A Federal High Court in Lagos on Wednesday refused an ex parte application to stop the Chief Judge of Bayelsa State, Justice Kate Abiru, from swearing in the Rivers State Governor-elect, Chief Nyesom Wike, on May 29, 2015.

Justice Ibrahim Buba, while turning down the application, said granting such would amount to “adding insult upon the injury” of the people of Rivers State, who currently “have no judiciary.”

The judge held that though the applicants had a meritorious cause of action because the issues bordered on the sanctity of the constitution, granting their ex parte application may occasion a state of anarchy in Rivers State.

“I am of the firm view that no court should make the order ex parte to further compound the problems in Rivers State,” Buba held.

The applicants are three Lagos-based legal practitioners: Monday Ubani, John Nwokwu and Gabriel Okoro.

Joined as respondents in the suit marked FHC/L/CS/769/2015 are the Attorney General of the Federation, Mr. Mohammed Adoke (SAN), Bayelsa CJ, Justice Abiru and Wike.

The plaintiffs are contending that Justice Abiru cannot swear Wike in because the constitution only allowed the chief judge of the state or the President of the Customary Court of Appeal of Rivers State to do so.

The Attorney General of the Federation, Adoke, had, in a press statement on May 19, requested Abiru to swear in Wike on May 29, because Rivers State currently has no substantive chief judge.

Adoke had reportedly said it was to avert a likely constitutional crisis in Rivers State.

He said the directive was in line with the constitution and urged the citizens to take note and respect it.

But Nwokwu, who deposed to a 25-paragraph affidavit in support of the ex parte application, claimed that Adoke’s directive “is already causing public confusion and uncertainty in the country.”

The applicants therefore sought an order “restraining the 2nd defendant from administering the oath of office on the 3rd respondent on the basis of the directive of the 1st respondent and to stay all actions pending the determination of the substantive suit.”

In the alternative, they wanted the court to make an order “restraining the defendants whether by themselves, agents, servants and privies from taking any further steps in connection with the matter pending determination.”

They had claimed that it would be in the interest of justice to grant the ex parte application.

Buba, however, refused it, saying “we cannot all be shallow or be shallow-minded. There shall be no room for anarchy.”

He adjourned till June 29 to hear the motion on notice.

your mentioning fashola's name shows you are being dubious with your assertion. If fashola isn't a performer, you won't have bothered about him.

If Aresa should show you the pictures of the several hospitals fashola littered lagos with, hospitals that are far better and fully equiped than this, you will run away.

A Federal High Court in Lagos has ordered the more than 50 operatives of the National Drug Law Enforcement Agency to immediately vacate the Lagos residence of the senator-elect for Ogun East Senatorial District, Mr. Buruji Kashamu.

The NDLEA, whose operatives had laid siege on Kashamu’s residence in Lagos since Saturday, said it had received a formal extradition request on Kashamu from the government of the United States of America and was coming to court to secure an extradition order.

But Justice Ibrahim Buba, in a bench ruling on Tuesday afternoon, pronounced the action of the NDLEA as sub judice and ordered the men of the Nigerian police to ensure that NDLEA operatives vacate Kashamu’s premises “without a free for all.”

This is one of my problems with NOI. She failed big time in this area.

There was never anything as subsidy. If there was, we would have been buying fuel for below N50 per litter. What exists is an imaginary subsidy where our money is being shared among the cabals. We shall hear more revelations VERY SOON!

Politics › Buhari Not Happy With Govs Inability To Pay Salaries, Rejects Ministerial List by HzRF(op): 5:07am On May 26, 2015
– An early minute brow between President-Elect, General Muhammadu Buhari and governors elected on the platform on the All Progressives Congress may be in the offing as Buhari has asked the governors to steer clear of his ministerial list.
Vanguard gathered that Buhari is contemplating a system operated in the second republic during the era of National Party of Nigeria, NPN, where appointment of ministers was done by the national secretariat of the party and not by the governors.
A source at the National Headquarters of the APC yesterday said that Buhari had directed the leadership of the party to pass the message of non interference to the governors.
According to the source, Buhari could not find any justification for the state governors to choose Ministers for him after they had chosen their own commissioners without unnecessary interferences from the federal government.
Vanguard learnt that there had been a list of Ministers submitted by the governors which was rejected.
The source also hinted that the president-elect was not happy with the governors on their inability to pay workers’ salaries after collecting their states allocation from the federal government.
It will be recalled that APC governors had recently met with Buhari in Abuja where they requested his intervention to pay salaries of workers, noting the dwindling state of the economy.
But Buhari reportedly asked them to pay salaries having collected their allocation.

If we must progress this has got to stop in one way or the other. Whether in APC or PDP states. Can you imagine how Nigeria's economy would have been like if we can generate half of the 40,000MW of electricity SA generates? The monies spent on power since 1999 will give any serious country that amount of power but here we are talking about 1.3GW of electricity. It's shameful hearing that word Nigeria is the largest economy in Africa when it's been powered by generating sets.
