Court Grants el-Rufai Bail in Corruption Case

By Gowon Emakpe
April 8, 2011 08:45AM

The Economic and Financial Crimes Commission (EFCC) yesterday re-arraigned former minister of the Federal Capital Territory (FCT), Nasir el-Rufai, before the Federal High Court in Abuja over allegations of fraudulent allocation of land and abuse of office during his tenure as minister.

The court however granted him bail in self-recognition.

The Court had recently ruled that an application by Mr. el-Rufai, seeking to stop his arraignment by the Commission, lacked merit and that he should make himself available for trial.

The trial judge, Sadiq Umar ruling on a preliminary objection by Akin Olujimi, lawyer to Mr el-Rufai, said the trial of the former minister should go ahead.

Mr. Olujimi, in the preliminary objections, argued that the charges levelled against his client had no legal bases, having been filed under a repealed law, the ICPC Act 2003. He said under the repealed law, the FCT High Court lacked the jurisdiction to entertain the matter and urged the court to quash the charges and discharge the accused persons.

But Justice Umar held that the EFCC had filed fresh charges based on the ICPC Act of 2000, and held that under the Act, the EFCC had the powers to amend the charges against an accused before judgment is delivered.

“In this case, the accused have yet to be arraigned to take their plea, so the court can grant the EFCC leave to amend the charge as contained in the provisions of the ICPC Act 2000,” he said.

The judge also held that the EFCC, under provisions of section 46 of the act setting it up, has the responsibility to investigate all economic and financial crimes in the country.

A Federal High Court in Abuja had, last year, thrown out the suit filed against the former minister on the same issue. The presiding judge, Adamu Bello, ruled that the charges had no legal basis, having been filed under the Independent Corrupt Practices and Other Related Offences Commission (ICPC) Act of 2000, a law that has since been repealed.

The judge quashed the charges and discharged El Rufai.

The Federal Government however responded to the dismissal of the charges by filing fresh charges at the Abuja High Court. Mr El-Rufai and two others were accused by the EFCC of illegally allocating land in the FCT to friends and relatives, some of whom included: Iyabo Obasanjo-Bello, the daughter of former president Olusegun Obasanjo.

The other accused persons are Altine Jubrin, former director general of the Abuja Geographical Information System, and Ismail Iro, former general manager of the agency. All three men pleaded not guilty.

Liberal bail condition

At yesterday’s sitting, Mr Umar granted bail to El Rufai in self-recognition after the former minister pleaded not guilty to the eight count charge, saying that given El Rufai’s past service as a minister and his compliance with the bail conditions previously imposed by the EFCC and the Federal High Court, the court decided to exercise its discretion by granting him bail in self-recognition.

He adjourned the matter till May 17, 2011.

El Rufai and two others were arraigned on charges relating to the allocation of plots of land in the federal capital. After the pleas were taken, Mr Olujimi moved the application for bail, urging the court to grant it in very liberal terms.

But counsel to the EFCC did not oppose the application, citing the antecedents of the case and the compliance of the accused persons to previous bail conditions.

RevMallam:
I believe most responders to the well articulated question posed by the author seem to have either chosen to interject tribal jingoisms or simply ignored the  question and drifted to expected responses based on tribal sentiments.
I am of the opinion that what the author was trying to say are these:
(1) Igbo women have done well and continue to excel in whatever they do. They should be emulated by others.
(2) Yoruba women, "it's time to catch up. Your primary competitors are leaving you". This is a call to arms for you.
(3) The northern women, though huge in numbers have very little to show. (but same can be said of the men, sadly)
(4) Finally I think, he is saying, Igbo women, don’t get complacent, your competitors are watching.

Love or hate the Igbos, they are an enigma that should be copied and  emulated. The fact that they are where they are today after a devastating war tells a lot about them. In my opinion, what other should be doing is trying to find out what makes the Igbos tick and  attempt to beat them at their own game. The Japanese did same to Americans and the Chinese are now doing same. So don't bash the  Igbos, rather attempt to out do them if you can.

I believe, the Igbos for whatever reason believe they are born with their backs against the wall. This may help explain why they are hell bent on succeeding and excelling. In fact, Ojukwu used this to lead his folks to fight to the last man standing.
There was a guy on Radio Biafra  Okon Okon Ndem, who used to begin his broadcasts by reminding the Igbos that "he who is surrounded by enemies is on perpetual guard , " (Maybe Igbo folks on this trade can speak more on this).
As for those that are defending the subjugation of women and in fact the entire populace by a few elite from the core North, I think we are doing a great dis-service to ourselves.

The fact that Imo State in the East produces more University Graduates than the entire North should be a cause for worry and shame. In fact, left alone, 2 Igbo states, Imo and Abia can fill the the entire University allocations in the country.
Instead of building Universities and colleges, we build Koranic schools and what have you. Even the universities that we have are populated and filled with,  surprise, children of people with Igbo ancestry. While the majority of our kids are out begging, the Igbos are out getting education and what have you.
We should praise our women no matter where they come from in Nigeria if they are doing well, and it just happens that they are Igbo, fine and well. The question we should be asking is, what are the others going to do to dethrone the Igbos if we can, or catch up with them? But it must also be remembered that Igbo women have been at the forefront from the get go. It was Igbo women who started the independence drive in Aba by engaging the mighty British army in what they derisively call, Aba women’s riot. So their  over-achieving is nothing new.
But the Igbos should not be beating their chest, because this is a global phenomenon. Even  in the America, women are out-performing men in many fields. If the playing fields are leveled in America, women will take over. Despite all their chest beating, women in America still remain second class citizens and only gained the rights to vote not too long ago.
So, find a woman who has done well and encourage your daughters to strive to be like them, I think that is the best gift you can give them and if they happen to be igbo, so be it.
Great post. Igbo women will continue to succeed. Let us continue to support them.

My brother, don't be deceived by what Nairalanders say. ACN is being voted because of individuals. If Ngige was in labour party or CPC, he would still win. ACN is not a Yoruba party as purported. Tinubu could control Fashola, can he control Ngige? What has been his influence over Oshimole?
ACN is a national party. The more they win in other regions, the more national ACN becomes.  APGA is also winning in some states. I heard that they took Imo state.
If ACN doesn't deliver, they will be voted out too in the nearest future. It is healthy for Nigeria's politics. My only fear is that ACN may actually become worse than PDP in terms of rigging.
For our sake, I hope you are right. I will still wave the APGA banner, because I believe in regional parties. Sorry, but I cannot trust ACN. It may be good for democracy, but it may not be good for Igbo interest. And since my people's interest is what I hold close to my heart, then that is what I shall do.

No, ACN is no threat. It is also a national party. So, how is it a threat? I want PDP to be voted out in the NASS, and some Governorship posts e.g IMO, ABIA. I want GEJ to win the presidential elections. It will provide a balance for the equation.
It is a tribal aligned party. That is why I call it a threat. PDP is a national party for all of its problems. I will never be aligned with a tribal party that follows the path that Awolowo set for them. And yes, I want PDP voted out locally, especially in Abia, but I don't want to see ACN in my backyard. angry
