The Abuja Division of the Federal High Court, on Wednesday, okayed three separate suits seeking to declare the seats of Governors Samuel Ortom of Benue State, Aminu Tambuwal of Sokoto State and Abdulfatah Ahmed of Kwara State, vacant, following their defection to the Peoples Democratic Party, PDP. The suits marked FHC/ABJ/CS/901/2018, FHC/ABJ/CS/940/2018 and FHC/ABJ/CS/943/2018, respectively, were lodged before the court by a civil society group under the aegis of Incorporated Trustees of Advocacy for Change and Social Values Network. The group is praying the court to direct the Independent National Electoral Commission, INEC, to within 90 days, conduct fresh poll to elect new Governors in the three states and a Deputy Governor in Benue State, in accordance with the law. Tambuwal, Ortomand Ahmed It equally applied for an interim order, directing Chief Judges of the states to swear-in Speakers of the State Houses of Assembly, to hold office as Acting Governors, pending the conduct of fresh elections by INEC. Whereas Governor Ortom was sued alongside his Deputy, Mr. Benson Abounu, both Tambuwal and Ahmed were sued alone. Also joined as Defendants in the suits were INEC and the All Progressives Congress, APC. Specifically, the plaintiff, among other things, wants the court determine, “Whether having regard to the totality of the Constitution of the Federal Republic of Nigeria I999 (as amended), a person elected into office as Governor or Deputy Governor on the sponsorship of a particular political party which won the election, can move or defect to another political party without the consent of the sponsoring political party, whilst still retaining the benefit of the election won by the initial political party? Whether by the combined provisions of Sections 177(c) and 221 of the 1999, Constitution, as amended, and the decision of the Supreme Court in the case of AMEACHI v lNEC (2000) S NWLR (Pt.l080) 227, it was not the APC that won the 2015 governorship election in Benue, Sokoto and Kwara states. Whether having regard to the Constitution of the Federal Republic of Nigeria, I999 (as amended), there is any provision that allows or empowered the three governors and the deputy governor of Benue State, elected under the APC, to move or defect to another political party? “Whether an election victory won by a political party, in this case the APC, can be transferred to another political party, without the express consent of the political party that won the election, and contrary to the express provision of the Constitution of the Federal Republic of Nigeria, 1999 (as amended)? “Whether, except for the offices or positions and under the circumstances specified in the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Defendants who were declared elected into the office or position of Governor and Deputy Governor on the sponsorship of a particular political party (the APC) can transfer the victory of such election to another adverse political party by retaining the office or position? “Whether, except for the offices or positions and under the circumstances specified in the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Defendants who have withdrawn and resigned their membership of the political party upon which they were elected, are still entitled to the rights and privileges that accrued to them as, and while they were, members of the initial political party (the APC)”. In the case of Benue State, the plaintiff asked the court to further determine “Whether the 2nd, 3rd and 4th Defendants (Ortom, Abounu and the APC) can, either expressly or impliedly and outside the contemplation of the law, reconfigure, restructure or extinguish the political platform and framework upon which they canvassed and secured votes and mandate of the electorates represented by the Plaintiff and the other electorates in the 2015 General Governorship Election in Benue State, and still retain the position, and if not, was the of the 2nd and 3rd Defendant’s defection and invariable restructuring and reconfiguration of the political platform and framework upon which they were voted, not unlawful, ultra-vires the Constitution and amounts to a violation of the electorates’ right to elect political party of their choice? As well as, “Whether having regard to the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the circumstances and justice of this case, the proper order for the Court to make is not one directing the 1“ Defendant (INEC) to conduct a new election for the completion of the unexpired term of the 2nd and 3rd Defendants as Governor and Deputy Governor of Benue State respectively?”. Upon determination of the legal questions, the plaintiff, sought for a declaration that the defection, movement, crossing of carpet or howsoever called, by the three governors and the deputy governor of Benue State, from the political party that sponsored them and also won the 2015 General Governorship Election in the states, to another political party, was unconstitutional in the absence of any statutory provision or authority that permitted such movement. A declaration that the continued stay in office of the three Governors and the Deputy Governor of Benue State, having withdrawn and resigned their membership of the APC which was the political party that sponsored them and also won the 2015 General Governorship Election, and defected to the PDP, was unconstitutional and in gross violation of mandate of the electorates. A declaration that the Defendants, having withdrawn and resigned membership of the APC, the political party that sponsored them and also won the 2015 General Governorship Election in their states, and defected to another political party, the composition of the Office of Governor as presently being held and occupied by two different political parties, represented by the APC and the Defendants, is unconstitutional, violates the mandate of the electorates including those represented by the Plaintiff. “A declaration that under the Constitution of the Federal Republic of Nigeria 1999, (as amended) and existing laws, no two adverse political parties can present a single candidate in an election in which both party are contesting or lay claim to victory in one elective position or office, except as provided and contemplated by the Constitution. A declaration that under the Constitution of the Federal Republic of Nigeria 1999 (as amended), the legal right to the electoral victory won by a political party, in this case, the vested right of the APC in electoral victory in the 2015 General Governorship Election in Benue, Sokoto and Kwara States, cannot be severed or transferred from the political party that won the election, to another political party, without subjecting same to a re-election by the electorates, in accordance with the law. A declaration that the Defendants cannot, either expressly or impliedly, reconfigure. restructure or extinguish the political platform and framework upon which they canvassed and secured votes and mandate of the electorates, including those represented by the Plaintiff, in the 2015 General Governorship Election, except in accordance with the law. As well as, “A declaration that the defection and invariable restructuring and reconfiguration of the political platform and framework upon which the Defendants canvassed and secured votes and mandate of the electorates, including those represented by the Plaintiff in the 2015 General Oovernorship Election in Benue, Sokoto and Kwara States, was unlawful, ultra-vires the Constitution and amounts to a violation of the electorates’ right to elect political party of their choice”. Meantime, Justice Nnamdi Dimgba has ordered service of all the relevant court processes on the Defendants to enable them to appear before the court on October 10. President Muhammadu Buhari has said that before Nigerians demand to see the changes he promised them during the 2015 election, they must first change their own attitude by shunning corruption and other social vices. He adds that change is not about economic or social progress, but it is in terms of citizens’ personal behaviour. Buhari said this while delivering a speech at the inauguration of the national re-orientation campaign tagged, ‘Change Begins With Me’ in Abuja on Thursday. The President acknowledged that Nigeria is currently passing through a challenging period where hardly anything works normally. He lamented that honesty, hard work and godliness had given way to all kinds of manifestations of lawlessness and degeneration in our national life. Buhari said, “Our citizens must realise that the change they want to see begins with them, and that personal and social reforms are not a theoretic exercise. If you have not seen the change in you, you cannot see it in others or even the larger society. “In other words, before you ask ‘Where is the change they promised us?’, you must first ask, ‘How far have I changed my ways? What have I done to be part of the change for the greater good of society?’ The President said his government had done well in the fight against corruption, adding that the fresh campaign was a way of getting Nigerians to join in the struggle. Former Governor of Plateau state and a current senator, Joshua Dariye has purchased nomination form from prison for his re-election. Dariye Obtained the All Progressive Congress, APC Senatorial Nomination form through his personal assistant, Itauna Dinka on Friday, September 7. Dariye has been sentenced to 16 years in prison on June 12 through the federal capital territory (FCT) high court. Dariye, a serving senator, will serve a two-year and 14-year jail term concurrently. Adebukola Banjoko, the judge, did not give him an option of fine. In 2007, the Economic and Financial Crimes Commission (EFCC) charged him with money laundering. He was accused of diverting N1.126bn from Plateau government’s ecological funds. The former governor was said to have operated Ebenezer Reitner Ventures, an unregistered company through which he diverted the said funds. In her ruling, the judge said: “I can’t imagine a brazen act of looting as in this case,” Banjoko said. “I welled up while reading (the judgement) thinking of the victims, it is a litany of woes. They were adults making rational choices. he alleged resignation of the Accountant General of Osun State, Mr. Alaba Kolawole, has sparked controversies and allegation of fraud against the administration of Governor Rauf Aregbesola-led government in the state. There are claims that the Accountant General, who celebrated his 60 birthday in July, was granted an extension of service by the governor until October but Kolawole reportedly tendered his resignation on Friday. He was said to have written letters to some commercial banks that they should no longer honour any cheque bearing his signature starting from Monday, September 10. But the Commissioner for Information in the state, Mr. Adelani Baderinwa, when contacted told our correspondent that the accountant general did not resign but that he retired on the account of clocking the mandatory age of 60. The commissioner later issued a statement on Kolawole’s retirement and said Aregbesola had accepted the resignation and wished him well in his future endeavours. The statement read, “The Accountant General of the State of Osun, Mr. Alaba Kolawole, has retired from the service. “Mr. Kolawole retired from service, having gotten to the threshold age of 60 years a few weeks back, in line with the civil service rules and practice. “He had served the state meritoriously in various capacities since he joined the service some decades ago and he was appointed the Accountant General of the state by Governor Rauf Aregbesola in 2012 when he reached the pinnacle of his career. “Mr. Kolawole was known to be diligent and hard-working in his duties while in office and the service will miss him and his contributions.” But the Peoples Democratic Party in the state has linked the alleged sudden resignation of Kolawole to the secret release of N16.67bn election fund to Osun State by the All Progressives Congress-controlled Federal Government. The state Chairman of the PDP, Mr. Soji Adagunodo, who said this in a statement, also called on anti-corruption agencies to investigate the development. Adagunodo added that the issue also confirmed the several concerns raised by the PDP about the manner in which Aregbesola had been handling the finances of the state in the last eight years. The PDP also berated the Federal Government for allegedly secretly funding the APC election through a selective disbursement of Paris Club refund to Osun State. There are concerns over the steady decline of Nigeria’s foreign reserves since the last three months despite the rise in oil prices and accruals from foreign bonds issuance. Exclusive findings by LEADERSHIP Sunday showed that the reserves recorded a huge decline from $47,787,183,153 billion where it was on June 22, 2018 to a “worrying” point of $45,468,258,469 billion on Thursday, September 6. The reserves took a bullish peak between May 18 – when it was $47.799 billion, and June 21 – when it had the last high figure of $47,784,255,384 billion, according to data obtained from the Central Bank of Nigeria (CBN). Apart from oil which accounts for about 80 per cent of Nigeria’s foreign reserves, the federal government is also hoping to borrow N849 billion (denomination in dollars) from the foreign market to finance the N1.6 trillion budget deficit. Experts have blamed the continuous decline in reserves on three factors: increased dollar supply by the CBN to the foreign exchange market, instability in the nation’s securities and exchange market, and the coming general elections in the country. Those who spoke with LEADERSHIP Sunday on the development at the weekend expressed worry that the situation could have negative implications on the fragile growth of the economy and consumer demand. They said the decline in the external reserves would persist in the short term as demand for the green back grows amid the continued intervention of CBN in order to curtail the pressure on the naira at both the I&E and BDC segments as well as the expected increased demand by portfolio investors who have been reported to be leaving the country ahead of the 2019 general elections. Transactions on the floor of the equities reportedly took a bearish direction last week, with most highly capitalised securities not left out in the price nosedive, a development that forced market capitalisation to lose by about N4 billion in the weeklong trading. By the close of business on Friday, the stock market had fallen further by 0.88 per cent amid sustained profit taking activity. The All–Share Index shed 304.15 absolute points, representing a decline of 0.88 per cent to close at 34,110.22 points. Also, the market capitalisation declined by N111 billion to close at N12.453 trillion. The fall was ascribed to profit-taking by investors or shareholders. The CBN had intensified injection of hard currencies into the forex market since it signed a currency swap deal with the Peoples Bank of China to ease pressure on the Nigerian foreign exchange market. On Friday, the Central Bank injected the sum $303.91 million into the interbank retail Secondary Market Intervention Sales. This is in addition to the sale of CNY 46.58 million in the spot and short-tenored forwards. The director, Corporate Communications at the CBN, Mr. Isaac Okorafor, said the releases were for the payment of Renminbi denominated Letters of Credit for agriculture and raw materials. The Senate President, Bukola Saraki, has challenged the Acting National Publicity Secretary of the All Progressives Congress (APC), Yekini Nabena, to a debate on national issues on any national television. Mr Saraki presented the challenge, alleging that many people in the media believe he (Mr Nabena) is a robot and does not have a face. His statement was in reaction to another earlier released by Mr Nabena on behalf of the APC where he said Nigerians are tired of Mr Saraki’s retrogressive politics and deserve no more. He had also said Mr Saraki’s presidential declaration is his tactic to deflect attention from the deluge of issues he deals with particularly ahead of the 2019 General Elections i.e. pressure to reconvene the National Assembly, a fast shifting political order in Kwara State, among others. The APC spokesperson described the senate president as an abysmal failure and incompetent candidate of leadership as well as guilty of budget padding, among others. “A Presidential aspirant who promises to create jobs and turn around the economy at the national level, must have done so in a state he served as Governor for eight years. We challenge Saraki to give the nation his scorecard as a Kwara State,” part of the statement read. In a statement by his Special Adviser on Media and Publicity, Yusuph Olaniyonu, Mr Saraki said he “will not be distracted by the antics of an upstart who lives in Abuja but waits to sign press statements composed for him from Lagos.” He further said he does not have any credibility issues except the ones concocted by the “putative demagogues” to whom he (Mr Saraki) has become a nightmare. “Meanwhile, Mr Yekinni Nabena should know by now that many people on the media believe he is a robot and has no face. Here is an opportunity for him to come out of his hiding and come on a national television to debate all the issues he has raised with one of the aides of the Senate President. “We hope he will take up this challenge and stop behaving like a masquerade. He is free to choose any independent TV station of his choice. “When his masters show their face, we will debate all the issues they have raised and the ones they may wish to even concoct,” the statement said. The lawmaker wondered what APC’s business with an aspirant of another party was. “The truth is APC is scared stiff of the possibility of a Saraki candidacy. Fortunately, they have no role in deciding that.” When contacted, Mr Yekinni accepted the challenge as he asked him (Mr Saraki) to take on the leadership of the APC. “Is it his aides that will argue for him? What about himself? I am challenging him to come out and debate on national issues with the leadership of the APC. “He has declared for presidency. If he feels he knows what he will go and do there, he should come out and tell Nigerians. It’s not by bringing his aides. Are they the ones running for presidency? “APC is ready to take him up on any issue. He believes that he doesn’t have any issue apart from his personal and selfish interest,” he said. The United Kingdom has informed that her position about returning looted funds is that Nigeria cannot be trusted with its money, saying that’s what underpins it poor asset return rate and it has to be addressed. Philip Hackett, a Queen’s Counsel, said this is the reservations of the UK, when it comes to returning looted funds to Nigeria. Speaking on the theme: ‘Institutionalising the War against Corruption – New Approaches to Assets Tracing and Recovery’, at the Annual General Conference of the NBA in Abuja on Wednesday, Hackett said the issues with accounting for the funds also contributed to the UK’s hesitation on returning looted funds. He said: “How much money has been recovered? Practically nothing. Nigeria has recovered so little. “The UK’s position is that Nigeria cannot be trusted with its money. That’s what underpins it (poor asset return rate), and it has to be addressed.” The session was chaired by Professor Bolaji Owasanoye, Executive Secretary, Presidential Advisory Committee Against Corruption (PACAC), and featured the presence of Ibrahim Magu, the acting Chairman of the EFCC, who was represented by Chile Okoroma, EFCC’s Director of Legal and Prosecution Department. In his address, Magu lamented “poor record keeping system”, noting that it is difficult to estimate how much has been looted from the country. He said: “It is difficult to estimate what Nigeria has lost because we have poor record keeping system. “Lawyers have been involved in money laundering; laundering of proceeds of crime. When they were asked to register with the Special Control Unit against Money Laundering (SVUML) for regulation, they went to court. NBA said it could regulate itself. But how far has NBA gone in regulating itself? That is the issue. “I think the NBA Disciplinary Committee should be up and doing. I get embarrassed when NBA descends heavily on lawyers who are not considered to be significant, but they turn a blind eye to what big-time counsels are doing. “I think they have to do their work without looking at faces, no matter whose ox is gored.
