If you consider how this CJN emerged, it was pretty obvious that buhari was never comfortable with him. But because he lacked the powers to unilaterally pick a name not forwarded to him by the NJC, he kept stalling till he traveled out. It was Osinbajo who sent his name to the Senate. I'm sure if Tanko is investigated too, he'll have questions to answer. What is obvious is the president's apathy towards the present CJN which is why he developed itchy fingers in the bid to carry out the plot. FYI, CCT is directly under the presidency's supervision

The argument has always been if the President has the power to suspend a CJN NOT remove as a part of his constitutional powers: this is the point.

Is Onnoghen guilty for breaching the code of conduct? of course. Because he admitted this by claiming he forgot to declare his asset.
And this is enough evidence to indict him.

The questions that are begging for answers are; is Onnoghen guilty?
Is the CCT allowed to try him by law based on his misdemeanor ?
Is the President's suspension of Onnoghen within his powers according to the law?
You should answer these questions without bias and convince me beyond reasonable doubt that my stance are wrong.

You do realize though that you can only exercise such discretionary powers on someone who answers to you. Its a simple employee-employer relationship. The CJN does not answer to the President. Only the NJC can suspend a Judicial officer; that is clear from the principle of the separation of powers. The president does not unilaterally appoint a CJN. He receives recommendation from the NJC, vets it and if satisfied, forwards to the senate for confirmation. That's why he's relying on a purported suspension order from the CCT. Problem is, the CCT does not have the powers to recommend suspension of a Judicial officer to the president. Only the NJC can do that
Does your analogy has any backing from the constitution?

From the above sections, it is clear the president has the power to appoint, suspend and re-instate when necessary.

And as for the CJN he can't be a judge in his own case na? isn't it?
How do you expect NJC to judge and pass verdict on his chairman, the CJN?
If the CJN, I mean, the ex-CJN was for due process why is he stalling proceedings on his case at the CCT with different court injunctions?

And he is even stalling NJC from convening because he knows he has a case to answer.

However, I will wait for further interpretation on this matter because I maybe wrong in my assertion, but I think we shouldn't be hiding or aiding and abetting somebody who is clearly guilty under the name of 'following procedures.'

If you are not being mischievous, you'll realize that this act says "power" to remove or suspend. The power here is not absolute for the president especially if there are laws which are spelt out in the constitution for removal. If we are to follow your logic, then it can be said that since the president can only be elected by popular vote, then he can only be removed by popular vote. This we all know is not true since he can be impeached by the national assembly subject to the Chief Justice's committee, or by a proclamation of the FEC. In other words, it has been clearly spelt out here that the process of suspension OR removal should be the same as clearly spelt out in the constitution.
SUSPENDED oga,not removal.

If Onnoghen had any moral compass ,why has he been stalling proceedings through court injunction and you expect such man to sit over a case which he himself has flaunted?

His removal may not be constitutional ,but I think the move should be welcomed by well meaning Nigerians.
