Exposed: How Judicial Crisis In Ekiti Affects Jonathan’s Second Term Bid – The Role Of Fayose

The All Progressives Congress in Osun State has said that the attack on the judiciary in Ekiti State is an alleged plan of President Goodluck Jonathan to cause crisis in the South West in a bid to capture the region and win the 2015 presidential election. The Director of Publicity, Research and Strategy of the APC in Osun State, Mr. Kunle Oyatomi, said this in a statement he made available to our correspondent in Osogbo on Sunday.

The APC also described the governor-elect in Ekiti State, Mr. Ayo Fayose, as the arrowhead of the Peoples Democratic Party’s alleged plan to execute the plan of the President. The party which accused Fayose of being behind the attack on the court in Ekiti State said such attack portended a grave danger to the nation’s democracy except those behind it were brought to justice quickly.

The statement read, “The fact that Federal Government security officials stood by and watched while Fayose and his rampaging horde of thugs were beating up judges and lawyers in the premises of the hallowed chambers is clear indication that the PDP Federal Government is complicit. Politicians should rally and impress it on President Goodluck Jonathan that if this judicial sacrilege in Ekiti presages his intention for seeking a second term in office, it could well be the beginning of the end of democracy and the rule of law in the country.”

“It is therefore imperative not only that Fayose and his thugs should be made accountable, everything should be done to persuade President Jonathan that[b] no Federal Government has survived creating anarchy in the West. The earlier this lesson is learnt by the Jonathan administration, the better for democracy in Nigeria.[/b] Ayo Fayose should be closely watched because he appears to represent PDP’s game plan of using the rule of the jungle to capture and sustain itself in power. I don't support Fayose being denied his mandate to lead Ekiti through the use of back door tactics. I believe Fayemi lost the election to Fayose. Nonetheless, this is politics and any legitimate and legal tactics to defeat a foes is 'par for the course'. If the APC Fayemi camp has now seen a legally pertinent argument establishing the case, beyond doubt, that Fayose was disqualified from running as a gubernatorial candidate then they would be incorrigible victims for not using this advantage to confront PDP impunity and lawlessness.

The same thing happened in the past when some stakeholders tried to prevent Ibori from contesting to be a governor. Those brave stakeholders took their case to court and argued correctly that Ibori had been convicted of a criminal offence in the UK and thus disqualified from participating in a guber race in Nigeria. OBJ, with his mind settled on another 'criminal son' in Ibori, would have non of it. The judge brazenly declared that the Ibori convicted of criminal behaviour in the UK was not the same Ibori vying to be Governor In Nigeria. Of course we all now know this to be false and another disgrace to corrupt Nigerian judiciary and the lawless backbone of Nigerian leaders OBJ and GEJ commonly typify.

Fayose won but the APC should not let go if there is a legally verifiable reason barring Fayose from contesting in the first place. Enough of the PDP foisting convicted criminals and felons on Nigeria.

Fayose on his part, if he is not the thug people claim he is, should never use thuggery and violence in an an effort to intimidate the judicial process. That is unacceptable in civilised and democratic society. I think Fayose knows that a legally enforceable case against him can be established and this is why he is acting desperately. Most folks can admit he won but Nigeria should never seek to be a Country where law and order is relegated to the back because of political agenda. If it can be proven that Fayose was disqualified from running then let this be a watershed case that perhaps puts an end to PDP's practice of presenting disqualified convicted criminals and felons as candidates for important public office. They have gotten away with it for far too long.

Nigeria’s human rights lawyer, Femi Falana, has called on the acting Inspector-General of Police, Suleiman Abba, to “arrest and prosecute without any delay” those who invaded an Ado Ekiti High Court, beat up a Judge, and violated the Court of Justice.

Falana blamed the Ekiti state governor-elect, Ayodele Fayose for the sacrilege committed against the state judiciary.
In a statement released today, Falana said: “This is a reminder of the Idi Amin era in Uganda when judges were killed while discharging judicial functions,” he said.
“In my reaction to the outcome of the Ekiti state governorship election held on June 21, 2014 , I expressed the view that the Ekiti people had gone back to Egypt. The mayhem unleashed on a high court judge, lawyers and litigants in the precinct of the Ekiti State High Court sitting at Ado Ekiti on Monday, September, 23, 2014 by a gang of hired hoodlums has confirmed that the Ekiti people have fully returned to the wilderness.
“As the thugs were not brought to book they regrouped this morning and launched another attack on the High Court. In the process Justice Isaac Adeyeye was beaten up while the car of Mr. Rotimi Akeredolu, a former President of the Nigerian Bar Association was destroyed. Other judges and lawyers ran for dear lives.
“Thus, by desecrating the temple of Justice with the connivance of the Police the armed lumpen elements left no one in doubt that they have the full backing of the ruling party in executing the premeditated onslaught on the judiciary.
He noted that: “So far, those who perpetrated the barbaric attack and their sponsors have admitted their ignoble role through public statements issued by them. The Ekiti state governor-elect, Mr. Ayo Fayose has justified the shameful attack on the rule of law in Ekiti State by saying that his election cannot be challenged in court. This is a reminder of the Idi Amin era in Uganda when judges were killed while discharging judicial functions. Mr. Fayose and his thugs should not be allowed to kill judges and lawyers before calling him to order.
“Since the Ekiti State police command is completely compromised the Acting Inspector-General of Police, Mr. Suleiman Abbah is called upon to ensure that all the assailants are arrested and prosecuted without any delay.
He then urged Ekiti people to ensure that the truth of the matter is uncovered. “Any attempt to cover up the brazen contempt of court should be resisted by the Attorney-General of Ekiti State, Mr. Wale Fapounda who should take decisive measures to bring the criminals to book. Let no one politicize the criminality of those who are bent on replacing the rule of law with rule of force in Ekiti State. The Federal Government ought to distance itself from the shameless display of brute force by an in-coming governor Ekiti state.
“In view of the duty imposed on the Nigerian Bar Association to defend the rule of law and protect judges and lawyers the leadership of the Bar in Ekiti State and at the national level should mount pressure on the Police Authorities to fish out those who beat up a judge, chased judges and lawyers out of the Ekiti State High Court.
“Even under the defunct military junta judges were never subjected to physical assault over their decisions. Hence, in Garba v Federal Civil Service Commision (1998) 1 NWLR (PT 70) 449 it was held by the Supreme Court (per Eso J.S.C.) that:
“The military in coming to power is usually faced with the question as to whether to establish a rule of law or rule of force. While the latter could be justifiable a rule of terror, once the path of law is chosen the mighty arm of government, the militia which is an embodiment of legislature and executive must in humility bow to the rule of law thus permitted to exist.
“The rule of law knows no fear, it is never cowed down, it can only be silenced. But once it is not silenced by the only arm that can silence it, it must be accepted in full confidence to be able to justify its existence,” his statement read.

Ogun is already one of the most industrialised State in Nigeria under Amosun. Don't just be consumed with delivering negatively ignorant comment for the sake of it alone. Amosun, for his achievements which trumps that of almost all his peers, deserves to be respected and taken seriously as a leader who delivers. He is not the usual "thief" you can just malign with the blanket negativity used for majority of Nigerian leaders. Ogun folks, given what the governor has done already, have reasons to be excited when Amosun unveils new plans for the State.

Ogun, most industrially developed state in Nigeria - Jonathan


President Goodluck Jonathan has described Ogun State as the most industrially developed state in the country and attributed the state’s new status to the economic plan of the Senator Ibikunle Amosun-led administration.

The President further expressed the readiness of the Federal Government to partner with the state government in its rebuilding mission.

Speaking at the commissioning of the Procter and Gamble multi million dollar plant in Agbara, Ogun State, Jonathan, who was represented by Vice President, Namadi Sambo, affirmed that the Amosun-led administration was creating a conducive environment for business to thrive in the state.

“I believe Ogun State is the most industrially developed state in this country. We will partner with you. We will work with you based on synergies and policies that allow for business to thrive”, he said.

The president revealed that the contract for the construction of a standard guage fast train that would connect Lagos through Ogun State to Ibadan had been awarded, adding that, “Olorunsogo Power Plant in Ogun has been successfully completed and privatised”.

While pointing out that plans for the long awaited Lagos-Sokoto Road had reached an advanced stage, the president emphasised that, its designs were being completed and the work would be executed under a Public Private Partnership arrangement.

“Federal Government is building an additional power transmission system, as well as investing in development of gas infrastructure to support the efforts of the state government”, he said.

In his remarks, Amosun disclosed that the commissioning was the 43rd he would be performing in less than three years of his administration, stating that the newly commissioned multi million dollar investments would create 2000 direct and indirect job opportunities for the people of the state.

He charged all industries resident in the state to be up and doing in their Corporate Social Responsibility to their host communities, while reiterating that his administration would not shirk its responsibility in providing security and enabling environment for investors.

Let us watch as events unfold. "Endorsement" indeed. The game is just beginning and below is what I wrote elsewhere about the topic. The reality is that GEJ, when he was an unknown entity and somewhat trusted 'newby' promising the earth, faced Primaries before the 2011 elections because many had goodwill for him back then.

Now that Mr.President is cognisant of the fact that everyone is aware he is an ultra-corrupt misruler who never kept his promise first time round, to many who supported him in the past, why will GEJ not embrace the path of bullying and compromising everyone into this "endorsement" charade? How else could he win? We will see how things eventually play out because I know there is real anger and resentment against GEJ, especially from the North, that discredits the whole "unopposed endorsement" charade.

The fact is that the fight is squarely between those who love Nigeria and feel she needs rescuing from the horrendous misrule of GEJ and those who money and personal enrichment compromises their patriotism and sense of morality. In short patriot versus those of AGIP mentality and persuasions i.e "any government in power".

The truth is that GEJ will find it easy to compromise the AGIPs first because that is entirely what they are about i.e receiving profitable inducement to back the government of the day however badly such leadership is failing Nigeria. GEJ will of course use the vast resources available to the Presidency (Cash, EfCC/prosecution browbeating, contract largess, concessions, waivers, general patronage and public appointment like those given Adesiyan and Obanikoro) to sway "unopposed endorsement" . Impressive plans from a Governor who has delivered a lot already. With four more years, and the delivery of the Ogun State light rail network, I see Amosun turning Ogun into a great State to live and work in.
