The Lagos Division of the Court of Appeal on Tuesday ordered Barewa Pharmaceutical Company to pay a fine of N1m for the sale of a contaminated baby teething mixture, My Pikin, which resulted in the death of a number of babies in the country. In a lead judgment read by Justice Chinwe. Iyizoba, the Court of Appeal set aside the decision of a Federal High Court in Lagos, which on May 17, 2012 ordered the winding up of the company and the forfeiture of its assets. Rather, the appellate court ordered Barewa Pharmaceutical Company to pay a fine of N1m for the offence. The Court of Appeal however upheld the seven years imprisonment imposed on the company’s Production Manager, Adeyemo Abiodun, and its Quality Assurance Manager, Egbele Eromosele, by the lower court. “The order for the winding up of the appellant is set aside, instead the appellant is sentenced to a fine of N1m,” Justice Iyizoba held. The Federal High Court had in a judgment delivered in 2012 by Justice Okechukwu Okeke, now retired, convicted Barewa Pharmaceutical Company, Abiodun and Eromosele on two counts of conspiracy and sale of a harmful teething mixture pressed against them by the National Agency for Food and Drug Administration and Control. But displeased with their conviction, prison sentence and the winding up and forfeiture orders, the company and its officers filed separate notices of appeal before the Court of Appeal, seeking to set Justice Okeke’s judgment aside. However, in its judgment delivered in 2013, the Court of Appeal upheld the decision of the Federal High Court on the conviction of Abiodun and Eromosele, but set aside the order for the winding up of Barewa Pharmaceutical Company. Not pleased with the decision of the Court of Appeal, Abiodun, Eromosele and Barewa Pharmaceutical company subsequently appealed to the Supreme Court. In a judgment delivered on March 18, 2016 by a seven-man panel led by the Chief Justice of Nigeria, Justice Mahmud Mohammed, the Supreme Court set aside the decision of the Court of Appeal and ordered a fresh hearing of the case at the Court of Appeal. Justice Bode Rhodes-Vivour, who prepared the lead judgments in the three appeals, which were read by Justice Sylvester Ngwuta, noted that what the Court of Appeal treated and delivered judgment on was an abandoned notice of appeal filed by the appellants. The apex court thus ordered the appellate court to hear the appeals on the “valid notice/grounds of appeal” filed on July 3, 2013 by the appellants. |
Gunmen Saturday night stormed Ozochi community in Ahoada East Local Government of Rivers State and killed eight persons, including the oldest man in the community. The gunmen were said to have shot sporadically as they made their way into the community, even as residents scampered to safety. Houses, shops and other property were destroyed by the gunmen, who wasted no time to set anyone in sight ablaze. The Caretaker Committee Chairman of Ahoada East LGA, Mr. Britain Ewor, who confirmed the incident, described those behind it as enemies of the local government area and the state. Ewor, who spoke through his aide, Mr. Monday Oyagiri, asked troublemakers to stay away from the area. The council boss maintained that any person found to be involved in Saturday’s killings would be dealt with according to the law. He expressed sympathy with the families of the deceased. Also, the member representing the area in the state House of Assembly, Edison Ehie, confirmed the incident. Ehie urged security operatives in the state to ensure that those involved in the killings were arrested and punished. A source disclosed that the local government was planning a peace and prayer session to seek God’s intervention to the killings in the area. Contacted, the state Police Public Relations Officer, Mr. Ahmad Muhammad, confirmed the incident, saying that the State Commissioner of Police, Mr. Musa Kimo, had deployed a team of armed mobile policemen in the area to forestall further attack. Muhammad explained that investigation had commenced with a view to fishing out those behind the act. He said, “Yes, it happened, but the Commissioner of Police in the state has ordered the deployment of armed mobile policemen in the area. As I speak with you, the situation has been brought under control.” |

As part of efforts by the Federal Government to check the spate of renewed attacks on oil and gas installations in the Niger Delta region, the Nigerian Army has arrested 10 suspected members of the militant group, Niger Delta Avengers. The suspects were said to have been arrested at about 1:40am on Saturday in Oporaza community, Warri South-West Local Government Area of Delta State, following a search conducted in the community. Some oil installations in the region have been vandalised by militants suspected to be members of the Niger Delta Avengers, threatening the production and supply of oil and gas in the country. The Commander of the 4 Brigade, Brigadier-General Farouk Yahaya, who paraded the suspects on Sunday in Benin, the Edo State capital, said there had been cases of sabotage by suspected militants and vandals in Delta State since January 1, 2016 and threats “to shut down all operations” in the sector. He noted that several items were recovered from the arrested suspects. They include 28 detonator cords (also known Detonator 33), one pistol, two pistols, 196 rounds of 7.62 special ammunition, one round of nine-millimetre ammunition, a live cartridge and five daggers. Also recovered were 15 handheld radio sets, 18 phones, 203 SIM cards belonging to three major network providers, five swimsuits, two headlamps, a laptop, two ipads and a camera. Others are seven wraps of substances suspected to be Indian hemp, five speedboat throttle cables, six pairs of hand gloves, the sum of N23,000 cash and a cheque book. He said that although investigation would reveal the true identity of the suspects, recent explosions carried out by the Niger Delta Avengers suggested that the arrested suspects might not be unconnected to the group. He added, “Within the period under review, you can see that the Niger Delta Avengers have claimed virtually all acts of criminal activities against oil and gas and they continue threatening a shutdown of the whole sector. So, most likely, they (suspects) will be the people, who else would they be? On the speculation that the militants might have adopted the use of charms to evade arrest, Yahaya said, “Whatever a person wants to use, he can use it. But I know that God is always on the side of the truth. “We are not worried by voodoo. It did not stop the suspects from being arrested and others that have been arrested before now.” “Operations that led to these arrests and recoveries were conducted professionally, guided by our mandate, operation orders, code of conduct and rules of engagement. Our operations are strictly targeted against perpetrators of all criminal acts in our area of responsibility and not innocent citizens,” he added. The brigade commander, who noted that the suspects would be handed over to prosecuting security agencies at the end of preliminary investigation called on the general public to provide the Army with relevant information on militant groups to assist it to combat criminal elements in the interest of the country.

A lecturer at the Federal College of Education in Obudu, Cross River State, Dr. Walter Ibe, was on Saturday abducted from his official residence by gunmen. Ibe, who is in the Department of Computer Science, was whisked to an unknown destination, but Southern City News gathered that the abducted lecturer was released in the early hours of Sunday. It was learnt that the abductors had demanded N5m but it was not clear if any ransom was paid at the time of his release. This is coming three weeks after three persons were abducted from the University of Calabar staff quarters and released after they were said to have paid N5m as ransom. Ibe, who is also a pastor at the Pentecostal Church in Obudu, was in his home on Saturday night when the gunmen stormed his sitting room and seized him in the presence of his family. It was learnt that the gunmen immediately made contact with the family and demanded N5m ransom. But the state Chairman of Pentecostal Fellowship of Nigeria, Pastor Lawrence Ekwok, who confirmed the abduction, could not ascertain if any ransom was paid. He, however, said that the abducted lecturer is the Public Relations Officer of the Christian body in Obudu. He decried the incessant abduction of men of God in the state for the purpose of what he referred to as ‘blood money’. In a statement made available to Southern City News, Ekwok said, “PFN warns kidnappers who have taken the act of abducting men of God to extort money from them to desist from such action or face the wrath of God. “We hereby call on the police and other security agencies to ensure the release of Pastor Ibe. They should ensure they arrest and prosecute the perpetrators of such evil act without delay.” He said the kidnappers stormed the home of Ibe in a Toyota Camry saloon that had no registration number. Meanwhile, the Police Public Relations Officer in the state, Mr. John Eluu, said he was not aware of the development. He, however, promised to get back after making inquiries, but did not call as at the time of filing this report. |

Some students of the Bayelsa State-owned Niger Delta University, Amassoma, on Saturday, took to the streets to protest the indefinite closure of the university. The lecturers of the institution, had on April 28, 2016, proceeded on an indefinite strike, following the inability of the state Governor, Mr. Seriake Dickson, to pay backlog of workers’ salaries. As of the time the lecturers commenced their strike, the state government was owing the lecturers and non-lecturers of the NDU four months salary arrears as they have not been paid since January 2016. The students, under the aegis of the Niger Delta Visionary Movement, also criticised other students’ bodies such as the Student Union Government of NDU, National Union of Bayelsa State Students and the National Union of Izon-Ebe Students, describing them as puppets. The aggrieved students in a statement by the spokesman,, NDVM, Mr. Wisdom Adike, threatened to march naked with their books and block the entrance to Government House if after a week the stakeholders failed to settle their rift and open the university. Adike said, “We wish to bring to the notice of the general public, that the strike embarked upon by the ASUU, NDU chapter, on April 26, 2016, over nonpayment of salaries, have led to the shutdown of the institution for over one month now. “This development has continued to give parents and students great concern. “Niger Delta University being the only state owned university is a legacy institution established by the late Chief Diepreye Alamieyeseigha who was recently laid to rest. The institution has not only helped in meeting the manpower needs of the state but the entire Niger Delta region and beyond. “However, we wish to express our displeasure over the lingering strike and government’s attitude towards resolving the situation. The strike has increased hardship, made students to sit idle at home and lose focus on their academic pursuit, as well prolong their academic programmes, thereby causing youth restiveness and society unrest.” He wondered why all the students’ bodies kept quiet over the plight of students, a pealing to the Ijaw Youth Council Worldwide to intervene and ensure immediate reopening of the school. He added, “We also call on the Ijaw Youths Council to stand up, break their silence and defend the legacy of the Ijaw nation by ensuring the immediate reopening of Niger Delta University. The Niger Delta Avengers have blown up trunk lines belonging to Nigerian Agip Oil Company and Aiteo Oil company in Bayelsa State. Our correspondent learnt that the Avengers blew up Nembe 1, 2, and 3 Brass to Bonny trunk lines belonging to the two oil majors in Nembe Local Government Area, on Saturday. When contacted, Shell spokesman, Joseph Obari, told SUNDAY PUNCH that its trunk line blown up had been “left” by the company since 2014. He, however, clarified that the second trunk line belonged to Aiteo Oil Company and not Shell anymore. “Kindly contact Aiteo, the operator of the reported assets for information on their status,” Obari said in a text message. It was learnt that the militants and a crack team of the Nigeria Security and Civil Defence Corps battled in the creeks of Bayelsa on Saturday following the twin blasts that ruptured pipelines belonging to Agip and Aiteo. The NDA claimed on its Twitter handle, @DAvengers, that it attacked the facilities at 2:15am, in Nembe and Southern Ijaw Local Government Areas of the state. Nembe’s attack occurred at a creek opposite Orubiri community. The creek warlords, who were said to have accessed their targeted pipeline through speedboats, reportedly used dynamites to blow up the oil facilities. A civil defence operative, who spoke on condition of anonymity, said another blast happened along a pipeline located at Legosgbene in Southern Ijaw area. He said, “As I am talking to you now, our team has advanced to the Legosgbene. The perpetrators are there laying ambush.” The Bayelsa State Commandant, NSCDC, Desmond Agu, confirmed the incident and said the militants were engaged in gunfire with his men at Southern Ijaw. Agu said, “We have deployed two teams in the two different locations where Agip pipelines were attacked in the state. Our team heading for the Southern Ijaw location discovered that the militants laid an ambush in the area. We will soon clear the area and ascertain the extent of damage done to the pipeline”. Meanwhile, Bayelsa State government has condemned the NDA attacks on the two crude trunk lines operated by Aiteo and Agip. Aiteo, new owners of one of the lines could not be reached for comments. Aiteo had in 2014 acquired the 100-kilometre Nembe trunk line from Shell which SPDC relied on to convey crude to Bonny Export Terminal from Bayelsa State. The State Commissioner for Information and Orientation, Jonathan Obuebite, who confirmed the attack in an email on Saturday afternoon, condemned the twin attacks, describing it as one attack too many. Obuebite, who expressed concerns on the economic impact of destruction of the key oil facilities on the country and Niger Delta region in particular, wondered why the militants would go to that extent. He noted that despite concerted efforts of the government to move against such atrocities, the militants were still unrepentant in their acts of vandalism. Obuebite urged the group to embrace dialogue, adding that their activities is adversely affecting people residing in areas where oil facilities were destroyed. The commissioner also called on security agents to be more alert and to devise new means to protect important oil and gas facilities in order to prevent further attack. Obuebite equally urged Bayelsa residents, especially those in oil communities to be vigilant and work closely with security agents to apprehend anyone or group attempting to undermine key national assets. Meanwhile, Vice-President Yemi Osinbajo has said the Federal Government would not engage with people destroying oil and gas facilities in the country. He said the government was already engaging with people nursing genuine grievances, adding that destruction of oil pipelines and export facilities was criminal conduct. The Federal Government has invited the leadership of organised labour to a meeting in the Office of the Secretary to the Government of the Federation on Monday to discuss the increase of fuel pump price from N86 and N86.50k to N145. Representatives of organised labour and the civil society had, after a meeting in Abuja on Saturday, given the Federal Government till midnight on Tuesday to reverse the increase or face an indefinite national strike. The group gave the strike notice in a joint communiqué issued by the Nigeria Labour Congress and the Trade Union Congress after the meeting. The General Secretary of the Nigeria Labour Congress, Dr. Peter Ozo-Eson, told one of our correspondents on the telephone on Sunday that organised labour had received invitations via text messages from the Ministry of Labour on Sunday to attend the meeting with the government at the office of the SGF. Ozo-Eson said while organised labour would honour the invitation to attend the meeting, the only thing that could stop the planned action was a reversal of the fuel price increase and the 46 per cent increase in electricity tariff. |

While conversing with a friend I was asked the differences between GPRS, EDGE and 3G, decided to share my little knowledge about the topic in case you might be confused about it too. Before advancing, it should be known that 1G, 2G, 3G, 4G, 5G etc refers to the different generations of wireless communication technology characterized by having a defined range of speed. GPRS(General Packet Radio Service) GPRS is a packet-based* wireless communication service. It is a 2G technology network that support a download speed of up to 114Kbps. Limitation of GPRS is that GPRS data cannot be sent while a voice call is in progress. EDGE(Enhanced Data GSM Evolution) GPRS and EDGE are both 2G technology but EDGE is significantly faster with a download speed of up to 384Kbps. EDGE is sometimes called a 2.5G network as it also has some characteristics of a 3G network but it doesn't satisfy the specification. 3G Introduction of 3G network made video calling and seamless streaming of video possible, with download speed of up to 3.1Mbps. HSDPA(High-Speed Down-link Packet Access) It is based on the 3G network and an enhancement to 3G. Thus has a faster speed, download speed can be up to 14Mbps. HSDPA is sometimes called 3.5G. HSPA+(Evolved High-Speed Packet Access) HSPA+ is an evolution HSPA(HSDPA&HSUPA). It is a 4G technology that allows download at a rate of up to 168Mbps. 4G LTE(Long Term Evolution) LTE is a 4G communication standard that supports HD video streaming, download speed as high as 299.6Mbps.
