My dad got married to my mum over 40years ago traditionally, but in 2017 their marriage became obsolete by mutual agreement of the both family, so dowry was returned and everyone went separate ways.
In 2018, my dad remarried and this time he had a statutory wedding with his new wife.

1. This new wife tend to sit powers over everything saying she married in court so she is entitled to every details running at home, e.g my dad has chains of businesses and houses around Lagos and Delta.
Me being the senior son, I tried to be close to her so she could be loved by my younger ones, but her attitude and pompous ego centric behavior is making her feel untop the world that she is the boss because she got married in court and legally she controls what the husband has with equal power. Example, in one of my fathers compound, the wife is currently building a house on it without my knowledge, and she is bragging about it that so long she did the statutory marriage is her legal right to build on it because she owns what the husband own, this are properties she met just less than two years now, this are lands I myself had plans of building on to generate income.

Please OP, after reading most comments here I understand now that I too have a right, and her statutory marriage gives her support not to be chased away without legal divorce or compensation and child support if she had a baby for my dad (although no issue yet between them)

2. How can I cut her power, because this whole thing is tiring, I can't go to tenants to collect rents because them say madam don come collect am. I don't have to fight her, because the husband(my dad) is hypertensive.

3. I need more insights as to what we the kids stand to achieve or legally claim if a Will is not written in her favor after death or even if the will goes in her favor after death.

Very sad situation. Upon your mum's dissolution of the marriage with your dad, she should have asked for a separation of property then some properties would be given to mummy. And then to you.
Now you didn't state where you come from, but under the administration of estates law in most states, the legal wife is entitled to 1/3 of the man's estate if he dies without a will. So do your maths.

Ive been seperared from my husband for 3yrs plus. The registry wedding was not properly done cos i got the form from ikoyi, he paid someone there to fast track the 21 day notice. We didn't have a swearing in ceremony but i was given a form to be taken to the church which was returned to the registry after the church wedding.

You need to apply for a divorce. Was the marriage celebrated in church and signed? If yes, then you are married. Pls give me a number so I can contact you

1st of all some details have not been provided for a more professional legal advise but I will advise the following pending they seek proper legal counsel.
1. Get a lawyer or they apply to the court for a copy of all the court documents. So the lawyer can review same.
2. Apply for a stay of execution pending appeal. They can appeal the judgement.
3. Before the appeal they can apply to court for the judgement to be set aside if they can prove fraud.

The law differs from state to state. But u will require the legal parent or guardian to approve. You will also require the ministry if women's affairs or social welfare to approve. Finally a magistrate or judge must sign.

my advice is simple.
if they were accused if the same offence and the evidence led against them is the same. then quickly go to the court that released his colleague, get copies of all documents filed and apply same for your friend. however it is strange for the appeals to have been heard separately

it depends on the state your u are and the laws governing same. FIDA will be a useful help but once the state laws don't provide for same there is little that can be done

lawyers dont draft divorce papers. what they do is petition the courts for a decree nisi dissolving the union.
however in your case since its an islamic marriage then its either the sharia court or the customary court that will decide on it. so go to the nearest customary court or sharia court in your vicinity and apply for the divorce

lawyers don't draft divorce papers. it is only a court that can pronounce that a marriage has been dissolved

not to sound harsh, I will advise you get a solicitor to advise you properly.
1. u can give them the loan if and only if the sign over the property they wish to sell over to you.
£20k is not small money and if the money fails which I know it will, you will be left in the lurch and they will not be in a rush to sell the property.
also after giving them the loan and before the sale of the property, don't give them an allowance as u need the money to offset any loan and recover financially.

Good evening Nairalanders, I have no idea how to go about making this as clear as possible, but truth is I married a stranger.
I met this Lady in 2012,we became friendly, and talked on consistently.
At the time she was on NYSC in Ikom cross River State. By the way she is from Obosi in Anambra state.
She was visiting me in Lagos every week, of course I paid for her flight tickets back and forth for all the times she visited till we got married and beyond. I have never let her use the bus or public transport to anywhere, it's either I drive her, she drives or a taxi.
A few months to her passing out, she told me she was pregnant, so I thought I would marry her and cut the drama short, but that was my undoing.
We got married, but all through, she spent more time with her parents and siblings.
Fast forward to 2016,my wife got a job through my sister in Abuja, and everything got worse, she wouldn't get back home till very late everyday.
Her explanation was that her boss delayed her.
I got to find out she was dating her boss later, even caught her at hotels in ikeja G. R,.A and on the island with her boss at very odd hours of the night.
Don't get me wrong, I am okay, I live in a 5 bedroom duplex in ikeja, the house is very comfortable and cosy, and almost completing my personal building at awoyaya in ibeju. i am not a poor man.
Well, she gave birth to my first child a boy, but insisted on C. S, then my daughter, through C. S too. All were elective!
She wouldn't come back home,and spent more time at her parents than in our home, always saying she needs herMum to watch the kids,while she is out, we got maids, but she was so violent with them, they all left.
Fast forward to 2017,i asked my wife to come back home, she refused, well I told her the marriage wouldn't work anymore,as she wasnt living with me for the past two years.
She immediately went and petitioned me at office of the Public defender in Lagos State citing domestic violence, irresponsibility as to my kids and stuff, I have always provided food, toiletries, medicals,as well as pay my children's school fees till this minute. But she teamed up with her Mum and brother to make up so many fabrications because they demanded I pay a stipend to them every month, and I said no, I won't do that, your daughter, my wife is in your house cos she wants to be there, not because I sent her away or anything like that.Her father is the only person who is sane, but the man is a pensioner and can't help himself much, so she treats him with intimidation She reported me to the police and all agencies you can think of, well at last they conducted their investigations and found out she was telling lies.
I am no more interested in keeping her, and she has vowed that I can't divorce her or I die, but my kids are the issue now.
I need sound advice on how to go about this.

1. You have strong grounds for a divorce even if adultery can't be proven.
2. For the kids, continue paying for their upkeep. Food school fees etc. And keep receipts. In a divorce this will be taken into consideration.
3. You will not get custody of the children until they are older. You will get free access to them.
4. As to OPD. They can look into the matter, just tell them the facts, they can't force you to give the wife money. However they can insist you cater for the kids which you do.
