The United States Court of Appeals for the Fourth Circuit has ordered a White South Carolina restaurant manager to pay $546,000 as restitution to a Black man with intellectual disabilities after he forced him to work at an eatery under his management for five years without pay.
The recent ruling comes after a district court initially ordered 56-year-old Bobby Paul Edwards to pay $273,000 to John Christopher Smith in unpaid wages and overtime compensation after he reached a plea deal with authorities in 2019, The Washington Post reported. Edwards, who ran the J&J Cafeteria in Conway, was also sentenced to 10 years in prison after pleading guilty to one count of forced labor.
However, an April 21 ruling by the appellate court determined the district court “had erred” in not calculating the initial amount based on federal labor laws – meaning Smith was actually entitled to $546,000 or twice the amount. Smith, who worked at the restaurant from 2009 to 2014 without any remuneration, was also subjected to physical and racial abuse by Edwards during that period. Smith was also reportedly forced to work for over 100 hours every week and was not entitled to any day-offs.
“When an employer fails to pay those amounts (regular and overtime pay), the employee suffers losses, which includes the loss of the use of that money during the period of delay,” the ruling determined.
Smith, 43, started working at the eatery as a dishwasher and table busser in 1990 at the age of 12. And though he initially did not have any issues with the previous restaurant managers, things started to go south when Edwards took over in 2009. With the now-convicted Edwards in charge, Smith was denied his salary and was treated without any respect for human decency.
Edwards forced the Black worker to move into an apartment that was infested with roaches, The Washington Post reported. Smith’s attorneys said the apartment, which belonged to Edwards, was “sub-human,” “deplorable” and “harmful to human health.” Besides that, a Department of Justice report also stated Edwards subjected Smith to physical abuse. This included beating him into submission, whipping him with a belt, knocking him with pots and pans, and at one time, burning him with hot grease. Edwards also prevented Smith from having any contact with his family and threatened to call the police on him.
“Most of the time I felt unsafe, like Bobby could kill me if he wanted,” Smith said, per court documents. “I wanted to get out of that place so bad but couldn’t think about how I could without being hurt.”
Edwards was eventually arrested in 2014 after a lady whose daughter-in-law worked at the restaurant reported him to authorities. Workers at the restaurant were initially hesitant to report Edwards out of fear of retaliation from him.
“For stealing his victim’s freedom and wages, Mr. Edwards has earned every day of his sentence,” U.S. Attorney for the District of South Carolina Sherri A. Lydon reportedly said after his 2019 sentencing. “The U.S. attorney’s office will not tolerate forced or exploitative labor in South Carolina, and we are grateful to the watchful citizen and our partners in law enforcement who put a stop to this particularly cruel violence.”

A nasal spray which can prevent a coronavirus infection for up to two days could be available in high street pharmacies by the summer, researchers have said.
Scientists at the University of Birmingham have been developing the spray since April last year and are currently in discussions with shops and pharmaceutical giants on the next steps to mass produce it.
Dr Richard Moakes, the study’s lead researcher, said he is confident in the spray’s formula to help unlock society from social distancing restrictions and “get schools going again”.
The nasal spray, which has not yet been named, is made from ingredients that are already approved for medical use, meaning it is safe for use by humans and does not require further approval.
The formula helps prevent infection by capturing the virus in the nose and encapsulating it in a coating which it cannot escape from. As a result, it would be safe for a person to breathe out - even if inhaled by another person - because the virus would be inactive and harmless.
“As an over the shelf product, we have spoken to companies with a presence on the high street as we think they could distribute it effectively,” Dr Moakes told the Telegraph.
“Based on the product, it will be much quicker to get to the user than a novel drug.
“I am confident that the formulation can make an impact. Our goal is to make an impact as soon as possible, we would really like to see this happen by summer.”
In November last year, the researchers announced that laboratory experiments showed the spray prevented a coronavirus infection from spreading for up to 48 hours.
The team believes using the spray four times a day would be enough for general protection, although it is safe enough to be applied every 20 minutes if in a high-risk, densely populated environment such as schools.
Dr Moakes believes that the spray could be particularly effective in getting children back into classrooms across the country.
He said: “We think it will help in schools , as one of the good things about the formulation of the nasal spray is that it would not need to be reformulated for children.
“It means we would give it to children and adults alike, and it might be able to get schools going again.
“We also believe that the way it sprays would make it more user compliant, reducing the sensations which put people off many current nasal applicants.
“If it could facilitate getting students back to school, and education being re-established, then that would be great.”
The spray is a combination of an antiviral agent called carrageenan, commonly used in foods as a thickening agent, and a solution called gellan – a gelling agent selected for its ability to stick to cells inside the nose.
Gellan is an important component because it has the ability to be sprayed into fine droplets inside the nasal cavity, where it can cover the surface evenly and stay at the delivery site rather than sliding downwards and out of the nose.

Last year Professor Liam Grover, the study's co-author, said: "Although our noses filter thousands of litres of air each day, there is not much protection from infection and most airborne viruses are transmitted via the nasal passage.
“The spray we have formulated delivers that protection but can also prevent the virus being passed from person to person."

The Federal High Court in Abuja, on Saturday, dismissed the certificate forgery case the All Progressives Congress, APC, and one its members, Mr. Williams Edobor, instituted against Governor Godwin Obaseki of Edo State.
The court, in a judgement that was delivered by Justice Ahmed Mohammed, held that the Plaintiffs, failed to by way of credible evidence, discharge the burden of proof placed on them by the law.
Justice Mohammed said there was no iota of evidence before the court to establish that Obaseki forged either his O’level certificate or the degree certificate that was awarded to him in 1979 by the University of Ibadan.
He held that allegation of forgery the Plaintiffs levelled against Obaseki bordered on crime and therefore required to be proved beyond reasonable doubt.
“None of the witnesses called by the Plaintiffs was able to prove that the certificate as forged.
“In fact, the witnesses admitted that none of them visited the University of Ibadan to confirm the authenticity of the certificate.
“The Plaintiffs only relied on photocopies that were attached to the Form EC9 the 1st Defendant submitted to the Independent National Electoral Commission”, the court noted.
It held that apparent discrepancies in the documents Obaseki submitted to INEC, “were satisfactorily explained”.

I am reading comments of people saying she should petition the NBA to discipline the lawyer. I shake my head. That is not the solution & it will amount to nothing & probably gets the lawyer angry.
The lawyer is fully within his right to withhold those documents as a lien for unpaid fees. see Rule 50(3) Rules of Professional Conduct (RPC) 2007. This is called a Right of Lien.
The solution is to find money asap to pay the lawyer. The more time passes, the money owed to the lawyer increases because of accrued interest.
When the lawyer has been paid & the documents returned to your aunt, your aunt will be in a better position legally to contest & recover the properties.

IN RESPONSE TO OBASEKI'S FORGERY CASE, AND SETTING THE RECORDS STRAIGHT

I believe there is need for me to reiterate the fact that I am not a member of any political party, neither am I affiliated to any political party in Nigeria. And I strongly doubt if I will ever belong to any political party. So, let's get that straight.

Still on the subject matter, firstly, Obaseki was accused of not having a credit pass in English language in one or two sittings. And secondly, it was said that he had just Three Credit passes without English. But bear in mind that he read Arts as a course. And for one to be admitted to read any Arts courses in the past, and, even now in Nigerian universities, one must have a credit pass in the English Language, which Obaseki doesn't have.

Up till now, nothing has been put forward by him to establish that he met the complete criteria to have been admitted to read any of the courses in UI. Also, I should have expected Obaseki and the UI authorities to re-tender the complete Degree certificate document, as well as his entry qualification details which they used to have admitted him into UI. That will end all the noise about Obaseki's eligibility to contest as Governor of Edo State.

This would not be the first time that I would have criticized politicians when they must have goofed. I criticize President Muhammadu Buhari more than any politician in Delta and Edo States. The simple fact is that Obaseki and the said Deputy Registrar has goofed. It is a shame for all of us because it will further dent Nigeria image, and the respected reputation of UI as Nigeria's premier university. Those still in doubt, should create time to read through this falsehood and reports by the supposed Deputy Registrar, Legal, Mr. Abayomi Ajayi, of the premier University.

As said by a friend, a man as enlightened as Obaseki and his informal Aide made a photocopy of his certificate without the date and signatures. What kind of mistake is that? That is, if it was even a mistake in the first place. Obaseki and his Aide should understand that a document without date or signatures is valueless. What prevented him from showing his original certificate with date and signatures on it when this case was instituted against him?

The usual certificate of Degrees are just the normal size of any Degree certificate. It doesn't make sense for a Deputy Registrar of a University to defend a document he terms as incomplete, as a legal document. What stopped the Registrar from tendering Obaseki's complete Degree certificate in their records to the court?

All of these tells you that the country is debauched with criminals in public offices. They can be bribed with money to fool themselves, even before a court, without being troubled if their integrity is stained along the line. It is obvious even to a person with poor judgement that the controversy surrounding the Obaseki's certificate forgery case has a lot of loopholes and questions.

The writer is politically biased. First & foremost, the Court has no business in veering into how a candidate got admission into a tertiary institution more than 40 years ago especially when their was yet to be JAMB & no uniformed admission requirements/process. What can the court to do? void his admission?
Secondly, the UI which is the issuing authority of Obaseki certificate has authenticated the certificate. About the photocopy machine debacle, even Ize iyamu witness testified that such do happen.

Education Secretary Betsy DeVos has submitted her resignation, saying President Donald Trump's role in spurring the mob that breached the US Capitol on Wednesday was "the inflection point," making her the second Cabinet member to resign over the incident.

In her resignation letter to Trump dated Thursday, which CNN obtained a copy of, DeVos called the rioters' behavior "unconscionable" and wrote, "There is no mistaking the impact your rhetoric had on the situation, and it is the inflection point for me."

"Impressionable children are watching all of this, and they are learning from us," she added.

"I believe we each have a moral obligation to exercise good judgment and model the behavior we hope they would emulate. They must know from us that America is greater than what transpired yesterday."

DeVos joins Transportation Secretary Elaine Chao, who had announced her resignation earlier Thursday after taking "time to absorb" the insurrection on Capitol Hill and the President's response to it, according to a senior administration official.

"Today, there was a lot of soul-searching and discussion," a senior official said. "It was obviously the right thing to do."

Resignations had started Wednesday with first lady Melania Trump's chief of staff, the White House social secretary, a deputy press secretary and Trump's deputy national security adviser all exiting before the night's end. Other officials, sources told CNN, had been considering resigning.

The wave of abrupt exits came after Trump supporters -- spurred by the President -- had breached the Capitol on Wednesday and engulfed the nation's capital in chaos.

After hundreds of pro-Trump rioters pushed through barriers set up along the perimeter of the Capitol, demonstrators eventually made their way into the building and the House floor was evacuated by police.

Only after pleading from aides and congressional allies inside the besieged Capitol did Trump release a video urging the rioters to "go home," while still fanning their baseless grievances about a stolen election.

DeVos had said in a statement released Wednesday in the aftermath of the breach: "The eyes of America's children and students -- the rising generation who will inherit the republic we leave them -- are watching what is unfolding in Washington today. We must set a better example for them, and we must teach them the solemn obligations and duties that come with the title 'American.'"

A peaceful transfer of power, she said, "is what separates American representative democracy from banana republics."

A top Republican donor and school choice activist, DeVos was tapped to head the Department of Education in 2016. The President hailed her in a statement at the time as "a brilliant and passionate education advocate."

"Under her leadership we will reform the US education system and break the bureaucracy that is holding our children back so that we can deliver world-class education and school choice to all families," Trump said.

While DeVos' tenure was marred by intense criticism of her education policies -- particularly her support for charter schools -- her eagerness and effectiveness at delivering on conservative priorities kept allies of Trump happy.

Frederick M. Hess, an education policy expert at the conservative American Enterprise Institute, previously called her a "trust buster" and a threat to the education establishment.

That includes her advocacy for charter schools as well as rolling back of numerous Obama-era regulations and guidelines. Among these was the institution of new protections for college students accused of sexual assault, which her department called a restoration of due process.

Recently, she faced considerable scrutiny internally for rarely attending coronavirus meetings, despite the heavy focus on whether schools should remain open in the spring or open as scheduled in the fall.

But even in her resignation letter, DeVos touted what she called the Education Department's advocacy for "forgotten students" as she bemoaned how Wednesday's violence took away from the Trump administration's "many accomplishments."

"Holding this position has been the honor of a lifetime," DeVos said in concluding her message, "and I will be forever grateful for the opportunity to serve America and her students."

There is a difference between the United States of America Capitol Hill which belongs to the federal government & that of a State Capitol Hill. The one you posted about is that of the California Capitol Hill. Every States in the US has it's own Capitol Hill.

Its a complex, that pulls down leaders, their country and followers with them.

When people keep on winning and feel that its their destiny to always win and then begin to make rash actions which clearly will bring them, as they feel that they have a destiny that no human calculation can bring down.

Trump operating on this grandiose nature, operated only on instinct, he threw out all scientific advice on quelling the spread of the virus and thoughtlessly proposed that Americans drink disinfectant to quell the virus.

He felt, Biden was too dumb to win him, he didn't know that it was bot about Biden, it was himself that he was running against as he alone had the power to mar or make things work for him.

With 250,000 dead, he still went on to advice his voters to not vote by mail, something that really came out to bite him and to bite him bad, and his legal team was headed by s lawyer that was out of practice for almost 30years, leading him on a streak of loses in courts, amounting to almost 100 loses.

He had the cult followers, people who contributed millions for him to run his case in court, people who would have turned up for him in 2024 to correct the mistakes of having told people to not use the mail in vote, he could have gone back to draw up plans to make it happen, he could have campaigned to ensure that Democrats lost in Georgia, thus loosing control of senate and having a chaotic 4term rule. But then, he worked for the democrats by telling republicans that the election is fraud thereby making them stay back.

And yesterday, all the incitement he had been fanning-up had fruition, and his hard liners took over congress, desecrating the American Democracy in full view of the whole world, and countries like Venezuela now had to tell Americans to allow the will of the people to stand.

Trump has been able to finally unite the whole American people into seeing what that could be at state in supporting an extremist and everyone will now try to work together to forestall this reoccurrence.

In the end, when the worst days in American Democracy is reviewed, it will be the President who incited a Coup on the Constitution and the will of the people that will take centre stage.

Hong Kong police arrested about 50 former lawmakers and pro-democracy activists Wednesday for allegedly violating the new national security law by participating in unofficial election primaries for the territory’s legislature last year.
The mass arrests, including of former lawmakers, were the largest move against Hong Kong’s democracy movement since the law was imposed by Beijing last June to quell dissent in the semi-autonomous territory.
“The operation today targets the active elements who are suspected to be involved in the crime of overthrowing, or interfering (and) seriously destroy the Hong Kong government’s legal execution of duties,” said John Lee, Hong Kong’s security minister, in a news conference.
He said those arrested were suspected of trying to paralyze the government, via their plans to gain a majority of the seats in the legislature to create a situation in which the chief executive had to resign and the government would stop functioning.
In a video released by former lawmaker Lam Cheuk-ting on his Facebook page, police turned up at his house and told him he was “suspected of violating the national security law, subverting state power.” Police told those recording the video to stop or risk arrest.
The election that would have followed the unofficial primaries was postponed by a year by Hong Kong Chief Executive Carrie Lam, who cited the public health risks during the coronavirus pandemic. Resignations and disqualifications of pro-democracy lawmakers have left the legislature largely a pro-Beijing body.
Lee said the police would not target those who had voted in the unofficial primaries, which were held in July last year and attracted more than 600,000 voters even though pro-Beijing lawmakers and politicians had warned the event could breach the security law.
All of the pro-democracy candidates in the unofficial primaries were arrested, according to tallies of the arrests being reported by the South China Morning Post, online platform Now News and political groups.
At least seven members of Hong Kong’s Democratic Party — the city’s largest opposition party — were arrested, including former party chairman Wu Chi-wai. Former lawmakers Lam, Helena Wong and James To were also arrested, according to a post on the party’s Facebook page.
Benny Tai, a key figure in Hong Kong’s 2014 Occupy Central protests and a former law professor, was also arrested, reports said. Tai was one of the main organizers of the primaries.
The home of Joshua Wong, a prominent pro-democracy activist who is serving a 13 1/2-month prison sentence for organizing and participating in an unauthorized protest last year, was also raided, according to a tweet posted from Wong’s account.
Police also went to the headquarters of Stand News, a prominent pro-democracy online news site in Hong Kong, with a court order to hand over documents to assist in an investigation related to the national security law, according to a livestreamed video by Stand News. No arrests were made.
Lee also pointed to a “10 steps to mutual destruction” plan among those arrested, which included taking control of the legislature, mobilizing protests to paralyze society and calling for international sanctions.
“The plot is to create such mutual destruction that if successful ... will result in serious damage to society as a whole,” said Lee. “That is why police action today is necessary.”
In recent months, Hong Kong has already jailed several pro-democracy activists including Wong and Agnes Chow for their involvement in antigovernment protests, and others have been charged under the national security law including media tycoon and outspoken pro-democracy activist Jimmy Lai.
The security law criminalizes acts of subversion, secession, terrorism and collusion with foreign powers to intervene in the city’s affairs. Serious offenders could face up a maximum punishment of life imprisonment.
Hong Kong leader Carrie Lam had said at the time of the unofficial primaries last year that if their aim was resisting every policy initiative by the Hong Kong government, the election may fall under subverting state power, an offence under the national security law.
Beijing had also called the primaries illegal and a “serious provocation” of Hong Kong’s electoral system.
Following the handover of Hong Kong to China by the British in 1997, the semi-autonomous Chinese city has operated on a “one country, two systems” framework that affords it freedoms not found on the mainland. In recent years, Beijing has asserted more control over the city, drawing criticism that it was breaking its promise of Hong Kong maintaining separate civil rights and political systems for 50 years from the handover.
The sweeping arrests drew condemnation from Anthony Blinken, the U.S. Secretary of State nominee for the upcoming Biden administration, who said on Twitter that it was an “assault on those bravely advocating for universal rights.”
“The Biden-Harris administration will stand with the people of Hong Kong and against Beijing’s crackdown on democracy,” Blinken wrote in his tweet.
Human Rights Watch said the arrests suggest Beijing has failed to learn that repression generates resistance. HRW senior China researcher Maya Wang said in a statement that “millions of Hong Kong people will persist in their struggle for their right to vote and run for office in a democratically elected government.”
In further remarks to The Associated Press, Wang said it wasn’t clear what provisions of the law were being cited to justify the arrests, but that local authorities seem less concerned with legal substance.
“The very nature of the national security law is as a draconian blanket law allowing the government to arrest and potentially imprison people for long terms for exercising their constitutionally protected rights,” Wang said.
“The veneer of rule of law is also applied in mainland China stripped of any meaning. Hong Kong is looking more like mainland China but where one ends and the other begins is hard to discern,” she said.
