated February 8, Mike Igini, Resident Electoral Commissioner for Akwa Ibom, had talked about the readiness of the electoral body to transmit the February 23 general elections electronically. The second video was a clip of the postponement of the general elections by INEC chairman, Prof. Yakubu Mahmood while the third video was a clip of AFEX Nigeria training of INEC ad-hoc staff on electronic result transmission. Similarly, the briefing by the Nigerian Army authority on the status of President Muhammadu Buhari’s alleged certificate saga completed the four materials shown in court. Counsel for the petitioners, Chief Chris Uche, SAN, had led the spokesman for the Atiku Abubakar Campaign Organisation, Segun Showunmi, to tender the materials before the five-man panel of justices. During his cross-examination by counsel for INEC, Yunus Usman, SAN, Showunmi agreed that the Resident Electoral Commissioner for Akwa Ibom was not a spokesman for the Commission. Usman also made the witness to confirm that the chairman of the electoral body only expressed the hope of the Commission to transmit results of the general elections electronically, but that it was actually done. Usman was of the view that the video clips front-loaded by the witness had nothing to do with the February 23 general elections. Showunmi attested to Usman’s question by saying that the four clips were events that preceded the election. The other clip was on the President’s certificate controversy, as the Army confirmed that Buhari had West African Examination Certificate with credits in English Language, History, Geography and a pass in English Literature. Meanwhile, counsel for Buhari, Dr. Alex Izinyon, SAN, had tendered a video clip dated February 6 where chairman of the Commission hinged the possible transmission of the election electronically to the signing of a new Electoral Act. Drama however ensued as the petitioners’ legal team refused to allow their system to be used to play the CD. In the circumstance, Izinyon filed an oral application for adjournment to allow his team bring their system and screen to continue with the cross examination of the witness. Justice Mohammed Garba went ahead to adjourn the proceedings until July 16 for continuation. Earlier, the petitioners had presented three of their witnesses, totaling about 40 of them out of the 400 that were listed to testify so far. On their parts, Babagana Kukawa, Hon. Abana Pogu, Suleman Mohammed, Local Government Area Collation Agents for PDP had alleged over-voting, vote-buying, and violent disruption of the election in their various states. When they were crossed examined, the witnesses were unable to back up their allegations with documentary evidence. The counsel to INEC had reminded them that their signature on Forms EC8C (results transmitted to the local government areas) were approval of the exercise at polling units and ward levels across their states. The People’s Democratic Party in Edo State has called on Governor Godwin Obaseki to begin prosecution of National Chairman of the All Progressives Congress (APC), Comrade Adams Oshiomhole and other persons connected with the awarding, poor execution and commissioning of the state multi-billion naira five-star Benin City Central Hospital. The PDP commended Governor Obaseki for taking a bold step to calling for a probe into the building despite the fact that he was a part of the government that initiated the project. State Chairman of the PDP, Chief Dan Orbih, also urged the Economic and Financial Crimes Commission (EFCC) to begin its anti-corruption crusade from Edo State Chief Orbih noted that for the state government must have gotten evidence for it to have come out to say that the project was fraudulent and a scam. Orbih said the hospital was built at an inflated rate when compared with others in its neighbouring states. His words, “By 2016, the government had wasted over N10,267,413,000.00 and every year, the Obaseki Government have been allocating and spending millions of Naira to “complete” the already commissioned project. “By way of comparison, the specialist new hospital (NOT WARD) in Calabar with comprehensive package of secondary gynaecology, obstetrics, paediatrics, internal medicine, General Surgery, Orthopedics, laboratory services, Basic cardiology, Dermatology and other medical services was built, equipped and commissioned at a cost of N6.4 Billion. The Akwa Ibom and Bauchi specialists hospitals were constructed at even lower costs”, he said. “Before the government will come out with a statement that the central hospital today is a fraud, a scam, they must have seen even more documents than the ones that are available to the public. “They have come to a conclusion that that project is a scam. What is expected by the government is to immediately put in place actions that will bring all those connected with the fraud to book. “Interestingly, after several past denials and defense by Godwin Obaseki’s government, they have now come out to admit that the project is a fraud. “They stated that the phased opening of the Hospital to public use is as a result of fraud in the contract and non-supply of equipment fully paid for by the government,” he said. Governor David Umahi of Ebonyi State, on Wednesday, disclosed that many of the citizens of the state were jostling for various political positions in his government. Umahi, who made the disclosure during the swearing-in of the the newly appointed Head of Service and Senior Special Assistants, said that following government advertisement, over 10,000 Ebonyians had applied as Commissioners, Senior Special Assistants, Special Advisers, Senior Technical Assistants, Technical Assistants and Coordinators of Development Centres across the state. It would be recalled that early this month, the Ebonyi State Government had called for applications from members of the public to apply as members, Local Government Advisory Committee, STAs, TAs, Coordinators and Management Committee Members. Speaking during the swearing-in of the HoS and 22 SSAs at the Executive Council Chamber of the Government House, Abakaliki, Governor Umahi, expressed dismay at the rate at which the people sought after political appointments. He said, “What is trending in Ebonyi state is everybody saying I want to be SSA and SA. Imagine the cabinet we have, everybody wants to be SA. If I am making more SAs, it must not be up to ten per cent of the SAs I have appointed. It is my opinion that we find something else doing. “My Commissioners will come last. I want to let them know that this job can be done without anybody. My former Commissioners started a very bad trend for the state and for me. “Everyday, they are discussing the Governor, going from one office to the another. They were going about saying that there were not being given anything and not taken care of. If I get complaints again, I will get rid of that person. “Anybody we will appoint now, we will tell the person, ‘this is not come and chop, it is come and work’. So, from day one, if you do not want to sacrifice to work for the people, you better go and look for another opportunity. If I get anybody complaining there is no money, I will get rid of the person. This is no longer going to be a gossip workshop. People are called to work. “This is not the era of coming with files. You have to create wealth. Let’s look beyond the money we get.” Read more here https://thickmatch.com/everybody-ebonyi-wants-sa-ssa-gov-umahi/
