No sir, it doesn't really work that way. If someone touches you without your concent, it's sexual harassment (and you can sue for that). If you approve by words or actions, you lose the legal ground. But when OP wanted to do the inserting, she refused both by her words and her actions (apparently, she had her limit set before coming over). Yet he forcefully had his way, that's simply rape. You can also decide to do it with them. But you can't just decide to rape them cause they touched you first. Rape does not necessarily involve the use of peniss.
Any form of forceful penetration is rape.
Which evidence does she need when OP have admitted to have forcefully pulled her jeans and fingered her.
For the fact that a lady went to a guy's house does not mean the guy have the right to have sex with her. Consent can be given and withdrawn at any point in time.
