Politicians behind Kogi, Anambra oil well conflict – Surveyor-General of Kogi State

In this interview with PATRICK ANDREW, the surveyor general of Kogi state, Abolarin Michael Biodun, says the contention over the ownership of the oil wells along the Kogi and Anambra boundary is largely due to political interference and the failure of the National Boundary Commission to adopt the right procedures to determine the boundary between both states.

How soon will the contention over oil wells between Kogi and Anambra be resolved?

The issue of the Kogi and Anambra interstate boundary has lingered for a long time. We have been going back and forth and there seem to be no end in sight basically because of the presence of the natural resource- crude oil- found in the area where both states share boundaries. The area has become a major contention among the stakeholders.
The problem actually is that Anambra wanted to define what is below the ground or what is below the surface of the soil and claim it to be boundary. Anywhere oil is around the corridor of Aguleri they claimed that it is their land whereas oil is like a flow of river, you cannot say that the river flows and in this case oil flows in one particular place within your corridor. That has been a major contention between Kogi and Anambra state.
The National Boundary Commission (NBC) has insisted that they will use the legal instrument of 1954 as the instrument by which they would delimit the boundary between Kogi and Anambra state. But we have objected to that because a ground-to-paper instrument would have been the best approach.And the result of the ethnographic survey that was conducted in 2017 would have been the best because even NBC has agreed that the legal instrument of 1954 is flawed with a lot of irregularities and inadequacies.

So we ask why are you going ahead to use an instrument that is flawed: an instrument that is full of inadequacies, one that cannot stand the test of any mathematical proof?

So we have appealed against it. However, the major contention of the NBC is that they cannot be using the legal instrument of 1954 from Cross River coming North only to jettison it when it gets to Kogi and start with the legal notice of 1936.

What are the major differences between the legal notice of 1936 and the legal instrument of 1954?

The major differences are basically the tripartite points. For example, the legal notice of 1936 ceded Odeke and Lekitolu to Kogi state but if you know Odeke very well Lekitolo is just beside Odeke and the Odeke people have been the one exercising authority over Lekitolo and everyone knows that it is their fishing lake, they fish there. It is Odeke pond, but the legal notice of 1954 unfortunately ceded Itolo to Anambra state and that is the contention.It is contentious because the distance between them is insignificant and, in fact, Odeke has even encircled Lekitolo itself. It would, therefore, mean that if you cede Itolo to Anambra state part of Odeke will be in Anambra state, yet the people have one king, one chief, one house of assembly, have one local government council chairman, I mean the Ibaji Local Government Area end of Kogi state. That is the contention and the reason the ownership of the oil found there has remained unresolved.

What then is the solution particularly as it affects ownership of crude oil found in the area in contention?

We have conducted ground to paper work and the Anambra people have not done so. In fact, those indigenous people around Agulere have not claimed any portion of land that belongs to Odeke, which is in Kogi state. They have not the land that belongs to Ochohor or Odeke, which are in Kogi state. The people there intermarry because they are neighbouring communities yet no conflict between them over parcels of land.
Besides, we have conducted an ethnographic survey- which is a kind of survey where people are interviewed and they show you their boundaries, tell you about how they inter-married and other social scenes between them.The survey was such that people from Agulere showed us their boundary, natural and physical features and we marked those points, and we made many other specific observations. That is what is called from a ground- to- paper survey. This is significant because when you plot the marked points the boundary will clearly come out.
This has been our position but the NBC have said they are sticking to the 1954 legal instrument inherited from the colonial administration and they have also agreed contains a lot of errors, inadequate delineation points.

In view of this what is Kogi state actually canvasing as the most likely proactive approach to resolve the contention?

Our position has always been for us to adopt and work with the ground- to- paper approach. Let the authorities conduct the ethnographic survey, yes interview the indigenous people of the area whereby the people will be called upon to point out both the natural and physical features of the boundary lines between them.
Ordinarily, were the government not involved, especially if the elite and politicians were not for politics with the issue, the indigenous people around the area don’t have problems with each other, they share same source of water, socialize easily and readily, cross over to celebrate marriages and unreservedly inter-marry without hesitation.
So basically the reason why there is conflict over ownership of the place is both elitist and political. Had the elites and politicians not showed undue interests as well as brought in political interpretations to a simple boundary issue between ordinary people who normally go about their businesses without giving consideration to political prance, there won’t have been any contention in the first place.
So, talking about resolution of the contention over real ownership of the portion of land where crude oil has been discovered, there is no end in sight yet. Unless, the NBC adopts the proactive method which invariably would be the resort to the use of a ground-to-paper method of delimiting the boundaries between the affected communities, the issue will continue to linger.Besides, there is a need for both the federal government and agencies involved in boundary determination and delimitation to have the political will to do the basic things needed to determine boundaries without political connotations.

Some have called for the composition of a special task force to conduct demarcation of boundaries in contentious areas in order to reduce vested political interests, what is the position of Kogi in this regard?

Usually, when delimiting boundaries between two states, the surveyors-general of both states will be observers to take care of the interests of their respective states. For instance, during demarcations I, as the Surveyor General of Kogi, takes care of the interest of Kogi ditto my counterpart from Anambra while the Office of the Surveyor General of the Federation is supposed to be neutral in order to interpret what is on the paper to the ground. Our role as observers is to ensure that interpretation is accurate and in line with what is on the paper. But it seems there are issues with the neutrality of the supervising authority.

Is Kogi then in support of the special task force?

Well, the special task force will enjoy the support of Kogi state to the extent that the ground- to- paper and ethnographic surveys conducted in 2017 are used as the basis for determining and delimiting the boundaries between Kogi and Anambra state.

What are the other issues you feel Kogi state has not been fairly treated?

We have other unsettled issues Kwara state and painfully Ondo state. Take for example the people of Ayere in Kogi state and Ayowa in Ondo state have lived together for ages, they know their respective boundaries and are recognized even by the legal instrument of 1954, which the NBC is using to define the boundary. Unfortunately, when it was finally plotted there was a gap. Under normal circumstances when there is such a gap, you go back to the field and confirm from the people who owns what, what are the natural and physical features which demarcate them and then the gap is closed appropriately. Sadly, the Office of the Surveyor-General of the Federation never did that, instead they ceded that gap to Ayowa in Ondo state. Consequently, the people who hitherto had been living peaceably together are now sworn enemies. Those are the kind of issues Kogi state is grappling with.

What impact will the ongoing interactive session among North-central states boundaries committees have on the rising conflicts within the region?

Kogi state is bounded by nine states including the FCT making it 10, so the programme brings to the fore and arouses the awareness of neighbours around our corridor the need for cooperation and understanding. It helps to highlight the predicament of Kogi state and the position of the state in respect of needed boundary adjustment issues with our neighbours.The interactive session is important because it does not only generate friendship among the officials, experts and participants from all the states but creates room for understanding and appreciation of the problems we all face as well as all to work together. Therefore, unity of purpose and common resolve to cooperate and live in peace with ourselves won’t be far-fetched.

The Acting Director-General, National Boundary Commission (NBC), Mr Adamu Adaji, has called on the governments of Imo and Rivers to promote peaceful coexistence among border communities to facilitate proper boundary demarcation. Adaji made the call in his address of welcome during the Joint Meeting of Officials of NBC representatives from Imo and Rivers and other stakeholders in Abuja, on Friday. “The meeting is intended to review the status of previous actions on the boundary and plan on the best way towards fast tracking the boundary definition process. “It is not surprising that since the creation of Rivers and Imo states, disagreements among communities regarding the boundary, were reported in some sectors. “The NBC first intervened on the boundary issue when a similar meeting was convened in Owerri in 2003 and another in Port Harcourt in 2011. “But unfortunately then, the two states were not ready. I believe that the time is right now. “I urge the two states to accord the boundary definition priority attention so as to sustain the peaceful boundary regime among the border communities in the two states. “I pray that we discuss all the issues dispassionately with the sole aim of defining the inter-state boundary as quickly as possible. “There is no doubt that the border communities of the two states have co-existed side by side over the years and share so much in common,” Adaji said. Also, the Deputy Governor of Imo, Prof. Placid Njoku, said boundary demarcation would put to rest, problems arising from claims and counter-claims of boundary limits, oil wells and youth unrest among border communities.
According to Njoku, the 10th Edition of the Administrative Map of Nigeria produced by the Office of the Surveyor-General of the Federation (OSGF), did not capture correctly the boundaries of Imo with Rivers. “The map reduced the extent of the land mass of Imo, when compared with its true position on ground. “The 11th Edition of the Administrative Map of Nigeria, which ought to correct the anomaly, still has some defects and did not capture the Imo/Rivers case accurately as it really is on ground. “Some oil wells that were verified to be in Imo are being classified as `straddled oil well’, such that the proceeds are shared 50-50 with Rivers. This is an anomaly that has persisted since 2001. “It is our believe that early and proper field tracing and demarcation of the boundary between the two states will cure the disputes and unnecessary conflicts between the border communities,” Njoku said.
Similarly, Dep. Gov. Ipalibo Banigo of Rivers, said the people of her state were desirous of peace with their Imo neighbours. Banigo expressed the hope that the meeting would address the boundary issues between the two states. “I call on NBC and OSGF to be fair in addressing the issues. We shall submit our position in due course. “I also appeal to NBC to fast track the modalities in addressing the boundary issues between the two states. “I pledge our support and commitment to NBC in its right of addressing the conflict 0between Imo and Rivers,” Banigo said. The efforts of the government of Senator Hope Uzodinma to boost the economy of Imo State has received a huge boost following the move by the government to recover some oil wells wrongly ceded to Rivers State.

Imo and her neighboring Rivers have been in a protracted battle over oil wells belonging to the state but for which Rivers State receives monthly allocation and other benefits.

It was gathered that the Rivers State government had frustrated previous efforts to resolve the issue, leading to the decision of the Imo State government under Uzodimma to intensify efforts towards recovering the oil wells through legal means.

Last Thursday, the deputy governor of Imo State, Prof. Placid Njoku, led a team of state officials to appear before the National Boundary Commission and submitted sensitive documents, including the survey plan of the state, with which to reclaim the disputed oil wells.

According to a release issued by the deputy governor’s media assistant, Ozioma Ukwuoma, the documents were submitted to the National Boundary Commission in the presence of the Surveyor-General of the Federation, Surveyor Samuel Adeniran, and the Director-General of the National Boundary Commission, Surveyor Adaji Adamu.

Prof. Njoku, who is also the chairman of the Imo State Boundary Commission, was quoted to have urged the commission “to rise to the occasion and give justice to the people of Imo State, who have suffered untold hardship over the years as a result of the brazen denial of their God-given wealth which should have been used for their development but had been in the hands of the wrong state”.

Njoku stated that “the impact of recovering lost oil wells back to the state would become one of the greatest economic development strategy tools deployed in the last 30 years in Imo State as it would usher in increased fiscal and non fiscal revenue, increased foreign direct investment (FDI), increased local content participation that create thousands of job opportunities for Imo people as well as increase the influence of the state as an oil producing state”.

The delegation included the Attorney General and Commissioner for Justice, Barr C.O.C Akolisa, the Special Adviser and Coordinator Oil and Gas, Rt. Hon. Goodluck Nanah Opiah, Oil and Gas expert, Dr. Chioma Njoku, Permanent Secretary, Ministry of Lands, Survey and Physical Planning, Surveyor Uzoma John, and the Surveyor General of the State, Surveyor C.A.P. Anele.

Lagos — Complaints of marginalisation have resurrected an
age-old agitation by the people of Oyigbo local government
in Rivers State for a merger with their kith and kin in Abia
State.

There is a grounds- well of discontent and agitation in
Oyigbo local government area of Rivers State. The people
are seriously complaining of marginalisation in the affairs
of the state and now want to go back to Abia State from
where they were carved out in 1976.



Oyigbo local government was merged with Rivers State following federal government's acceptance of the report of the Justice Mamman Nasir boundary adjustment commission. Besides,
they insist that they are Igbo and would be better catered for
in a predominant Igbo territory.

Impressed by the leadership attributes and
philanthropy of one of the sons of the late Nze Obi
of Egbema, a foremost traditional ruler in Imo State,
youths from the area have asked Chief Francis Uzor
Obi to provide leadership for them.

The Egbema youths, drawn from Imo and Rivers
states, said they were in need of a leader who
would refocus them towards development,
declaring that the younger Nze Obi was the ideal
man they were looking for.

During a visit to Chief Nze Obi at his father’s
palace in Egbema, the youths said they were
appreciative of the employment opportunities he
offered them and other programmes he initiated.


Mr Cletus Chukwu, president of Egbema Youth
Consultative Vanguard, who read an address on
behalf of the youths numbering more than 100,
noted that since Nze Obi, a petroleum engineer
graduated from the university, his obsession had
been to uplift the condition of Egbema youths.

“Right from your days in the oil industry, we know
how many of us you empowered and changed our
lives. But most importantly, you have always
pleaded with us to support government and refrain
from violence”, they noted.
According to them, unlike some other important
personalities in the zone, the younger Nze Obi had
been at the forefront of encouraging the youths to
remain on the path of development.

They were happy that in setting up Orange Room,
one of the best entertainment outfits in the South
East, Nze Obi had offered the youths another
avenue to explore their talents and take their minds
off criminality.

“We are grateful to you for these and more and that
is why we have come to you to formally provide us
leadership because you have the God-given
attributes,” they submitted.

The indigenous people of Obigbo in Rivers are Igbos made up of the Asa and Ndoki peoples. The Ndoki and Asa people also dominates Ukwa East and Ukwa West local government respectively in Abia State and are the immediate neighbours to the Asa and Ndoki Igbo people who are indigenous to, owns and dominates the Obigbo (oyigbo) local government in Rivers State.

The Obigbo local government have always been governed by the then Imo State made up of current Imo and Abia State until 1975 when they where unjustly and forcefully removed from Imo State and ceded to Rivers State by the unjust and evil justice mamman nasir boundary adjustment.

The Nigerian Army and Governor Wike are solely responsible for the many killings, brutality and torture of the indigenous Igbo people in Obigbo Local Govt of Rivers State.

How can you identity IPOB members from some Obigbo indigents who are members of IPOB. It is no news that the Asa and Ndoki indigenous peoples of Obigbo (oyigbo) have been agitating to be united with the kiths and kins in Abia State.

Shame to the Nigerian Army and Wike for the gross human rights violations, torture and killings in Obigbo.

Highlights

Initial US$7.5 million loan to Decklar, 10% per annum coupon;
15% equity interest in Decklar, with an option to increase to 30% equity interest based on drilling results;
Decklar is the Risk Service Provider to the operator of the Oza field, onshore Nigeria, having exclusive rights to develop the field with the operator;
Cash sweep in San Leon's favour until loan and interest repaid; and
Attractive fiscal terms on licence and existing infrastructure in place.

San Leon Energy, the independent oil and gas production, development and exploration company focused on Nigeria, has conditionally agreed to invest US$7.5 million by way of a loan to Decklar Petroleum, the local subsidiary of Asian Mineral Resources, listed on the Canadian TSX Venture Exchange. Decklar is the holder of a Risk Service Agreement ('RSA') with Millenium Oil and Gas Company on the Oza field in Nigeria. Until the loan and its interest are repaid, 100% of the Available Funds (as defined below) that can be distributed from Decklar's RSA proceeds will be paid to San Leon in satisfaction of those payments. San Leon will also subscribe for a 15% equity interest in Decklar.

The Oza Oil Field

The Oza Oil Field was formerly operated by Shell Petroleum Development Company of Nigeria Ltd. ("Shell"wink. The field has three wells and one side track drilled by Shell between 1959 and 1974. During the period when Shell was the operator, there were two periods of extended production testing from the Oza-1, -2 and -4 wells. The field was never tied into an export facility, nor was it fully developed by Shell and put into commercial production.

In 2003, the Oza Oil Field was awarded to Millenium, having won the bid during the Marginal Fields Licensing Round. Since Millenium's acquisition of the Oza Oil Field in 2003, approximately US$50 million has been spent on infrastructure in support of a restart of production including an export pipeline that connects the Oza Oil Field production into the Trans Niger Pipeline (TNP) which goes to the Bonny Export Terminal, a lease automatic custody transfer (LACT) unit fiscal metering system, infield flow-lines, manifolds and a rental 6,000 barrel per day early production facility ("EPF"wink. The RSA entered into between Decklar and Millenium provides Decklar with the majority share of production and associated cash flow from the Oza Oil Field in exchange for funding and technical assistance to restart commercial production and full field development; including a preferential return of its costs plus a share of cash flow thereafter. In exchange, Decklar is entitled to priority recovery of its capital from 80% of distributable funds. After achieving cost recovery, Decklar's profit share is based on a sliding scale starting at 80% and declining to 40% once cumulative production exceeds 10 million barrels.

Decklar intends to fast-track the initial development of the Oza Oil Field including a re-entry on the existing Oza-1 well, anticipated to test three oil bearing zones and place the well into production from two of the three zones tested. The drilling rig is expected to then be skidded on the same location as Oza-1 to a new drilling slot and a development well is expected to be drilled horizontal into the third zone tested in the Oza-1 well re-entry. The Oza-1 well and new horizontal development well are anticipated to generate significant production levels and cash flow in an abbreviated time frame. The Oza Oil Field development is anticipated to then continue with one or two more existing well re-entries and additional development drilling with the potential for eight to ten wells being drilled in total for the full field development. Additional early production and central processing facilities will be added as required to accommodate additional production levels from the Oza Oil Field's development activities. Decklar estimates that first production will be three to four months following the drawdown of the financing described within this announcement.

The Oza Oil Field has significant export and production processing facilities and infrastructure already in-place and operational, which will allow for the export and sale of crude oil from the Oza-1 well re-entry, the initial Oza horizontal development well and future wells.

Subscription Agreement

San Leon has entered into a subscription agreement with Decklar. The Subscription Agreement entitles San Leon to purchase US$7,500,000 of 10% unsecured subordinated loan notes of Decklar and 1,764,706 ordinary shares of Decklar (representing 15% of the enlarged share capital of Decklar) for a cash consideration of US$7,500,000 and N1,764,706 (c. US$4,600), respectively. In addition, Decklar and San Leon have entered into an option agreement that, at San Leon's sole discretion, entitles San Leon to purchase an additional US$7,500,000 of Loan Notes and 2,521,008 Decklar Shares (representing an additional 15% of the enlarged share capital of Decklar, together with a gross-up of the original 15% so as to provide San Leon with a total of 30% of the enlarged share capital of Decklar) for a cash consideration of US$7,500,000 and N2,521,008 (c. US$6,500), respectively, at any time until the date that is forty-five (45) days after the well test results of the first development well on the Oza Oil Field have been delivered to San Leon.

The Subscription Agreement provides for certain conditions precedent to be confirmed prior to finalising and issuing the Loan Notes and Decklar Shares, including entering into an agreed form of shareholders' agreement in respect of Decklar and the restructuring of certain historical indebtedness by the owner/operator of the Oza Oil Field, Millenium, to the satisfaction of San Leon at its sole discretion and the approval of the transaction contemplated by the Subscription Agreement by the TSX Venture Exchange.

In addition, Millenium has entered into a non-binding term sheet with a local Nigerian bank and the trading subsidiary of a major oil company for up to US$33,000,000 in a five year term debt that provides a use of proceeds of US$22,000,000 to refinance existing debt of Millenium and US$11,000,000 for development activities on the Oza Oil Field, based on entering into a crude sales and purchase contract. Decklar is expected to provide a corporate guarantee as part of this US$33,000,000 term debt facility. If San Leon subscribes for the Option Loan Notes then, together with the amount subscribed under the Loan Notes, upon completion these arrangements will represent new funding for Decklar of up to US$26,000,000.

Concurrently with entering into the Subscription Agreement, San Leon has advanced US$750,000 as an initial deposit with the release of the balance of the US$7,500,000 being subject to the satisfaction (or waiver) of the conditions precedent contained in the Subscription Agreement. In the event the transactions contemplated by the Subscription Agreement are not completed on or prior to September 30, 2020, Decklar will be required to repay the Deposit to San Leon within three months of that date. A further announcement will be made in relation to the completion of the Subscription Agreement.

San Leon will be allocated one seat on the board of Decklar. Pending development of the Oza Oil Field, Decklar is yet to report meaningful financial information and, in the last audited accounts for the year ended 31 December 2019, it reported a profit before tax of nil and fixed assets of N267,440,000 (c. US$692,000).

Total Will Commit 300mscf Gas To Nigerian Domestic Market Daily

Total Exploration and Production Nigeria Limited, has committed to devote about 300 million standard cubic feet, mscf, of gas daily to the domestic market in the country.

This is in fulfillment of its domestic gas obligation, DGO, as required by the Federal Government under the Gas Master Plan, GMP.

About 100MSCF of the 300MSCF gas will be used to feed the Alaoji Power Plant, a 1,131 megawatt, MW, capacity plant located near Aba, Abia State, while the balance of 200MSCF/d will be used for petrochemicals industry development during a tour with newsmen, of Owaza Gas Plant, Ukwa West area of Abia State, from where the gas will be transported to Alaoji plant.

Managing Director/Chief Executive, TEPNG. Nicolas Terraz, announced that the plant would be ready for commissioning in July this year.

Terraz, said the project was “to help Nigeria achieve its gas aspiration and meet the Nigerian government gas flare out policy.”

“The project is being completed safely, with no major accident or injury. The project is designed to protect the environment, both in terms of operations and waste disposal.”

Eight, “Even then, this court declared the first appellant the winner in the said election when there was no evidence that he satisfied the true requirement of highest number of votes cast in the election and a position of not less than one-quarter of all the votes cast in each of at least two-thirds of all the local government areas in the State, Section 179 (2) (a) and (b) of the Constitution. If left, the said judgement of the Supreme Court will continue to haunt our electoral jurisprudence now and in the future.”
