TUESDAY, APRIL 30, 2019 NIS begins issuance of new passport without LAGOS and others The Nigeria Immigration Service (NIS) has begun the issuance of the new passport booklets with 10-year validity. President Muhammadu Buhari launched the new passport in January, Muhammad Babandede, Comptroller-General of the NIS, explaining that the new passport with 32 pages would cost N25,000 at home and $130 abroad, the 64-page document with five-year validity would cost N35,000 and $150 abroad, and the 64-page version with 10-year validity N70,000 in Nigeria and $230 abroad. “The new passport reform programme is weather-friendly, International Civil Aviation Organisation (ICAO)-compliant," Babandede had said. "It has polycarbonate technology that eliminates damage, enhanced security features and save Nigerians in the Diaspora time of frequent visit to Nigerian Embassy among others." Conducting journalists round the NIS headquarters in Abuja on Monday during the maiden issuance of the passport, Sunday James, Public Relations Officer of the NIS, said the new-look booklet is part of the Nigerian Government’s efforts to improve the quality and security of the travel document, while also reduce susceptibility to damage, and forgery. James reiterated the NIS’s previous warnings that applicants would be denied passports without supplying their National Identification Number (NIN). He added that to make it easy for applicants, the NIS had provided space for National Identity Management Commission (NIMC) at the service headquarters, Abuja, to register applicants and issue them a NIN. “The public are advised not to rush for the new booklet, as the new enhanced passport will run concurrently with the old one,” he said. He said Babandede had directed passport offices at the state commands to continue to issue the old booklet, while only the service headquarters in Abuja would issue the new passport booklet. He specifically said the enhanced polycarbonate booklet with 64 pages will be available in Ikoyi beginning from June 3, Alausa, Lagos from July 8, and London from July 29. To avoid humiliation of being retired by the Presidency , former Chief Justice of the Federation, Walter Onnoghen, threw in the towel in a game of survival that has subsumed the Judiciary within the Executive arm of government. Furthermore, the principle of Federal Character has finally been buried in the political arrangement of the country. The National Judicial Council, NJC, has immediately after their decision on Onnoghen, dispatched their postion to the Presidency. Almost immediately, Onnoghen, through the Chief of Staff to the federal government, Abba Kyari, submitted his resignation letter. The resignation takes effect immediately. With this, he preempted the planned retirement by the presidency, who were said to be planning a soft landing, thereby giving the impression of presidential magnanimity. The Presidency, according to sources, is yet to come to terms with the next line of action. hence the presidency has kept sealed lips over the issue, though Garba Shehu was said to be in Saudi Arabia for Haj while Femi Adesina is on Buhari’s entourage to the ongoing Economic Summit in the Arab World. Both were spokespersons for the Presidency. With this, all important positions are finally in the hands of Northen Buhari loyalists. From May 29, the CJN, The President of the Court of Appeal and Head of the Federal High Court will all be Northerners. Same goes for Chairman of the Code of Conduct Tribunal, Chairman of the EFCC, Director of the NFIU, Inspector General of Police, Director general of DSS, DG NIA, DG DIA, Defense Minister, NSA, Chief of Air staff, Chief of Army staff. They are all from Muslim North.The Head of the Executive is already there, and both Legislatuive chambers are also expected to follow suit. Onnoghen’s travail started a long time ago. Once gave a minority report on the Supreme Court judgement upholding one of Buhari’s foyers into Presidential contest. Buhari had gone to court to challenge the election results. While Ambassador Nsofor, who is now retired Supreme Court Judge, also wrote a minority report in favor of Buhari, the octagenarian was appointed Ambassador to the United States. When Buhari took over power, Onnoghen was the highest ranking Justice of the Supreme Court. And that was where the battle began. Buhari had immediately started to interfere with the Judiciary in his bid to completely Northernise governance, which he had succeeded in other areas except the Judiciary. The National Judicial Commission, NJC, preempted him and broke protocol. Instead of submitting names of the three most senior judges, which could have included Ibrahim Tanko and Onnoghen for tyhe presidency to choose from, they submitted only the name of Onnoghen. This means Buhari had no choice than to approve Onnoghen. Buhari refused to send Onnoghen’s name to the Senate for approval. The face-off was intense, but when Buhari went on his normal medical tourism in the United Kingdom, Vice President Yemi Osinbajo sent his name to the Senate for approval. The Senate confirmed him before Buhari could come back. And thus began the long battle of his removal. Some Lawyers, believed in some quarters to have been sponsored by the presidency, dragged him to the Code of conduct Tribunal for declaration of Asset infraction. The Economic and Financial Crimes Commision beamed their satelite on his finances, using a took comb to brush out the tinniest dirt on him. The Media trial began: figures, later proved to false in court, started flying all over the Nigerian media space. Five houses transformed to fifty five houses, a few millions transformed to billions. Onnoghen was undoubtedly facing his Golgotha. Enter the election period. Onnoghen, as the Chief Justice, has the prerogative to appoint and inaugurate the judges that will handle the fall out the elections. Allegations from opposition quarters indicate that he was presented with a list from the presidency which he rejected. The Presidency was said to be piqued with the rejection. On the eve of his inauguration of the judges, Presidency struck, suspending him based on the CCT trial. He based his suspension on the humongous figure being bandied about in the media. Then he appointed Tanko as acting CJ, thereby turning the Law on it’s head. Tanko went ahead to swear in those on the presidency list, which ironically was alleged to have included some dead Judges. His appointment was done without recourse to the NJC as required by law. It was after his appointment that the NJC was reached out to, and the EFCC petitioned the NJC as was the custom. Because Tanko was also petitioned against, the NJC, with a Northern interim chairman, recused both of them, requiring them to answer to the allegations before them. Suddenly, the CCT that suspended trial on Onnoghen started in full force, in violation of court order declaring otherwise. The NJC wisely waited until after the presidential results to know who is the incoming president before reaching a decision: Retire Onnoghen and make Tanko the substantive CJ. Tragedy struck at a hostel in Imo State , on Tuesday , as two undergraduates of the Federal University of Technology, Owerri , were found dead while allegedly engaged in sex romp with a female student of the institution. The Police Public Relations Officer in the state, Orlando Ikeokwu , who confirmed the development to our correspondent on Wednesday, said the deceased students were suspected to have abused drugs during the sex romp. The police spokesperson, gave the names of the dead victims as Ugochukwu Kingsley and one Richard , while the third victim , Aka Uche , 27 , and the female victim, Onyinyechi Okafor , were receiving treatment in hospital . He said the incident occurred at the Sunshine Lodge in Ihiagwa, near the FUTO campus. According to him , the police personnel , who evacuated the corpses and took the two unconscious victims to hospital , recovered substances suspected to be Indian hemp and tramadol from the scene. Ikeokwu stated , “ On April 2, information was received from the caretaker of the Sunshine Lodge in Ihiagwa , Owerri , that the students of the Federal University of Technology, Owerri , Ugochukwu Kingsley , Richard and one Aka Uche were engaged in a sex romp with one Onyinyechi Okafor, also a student of the same university . “ Police detectives from the Nekede Division promptly mobilised to the scene and found the four victims completely naked and unconscious . The police operatives recovered substances suspected to be Indian hemp and tramadol from the scene . “ The victims were immediately conveyed to the police clinic and two of the victims, Kingsley and Richard , were certified dead by the medical doctor on duty . “ The corpses have been deposited in the morgue of the Federal Medical Centre, Owerri , for autopsy, while the female victim, whose condition is yet to be stabilised , and uche have been referred to the FMC, Owerri, for further medical attention . “ The families of the deceased have been contacted , while the conditions of the surviving victims are still being closely monitored .” Ikeokwu said the state Commissioner of Police frowned on drug abuse and other illicit acts by youths, whose parents were working hard to ensure that their future was guaranteed . When contacted, the Public Relations Officer, FUTO, Uche Nwelue , said the institution was still investigating to confirm if the victims were its students . Nwelue stated , “ We are still investigating to ascertain if truly they are students of FUTO. You know that the hostel where the incident occurred , is being occupied by students from different institutions . “ Apart from FUTO students , who live there, students of the Federal Polytechnic, Nekede , also live there . We have to conclude our investigation first before we can come up with an official position on the incident . The Court of Appeal sitting in Benin, the Edo State capital, has reaffirmed the nullification of the reelection of Ovie Omo-Agege, the senator representing Delta Central district on the platform of the All Progressives Congress (APC), and that of Francis Waive, who was declared winner of the Ughelli North, South and Udu House of Representatives seat on the APC platform. In a judgement delivered by Justice Tosin Adegoke On March 18, the Federal High Court 1 sitting in Asaba, the Delta State capital, had sacked the Great Ogboru/Ovie Omo-Agege factional state executive committee of the APC led by Jones Erue and upheld the O'tega Emerhor faction led by Cyril Ogodo as the authentic state executive committee. The Federal High Court also nullified all actions taken by the sacked Erue-led executive, including ward and local government congresses, party primaries and the list of candidates that emerged from the primaries held by Erue’s faction, declaring it null and void. Following the judgement of the Federal High Court, Omo-Agege and Waive had approached the Court of Appeal sitting in Benin to seek the leave of the court to appeal the judgment nullifying their candidatures and reelection. At the hearing of the case on Friday in Benin, the Court of Appeal dismissed the case filed by Omo-Agege and Francis Waive seeking a leave of court to appeal the Federal High Court judgement which sacked the Jones Erue-led state executive faction of the APC and nullified the list of its candidates. After dismissing both applications for lacking in merit, the Appeal Court awarded a fine of N300,000 each to the two party candidates. Innoson Nigeria Limited has obtained a writ of Fifa from the Federal High Court in Awka, Anambra State, against Guaranty Trust Bank (GTB) to effect the judgment given by the Federal High Court in Ibadan and upheld by the Supreme Court of Nigeria. This was made known in a press release issued by Cornel Osigwe, the head of corporate communication of Innocent Nigeria Limited. Writ of FiFa (Writ of Fieri Facias) is a leave of court to execute a judgment obtained by a judgment creditor in a legal action for debt or damages by levying on the property of the judgment debtor. In 2014, the Federal High in Ibadan had ordered GTB by way of Garnishee order absolute to pay N2.4billion to Innoson with a 22% interest, per annum, on the judgment sum until the final liquidation of the judgment debt. However, GTB appealed this decision at the appeal up to the supreme court. But, according to Innosson, the Supreme Court on February 27, 2019, dismissed GTB’s appeal and upheld the decision of both Federal High Court and the Appeal Court. The Statement read: “The Chairman of Innoson Group, Chief Dr. Innocent Chukwuma, OFR has through a Writ of FiFa taken over Guaranty Trust Bank PLC for and on behalf of Innoson Nigeria Ltd as a result of the bank’s indebtedness to Innoson Nigeria Ltd. In a landmark decision on February 27th 2019, the Supreme Court of Nigeria dismissed GTB’s appeal — SC. 694/2014 — against the judgment of Court of Appeal, Ibadan Division. “The Court of Appeal, Ibadan division had in its decision of 6th February 2014 dismissed GTB’s appeal against the Federal High Court, Ibadan Division. “Thus, the Court of Appeal affirmed the judgment of the Federal High Court, Ibadan Division which ordered GTB by way of Garnishee order absolute — to pay N2.4billion to Innoson with a 22% interest, per annum, on the judgment sum until the final liquidation of the judgment debt. Rather than obey the judgment of the Court of Appeal, GTB approached the Supreme Court to challenge the Court of Appeal's decision. “However in a ruling delivered by Honourable Olabode Rhodes-Vivour JSC on Wednesday, February 27th2019, the Lord Justices of the Supreme Court (JSC) dismissed GTB’s appeal and thus affirmed the concurrent judgment of both the Court of Appeal and the Federal High Court, Ibadan Division which ordered GTB by way of Garnishee order absolute — to pay N2.4billion to Innoson with a 22% interest, per annum, on the judgment until the final liquidation of the judgment. “The Judgment debt of N2.4bn has an accrued interest as at today of about N6,717,909,849.96 which results to about N8.8 billion. “Based on the Supreme Court's decision of 27th February 2019 the counsel to Innoson, Prof McCarthy Mbadugha ESQ, had approached the Federal High Court, Awka Division for leave to enforce the judgment having obtained certificates of Judgment from the Ibadan Division of the Federal High Court. “Having obtained the requisite leave, the Federal High Court issued the necessary process for levying execution — the Writ of Fifa.” The motor company and GTB had been in a long legal battled over alleged indiscriminate charges on Innoson’s account with the bank. GTB later claimed that Innoson fraudulently brought in vehicle parts with forged documents. However, the motor company denied this allegation, saying the allegation was an effort of defect from the real issue of ineptness against him. The All Progressives Congress candidate for the Ibeju- Lekki Constituency I of Lagos State , Mr Mojeed Fatai , has been declared winner of the rerun held on Saturday . The Returning Officer of the Independent National Electoral Commission for the exercise , Prof Rasheed Ojikutu, declared Fatai the winner of the exercise having secured 9, 484 votes to defeat his rival of the Peoples Democratic Party, Tari Oliver , who got 1,901 votes. Ojikutu stated that out of a total of 122 ,442 registered voters, only 12 ,245 were accredited for the exercise . The exercise was said to have witnessed low turnout as voters came out in few numbers to the nine polling units where the elections held. The Peoples Democratic Party in Cross River State has retained all 25 seats in the Cross River State House of Assembly. The Public Affairs Officer of the Independent National Electoral Commission in the state, Mrs Aneh Kanu, confirmed that the results for the House of Assembly election had been received from local government headquarters where they were collated and announced. "The results are with us. We are compiling them and as soon as we are through with it , it will be made available to the media, ” she told journalists. Meanwhile , the Speaker of the House of Assembly, John Gaul- Lebo is not returning in May. He contested for the House of Representatives but lost to the All Progressives Congress in the February 23 National Assembly election .
