please colleagues I need an impute on this. Company A responded to a Local Purchase Order issued by company B to them for a supply and installation of Aluminium roofs.

Company A addressed company B on the LPO wrongly as Buzzy Aluminiums instead of Buzzy Construction Works and Industrial Ltd.

On this basis and error the contract was entered and company A became indebted to Company B (buzzy).

Now company A is claiming that buzzy aluminium does not exist in law and they can't pay the debt.

From the testimony of manager of buzzy. He orally directed company A to correct the erroneous name, but Company A neglected the directive and encouraged him to carry on with the transactions and supplies hence the name has been submitted to company A's partners in the business.

Please I need your legal imputes on how to go about this. Being sure of the fact that unexisting Company cannot enter into a contract. On what technical grounds can Buzzy has chances of getting his funds from Company A ? God bless

Is there any documentation at all? I mean regardless of the name it is carrying. Though, it appears dicey, but not really. There are two options here:
1: Express your interest to write a petition against Buzzy construction works and industrial limited for fraud. If it is aware of the risk of being wound up, it may cooperate.

2: You can institute an action against the company and join its directors and those who contracted on its behalf. Their original offer should be pleaded (that carries their name). Then explain the circumstance of the mistake in your statement of claim. With a good job, the court will consider the mistake as not being fundamental especially on the principle that a party who benefitted from a contract cannot turn around to rescind on his obligation.
However, exhaustive opinion cannot be given online.

Good morning house, so the admin of this page @hidentity came to deliver a paper at the Nigerian law school Abuja on Thursday on career prospects for lawyers in Nigeria. Here are the few things I was able to pick when I joined in :
1. Hard work matters alot,. If you want to make it in the legal profession, you have to be hardworking and diligent to your work and you should also be alto work intelligently. In fact I heard tat if you can't read for 4hours right now, the legal profession is not for you.

2. That everything takes time. This is another important thing I also learnt that day that while it is normal to have expectations as humans, we ought to realise some things takes time to fall in place hence the dire need for lawyers to be patient and be prepared as opportunity can come knocking at anytime.

3 Importance of Networking can't be over emphasized in the legal profession.

4. Get yourself a mentor if you want to go far in the profession.

5. Chase discipline and hard work , the money will come knocking.

It was nice experience anyway coupled with the smirk on your face when you know the person delivering the speech( Even though I never knew the Admin in person until that day) , I got to know from the last name and the firm's name.

And yes I walked up to @hidentity and introduced myself as "XYZ from Nairaland" and pheeew.. .i got a business card .

Moral: This world is really small like they say as I never even thought I could meet the admin in that way.

Am proud of u all but cle and nysc are making things hard for we noun law graduates despite the Senate amending the nou Act to allow us through. I have 2 diploma in civil law n law from unimaid and ABU Zaria and LL.B from noun.my friends are lawyers now while some are in law school and others serving.my only mistake is believing in ODL (open distance learning)system as a means of learning in the 21st century.question for 500l students and lawyers in the house did u guys study ADR? Is ADR a course at law school? Thank you
